Regarding the general landscaping, all construction damage is to be revegetated
and restored to natural Sonoran landscaping. An intensive Sonoran landscaping
plan will be designed for behavioral health programs within a 10’ building offset
and related building courtyards.
The Corporate Complex will be designed with native desert grasses only from the
edge of the pond to the mid-point of the corporate complex. These grasses will
only be native, annual grasses currently found on-site such as sixweeks gramas,
Brachiaria arizonica and Sixweeks fescue.
From the midway point of the complex out towards the parking will be more
regularly and intensively Sonoran landscaped.
In the parking lots and road areas, stabilized granite with a slurry coat for dust
control will be used for the roadways and parking lots. Native Sonoran Desert
plants and trees will be used to vegetate the green spaces between parking
spaces, including at least one tree per island.
On either side of the drives on site (both new and existing) within a 5’ offset will
incorporate native Sonoran revegetation.
A sound wall in the front of the site to incorporate desert hardy flowering vines that
will grow on the vertical side facing the Corporate Complex. On the highway
facing side, the berm will incorporate Native Sonoran plants and trees that will mix
in with existing vegetation. The sound wall will be keystone block construction
above grade, with reinforced concrete below the berm

Adam,
ADOT has no concerns with the zone change.
ADOT has been working with the engineer for the Meadows at Rocking Horse development
on the design of the improvements within the ADOT Right of Way since back on November
30, 2020. ADOT received and accepted the revised final plan set on October 26, 2022. The
ADOT Northwest District Permits office is currently working on the permit application and
supporting documentation for the roadway improvements within the ADOT right of way along
US-60 for the Meadows new facility which was received August 8, 2022. We will be working
on obtaining a bond for the offsite improvements prior to issuing an approved permit.
Contact the Northwest District Permits office with any questions
Thank You.

RE:
Maricopa County Comprehensive Plan Amendment/Zone; White Tank/Grand Area
Plan Change for Meadows at Rocking Horse Behavioral Health Facility
Dear Mr. Cannon:
The Arizona Game and Fish Department (Department) appreciates the opportunity to review the
Comprehensive Plan Amendment/Zone (CPA) change for the proposed behavioral health facility,
Meadows at Rocking Horse, located East of the US-60 and Rocking Horse lane in Maricopa
County, directly adjacent to the Hassayampa River and Monarch Wash. The Department
understands that the 125-acre project footprint will not change, but multiple improvements will
be made within the existing footprint. The improvements include: the construction of multiple
buildings and facilities, access roads, a non-swimming recreational pond, along with all needed
below ground infrastructure to serve the community as a behavioral health center.
Under Title 17 of the Arizona Revised Statutes, the Department, by and through the Arizona
Game and Fish Commission (Commission), has jurisdictional authority and public trust
responsibilities to conserve and protect the state fish and wildlife resources. In addition, the
Department manages threatened and endangered species through authorities of Section 6 of the
Endangered Species Act and the Department’s 10(a)1(A) permit. It is the mission of the
Department to conserve and protect Arizona's diverse fish and wildlife resources and manage for
safe, compatible outdoor recreation opportunities for current and future generations. For your
consideration, the Department provides the following comments based on the agency's statutory
authorities, public trust responsibilities, and special expertise related to wildlife resources and
recreation.
Attached for review is a project report (HGIS-16627) from the Department’s Online
Environmental Review Tool (ERT) . The report highlights Species of Greatest Conservation
1
Need (SGCN) and Species of Economic and Recreational Importance (SERI) as identified in the
State Wildlife Action Plan which have been documented or predicted within the buffered
footprint. Multiple special status species have been recorded within 3-miles of the Project area.

