ACTION/MOTION: (This language identifies the formal motion to be made by the Council) 
Council to take action on Change Order No. 1 to the Construction Contract (No. 2024173) between the
City of Buckeye, an Arizona municipal corporation, and J. Banicki Construction, Inc., an Arizona
corporation, related to roadway construction and improvements on Miller Road, Durango Street to Lower
Buckeye Road, Capital Improvement Program (CIP) Project No. 105260; and authorize the City Manager
to execute and deliver said Change Order on behalf of the City of Buckeye.
SUMMARY
PROJECT DESCRIPTION:
Miller Road currently consists of limited travel lanes in each direction, occasionally widened to
accommodate turns into developments. There are no existing curbs, gutters, or sidewalks along the
road, except for a brief section in front of the Chevron gas station. This hard bid project is intended to
widen Miller Road to its ultimate roadway width between Lower Buckeye Road and Pima Street,
including improvements to the west half of the street as required at intersections. Construction services
are necessary for this project. Change Order #1 will allow for an extended timeline from the old contract
through the commencement of this change order, ensuring no gap in the timeline. This change order
also extends the service period from its original Two-Hundred Seventy-Five (275) calendar days after the
effective date of the Notice to Proceed to Three Hundred Eighty-Eight (388) calendar days from the
effective date of the Notice to Proceed. Further it increases the Contract Price by $1,150,000.00 from the
original $11,018,061.47 to $12,168,061.47 not-to-exceed (NTE). The increase is inclusive of
$125,376.77 in contingency. 
BENEFITS:
Change Order #1 will allow J. Banicki Construction the necessary additions in timeline and funding to
dully deliver construction services for this project. 
FUTURE ACTION:
Completion and delivery of the proper Roadway Improvements on Miller Road, Durango Street to Lower
Buckeye Road.
FINANCIAL IMPACT STATEMENT:
The project is programed in the CIP program in FY25. The total cost of this Change Order #1 is
$1,150,000.00. The original Contract Price was not-to-exceed (NTE) $11,018,061.47. The amended
Contract Price after this Change Order #1 is NTE $12,168,061.47. The increase is inclusive of
$125,376.77 in contingency. This change order is within the project FY25 budget of $13,166,400.
