Chairman Gates opened the meeting and asked the Clerk to call the roll.

ROLL CALL - LISTA
The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at
9:30 AM on Wednesday, December 7, 2022, in the Supervisors' Auditorium, 205 W. Jefferson
Phoenix, AZ 85003, with the following members present: Bill Gates, Chairman, District 3; Clint
Hickman, Vice Chairman, District 4; Jack Sellers, Supervisor, District 1; Thomas Galvin,
Supervisor, District 2; Steve Gallardo, Supervisor, District 5 (entered meeting late, remote). Also
present: Juanita Garza, Clerk; Joy Rich, County Manager; Andrea Cummings, Legal Counsel;

INVOCATION - INVOCACIÓN
Chairman Gates introduced his guest, Mayor of Paradise Valley, Jerry Bien-Willner.
Mayor Bien-Willner offered the invocation.
3.
PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Mayor Bien-Willner led the Pledge of Allegiance to the flag. After the Pledge, Chairman
Gates commented on Mayor Bien-Willner’s contributions in the community and
partnership with the County. Supervisor Galvin echoed the previous comments and
added that the Mayor was a pillar in the community and he appreciated the leadership.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -
PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE
CONTROL Y CUIDADO DE ANIMALES
Kim Powell with Maricopa County Animal Care and Control (MCACC) introduced two
four-week-old puppies that were found abandoned on the Salt River Indian
Reservation. The puppies are currently being cared for by MCACC foster program and
will be available for adoption in five weeks. For more information on adoptions visit
Pets@maricopa.gov.

APPOINTMENT OF A CONSTABLE FOR THE ARCADIA-BILTMORE JUSTICE
PRECINCT
Pursuant to ARS §11-251(16), consider a nomination for appointment of a Constable for the
Arcadia-Biltmore Justice Precinct to fill the vacancy created by the resignation of Carolyn
Lane, the previous Constable. This appointment shall be to fill the vacancy for the remainder
of the term which ends December 31, 2024.
The recommended salary for the newly appointed Constable is $48,294.00, consistent with
A.R.S. §11-424.01(C)(2) and the Board of Supervisors’ action related to Constable salaries.

Commission Recommendation: On 11/3/22, the Commission voted 9-0, to recommend
approval of Z2022100 subject to conditions ‘a’ – ‘g’:
a. Development of the site shall be in substantial conformance with the Zoning Exhibit
entitled ‘Black Rock Coffee Bar Black Rock Coffee’ consisting of 1 page, dated August 3,
2022, and stamped received September 15, 2022, except as modified by the following
conditions. Staff may determine slight refinements to remain in substantial conformance with
the approved narrative. Minor and major amendments to the narrative will be determined in
accordance with Chapter 3 of the Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “NEC of Gavilan Peak Parkway & King Drive Proposed Rezone from C-O to C-1
CUPD”, consisting of 11 pages, stamped received October 21, 2022, except as modified by
the following conditions.
c. The following CUPD standards shall apply:
1. Menu-boards for drive-thru restaurants containing speakers shall not be located any closer
than 90 feet to a Rural or Residential zone
2. A solid wall shall not be required along and adjacent to any side or rear property line
abutting any rural or residential zone boundary.
3. Adjacent to any rural or residential zone parking areas shall not be screened from view.

4. Uses Permitted – Cafes, including drive-through but not including those having dancing
or shows, or drive-in car service. The sale of alcoholic beverages for on-site consumption
only may be permitted as an accessory use if the kitchen facilities in the restaurant do not
exceed 20% of the floor area. Patios, cocktail lounges, and outside dining and drinking area
shall be limited to a space serving no more than 50 patrons, and no entertainment or music
shall be audible off site.
d. Administrative approval of a Plan of Development will be required prior to approval and
issuance of construction permits to develop and establish use of the site. Prior to issuance
of a building permit, written confirmation will be required from the emergency fire protection
jurisdiction having authority that the facility has been designed in accordance with their
regulations and requirements, and that emergency fire protection service will be provided to
the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction
review and approval will be required.
e. The Following Engineering Conditions shall apply:
1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to number of proposed building lots/units,
drainage design, access and roadway alignments. These items will be addressed as
development plans progress and are submitted to the County for further review and/or
entitlement.
2. A traffic impact study must be submitted with future entitlement (POD) application(s).
3. The applicant shall coordinate with MCDOT, who has initiated a Transportation
Improvement Project (TT0662) involving the signalization of King Drive and Gavilan Peak
Pkwy, with future entitlement (POD) application(s).
4. Engineering review of re-zone cases is conceptual in nature. All development and
engineering design shall be in conformance with Section 1205 of the Maricopa County
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa
County; MCDOT Roadway Design Manual; and current engineering policies, standards and
best practices at the time of application for construction.
f. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
g. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, the property shall revert
to the zoning that existed on the date of application. It is, therefore, stipulated and agreed
that either revocation due to the failure to comply with any conditions, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation of the Zone Change. The Zone Change enhances the
value of the property above its value as of the date the Zone Change is granted and reverting
to the prior zoning results in the same value of the property as if the Zone Change had never
been granted.