Two in particular, the Western Yellow-Billed Cuckoo and the Monarch Butterfly have been
identified recently within ½-mile of the proposed site.
●
The Yellow-billed Cuckoo, which is federally listed as Threatened under the Endangered
Species Act (ESA), have been recorded within a 1-mile radius of the current Project area.
If you are uncertain about the effects of the project to the Yellow-billed Cuckoo, or if it is
anticipated the project will not be in compliance with the ESA, the Department
recommends that the project proponent contact the U.S. Fish and Wildlife Service2
(USFWS) for their Technical Assistance. The USFWS will provide options to comply
with the ESA, such as conservation measures to avoid or minimize adverse effects to
listed species.
●
The Monarch butterfly has been identified within less than a 1-mile radius of the Project
area. While there are no Federal or State regulations for the Monarch, consider including
milkweed species as part of the Landscaping plant palette to help improve their breeding
3
habitat.
Best Management Practices
The Department recognizes riparian habitats as areas of critical environmental importance to
wildlife and fisheries, and encourages management practices that will result in the conservation
and protection of riparian habitat. The Department recommends management practices that will
maintain current riparian areas so that there is no “net loss” of habitat, if feasible, through
balancing economic development with mitigation and restoration efforts. Implementing a No Net
Loss approach ensures riparian habitat remains the same acreage within the project footprint. The
Department also encourages the maintenance, restoration, and protection of instream flows that
are essential to riparian habitat.
The Department offers the following strategies, if feasible, to off-set or minimize potential
impacts to these riparian areas:
●
To the extent possible, avoid altering all existing riparian areas in your project area so
they remain in their natural state.
●
Avoid removing vegetation (small trees, shrubs, perennials, annuals, and grasses) within
and immediately adjacent to the riparian area.
●
Avoid channelizing with impervious surfaces (i.e. concrete berms or channels).
●
Avoid disturbance in riparian areas during breeding season for birds (generally May
through late August for Yellow-billed Cuckoos).
●
Avoid fragmenting habitats by encouraging the connectivity of riparian areas past the
boundary of your project area.
●
To the extent possible, maintain a buffer of 100 feet around the riparian area. Riparian areas
buffer waterways against excessive runoff from upland activities which can degrade water
quality. Minimize alterations of the waterway and implement water control features to minimize
stormwater runoff to preserve water quality.

●
Riparian areas are important movement corridors for wildlife. For more information, see the
Department’s guidelines on how to plan for wildlife and preserve wildlife corridors here .
4
If proposed ground disturbance (both temporary and permanent) will require removal of native
vegetation that is 0.25 acres or more, please ensure the project complies with Arizona Native
Plant Law regulations . A Native Plant Inventory may need to be conducted to identify, record,
5
and coordinate plant salvage efforts for species that are Protected under the Arizona Native Plant
Law. In addition, the applicable land management agencies should be consulted regarding
guidelines for revegetation efforts.
The Department appreciates the opportunity to provide comments on this project. It is the
Department’s goal to work with project proponents to find solutions that will avoid, minimize,
and
mitigate
any
adverse
impacts
to
wildlife.

Disclaimer:
1. This Environmental Review is based on the project study area that was entered. The report must be
updated if the project study area, location, or the type of project changes.
2. This is a preliminary environmental screening tool. It is not a substitute for the potential knowledge
gained by having a biologist conduct a field survey of the project area. This review is also not intended to
replace environmental consultation (including federal consultation under the Endangered Species Act),
land use permitting, or the Departments review of site-specific projects.
3. The Departments Heritage Data Management System (HDMS) data is not intended to include potential
distribution of special status species. Arizona is large and diverse with plants, animals, and
environmental conditions that are ever changing. Consequently, many areas may contain species that
biologists do not know about or species previously noted in a particular area may no longer occur there.
HDMS data contains information about species occurrences that have actually been reported to the
Department. Not all of Arizona has been surveyed for special status species, and surveys that have been
conducted have varied greatly in scope and intensity. Such surveys may reveal previously
undocumented population of species of special concern.
4. HabiMap Arizona data, specifically Species of Greatest Conservation Need (SGCN) under our State
Wildlife Action Plan (SWAP) and Species of Economic and Recreational Importance (SERI), represent
potential species distribution models for the State of Arizona which are subject to ongoing change,
modification and refinement. The status of a wildlife resource can change quickly, and the availability of
new data will necessitate a refined assessment.
Locations Accuracy Disclaimer:
Project locations are assumed to be both precise and accurate for the purposes of environmental review. The
creator/owner of the Project Review Report is solely responsible for the project location and thus the correctness
of the Project Review Report content.

