Kim Powell with Maricopa County Animal Care and Control stated Biggie, who was to 
be introduced today was recently adopted. She introduced Copper, a four-year-old dog. 
He is house trained and likes to play fetch and loves attention. For pet adoption

Chairman Gates asked the Clerk if there were any announcements or corrections to 
the agenda. The Clerk said there are a few announcements:

Items 7 through 11 are CPA cases whose approvals are subject to resolutions



Site Location:  Located on the NWC of Cactus Rd. and Perryville Rd. in the Surprise area
Commission Recommendation:  On 10/6/22, the Commission voted 8-0, to recommend 
approval of Z2022108 subject to conditions ‘a’ – ‘h’:
 
a. Development of the site shall be in substantial conformance with the site plan entitled 
“Cactus & Perryville RV, Boat & Self Storage Campus” containing two full-size sheets, dated 
August 15, 2022, and stamped received August 16, 2022, except as modified by the following 
conditions. 
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Cactus and Perryville RV, Boat and Storage Campus”, consisting of 13 pages, dated 
August 15, 2022, and stamped received August 16, 2022, except as modified by the following 
conditions.
c. A Plan of Development is approved subject to site plan entitled “Cactus & Perryville RV, 
Boat & Self Storage Campus” consisting of two full-size sheets, dated August 15, 2022, and 
stamped received August 16, 2022. The Plan of Development may be amended 
administratively under separate application as long as the amendment complies with the 
established CUPD development standards as approved by the Board of Supervisors. Staff 
may determine slight refinements to remain in substantial conformance with the approved 
site plan.  Minor and major amendments to the site plan will be determined in accordance 
with Chapter 3 of the Maricopa County Zoning Ordinance.
d. The following Planning Engineering conditions shall apply: 
1. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for construction.
2. Based on the conceptual design nature of the information submitted, changes to the site 
layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure.
3. Detailed Grading and Drainage (Site Infrastructure) Plans and a Final Drainage Report 
must be submitted with the application for Building Permits.
4. The entire site and adjacent half-streets’ runoff shall be retained onsite. If portions of 
adjacent right-of-way are controlled by other jurisdictions, the adjacent half-streets’ runoff 
shall be retained unless separately addressed by the other jurisdictions.
5. Sufficient retention volume shall be provided onsite to retain the required 100-year, 2-hour 
runoff from all contributing areas. Retention basins with stormwater depths exceeding one 
foot shall provide one foot of freeboard.
6. All retention basins shall drain within 36 hours per County requirements.

7. The County requires that the permission for access points to the site and other traffic 
impacts must be coordinated with the City of Surprise. A copy of the posed development 
Traffic Statement (TS) must be submitted to the City of Surprise for its review and approval. 
Coordination/approvals from City of Surprise shall be provided to PND for documentation.
e. All buildings subject to noise attenuation as per ARS § 28-8482(B).
f. The following C-3 CUPD standards shall apply:
1. There shall be minimum side yard of five feet from the west zoning boundary. 
2. There shall be minimum rear yard of five feet from the east zoning boundary.
3. The fences along the lot’s north and west property lines shall consist of chain link with 
screening slats and topped with barbed wire.  
4. The use of the site shall be limited to the commercial self-storage of RVs, boats, and 
personal belongs.  
g. The property owner/s and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions.
h. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, the property shall revert 
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, does not reduce any 
rights that existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held on the date 
of application due to such revocation of the Zone Change.  The Zone Change enhances the 
value of the property above its value as of the date the Zone Change is granted and reverting 
to the prior zoning results in the same value of the property as if the Zone Change had never 
been granted.