Commission Recommendation: On 11/3/22, the Commission voted 9-0, to recommend
approval of Z2021162 subject to conditions ‘a’ – ‘i’:
a. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and
ARS § 11-814 for five (5) years for the initial phase and an additional five (5) years for each
subsequent phase, within which time the construction permit for each phase must be
obtained. The applicant shall submit a written report every five years from the date of Board
of Supervisors approval of Z2021162 which details the status of this project, including
progress on obtaining construction permits. The status report to be administratively reviewed
by Planning and Development with the ability to administratively accept or to carry the status
report to the Board of Supervisors (Board), upon recommendation by the Planning and
Zoning Commission (Commission) for consideration of amendments or revocation of zoning
for undeveloped parcels. Status reports will be required until completion of the initial
construction permits for each zoning parcel.
b. Prior to approval of the precise plan of development approval, except as noted in this
condition, the applicant shall provide the Maricopa County Planning and Development
Department with an executed pre-annexation service agreement with the Town of Gilbert
that identifies the detail for when the proposed project will be annexed and the provision of
water and sewer service. In lieu of pre-annexation service agreement the developer must
provide a ‘will serve’ letter from the certificated water and sewer provider(s). Until the pre-
annexation service agreement is executed or a will-service letter is accepted, the only uses
permitted shall be those that the Department considers to not require water and wastewater.
c. The following C-2 CUPD standards shall apply:
1. Height: 70’
2. Billboard height:70’
3. Distance from freeway travel lane for freeway billboard: 556’

4. Site Screening: Outdoor storage of products and materials may exceed the height of the
enclosure, but they shall not exceed 8’. Stored vehicles and related shade structures may
not exceed a height of 12’.

d. CUPD overlay shall prohibit the following uses:
1. Adult orientated facilities
2. Bars
3. Drive-in or drive-thru restaurants
4. Retail sales of gas (butane or propane)
5. Liquor stores
6. Theaters
7. Self-storage
8. Recreation centers with pool halls or billiards
e. The following PND Engineering conditions:
1. Drainage review of planning and/or zoning cases is for conceptual design only and does
not represent final design approval nor shall it entitle applicants to future designs that are not
in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the
Maricopa County Drainage Policies and Standards. No entitlement is inferred by this review.
2. All development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance and current engineering policies, standards and best
practices at the time of application for construction.
3. Any site development must include a grading and drainage plan prepared by a licensed
civil engineer in accordance with Drainage Review Requirements for Precise Plans (Planning

5. MCDOT has no comments on this application.
6. The subject premise is NOT located within the County’s Urbanized Area. A Storm Water
Pollution Prevention Permit (SWPPP) is not required for the development of this site.
f. Administrative approval of a Plan of Development will be required prior to approval and
issuance of construction permits to develop and establish use of the site. Prior to issuance

approval of CPA2022010 subject to conditions ‘a’ – ‘d’:
a. Development and use of the site shall be substantial conformance with the narrative report
entitled “Harquahala Sun III” dated revised October 7, 2022 and stamped received October
17, 2022, except as modified by the following conditions.
b. Development and use of the site shall be in substantial conformance with the land use
exhibit entitled “Harquahala Sun III” dated revised October 7, 2022 and stamped received
October 13, 2022, except as modified by the following conditions.
c. The land use designation of utilities approved as part of case CPA2022010 shall be subject
to any applicable time limits set forth in the subsequent zone change.
d. The applicant is proposing to develop a photovoltaic solar electric generating facility which,
pursuant to the Maricopa County Comprehensive Plan, necessitates a change in the land
use designation from Rural Development Area to Utilities. The proposal by the applicant
represents a comprehensive approach to the subject property and will allow the applicant to
pursue the proper entitlements pursuant to state law so that they can lawfully operate in
unincorporated Maricopa County. This particular proposal is an appropriate plan for the

with no street frontage, no utilities, and the visual clutter related to billboards. Ms.
McDonald requested this be denied but if it is passed, she asked that there be

uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, and at the time of
expiration of the Special Use Permit, the property shall revert to the zoning that existed on
the date of application. It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, or the expiration of the Special Use Permit, does

Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to
solicit comments on incorporating federal standards into Maricopa County Air Pollution
Control Regulations: Rule 360 (New Source Performance Standards), Rule 370 (Federal
Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and Appendix G (Incorporated
Materials). Following the public hearing, the Board is requested to adopt the proposed
incorporations into the Maricopa County Air Pollution Control Regulations.
The Maricopa County Air Pollution Control Regulations contain several rules, Rules 360,
370, 371, and Appendix G, which incorporate by reference federal regulations from Title 40
of the Code of Federal Regulations (CFR). These federal regulations include New Source
Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants
(NESHAP) and Acid Rain regulations. Every July 1, the U.S. Environmental Protection
Agency (EPA) codifies revisions made to these federal regulations during the preceding year.
The purpose of this rulemaking is to incorporate by reference the applicable federal

regulations as codified on July 1, 2022, and thereby update Rules 360, 370, 371, and
Appendix G with any revisions made to the corresponding federal rules during the preceding
year. This is necessary in order to continue to comply with the Maricopa County Air Quality

acid rain programs in Maricopa County, except for those specific authorities retained by the
EPA. After the rules are adopted by the Board of Supervisors, the MCAQD will request
delegation authority from the EPA to implement and enforce the federal standards.

CONSTABLE FIRST AND SECOND TERM PAY ADJUSTMENT
Pursuant to ARS §42-17106(B), authorize the following adjustment to the FY 2023 budget:
1. Decrease the expenditure authority for the Non Departmental (D470) General Fund (100)
Operating (OPER) in the line “Constable Salary Increase” (4711) by an amount of $66,364.
2. Increase the expenditure authority in the Constables (D250) General Fund (100)

Authorize the Office of Budget and Finance to include an FY 2024 Baseline Budget

INVESTIGATION FOR THE JOINT TERRORISM TASK FORCE - FFY23
Approve the Notice of Limits for FFY23 State and Local Overtime Reimbursements and
acceptance of up to $19,840.75 in reimbursement funding from the US Department of
Justice, Federal Bureau of Investigation for officers assigned to FBI managed task forces.
The FBI Joint Terrorism Task Force agreement commenced February 27, 2007 and will
continue for an indefinite period until terminated by one or both parties. Acceptance of this
agreement was most recently approved by the Board of Supervisors on December 10, 2014
under C-19-15-017-G-00. The FFY23 reimbursement funding began retroactively October 1,
2022 and will terminate September 30, 2023.
In accordance with paragraph 3 of the agreement, the agreement allows a 0% rate for indirect
costs, or $0 that may be incurred by the County Attorney’s Office of Maricopa County for the
administration of this agreement. The County Attorney’s indirect cost rate for FY23 has been
calculated as 22.35%, or $4,434.41. The non-recoverable indirect cost of $4,434.41.00 will
be covered by the department general fund. This agreement is recurring, non-competitive
and does not require a match. The agreement does not require on-going cash contributions
after the period end date. This funding indirectly supports the overall mandated function of
prosecution of criminal cases.
Approval of this agreement allows for reimbursement of overtime paid to the detective
assigned to the FBI Joint Terrorism Task Force. The purpose of the agreement is to ensure
that a capability exists in Maricopa County to deter, defeat, and respond vigorously to
terrorism through the joint investigation of suspected terrorist threats and sharing of
information and intelligence. The County Attorney has cooperated with the FBI since 2005.

Approve the acquisition of five vehicles, two vehicles as permanent additions to the fleet,
and three replacements for permanent vehicles, using funds from the County Attorney

DISABILITIES EDUCATION ACT (IDEA) BASIC ENTITLEMENT
Approve acceptance of revised amount of $48,713.33 in continued grant funding from the
Arizona Department of Education, for the FY2023 Individuals with Disabilities Education Act
(IDEA) Basic Entitlement. This item replaces the MCSO’s original request, approved by the
Board of Supervisors on March 9, 2022 (C-50-22-122-X-00) for $40,000.00. This funding has
been awarded the last nineteen (19) years and provides contracted special education
consulting services for staff training and IDEA implementation along with a variety of
contracted professional services for juvenile inmates. The term of this funding is from July 1,
2022 through June 30, 2023.
The Sheriff’s Office indirect cost rate for FY2023 is 12.30%. Total indirect costs associated
with this award increase are estimated to be $1,071.74 of which zero ($0.00) is recoverable.
Indirect cost recovery was not granted for the FY23 award. A cash or non-cash match is non-
applicable. The award is non-competitive and is based on number of eligible students and
enrollment. This award supports a continuing mandated function.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore, expenditures of these revenues are not prohibited by the budget

The priority use for these funds is to ensure Maricopa County Jail Education Programs are
in compliance with state and federal special education requirements. These funds will be

This funding supports of the Sheriff’s public safety mandate through efforts to reduce illegal
drug use with the interruption of drug trafficking. The funding is recurring and has been
awarded to the Sheriff’s Office for over twelve years. There is no matching requirement and
there are no future or ongoing contributions required after the grant period ends. This is a
competitive award. The Sheriff’s Office indirect cost rate for FY23 is 12.30%. There are no
unrecoverable indirect costs associated with this decrease in funding.
This award was initially accepted in BOS action C-50-21-167-X-00, taken on May 19, 2021,

