Deletion of the stipulations will allow the applicant to work with the county legal team to dissolve the existing development agreement. There are no outstanding concerns from reviewing agencies. There is no known opposition. Commission Recommendation: On 6/8/23, the Commission voted 7-0 to adopt a motion recommending the Board of Supervisors approve DMP2023002 subject to conditions ‘a’ – ‘o’: a. Deletion of conditions ‘f’ of DMP2008006 and ‘e’ of DMP2021004. b. Changes to the Hidden Waters Ranch Development Master Plan with regard to use and intensity, or changes to any of the stipulations approved by the Maricopa County Board of Supervisors, shall be processed as a revised application with approval by the Board of Supervisors upon recommendation by the Maricopa County Planning and Zoning Commission. Revised applications shall be in accordance with the applicable Development Master Plan Guidelines, subdivision regulations, and zoning ordinance in effect at the time of application(s) submission. The Maricopa County Planning and Development Department may approve minor changes administratively as outlined in the Maricopa County Development Master Plan Guidelines in effect at the time of amendment. Non-compliance with the approved Hidden Waters Ranch Development Master Plan narrative report, maps, and exhibits, or the stipulations of approval will be July 26, 2023 DMP2023002 Page 2 of 4 treated as a violation in accordance with the provisions of the Maricopa County Zoning Ordinance. c. All stipulations of approval shall remain in effect in the event of a change in name of the Hidden Waters Ranch Development Master Plan. d. The property owner and their successors waive claim for diminution in value if the County takes action to rescind approval of this Development Master Plan due to noncompliance with any of the approved stipulations. e. The master developer shall be responsible for the construction of all public and private on-site roads within the Hidden Waters Ranch Development Master Plan. Further, the Hidden Waters Ranch homeowners association shall be responsible for the maintenance and upkeep of all private roads, public open spaces and public facilities, washes, parks, roadway median landscaping, landscaping within public rights-of-way, and all pedestrian, bicycle, and multi-use paths. f. Prior to approval of each final plat, the master developer shall submit to the Maricopa County Planning and Development Department a landscape inventory and salvage plan which identifies and assesses the native vegetation within the development parcels, and which determines the preservation/disposition for each of the selected native vegetation. g. Landscaping of all common areas and open spaces, except for identified recreational areas, within Hidden Waters Ranch shall consist of indigenous and near-native plant species of a xeriphytic nature. h. Until annexation of the entire development master plan takes place, the master developer shall notify all future Hidden Waters Ranch Development Master Plan residents that they are not located within an incorporated city or town, and therefore will not be represented by, or be able to petition a citizen-elected municipal government. Notification shall also state that residents will not have access to municipally-managed services such as police, fire, parks, water, wastewater, libraries, and refuse collection. Such notice shall be included on all final plats, be permanently posted on the front door of all home sales offices on not less than an 8 ½ inch by 11 inch sign, and be included in all homeowner association covenants, conditions, and restrictions (CC & Rs). i. All park facilities shall be completed concurrently with residential development of the respective plat on which the park is shown. j. One (1) elementary school site dedication at a minimum of 14.3 acres. shall be reserved for the Saddle Mountain Unified School District at the location identified on the Hidden Waters Ranch land use plan. If at a future date State Land areas adjacent to the amended areas of the DMP are rezoned from residential to industrial use, SMUSD leadership may agree to reduce or eliminate the school reservation k. The following PND Engineering conditions shall apply: 1. Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to number of proposed building lots/units, drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the county for further review and/or entitlement. July 26, 2023 DMP2023002 Page 3 of 4 2. A traffic impact study must be submitted with future entitlement (POD/Plat) application(s) contained within the DMP. 3. Engineering review of planning entitlement cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. l. The following Maricopa County Department of Emergency Management stipulations shall apply: 1. Any areas not covered by the existing Outdoor Warning Siren System used to alert residents within the 10-mile Emergency Planning Zone of the Palo Verde Nuclear Generating Station in time of emergency shall be required to include additional sirens, at the developer’s cost, in order to provide adequate warning for the residents of that development, using technical information concerning the siren system obtained from the Emergency Planning Department at the Palo Verde Nuclear Generating Station. In addition, adequate signage available from the Palo Verde Nuclear Generating Station Emergency Planning Department shall be required to be posted on the site to inform the public of the presence of a nuclear generating station in the vicinity and outlining actions to take upon receiving warning notification. 