Council to take action on the Public Improvements In-Lieu Payment Agreement between the City of
Buckeye, an Arizona municipal corporation, and Ashton Woods Arizona, LLC, a Nevada limited liability
company, Starlight Homes Arizona LLC, a Delaware limited liability company, and CW - Algodon, LLC, a
Delaware limited liability company; and authorize the City Manager to execute and deliver said
Agreement on behalf of the City of Buckeye.
SUMMARY
PROJECT DESCRIPTION:
As part of the development of land generally located at the northeast corner of Southern Avenue and
Apache Road, known as Algodon, Ashton Woods Arizona, L.L.C, a Nevada limited liability company,
Starlight Homes Arizona L.L.C., a Delaware limited liability company, and CW - Algodon, LLC, a
Delaware limited liability company (collectively "Developers") are required to construct certain off-site
right-of-way improvements for Southern Avenue. As the ultimate condition of Southern Avenue is not
being constructed at this time, specifically the median landscape and irrigation improvements,
Developers have requested to make an in-lieu payment in a single lump sum in the amount of
$20,342.39 to the City as full satisfaction of the Developers' obligation to construct the off-site
improvements. The City shall hold such in-lieu payment funds until such time as the funds are applied by
the City to the cost of construction at the time the City constructs or causes to be constructed the
ultimate off-site improvements. The Public Improvements In-Lieu Payment Agreement memorializes the
terms and conditions related to the payment.
BENEFITS:
Implementing the Payment In-Lieu Agreement protects against waste and spoilage of City Resources.