in the Glendale Area.
Commission Recommendation:  On 10/6/22, the Commission voted 8-0, to recommend 
approval of MCP2022003 subject to conditions ‘a’ – ‘i’:
a. Development of the site shall be in substantial conformance with the Site Plan entitled 
“Phase 2 Virgin Industrial Park“, consisting of 7 full-size sheets, dated July 21, 2022, and 
stamped received August 16, 2022, except as modified by the following conditions. 
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “VIP Phase II (IndiCap)”, consisting of 12 pages, dated July 21, 2022, and stamped 
received July 25, 2022, except as modified by the following conditions.
c. The following Planning Engineering Comments shall apply:
1. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the

3. At the time of application for building permits, detailed grading and drainage plans will be 
required to demonstrate how flow from each respective drainage area will be directed to its 
designated retention basin.  This shall include the requirement to provide calculations to 
substantiate the storm drain design.  The use of bubble-up structures in retention basins is 
discouraged and must be re-evaluated with the final design.
4. Drainage (private) easements will be required for any drainage improvement that extends 
to Phase 1 of this project unless the Phase 1 and 2 parcels are combined.
5. Retention basins with a design depth greater than 3 feet (to HWE) must be fenced (pool 
barrier compliant).  Surface retention basins deeper than one (1) foot must contain one (1) 
foot of freeboard.
6. Work in the floodplain will require a floodplain use permit issued concurrent with building 
permits for site development.  In the event the owner/applicant pursues a FEMA 
CLOMR/LOMR, said application must be approved by the Flood Control District prior to 
issuance building permits required for site development.
7. Access(es) to/from Reems Road; and the south drainage channel discharge contain 
Special Flood Hazard Areas (FEMA Zone A); and also contain lands owned or encumbered 
by the Flood Control District (FCD).  In addition to floodplain use permitting, ROW permitting 
will be required by the FCD for work and discharges within FCD encumbered properties. 
Applicant shall refer to Permit | Maricopa County,  AZ for more information.  The FCD ROW 
permit(s) must be procured prior to issuance of any building permit(s).

8. The owner/applicant’s traffic analysis must demonstrate that the second (southern) access 
to Reems Road is warranted prior to issuance of an FCD Right-of-Way Permit for 
encroachment through FCD owned or encumbered properties.
9. Owner/Applicant must coordinate with the City of Glendale regarding any street 
improvements required along Reems Road.
10. Turn lane designs in Reems Road at both (if warranted) access shall be in accordance 
with the MCDOT approved Traffic Impact Study.
d. Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, local 
fire protection jurisdiction review and approval will be required.
e. The subject parcels, APNs 501-41-006K, 501-41-006T, 501-41-006U, and 501-41-006X, 
shall be consolidated in conformance to the parcel shown and the legal description provided 
on the POD prior to issuance of building permits.
f. All internal roadway easements not a part of the final site must be abandoned and recorded 
documentation of such must be provided to staff prior to issuance of building permits.
g. The following Maricopa County Department of Transportation conditions shall apply:
1. In the revised 2nd submittal, a new access point is proposed for this Phase 2 development. 
The new proposed full access (Access B) as provided in the Study is acceptable to MCDOT. 
Developer must also seek R/W permits from MCDOT Flood Control District (for vehicle 
crossing via Access B) as necessary.
2. Developer must provide turn lane lengths at proposed Access B as per the 
recommendations in the Study. 
3. Revised turn lane lengths at the Reems Road / Hatcher Road (Access A), as presented 
in the Study, are acceptable to MCDOT.  Developer must provide turn lane lengths at 
proposed Access A as per the recommendations in the Study. 
4. Developer must coordinate with the City of Glendale with regards to any half-street 
improvements required along the site frontage on Reems Road.
h. Memorialization of the following MCP district standards:
1. Height – 55’
2. Min. Front Yard – 15’
3. Min. side Yard – 25’
4. Min. Rear Yard - 25' (abutting rural or residential)
5. Min. Lot Area - 6,000 sq. ft
6. Min. Lot Width - 60’

Chairman Gates asked Tom Ellsworth, Director of Planning and Development, and 
Darren Gerard, Planning Division Manager, to come forward. Mr. Ellsworth stated items 
7 through 11 are for the decommissioning of five area plans that are approximately 30 
years old. He stated they have fulfilled their purpose and each area has experienced 
development, zoned or have been incorporated into municipalities of the surrounding 
area. Mr. Ellsworth recommended decommission of these areas. 
Supervisor Gallardo commented in support of these item. He also talked about item 9, 
the Mobile Area Plan, an area that he has worked on with the community. Supervisor 
Gallardo looks forward to working with City of Goodyear to ensure they continue to 
service the Mobile Area.