2. The developer shall ensure that public safety information regarding nuclear emergencies is initially provided to any new residents or building occupants. The applicant shall obtain this information from the Palo Verde Nuclear Generating Station – Emergency Planning Department. All costs associated with the duplication and dissemination of the initial distribution shall be assumed by the applicant. Thereafter, the Palo Verde Nuclear Generating Station will provide this public safety information annually. m. The following Flood Control District of Maricopa County stipulations shall apply: 1. The owner or his representative shall submit a Conditional Letter of Map Revision prior to any preliminary plat approvals. n. The following Luke Air Force Base condition shall apply: 1. The master developer shall notify future occupants/tenants that they are located near a military airport with the following language: “You are locating in a residential dwelling outside the “territory in the vicinity of a military airport,” however aircraft flying in this area are authorized to fly as low as 1,500 feet above the ground. You will be subject to direct overflights and noise by Luke Air Force Base jet aircraft in the vicinity. Luke Air Force Base executes an average of approximately 165 overflights per day. Although Luke’s primary flight paths are located within 20 miles from the base, jet July 26, 2023 DMP2023002 Page 4 of 4 noise will be apparent throughout the area as aircraft transient to and from the Barry M. Goldwater Gunnery Range and other flight areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends. For further information, please check the Luke Air Force Base website or contact the Maricopa County Planning and Development Department.” Such notification shall be permanently posted on not less than a 3 foot by 5 foot sign in front of all leasing and home sales offices and be permanently posted on the front door of all leasing offices on not less than 8½ inch by 11 inch sign. o. At its discretion, the Maricopa County Planning and Development Department may administratively approve up to a 5% change in the gross area of any parcel that is subject to a planned area development zoning overlay. Such change, either individually or cumulatively, shall not result in a change of any land use category by 5% or greater. Changes greater than 5% either individually or cumulatively shall be processed as a revised application with approval by the Maricopa County Board of Supervisors upon recommendation by the Maricopa County Planning and Zoning Commission. The applicant is proposing the deletion of condition “e” from DMP2021004 as well as condition “f” from DMP2008006, which both read as follows: “Prior to the approval of any zone change, the master developer shall enter into a development agreement with Maricopa County. Further, prior to approval of any zone change this development agreement shall be sign by both the master developer and the designated Maricopa County representative(s) and provided to the Maricopa County Planning and Development Department for public record.” The deletion of the two conditions would allow the applicant, in coordination with county legal counsel, to dissolve the existing development agreement (DA) between the property owners and the county, which was created as a result of these conditions. The applicant is seeking dissolution of the DA to remove the burden of needing approval from all property owners within the DMP area to sign off on any zone change requests. This has become a larger burden over the years as the property within the DMP area has been split and there are now several more property owners than when the DMP was initially created. The applicant also notes that the task of gathering all property owners to sign off on each zone change proposal within the DMP area has proven rather challenging. 2. On April 20, 2021 the board of supervisors approved both Z2021141, a zone change request from Rural–43 to IND-2, and DMP2021004, a land use designation change from Small Lot Residential to Employment/Industrial Center, over the subject parcels. The applicant applied for the subject modification of stipulations on April 6, 2023. The area plan defines Rural as areas desirable for single family residential development but where urban services are limited. Community Retail Center is defined as an area appropriate for community and neighborhood uses such as the sale of convenience goods and personal services. Public Participation Summary: 7. The applicant worked with staff to formulate an appropriate citizen participation plan. The applicant posted signs and sent mailers to all property owners within the DMP area. Staff received no public comment or opposition to the case as a result of the public participation or otherwise. However, the applicant did attract several other property owners within the DMP area to “sign onto” the proposal. Their signatures are included in the case attachments. Outstanding Concerns from Reviewing Agencies: 8. N/A. DMP2023002 Page 5 of 8 Staff Analysis: 9. The proposed deletion of stipulations “f” from DMP2008006 and “e” from DMP2021004 will allow the applicant to continue to work with the county legal team to dissolve the development agreement in place between the property owners within the Hidden Waters Ranch DMP and the county. Doing so will allow individual property owners the ability to bring forth new zone change requests without signoff of all property owners within the Hidden Waters Ranch DMP area. Staff notes that this request was done in coordination with county legal counsel. In addition, the Hidden Waters Ranch DMP is approaching twenty years old and may be out of date. The proposal is in line with several general plan goals and policies as it will allow new development to come to the area and take on a reasonable and proportional share of infrastructure cost resulting from each individual development. Staff has no concerns of the proposal. Recommendation: 10. