Section 24-1-3 Applicability 
A. 
This procurement code shall apply to the following:  
1. 
Every expenditure of public monies by the city for the purchase of goods and services. This article 
applies to expenditures of public funds irrespective of funding source, except as identified below.  
2. 
The disposal of abandoned personal property and surplus city materials and supplies, unless otherwise 
provided by law.  
B. 
The following are exempt from the provisions of this chapter:  
1. 
Contracts between the city and the federal government, the State of Arizona and political subdivisions 
of the State of Arizona, or intergovernmental agreements subject to A.R.S. §§ 11-952 et seq. except as 
provided in this procurement code.  
2. 
Any process used to award grants or grant funds by or through the city.  
3. 
Agreements negotiated by legal counsel representing the city in settlement of pending litigation or 
threatened litigation.  
4. 
Legal services, including the services of attorneys, expert witnesses and other legal advisors or 
consultants hired by the city attorney, or special investigative services for law enforcement purposes.  
5. 
Development agreements, as defined in A.R.S. § 9-500.05.  
6. 
Purchase or sale of real property and ancillary services related thereto, such as title insurance, 
appraisals or environmental assessments to the extent that they are negotiated in connection with a 
contract for purchase or sale of real property.  
7. 
Services and the performance of work for municipal improvement districts or other special taxing 
districts shall be procured and awarded in accordance with the statutes governing such districts.  
8. 
Petroleum, fuels, energy or utility purchases authorized by city council; permits and agreements, 
including maintenance agreements, license agreements or community services joint agreements.  
9. 
Professional certifications, professional memberships and conference registrations.  
10. 
Contracts for credit reporting services.  
11. 
Contracts for professional entertainment AND PERFORMANCE, WORKS OF ART, OR OTHER CREATIVE 
ENDEAVORS, INCLUDING TEACHING COMMUNITY CLASSES, THAT REQUIRE A PARTICULAR AND 
DEMONSTRATED SKILL OR TALENT.