ACCEPTANCE OF FFY 2021 STATE CRIMINAL ALIEN ASSISTANCE (SCAAP)
FUNDING
Approve acceptance of $731,427 Federal FY2021 reimbursement funding from the Bureau
of Justice Assistance, State Criminal Alien Assistance Program (SCAAP). The
corresponding application was approved by the Board of Supervisors (Agenda C-50-23-000-
X-00), on July 27, 2022.
This has been a reoccurring grant to the County for over 20 years and there is no cash or in-
kind matching requirement. Indirect costs are not applicable or recoverable since the
reimbursement formula calculation only allows for staff whose primary responsibility is the
care, custody, or supervision of persons detained (pre-trial detention) and incarcerated
(convicted and sentenced) inmates. This funding is not competitive. There are no future or
ongoing contributions required. This grant reimburses a portion of the costs for a mandated
requirement--incarcerating undocumented criminal aliens who are convicted of felony
offenses.
The Bureau of Justice Assistance allows these funds to be used for corrections purposes
only. The specific planned use, as designated by the County Budget Office, will be

drawdown the funds.

Joint Operation. The US Immigration and Customs Enforcement agreement commenced
February 29, 2008 and will continue for an indefinite period until terminated by one or both
parties. Acceptance of this agreement was approved by the Board of Supervisors on
February 20, 2008 under C-50-08-546-2-00. The FY23 reimbursement funding began
retroactively October 1, 2022 and will terminate September 30, 2023.
The Sheriff’s Office indirect cost rate for FY23 is 12.30%. Unrecoverable indirect costs have
been calculated as up to $3,690. The unrecoverable indirect cost of up to $3,690 will be
covered by the department General Fund. This agreement is recurring, non-competitive and

LAW ENFORCEMENT OFFICER’S DEPUTIZATION
Rescind and replace action taken by the Board of Supervisors on 11/16/2022 under C-50-
23-050-X-01 and MOU 22-MU-11031200-207 with a new action: Approve the MOU with
United States Department of Agriculture (USDA) for US Forest Service Law Enforcement
Officers Deputization (23-MU-11031200-027). This MOU establishes a general framework
for cooperation between the U.S. Forest Service and MCSO to further mutual law
enforcement interest and allow U.S. Forest Service Law Enforcement Officer’s Deputization
by the Maricopa County Sheriff’s Office. This is a non-financial MOU and is effective as of

the courts demands are not met. (Annual cost has been established and reported to be
$191,415.12. Thus the monthly penalty would be $574,245.36 per vacancy.) This request
projects 2 vacancies in the first month as MCSO achieves compliance.

Chairman Gates asked Sheriff Penzone to come forward to answer questions regarding
item 43.
Supervisor Hickman asked Sheriff Penzone to clarify the numbers related to the PSB
staffing. Sheriff Penzone said the dollar amount is established by the court order related
to the Melendres case. He said the volume of cases requires more staffing and
resources to make more progress in this case. The court order is to hire eight civilian
investigators to supplement the existing staff. Sheriff Penzone’s intention is to minimize
the financial impact on the community and taxpayers.
Chairman Gates thanked Sheriff Penzone for his focus on this matter.

Per ARS §22-125, each year the Arizona supreme court shall annually perform the
calculations required by subsection B for each justice court, for the previous twelve-month
period ending on June 30 to determine the total judicial productivity credits. The Arizona
Supreme Court shall report the total judicial productivity credits for each justice court to the
applicable board of supervisors within one hundred twenty days after the end of each twelve-
month period. Any adjustment to the salary of a Maricopa County JP is effective on the
following January 1.
Legislation in 2017 modified the formula used to calculate these credits and, may require the
Board of Supervisors to make justice of the peace salary adjustments.
Judicial Productivity Credits (JPCs) are based on Justice Court fiscal year filings. Fiscal year
2022 filings were compiled from monthly statistical reports submitted to the Supreme Court,
Administrative Office of the Courts.

vaccination, dog license tag, and new owner transfer fee within the first year of transfer for
each dog three months of age or older at no cost to the Contractor. The cost for these
services is $52 for each animal transferred in FY 2022 and thereafter. Animal Care and
Control estimates sixty-seven (67) New Hope transfers annually, for a total of $3,484 per

To approve an agreement between Southwest Behavioral Health Services (SWBHS) and

Treatment (“MAT”), Opioid Use Disorder (“OUD”) recovery support services, and opioid
prevention awareness for incarcerated patients transitioning to the community.
This Agreement shall begin upon approval by the Maricopa County Board of Supervisors
and shall terminate one year thereafter unless otherwise terminated or amended as provided
herein. By mutual written amendment executed by the Parties’ authorized representatives,
this Agreement may be extended for supplemental periods of twelve (12) months, up to
maximum of forty-eight (48) months
There are no financial responsibilities assigned by this Agreement; the Agreement is
intended to allow CBI and CHS to work together to better address the needs of the

Approve the Maricopa County Premium Pay Rates effective 12/12/2022. Human Resources
recommends adding Detention Officers to the Critical Staffing Differential.
These premium pay rates apply to the County’s elected offices, appointed departments,
Judicial Branch of Maricopa County who receives funding from Maricopa County, the Flood
Control District of Maricopa County, and the Maricopa County Library District (Special
Districts). The Board of Supervisors is authorized to jointly adopt policies applying to the
Special Districts under the Intergovernmental Agreement, C-06-18-393-6-00, approved on
April 11, 2018.

