Amendment No. C-22-25-013-X-01 Amendment No. 1 City of El Mirage IGA Page 1 of 3 AMENDMENT NO. 1 TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN MARICOPA COUNTY ADMINISTERED BY ITS HUMAN SERVICES DEPARTMENT AND CITY OF EL MIRAGE I. Maricopa County (“County”) administered by its Human Services Department and the City of El Mirage (“City”) entered into a financial Intergovernmental Agreement (“Agreement”) on or about October 10, 2024. The Subrecipient and County are collectively referred to here as the “Parties” and individually as a “Party.” The purpose of the Agreement is for the Subrecipient to construct an outdoor learning pavilion on the lot to the east of the El Mirage Library to benefit the residents of the City. The pavilion will be an open-air concept with six individual sitting/learning nodes that will be used for educational programs for individuals of all ages, with an emphasis on literacy programming and educational activities for youth and adults. The County provided the Subrecipient with $311,093 in U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG-CV) funds under Assistance Listing Number (ALN) 14.218. The Agreement term is October 1, 2024, through August 31, 2026. II. The Parties agree to enter into this Amendment No.1 to amend the Agreement as follows: A. Revise and replace Section III (Work Statement), Paragraph 5 (Budget), incorporated here. 5.0 BUDGET 5.1 Activity Budget Progra m Year Fiscal Year Construction, Management, and Closeout $361,838.80 PY2020 FY2020 Total $361,838.80 5.2 The County shall provide an amount not-to-exceed Three Hundred Sixty-One Thousand Eight Hundred Thirty-Eight and Eight Tenths ($361,838.80) subject to the terms of this Agreement and availability of funds. Funding is provided under ALN 14.218 U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG-CV) funds. This Agreement amount constitutes the County’s entire participation and obligation in the performance and completion of all work to be performed under this Agreement. Expenditures must be submitted for reimbursement by 8/19/2026. B. Funding for Amendment No. 1 is $50,745.80 and the total Agreement funding amount has increased from $311,093.00 to $361,838.80. The Agreement is amended to incorporate the changes contained in this Amendment No. 1. All other terms and conditions of the Agreement remain in full force and effect as executed by the Parties. This Amendment No. 1 is subject to and incorporates the provisions of A.R.S. § 38-511. IV. The Parties have authorized the undersigned to execute this Amendment No. 1 on their behalf, and it shall be effective upon approval and signature by both Parties.