Recommendations Disclaimer:
1. The Department is interested in the conservation of all fish and wildlife resources, including those
species listed in this report and those that may have not been documented within the project vicinity as
well as other game and nongame wildlife.
2. Recommendations have been made by the Department, under authority of Arizona Revised Statutes
Title 5 (Amusements and Sports), 17 (Game and Fish), and 28 (Transportation).
3. Potential impacts to fish and wildlife resources may be minimized or avoided by the recommendations
generated from information submitted for your proposed project. These recommendations are preliminary
in scope, designed to provide early considerations on all species of wildlife.
4. Making this information directly available does not substitute for the Department's review of project
proposals, and should not decrease our opportunity to review and evaluate additional project information
and/or new project proposals.
5. Further coordination with the Department requires the submittal of this Environmental Review Report with
a cover letter and project plans or documentation that includes project narrative, acreage to be impacted,

Project Type: Development Outside Municipalities (Rural Development), Public & Community Facilities (school,
library, church) and associated infrastructure, Maintenance/expansion/rehabilitation of existing facilities
Project Type Recommendations:
Consider impacts of outdoor lighting on wildlife and develop measures or alternatives that can be taken to increase
human safety while minimizing potential impacts to wildlife. Conduct wildlife surveys to determine species within project
area, and evaluate proposed activities based on species biology and natural history to determine if artificial lighting may
disrupt behavior patterns or habitat use. Use only the minimum amount of light needed for safety. Narrow spectrum bulbs
should be used as often as possible to lower the range of species affected by lighting. All lighting should be shielded,
canted, or cut to ensure that light reaches only areas needing illumination.

Minimize the potential introduction or spread of exotic invasive species, including aquatic and terrestrial plants, animals,
insects and pathogens. Precautions should be taken to wash and/or decontaminate all equipment utilized in the project
activities before entering and leaving the site. See the Arizona Department of Agriculture website for a list of prohibited
and restricted noxious weeds at https://www.invasivespeciesinfo.gov/unitedstates/az.shtml and the Arizona Native Plant
Society https://aznps.com/invas for recommendations on how to control. To view a list of documented invasive species or
to report invasive species in or near your project area visit iMapInvasives - a national cloud-based application for tracking
and managing invasive species at https://imap.natureserve.org/imap/services/page/map.html.
To build a list: zoom to your area of interest, use the identify/measure tool to draw a polygon around your area of
interest, and select “See What’s Here” for a list of reported species. To export the list, you must have an
account and be logged in. You can then use the export tool to draw a boundary and export the records in a csv
file.

Follow manufacturer's recommended application guidelines for all chemical treatments. The U.S. Fish and Wildlife
Service, Region 2, Environmental Contaminants Program has a reference document that serves as their regional
pesticide recommendations for protecting wildlife and fisheries resources, titled "Recommended Protection Measures for
Pesticide Applications in Region 2 of the USFWS",
http://www.fws.gov/southwest/es/arizona/Documents/ECReports/RPMPA_2007.pdf. The Department recommends that
direct or indirect impacts to sensitive species and their forage base from the application of chemical pesticides or
herbicides be considered carefully.
Based on the project type entered, coordination with State Historic Preservation Office may be required
(http://azstateparks.com/SHPO/index.html).
Trenches should be covered or back-filled as soon as possible. Incorporate escape ramps in ditches or fencing along the
perimeter to deter small mammals and herptefauna (snakes, lizards, tortoise) from entering ditches.
Based on the project type entered, coordination with Arizona Department of Environmental Quality may be required
(http://www.azdeq.gov/).
Development plans should provide for open natural space for wildlife movement, while also minimizing the potential for
wildlife-human interactions through design features. Please contact Project Evaluation Program for more information on
living with urban wildlife at PEP@azgfd.gov or
at https://www.azgfd.com/wildlife/planning/wildlifeguidelines/ and https://www.azgfd.com/Wildlife/LivingWith.
Project Location and/or Species Recommendations:
Your project site is within one or more defined Areas of Possible Occurrence. Please follow Department protocols
while working within an Area of Potential Occurrence at U:\Agency Directives\Jaguar Ocelot and Mexican Wolf
Management Directive 20171215.pdf
Analysis indicates that your project is located in the vicinity of an identified wildlife habitat linkage
corridor. The Arizona Missing Linkages represent ideal connections within or between intact blocks or core habitats.
The blocks are currently disconnected or isolated and the linkages should be examined for improving permeability, or are
currently intact and in need of preservation and/or enhancement. The reports provide recommendations for opportunities
to preserve or enhance permeability. Project planning and implementation efforts should focus on maintaining and
improving opportunities for wildlife permeability. For information pertaining to the linkage assessment and wildlife species
that may be affected, please refer to: https://www.azgfd.com/wildlife/planning/habitatconnectivity/identifying-corridors/.
Please contact the Project Evaluation Program (pep@azgfd.gov) for specific project recommendations.