RideChoice Services. Payment of invoices shall become due within thirty (30) calendar days
after receipt of an invoice from RPTA. If at any time the costs of this program are projected
to exceed the annual amount of $606,239, the parties will reduce service levels to stay within
the budgeted amount.

currently in possession of Maricopa County shall be remitted to RPTA for the same purpose.
Authorization shall be obtained from the Deputy Director of the Human Services Department
for the use of ALF monies in excess of the amounts shown in Schedule A and Schedule B.
3.10 Both Parties acknowledge that Maricopa County retains ownership of its ALF funding
and is responsible for ensuring its use of ALF funds comply with the ALF program
requirements.
3.11 Maricopa County acknowledges they will complete the ALF application annually within
the prescribed deadlines and submit the report and expenditure certification, as described in

between the Town of Gilbert (Town), and Maricopa County administered by its Human

rehabilitate homes and rent to low-income families in the Town of Gilbert. The County shall
provide the Town with HOME investment partnerships funds.

Approve a non-financial Memorandum of Understanding (“MOU”) between Maricopa
Association of Governments (“MAG”) and Maricopa County (“County”) administered by its

The MOU between the Parties is to document Maricopa County’s commitment to provide an
in-kind match value of $100,000 to be listed on MAG’s application for Maricopa Regional
Continuum of Care Planning Grant to the U.S. Department of Housing and Urban

consist of County staff participating in the Maricopa Regional Continuum of Care activities to

Request approval and receipt of Emergency Rental Assistance (ERA 2) funds from the U.S.
Department of the Treasury. The Department of Treasury assigned the funds to the Human
Services Department DUNS Number 050391270, Assistance Listing Number and Title
21.023 Emergency Rental Assistance Program. The funding amount is $17,628,444. The
total ERA 2.0 funding is now $ 41,133,037.
Section 3201(a) of the American Rescue Plan Act of 2021, Pub. L. No. 117-2 (March 11,
2021), authorizes the Department of the Treasury to make payment to certain eligible
grantees to be used to provide emergency rental assistance. On November 17, 2022, the
Department of Treasury provided notification via email of the funding allocation to the Human
Services Department Director.
The funding will be utilized to assist eligible renter households impacted by the COVID-19
Pandemic, with direct financial assistance including rent, rental arrears, utilities and home
energy costs, utilities and home energy costs arears, and other expenses related to housing.

This was a new, non-competitive award and it is not known whether it will continue beyond
this 5-year term. The grant does not require an in-kind match or ongoing cash contributions.
This is not a mandated function but provides a benefit to the citizens by assisting MCDPH in
optimizing resources to address disparities in maternal health. All program costs are

PH RFP 230080 CONTRACT FOR PROJECT ECHO COVID-19 RECOVERY
EDUCATION AND CARE MANAGEMENT PROGRAM
Pursuant to MC1-329 of the Maricopa County Procurement Code, authorize the Chairman
of the Board of Supervisors to execute one or more Public Health Request for Proposal (PH
RFP) contracts, in a form approved by the County Attorney’s Office, to one or more
successful bidders in response to PH RFP 230080, Project ECHO COVID-19 Recovery
Education and Care Management Program. Project ECHO (Extension for Community
Healthcare Outcomes) is a collaborative model of medical education and care management
that helps clinicians provide expert-level care to patients wherever they live using video-
conferencing technology to train, advise, and support health care providers. Maricopa
County Department of Public Health (MCDPH) intends to subcontract with a qualified
Contractor to develop and implement a program based on the Project ECHO model for health
care on subjects related to recovery from post-COVID-19 conditions.
The RFP was released on November 16, 2022, and responses are due by 2:00pm on
December 12, 2022. All responses will be reviewed by a Public Health Evaluation Committee
utilizing evaluation criteria included in the RFP. A subcontract will be offered to the
Respondent deemed to be the most advantageous to Maricopa County with an anticipated
contract start date of January 25, 2023, through May 31, 2024. The total amount of initial
funding available for this project is $500,000 and funding is being provided by the Centers
for Disease Control’s (CDC) COVID-19 Health Improvement Plan grant. Should the funding
source cease and alternate funding not be available, Section 4.0 of the Contract, Availability
of Funds, will apply allowing for a change or termination of the agreement. If additional funds
become available, any award resulting from this solicitation may be amended and/or
extended based on the need for additional services to complement the existing scope of

