Council to take action on Ordinance No. 14-25 approving the transfer of certain rights-of-way and
roadways generally located along Indian School Road, from 994 feet east of the centerline of Jackrabbit
Trail to the centerline of 191st Avenue, approximately 994 feet.
SUMMARY
PROJECT DESCRIPTION:
The City of Buckeye ("City") is the applicant for this property transfer request. The purpose of this
request is to transfer from Maricopa County's jurisdiction a segment of Indian School Road between
191st Avenue and Jackrabbit Trail. This will allow the future developments to complete the required
roadway and infrastructure improvements. Specifically with regard to a roadway, Arizona Revised
Statutes (A.R.S.) Section 9-471(O) allows for an abbreviated procedure by mutual consent of the
governing bodies of the county and a municipality if the property transferred is adjacent to the receiving
city or town and if each governing body approves the proposed transfer as a published agenda item at a
regular public meeting of their governing bodies. The transfer of such property is to be treated by the city
as if the transferred property is newly annexed territory, pursuant to A.R.S. Section 9-471(O).
BENEFITS:
This annexation and construction of street improvements by the developer will improve traffic circulation
in the vicinity of the project site. Also annexing this area will avoid any challenges for the City concerning
review submittals with the City and construction of this corridor.
FUTURE ACTION:
Upon approval by the Maricopa County Board of Supervisors, the Ordinance with legal descriptions will
be recorded with the Maricopa County Recorder's Office.