East Mesa County Area Plans have served their purpose. Staff conducted an outreach

conduct business on his property, and is asking for a continuance to the February 8, 
2023 meeting.

Approve the Agreement and acceptance of up to $59,522 from the U.S. Department of 
Justice, Drug Enforcement Administration for MCSO participation in the DEA Phoenix Task 
Forces. The term of this agreement is retroactive to October 1, 2022 through September 30, 
2023.  
The grant award is reoccurring and has been awarded to the Sheriff's Office since 1998. A 
cash or in-kind match is not applicable. There is no future or ongoing contribution required 
following termination of the grant period. The Sheriff’s indirect cost rate is 12.30% for a total

of $7,321.24 none of which is recoverable per item 7 of the Agreement. The $7,321.24 will 
be absorbed by the Sheriff’s Office General Fund (100) operating budget. The grant award

through illegal drug interdiction. The grant award is not competitively bid.   
This agreement reimburses overtime costs for three MCSO deputies that are assigned full 
time to the DEA Phoenix Task Force up to $19,840.75 per deputy for a total of $59,522.  
These revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget 
law.

Approve a mutual aid agreement between the Tohono O’Odham Nation and Maricopa

the U.S. Department of the Treasury not to exceed $7.8 million.  Designate Joy Rich, County

funds.  
Authorize the designee, to sign all application documents related to these grant funds, as 
applicable. The grant award is one time and there is no cash or in-kind match requirement. 
At this time it is not known if indirect costs are allowed. Future ongoing cash contributions 
are not required after the grant period. The grant award is not a mandated function but can 
be used for any governmental purpose other than a lobbying activity.  The grant award is 
allocated to revenue sharing counties based on an allocation formula using measurements

AMENDMENT TO AGREEMENT WITH ARIZONA PROPANE GAS ASSOCIATION FOR 
THE PROPANE FIRE PIT PROGRAM
Approve and authorize the Chairman to execute an Amendment 4 to the Agreement between 
the Maricopa County Air Quality Department (MCAQD) and the Arizona Propane Gas 
Association (APGA) for APGA to provide a restricted donation of matching funding to 
MCAQD for the Propane Fire Pit Program and accept the funds.
This Agreement will provide for continued matching funds to support MCAQD’s Propane Fire 
Pit Program which encourages the exchange of wood burning fire pits for cleaner burning 
propane gas devices, to aid in the reduction of particulate matter 2.5 (PM 2.5) during the 
wood burning season. This program will be marketed to all County residents and will offer 
through e-mail a voucher which can be taken to select Home Depot stores within Maricopa 
County for a discount on a propane fire pit.  There will be a $50.00 discount provided by the 
County and a $25.00 discount provided by the APGA, for a total of $75 per program 
participant.  The program is limited to a total of 1,100 vouchers redeemed.  The term of this 
Amendment shall commence on the Effective Date and end no later than April 1, 2023.
PM 2.5 is an EPA pollutant that is known to cause damaging health issues, including acute 
asthma symptoms leading to hospitalization and heart disease, as the tiny pollutant can 
deposit deep into the lungs and enter the blood stream. If PM 2.5 should exceed the EPA 24 
hour or annual standard, this could lead to more stringent regulations and negative economic 
impact for Maricopa County.  
Donation revenue funds of $27,500 are deposited into Fund 504 as they are received. 
Donation funds are not local revenues for the purpose of the constitutional expenditure 
limitation; therefore, expenditures of these revenues are not prohibited by the budget law. 
The approval of this action requested does not alter the budget constraining the expenditures

