RESOLUTION NO. R26-08-15
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF EL
MIRAGE, ARIZONA, APPROVING AN INTERGOVERNMENTAL
AGREEMENT WITH THE STATE OF ARIZONA, THROUGH THEIR
DEPARTMENT OF PUBLIC SAFETY, FOR PARTICIPATION IN THE
GANG AND IMMIGRATION INTELLIGENCE TEAM ENFORCEMENT
MISSION (GIITEM) STATE GANG FORCE; AND AUTHORIZING THE
MAYOR AND CITY STAFF TO EFFECUTATE THE TERMS OF THE
INTERGOVERNMENTAL AGREEMENT.
WHEREAS, the City of El Mirage, through its Police Department (“City”), and the State
of Arizona, through the Department of Public Safety (“State”), desire to enter into an
intergovernmental agreement (“IGA”) for the purpose of enhancing law enforcement services
concerning the criminal activities of street gangs through the cooperative efforts of the parties;
and
WHEREAS, the State of Arizona, through its Department of Public Safety, is authorized
to enter into such an IGA through A.R.S. § 41-1713(B)(3); and
WHEREAS, the State and the City are both authorized to enter into this IGA through
A.R.S. § 11-952; and
WHEREAS, it is in the best interests of the City to enter into an IGA with the State for the
purpose of enhancing law enforcement services concerning gang activity.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of El
Mirage:
Section 1.
THAT, the Mayor and Council of the City of El Mirage authorize the City
to enter into an intergovernmental agreement (IGA) with the State of Arizona, through its
Department of Public Safety, which IGA is referred to as DPS Contract No: 2021-064-R1.
Section 2.
THAT, the El Mirage Police Chief is designated as the authorized signatory
on the IGA (DPS Contract No. 2021-064-R1) to bind the City.
Section 3.
THAT, the Mayor and City staff are authorized to effectuate the terms and
conditions of the IGA (DPS Contract No. 2021-064-R1).
