Council to take action on Ordinance No. 23-25 amending the Buckeye City Code by Amending Chapter
24, Procurement, Article 24-1 General Provisions, Section 24-1-3, Applicability, to amend Subsection B.
11.; to clarify the exceptions for procurement requirements for works of art and other creative services;
providing for repeal of conflicting ordinances; and providing for severability.
SUMMARY
PROJECT DESCRIPTION:
Finance is requesting Council adopt the proposed revisions to the City Procurement Code to better
clarify exempt contracting activities by the Community Services Department for unique services.
BENEFITS:
The current code exemption relating to these unique services reads, “Contracts for professional
entertainment”. This brief description has caused some confusion on which Community Services
Department programs and business needs qualify as “professional entertainment”. Finance, Community
Services, and the City Attorney’s Office have worked together to propose these revisions to clarify.  The
proposed language is consistent with similar language used by other municipalities to exempt creative
works and performances from the normal procurement processes.  
FUTURE ACTION:
Should these proposed revisions be adopted, the added clarity will enable potential future delegation of
authority by the Procurement Officer to identified individuals in Community Services Department for the
purpose of more expedient processing of contracts with providers of these exempt services.