Formal recording of the Maricopa County Regional Travel Reduction Program (TRP) Task 
Force FY2022 Annual Report to the Maricopa County Board of Supervisors.
Pursuant to A.R.S. § 49-583(I), the TRP Regional Task Force shall review the performance 
of the travel reduction regional program annually and prepare a report for the Board of 
Supervisors.   
The following provides a summary of A.R.S. § 49-583(I) and the Task Force’s compliance 
with the same:
“The task force shall review the performance of the regional program annually and prepare 
a report for the board. The report shall include successes and problem areas and shall 
recommend revisions to this article, as necessary.”
The Task Force has completed its review of the report, and there are no recommended

To approve an agreement between Community Bridges Inc. (CBI) and Maricopa County to 
establish a program to increase access to Medication Assisted Treatment (“MAT”), Opioid 
Use Disorder (“OUD”) recovery support services, and opioid prevention awareness for 
incarcerated patients transitioning to the community.
This Agreement shall begin upon approval by the Maricopa County Board of Supervisors 
and shall terminate one year thereafter unless otherwise terminated or amended as provided 
herein. By mutual written amendment executed by the Parties’ authorized representatives, 
this Agreement may be extended for supplemental periods of twelve (12) months, up to 
maximum of forty-eight (48) months
There are no financial responsibilities assigned by this Agreement; the Agreement is 
intended to allow CBI and CHS to work together to better address the needs of the 
community. Nothing in this Agreement shall be deemed to be a commitment or obligation of

Fund Applications (C-20-16-032-G-00) approved on May 31, 2016, authorize Maricopa 
County through the Office of Budget & Finance to accept and pass-through Tribal Gaming 
Grant funds from the Salt River Pima-Maricopa Indian Community for the programs listed 
below in the not-to-exceed amount of $1,068,700.00 in FY 2023. These funds are for 
government or non-profit services that benefit the general public, including public safety,

Approve a non-financial Affiliation Agreement (Agreement) with Alverno College JoAnn 
McGrath School of Nursing and Health Professions-Mesa Location (“SNHP”) for Internship 
Student Placement with Maricopa County (“County”) administered by the Human Services 
Department Early Education Division – Head Start Program (“Program” or “Facility”). 
Through this Agreement, School Interns shall be provided with supervised practice 
educational experiences with the Head Start program in program activities.
Alverno College shall place nursing students at Head Start program locations to provide 
health screenings and health and nutrition education to Head Start children and their parents, 
to promote health services. 
The term of this Agreement shall be for a period of five (5) years from the effective date 
(November 2, 2022 through November 2, 2027). This Agreement shall be automatically 
renewed for two successive two-year terms upon approval and signature of both Parties and

IGA WITH THE TOWN OF GUADALUPE FOR COMMUNITY DEVELOPMENT BLOCK 
GRANT ACTIVITIES
Approve an Intergovernmental Agreement (“Agreement”) between the Town of Guadalupe 
(“Subrecipient”) and Maricopa County the (“County”) administered by its Human Services 
Department.
The purpose of the Agreement is for the Subrecipient to complete improvement to the Town’s 
wastewater system, resulting in improved system reliability, capacity, and longevity for the 
residents of the Town of Guadalupe. The County will provide the Subrecipient with $550,275 
in U.S. Department of Housing and Urban Development (HUD) Community Development 
Block Grant (CDBG) Program Year/Fiscal Year 2022/2023 (PY/FY 22/23) funds under 
Assistance Listing Number (ALN) 14.218.
Agreement term shall begin November 2, 2022 and will expire November 1, 2024.
Also request authorization for the Chairman of the Board of Supervisors to approve and 
execute Change Orders/Administrative Changes as listed in Section 1 General Provisions,