to the citizens by ensuring that immunization coverage levels in the County’s child,
adolescent, and adult populations improve for both public and private health care recipients.
The grant award is not competitive. All program costs are allocated to the grant so there will
be no additional burden on the department’s operating budget.
The Department of Public Health ‘s indirect rate for FY23 is 17.24%. Full indirect cost is
estimated at $199,013.48, all of which is recoverable. Department indirect rates are
reestablished at the beginning of each fiscal year and the future indirect rates will be collected

Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation therefore expenditure of the revenues is not prohibited by the budget law. This
agreement does not alter the budget constraining expenditures of local revenues duly
adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be
adjusted as necessary to accommodate this grant through a future reconciliation. Funding
for this Agreement is provided by a Grant from ADHS and will not affect the County’s general

VACCINATIONS
Approve a cost reimbursement Intergovernmental Agreement (IGA), CTR062177, between
ADHS and Maricopa County by and through its Department of Public Health (MCDPH),
Office of Community Wellness and Health Promotion, to provide funding for the COVID-19
Vaccinations. This grant will assist MCDPH to continue to enhance program stewardship
and accountability for all publicly purchased vaccine in support of the Vaccines for Children
Program (VFC) and the Vaccines for Adults Program (VAP). It will also provide vaccines to
children and adults in accordance with recommendations of the CDC Advisory Committee
on Immunization Practices (ACIP) and prevent and control Vaccine-Preventable Diseases
(VPD). This is a new agreement however it is funded by COVID-19 grants. Additionally, the
purpose of this IGA is to separate COVID-19 Immunization fund from non-COVID-19
immunization funds. The term of this Agreement is July 1, 2022, through termination date,
June 30, 2024.
The full amount as listed on this new agreement is in a not to exceed of $28,346,200.
Nonetheless, $4,256,944.22 has been spent in FY21 & FY22 combined so the actual total
not to exceed amount is $24,089,255.78. This new IGA contains five (5) activities/services
and caps the indirect rate for four (4) of the five (5) activities at 10% and the fifth (5) activity,
the Maricopa IDEAS, at full indirect rate.
This Grant deviates from County Policy A2505 and does not allow for full indirect cost
reimbursement, but a maximum of 10% indirect cost reimbursement as delegated in the
Grant Agreement. MCDPH indirect rate for FY23 is 17.24%. Full indirect costs are estimated
at $3,775,443.36 of which $2,189,932.34 is recoverable and $1,585,511.02 is
unrecoverable. Program costs not covered by the grant will be subsidized by the MCDPH

IGA WITH CITY OF LITCHFIELD PARK FOR THE EXCHANGE OF SERVICES
(ENTENTE)
Approve the Intergovernmental Agreement between Maricopa County and the City of
Litchfield Park for the exchange of services or reimbursement of services (Entente). This
Agreement shall become effective as of the date it is approved by the Maricopa County
Board of Supervisors and remain in full force and effect until either Party terminates it. Either
Party may terminate this Agreement at any time before the expiration date of this Agreement
by furnishing the other Party with a thirty (30) day written notice.
The purpose of this Intergovernmental Agreement is to identify and define both Parties'
respective roles in the execution of the responsibilities of specific maintenance tasks in areas
that cross jurisdictional boundaries.
The Agreement provides the opportunity to focus on specific maintenance tasks or
emergency highway projects and the availability of the most economical resources by
extending beyond jurisdictional or geographical boundaries. The Agreement's application will
benefit areas in the County and the City where the other Party could complete specific types
of routine maintenance or emergency highway project activities based on scheduled work

within the area. Individual tasks performed by either Party will be executed upon completing
a Letter of Agreement (LOA) approved and signed by the County Department of
Transportation Director and the City Manager, or their designees.
If the value of goods or services exchanged by the Parties is not of equal value, the total
aggregate reimbursement to the respective Party will not exceed $250,000 per fiscal year. If
no services are exchanged, there is no financial impact. An accounting mechanism will be
utilized to track each LOA, as applicable, to identify specific tasks and services and ensure
the exchange of these services is of similar value.

