El Mirage Road El Mirage, AZ 85335 VIA EMAIL AND MAIL Re: Notice of Intent to Renew Wired Telecommunications License and Right-of-Way Use Agreement Dear City of El Mirage: Pursuant to Section 1.3 of the Wired Telecommunications License and Right-of-Way Use Agreement dated October 19, 2021 (“Agreement”) between the City of El Mirage (“City”) and Wyyerd Connect LLC (“Wyyerd Fiber”), Wyyerd Fiber is providing its intent to renew the Agreement for an additional five (5) year period. In accordance with Section 1.3, the renewal must be made within one hundred eighty (180) days prior to the termination of the initial Term, which is April 22, 2026. In addition, A.R.S § 9-583(G) states that a license shall renew if the telecommunications corporation has satisfied the conditions for renewal and has complied with the material terms of this Agreement and applicable law. Wyyerd Fiber has complied with all material terms of the Agreement as well as applicable law. Wyyerd Fiber requests that the City please acknowledge receipt of this notice of intent to renew and provide Wyyerd Fiber with the City’s written mutual agreement to renew the Agreement by executing the signature block below. Wyyerd Fiber looks forward to continuing an excellent relationship with the City and providing state-of-the-art fiber optic telecommunication services to the City’s residents.