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve DMP2023002 subject to conditions ‘a’ – ‘o’: a. Description and Purpose of Proposal On behalf of 339th & I-10, LLC (“339th”), who is the owner of property generally located south of the 1-10, north of Buckeye Road, generally between 339th Avenue on the east and 351st Avenue on the west (APNs 504-12-007, 504-12-008, 504-12-006Z, 504-12-006P, 504-12-135, 504-12-137, 504-12-006S, 504-11-007). An Aerial Map of 339th’s Site is provided at Exhibit 1. We request a Zone Change Modification of Conditions on two stipulations and that the Board of Supervisors recind a development agreement related to the Hidden Water’s Ranch Master Planned Community. We request the Board of Supervisors 1) modify stipulation “e” to case DMP2021004 and 2) recind the Development Agreement recorded at instrument number 20091002577 and refenced in stipulation “f” to case DMP2008006. Specifically, 339th requests to delete the stipulations as shown below: 1) Case #DMP2021004 e. Prior to the approval of any zone change, the master developer shall enter into a development agreement with Maricopa County. Further, prior to approval of any zone change this development agreement shall be signed by both the master developer and the designated Maricopa County represenatives(s) and provided to the Maricopa County Planning and Development Department for public record. 2) Case # DMP2008006 f. Prior to the approval of any zone change, the master developer shall enter into a development agreement with Maricopa County. Further, prior to approval of any zone change this development agreement shall be signed by both the master developer and the designated Maricopa County represenatives(s) and provided to the Maricopa County Planning and Development Department for public record. 339th Requests these modifications and recinding of the existing Development Agreement in order to allow 339th and other affected property owners to develop their properties. Since the above stipulations were created, property in the Hidden Waters Ranch Master Planned Community has been sold to various parties. The approval of these requests will facilitate the development of underutilized land in Maricopa County. However, this request does not propose any development or phasing. All proposals by other owners are not known at this time. 339th LLC will pursue development in accordance with their the Major Amendment to the Development Master Plan approved in case DMP2021004 and Major Zone Change Amendment Application in case Z2021141. II. Surrounding Properties The Overall Hidden Water Ranch Development Master Plan is an existing 1,314 acre master planned community. The Surrounding area largely remains vacant with some large lot residential uses. The surrounding zoning is largely RU-43 with the exception of 3 the parcels rezoned to IND-2 by 339th. The development of this currently underutilized land will be a benefit to the area and the community as a whole. III. General Plan Conformance These requests will help to facilitate development of underutilized land and will promote valuable uses including the uses proposed by 339th to provide industrial and employment type uses that are in demand in this area. This request for modification of stipulation and to rescind the existing development agreement will promote the orderly development of properties and is supported by goals and policies of the General Plan as follows: Land Use Goal #1: Achieve balanced and efficient development patterns. Land Use Goal #4: Exercise sound financial management through land use decisions that build the county’s fiscal strength. Economic Growth Goal #4: Create and grow a diverse business climate Cost of Development Goal #1: Exercise sound financial management and build the County’s fiscal strength Cost of Development Goal #2: New development pays for its proper and reasonable share of the costs of new infrastructure, services, and other public improvements Response: Modifying this stipulation and recinding the existing development agreement will remove a barrier and allow efficient development that will add to the County’s fiscal strength be promoting new uses that will pay their share of public improvements. IV. Infastructure These requests propose no changes for accessibility, circulation, community facilities and services, or publuc utilities and services. 339th has already received entitlement approvals (which include infastructure anaylsis) as stated above. Any further entitlement approvals by 339th or other land owners within the Master Plan Area will require approvals where the County will have the opportunity to analyze and impacts on infastructure. As such, we don’t formally have any comment on this – but from a best planning practice standpoint, I would recommend that if a development agreement that defines street and utility infrastructure improvements is no longer a requirement for this Development Master Plan , that some other mechanism is in place to ensure that such improvements are master planned and constructed in larger phases, not piecemealed as each individual lot may develop.