Pursuant to A.R.S. § 42-18303 (E), the foregoing parcel was offered for sale at auction. No
bids were received for the parcel at the auction, but thereafter the following bid was received.
The Board of Supervisors may accept an offer from, and sell real property held by this state
by tax deed to, the county or a city, town or special taxing district in the county for a public
purpose related to transportation or flood control.
The following descriptions and considerations are presented to the Board of Supervisors, for
final approval for the sale of the parcel:

The Clerk stated there was a speaker slip received for item 126 from Blue Crowley. Mr.
Crowley bid $350.00 for the parcel in question.
Andrea Cummings, Legal Council for the Board, stated that accepting an additional bid
from another governmental entity was at the discretion of the Board. She said it was
not clear if there was a prohibition against taking additional bids, but the Board has the
discretion to accept offers from other governmental entities.
Chairman Gates asked Flood Control District representative to come forward for
clarification.
Jennifer Pokorski, Assistant County Manager, came forward. She stated that the parcel
in question was formally owned by an HOA that has been disbanded. There are existing
drainage issues on the parcel and is adjacent to a flood control basin. The Flood Control
District has bid the property from Maricopa County because of its proximity to the flood
control basin.
Chairman Gates said because this parcel is adjacent to a flood control basin, it made
sense to have the property in the Flood Control District. He thanked Mr. Crowley for the
bid.

NEW HOPE AGREEMENT WITH LAST CHANCE DOG RESCUE AND
REHABILITATION
Approve an agreement between Last Chance Dog Rescue and Rehabilitation and Maricopa
County, administered by Maricopa County Animal Care and Control, to allow said rescue to
transfer animals that have been deemed eligible for the New Hope program. Maricopa
County will provide a rabies vaccination, dog license tag, and new owner transfer fee within
the first year of transfer for each dog three months of age or older at no cost to the Contractor.
The cost for these services is $52 for each animal transferred in FY 2022 and thereafter.
Animal Care and Control estimates one hundred (100) New Hope transfers annually, for a
total of $5,200 per year, over the term of the agreement. The term of this agreement shall
commence upon approval and execution by the Board and will expire on June 22, 2025.

IGA WITH ARIZONA DEPARTMENT OF EDUCATION TO PROVIDE CAPACITY
PROJECTS TO DISTRICT SCHOOLS
Approve Intergovernmental Agreement (IGA) No: 23-12-ED, ESSER – Maricopa County
Teacher-Powered Schools and Social Emotional Lesson Plan Template Projects, between
Arizona Department of Education (ADE) and Maricopa County by and through the County
School Superintendent (CSS).
These projects are aimed at addressing student learning loss resulting from the COVID-19
pandemic through evidence-based practices and will apply the use of ESSER funds from
ADE. The IGA shall become effective from and after the date of execution and expire
September 30, 2024. Maricopa County is authorized to enter into this IGA under A.R.S. §11-
952 for the purposes of exercising joint powers or contracting for services.
The grant award is in the amount of $675,000 for the Teacher-Powered Schools Project for
the project period from July 1, 2022 through September 30, 2024 and $107,280 for the Social

Emotional Lesson Plan Template Project for the project period from July 1, 2022 through
June 30, 2024.
This is a new grant award and is not expected to reoccur. The grant does not require an in-
kind match, however, $139,000 of County monies already budgeted in the general fund will
be used to support the projects. Ongoing cash contributions are not required. This is not a
mandated function but provides a benefit to students by addressing learning loss resulting
from the COVID-19 pandemic. The grant award was competitive. Although the grant would
have allowed for indirect costs to be recovered, the grant proposal did not include indirect
costs, therefore indirect costs will be zero.
As a result of this IGA and pursuant to A.R.S. §42-17106(B), approve an adjustment to the
FY 2023 County School Superintendent (D370) Schools Grants Fund (715) Operating
(OPER) revenues and expenditures budget in the amount of $453,640.
Revenues are not local revenues for the purpose of the constitutional expenditure limitation,
and therefore expenditure of the revenues is not prohibited by the budget law. This budget
adjustment does not alter the budget constraining the expenditure of local revenues duly
adopted by the Board pursuant to A.R.S. §42-17105. Funding for this Agreement is provided
by a Grant from ADE and will not affect the County’s general fund.

Chairman Gates asked the Clerk if there was anything to report regarding Public
Comment email responses.
The Clerk said there were two regarding MCACC and 537 emails regarding elections.
The Clerk gave the inhouse speaker slips to Chairman Gates.
Chairman Gates called on the following speakers:
Debra Nolan, resident, and founder of Dontleaveme.org, an animal rescue
organization. Ms. Nolan said she wanted to comment on MCACC in a positive way and
thanked Chairman Gates and Joy Rich. She reported that she has put together a
stakeholder’s group to help solve the problems that have come up. Ms. Nolan said she
is anxious to share the findings of her group with the Board.
Lisa Richie, resident in Chandler for 16 years, was present to express opposition to a
proposed affordable housing project. She said her disapproval mirrors the opposition
expressed by Chandler City Council who recently signed a resolution. Ms. Richie said