Approve amendment 3 between Southwest Human Development (SWHD), Nurse Family 
Partnership (NPR), Home Visitation (HV) and Maricopa County by and through its 
Department of Public Health (MCDPH) to provide continued funding for the Nurse Family 
Partnership (NFP) program for the East Maricopa Region. The SWHD NFP program has 
adopted and implemented the NFP model in the East Maricopa Region and has been 
providing comprehensive community health nursing services to eligible women and their 
families.  This Amendment 3 shall extend the term of the contract to June 30, 2023 and 
increase the total not-to exceed amount to $734,855 which is equal to $146,971 for each of 
the five budget periods covered by this agreement. The original term of this Agreement was 
July 1, 2018, through June 30, 2022 but was renewable for up to three (3) additional twelve 
(12) month extensions.
This contract is funded through an Arizona Early Childhood Development and Health Board 
(AECDHB), First Things First (FTF), Home Visitation, Nurse Family Partnership, East 
Maricopa grant.  The FTF grant award is recurring and has been awarded in previous years. 
This grant does not require an in-kind match; has a maximum of 10% indirect cost 
reimbursement as delegated in the Grant Agreement; and ongoing cash contributions are 
also not required. The grant award is not a mandated function but provides a benefit to the 
citizens by providing intensive family support to 50 high risk pregnant women.  In addition, 
age-appropriate developmental and sensory screenings will be provided to 50 children of 
enrolled families throughout the first 2 years of their life. The grant award is competitive. 
There are no costs that will need to be absorbed by the department’s operating budget.

Approve the Intergovernmental Agreement between Maricopa County (County) and the City 
of Buckeye (City) for the installation, operation, and maintenance of fire preemption 
equipment on County-owned traffic signal at Sun Valley Parkway and Oasis Boulevard. 
Either Party may terminate this Agreement at any time prior to the expiration date by 
furnishing the other Party with a thirty (30) day written notice. 
The purpose of this Agreement is to define the responsibilities of each Party related to the 
purchasing, installation, and maintenance of fire preemption equipment. The City project will 
install a new traffic signal at Sun Valley Parkway and Oasis Boulevard that will be owned, 
operated, and maintained by the County.
Under this Agreement, the City shall purchase fire preemption equipment compatible with 
County traffic signals and controllers and the County will install the equipment as part of the 
project. The County will provide routine maintenance upon completion of the project. The 
City will incur all costs associated with replacement parts needed as part of normal, routine 
maintenance.

Rescind the July 27, 2022 approval by the Board of Supervisors (for the improvements of 
University Drive from Power Road to Higley Road C-64-23-006-X-00); and approve a revised 
version.
The action requested above is because, after the Board took its July 27, 2022 action to 
approve the Intergovernmental Agreement for the improvements of University Drive from 
Power Road to Higley Road. The City requests that no-cost permitting language be removed 
from the Agreement. Therefore, the County and its contractors will pay for permits related to 
the construction of the improvements. Thus, paragraph 10.3 of the intergovernmental 
Agreement is amended to "Issue to the County permits to work within the incorporated limits 
of the City or on City facilities will be issued to the County or its contractor subject to 
submission of the appropriate application and payment of generally applicable fees."
All other terms of the Agreement will remain with the Board of Supervisors' approval. They 
shall remain in full force and effect until all stipulations have been satisfied, except that it 
may be amended upon written Agreement by all parties.