Good morning, Adam,
Thank you for sending us documentation for the Comprehensive Plan Amendment. SHPO
recommends that a Class I (literature review) and possibly Class III (intensive, pedestrian)
survey of the property should be conducted to determine if historic properties are present. The
County or Applicant can use this link https://statemuseum.arizona.edu/crm to obtain a list of
qualified consultants or request a records search. If the project has a federal or state nexus,
consultation with SHPO is required. If there is no state or federal nexus, we are happy to
conduct a non-mandated (voluntary) review.
If you would like us to attend the meeting, please let us know and send us the meeting
information.
Thank you,
Caroline

Since the publishing of the staff report, staff received a letter from a neighboring property owner
(Mr. Dennis Schlarbaum) to the subject site (APN#506-06-027R). The letter is not a letter of
opposition or support, but expresses a concern related to the use of an existing access gate
present on the Meadows property.

Image of Access Gate

Location of Gate Between Properties

Mr. Schlarbaum states that individuals park on his property and also utilize the access gate to the
site which blocks access to his property and other neighboring property owners using another
road (Pepperwood Circle). Additionally, he states that he believes he has the right to remove the
gate and block access to the property.

Staff contacted the Mr. Schlarbaum for additional information; however, Mr. Schlarbaum has not
reached back out to staff regarding the matter. The applicant spoke with Mr. Schlarbaum, and
informed him that they would have no concerns with moving or removing the access gate.
Ultimately, staff believes this to be a civil matter to be resolved between private property owners
and easement right beneficiaries.

Mr. Schlarbaum-
This firm represents Meadows Behavioral Health regarding application
CPA2022003. Adam Cannon with Maricopa County Planning & Development
forwarded your email regarding the gate and signage near San Domingo Trail
and Peperwood Drive, both shown on the aerial photos below.
I spoke with Brian Whitmer at Meadows, copied on this email, this morning
about the gate and access issues. Meadows does not use San Domingo Trail to
access its property and did not erect the gate and signs. Meadows has no
concerns about the gate being removed or moved – whichever you and your
neighbors prefer. It sounds like this can be resolved fairly simply.
Here is Mr. Whitmer’s telephone number. He’d be happy to discuss the gate
with you. 602.348.1538.
Thank you!

I am submitting this information as an adjacent property owner: Parcels #503-06-014, 025, 005

I have no concerns regarding the project but have a continuing issue with the access to the stated
parcel # 503-06-027R From my property and Pepperwood Circle there is a gate to the stated
property. The gate has Fish & Game signs posted.
Checking with the Fish & Game Dept - these signs were not posted by them and were falsely
attached..
The use of this access gate creates continuing issues - the blocking of the Pepperwood access - the
parking of vehicles on my property blocking full access to tenants living on the property.- and the
adjacent property owner which uses the Pepperwood access.

I believe I have the right to remove the gate and block access to the stated parcel but look for a
more reasonable alternative.

My concern is that this project will only create more useage and abuse of the gated access and
further and continuing disregard to my tenants and property.

Look forward to your response and resolution.