traffic, water issues, and proximity to railroad tracks were reasons to look for another
location for the project.
Lu Wang, resident, was present to speak in opposition to the Landings on Ocotillo
project. Ms. Wang said she was in favor of affordable housing; however this location is
not suitable because the high-density housing would create a traffic burden directly
across from a local high school, and cause a shortage of water. She said Chandler
offered a different location to the developer.
Neo Zhg, a long-time resident of Chandler, said he appreciated the Board for the work
they do. Mr. Zhg was present for the rezoning hearing for Ocotillo Landing and he asked
if it would be possible to have the Board hold the next meeting at Chandler City Hall
during the evening hours. He stated it would be more convenient for the citizens
involved in this case.
Blue Crowley, resident, spoke on the issue of lawsuits being brought regarding the
election. He talked about the Gila River plans to yank the television network channel
that is spewing seditious lies.
Chairman Gates said there were several people who did not want to speak but to
register their opposition on Z2021175, Ocotillo Landing: Ying Chen, Ping Chen,
Zhenmer Hodge, Jiang Cling, Juan Shui, Rachel Liu, Susan Liu, Zhen Lu, Linna Luo,
Gray.
Chairman Gates thanked all the people who came to the meeting.

Supervisors'/County Manager's summary of current events - Resumen de temas de

Joy Rich thanked the Board for the consideration and interest on item 66 that will allow
the County to move forward on the development of a childcare facility to serve Maricopa
County employees.
Supervisor Hickman said he wanted to wish the Maricopa County employees happy
holidays. He thanked Chairman Gates for his leadership and support during these
turbulent times.
Supervisor Sellers said it was a privilege to serve with the Board and working together
to get projects accomplished. He said he met with Queen Creek Mayor-elect Wheatly,
Tempe Mayor Woods and commented how important it is to stay in touch with the local
mayors and councilmembers, working together to resolve important County issues like
homelessness. Supervisor Sellers attended an event called Chandler Chamber 100,
which was a gathering of the top 100 companies. He said it was a casual event allowing
leadership interaction. He said he went to a Valley Metro meeting, and the current goal
was to complete construction downtown by February 12, which is Superbowl Sunday.
The Taiwan Semiconductor Manufacturing Company (TSMC) has said they are
planning another factory in the Valley, bringing the total investment to $40 billion. He
said with the Intel project in Chandler and TSMC, this influx brings over 15,000 high
wage jobs. Supervisor Sellers added that with all the development coming, the County
needs the Prop 400e to go through to sustain this level of activity. He said it is important
that state leaders understand the importance of this legislation.

Supervisor Galvin thanked to all the citizens who showed up to the meeting. He talked
about he and County Attorney Mitchell going out to Mesa to read “Twas the Night Before
Christmas” to school children. He went to a Maricopa Association of Governments,
Economic Development meeting and heard a presentation on homelessness and the
impact it has on the County. Supervisor Galvin said thank you to Chairman Gates for
his professionalism and dignity during this last year. He said he was proud to have him
as a leader and a colleague. He said thanks to the 13,000 Maricopa County employees
and happy holidays to all.
Chairman Gates acknowledged former Gilbert Mayor Jen Daniels who was in the
auditorium. He said thank you to all the Maricopa County employees who worked so
hard this year and acknowledged his staff, Zach Schira and Chelsea Lett for all their
assistance this year. He echoed the holiday sentiments.

CAMPUS PARKING LOT REPLACEMENT; LANDSCAPE AND WATER
CONSERVATION RETROFIT
Authorize the Flood Control District of Maricopa County (District) to award the Pre-
Construction Services Contract (FCD 2022C014) to the selected CMAR respondent
(Rummel Construction) and, pending negotiation of a mutually acceptable Guaranteed
Maximum Price (GMP), authorize the District to award one or more Construction Services
Contracts to Rummel Construction without further action by the Board of Directors (BOD)
provided that the aggregate of all such contracts does not exceed the sum of $4,500,000.
This is a qualification-based selection in accordance with Maricopa County Procurement
Code, Article 5, Paragraph 504(F) and Article IV of the Maricopa County Procedures Manual.
The Project includes the replacement and improvement of the existing parking lot and
landscaping at the District’s property at 2801 West Durango Street, both of which are original
to the building when completed in 1990. Existing parking lot surfaces, concrete curbing,
pathways and pedestrian lighting improvements will be updated to comply with the
Americans with Disabilities Act. In alignment with Maricopa County strategic objectives,
existing landscaping and irrigation systems will be upgraded with highly water efficient
systems and desert adapted plants to maximize water use efficiency. Project features will
allow for stormwater to be harvested to offset the need for the use of potable water. Further,
infrastructure will be installed to facilitate placement of future electric vehicle charging
stations.
This is a complex project and, as such, the District will utilize the CMAR Contracting and
Construction Method to obtain valuable constructability, sequencing, and costing input
during the pre-construction services efforts – leading to the construction of a high quality and
successfully completed project. The property is owned and maintained by the District and
the Project is 100% funded by the District.