Set a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), for 
December 7, 2022, at 9:30 a.m. to solicit comments on incorporating federal standards into 
Maricopa County Air Pollution Control Regulations: Rule 360 (New Source Performance 
Standards), Rule 370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and 
Appendix G (Incorporated Materials). Following the public hearing, the Board is requested 
to adopt the proposed incorporations into the Maricopa County Air Pollution Control 
Regulations.
The Maricopa County Air Pollution Control Regulations contain several rules, Rules 360, 
370, 371, and Appendix G, which incorporate by reference federal regulations from Title 40 
of the Code of Federal Regulations (CFR). These federal regulations include New Source 
Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants 
(NESHAP) and Acid Rain regulations. Every July 1, the U.S. Environmental Protection 
Agency (EPA) codifies revisions made to these federal regulations during the preceding year. 
The purpose of this rulemaking is to incorporate by reference the applicable federal 
regulations as codified on July 1, 2022, and thereby update Rules 360, 370, 371, and 
Appendix G with any revisions made to the corresponding federal rules during the preceding 
year. This is necessary in order to continue to comply with the Maricopa County Air Quality 
Department’s delegated authority from EPA to implement and enforce NSPS, NESHAP, and 
acid rain programs in Maricopa County, except for those specific authorities retained by the 
EPA. After the rules are adopted by the Board of Supervisors, the MCAQD will request 
delegation authority from the EPA to implement and enforce the federal standards.

Supervisor Gallardo talked about a meeting he attended in Laveen. He said it was a 
round table discussion with about 150 people including the Mayor of Phoenix and three 
council members. They talked about common issues across the Valley. He hopes to

have more conversations like this in the future. Supervisor Gallardo said he was looking 
forward to seeing former President Barak Obama in District 5 this evening. 
Supervisor Sellers stated he appreciates Department of Public Health and the Opioid 
settlement updates. He is also spending a lot of his time with the Valley Chambers and 
Valley Partnership to help with Proposition 400. Supervisor Sellers talked about a 
meeting with his Critical Infrastructural Group in East Valley Partnership. They talked 
about Prop 400 and Salt River Project’s role in providing a sustainable water resource 
in Maricopa County. 
Supervisor Galvin said he had a breakfast meeting with former Supervisor Mary Rose 
Wilcox, who serves on the Board of the Valleywise Health Governing Board. They 
talked about interesting topics regarding housing, economic development, water, and 
transportation. He also attended the grand opening of the Rio Verde Fire and Water 
District. Supervisor Galvin said the Sheriff’s office will be housed in the same building. 
He was excited to attend a Head Start program in Mesa, where he spent time with staff 
and had the opportunity to read a book to the children. He spoke about elections and 
his concern about everyone’s safety but confident everything will work without a hitch. 
He reminded the candidates to accept the results. 
Vice Chairman Hickman stated he was recently in Colorado for a cowboy wedding. He 
also attended a conference about development and how Luke Air Force Base fits into 
the community. Vice Chairman talked about seeing Generals and the Mayor talk about 
the importance of working for the 18-year-old Airmen that are performing a valuable 
duty. He also thanked Joy Rich, County Manager, and the entire County for providing 
valuable services. 
Chairman Gates said he attended an affordable housing groundbreaking event in 
District 5. He stated Salt River Flats was an excellent project with 192 units at the Crock 
Center and a great partnership with the state and City of Phoenix. He also attended the 
first All Hands Meeting for MCDOT that was well attended. He mentioned Air Quality 
was doing wonderful work. Chairman Gates also talked about the coffee chat held at 
the Shadow Mountain Senior Center. Recorder, Stephen Richer and Sheriff, Paul 
Penzone attended, and they spoke about elections, early voting, registration and safety. 
Chairman Gates and Recorder Richer would be attending a panel discussion put on by 
the Democracy Resiliency Network in Tempe. The focus of the discussion would be on 
building confidence in the election process.

LIBRARIES
Approve execution of the "120 Day" termination clause contained within Intergovernmental 
Agreement # C-65-20-004-M-00 between the Maricopa County Library District and the City 
of Surprise for operation of the Northwest Regional, Hollyhock and Asante libraries.  This 
clause, found in Section 13. Conflicts; Termination, sub-paragraph 13.3 states said 
Agreement may be terminated in whole or in part by either party, for any reason, or no 
reason, by written notice at least one hundred twenty (120) days prior to the effective date 
of such termination ("Early Termination").
