The applicant is requesting a SUP to convert two LNC static
billboards to digital billboards on the same lot that are 531 feet
from each other, where 1,000 feet is the maximum spacing for
freeway-oriented billboards. Additionally, the request converts one
billboard to digital and raises the height of the billboard to 50 feet.
Another request is to convert the other billboard on the lot to digital,
increase its height to 90 feet, and increase its sign area for each
face to 1,200 sq. ft. This is a heavy industrial area isolated both
visually and physically from any residential neighborhood due to the
adjacent freeway stack interchange of I-10 and Loop 202. There is
no known opposition and no outstanding concerns from reviewing
agencies.

On 6/23/23, the Commission voted 6-0 to adopt a motion
recommending the Board of Supervisors approve Z2022105
subject to conditions ‘a’ – ‘n’:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled
“Plan of Development of a Digital Billboard Off-Site Advertising“, consisting of three full-
size sheets, dated April 13, 2023, and stamped received April 17, 2023, except as modified
by the following conditions. Staff may determine slight refinements to remain in
substantial conformance with the approved site plan. Minor and major amendments to

the site plan will be determined in accordance with Chapter 3 of the Maricopa County
Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Narrative Report / Special Use Permit for Digital Billboards”, consisting of 16
pages, dated April 13, 2023, and stamped received June 7, 2023, except as modified by
the following conditions.
c.
The following Planning Engineering conditions shall apply:
1.
The applicant shall be responsible for coordinating any requirements that may be
imposed by ADOT (redletter@azdot.gov).
2.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards, and best practices at the time of
application for construction.
d.
All lighting associated with the billboards shall adhere to Article 1112.3.2 of the Maricopa
County Zoning Ordinance.
e.
The digital billboards shall adhere to Article 1403.3.1.J of the Maricopa County Zoning
Ordinance.
f.
Minimum distance between the two billboards on site shall be 531 feet.
g.
Maximum distance a digital billboard shall be from a freeway main travel lane for the east
billboard shall be 345 feet.
h.
Maximum height for the west billboard shall be 50 feet from the adjacent grade.
i.
Maximum height for the east billboard shall be 90 feet from the adjacent grade.
j.
Maximum sign face area for the east billboard shall be 1,200 sq. ft.
k.
Maximum apex of a double-faced billboard for the east billboard shall be 58 inches.
l.
Engineering technical specifications and details that demonstrate the digital billboard’s
louver technology that will be used in their design must be submitted with each building
permit.
m.
Noncompliance with any Maricopa County Regulation shall be grounds for initiating
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
n.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, and at the
time of expiration of the Special Use Permit, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed that either

revocation due to the failure to comply with any conditions, or the expiration of the Special
Use Permit, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted.

Project Summary:
1.
The applicant is requesting a SUP to convert two LNC static billboards to digital billboards on the
same lot that is zoned IND-3. The site is southeast of the Santan Frwy. (Loop 202) and Maricopa
Frwy. (I-10) interchange in an industrial part of the County. Currently, the site is a fully developed
five-acre industrial site with one static billboard in the west part of the site and one static billboard
in the east part of the site. The billboard in the west part of the site is located 117 feet from the
nearest freeway lane of I-10 and does qualify as a freeway-oriented billboard since it is located
less than 300 feet from the freeway. One issue is that the east billboard is located 345 feet from
the nearest travel lane of Loop 202 Frwy. and would not normally qualify as a freeway-oriented
billboard. Another issue for these two billboards on the same lot is that they are only spaced 531
feet from each other, whereas the Zoning Ordinance clearly states that all billboards adjacent to
the freeway must be spaced 1,000 feet when located less than three miles from a municipality.
However, this spacing is what makes the two billboards LNC (to current ordinance standards)
and thus triggers SUP for their alteration.
2.
To rectify the above issues the applicant has requested an SUP for both billboards, with the
following varied development standards:
a. A height increase from 30 feet to 50 feet for the west billboard, due to the 26-foot elevation
of I-10’s main travel lanes, where –70-feet above the adjacent grade or 48 feet above the
elevation of the main freeway travel lanes is the maximum permitted height for the digital
billboard.
b. Allow the existing billboards to be spaced 531 feet apart where 1,000 feet is the minimum
distance permitted between billboards.
c. Convert the billboard face that is orientated towards the I-10 Freeway from static to digital
for the west billboard.
d. Convert both billboard faces that are oriented towards the Loop-202 Freeway to digital for
the east billboard.
e. Allow the existing east billboard located 345 feet from the main travel lanes of Loop 202
Freeway to be digitized where the minimum distance is 300 feet from a freeway to a digital
billboard.
f. A height increase of the east billboard from 60 feet (per approved variance BA2011030)
to 90 feet where – 70-feet above the adjacent grade or 48 feet above the elevation of the
main freeway travel lanes is the maximum height permitted for a digital freeway billboard.
g. An increase of each sign face of the east billboard from an area of 672 sq. ft. to 1,200 sq.
ft.
h. Allow for an apex of a double-faced billboard of 58 inches for the east sign, where 54
inches is the maximum apex permitted.

In 1993 the site was rezoned from Rural-43 to IND-3 with a subsequent Plan of Development
(POD) for the existing industrial use on the site (Z93-37v). On March 8, 2012, the Board of
Adjustment approved a maximum height for the east billboard from 30 feet to 60 feet and a
maximum sign area from 300 sq. ft. to 672 sq. ft. (BA2011030). On May 18, 2012, the Planning

staff administratively approved a Major POD Amendment for the east billboard on this site at a
height of 60 feet and a sign area of 672 sq. ft. (Z2011102). On May 15, 2013, Planning staff
approved a Major POD Amendment on the site for the west billboard with a staff interpretation,
that classified the west billboard as a freeway-oriented billboard and the existing east billboard
as a local street-oriented billboard (Z2013052). This interpretation is the reason why the existing
billboards were permitted only 531 feet apart.

as Employment. The Plan focuses attention on strengthening the community’s economic base by
expanding the growth areas and identifying a variety of employment areas for future growth.
Major employers, knowledge-based industries, and industrial/business parks are allowed within
the Employment land use designation.

The applicant complied with the Maricopa County Public Participation Process with the required
posting of the property and the notification to the adjacent property owners within 300 feet of the
subject site. Staff has not received any notice of opposition or support to the request.

Staff Analysis:

Staff supports the SUP request. The modifications of the two billboards on this site will not have
a predictably adverse impact on the surrounding area. The existing billboards have been on this
site in the same locations for the last ten years. In general, staff always considers conversion to
digital faces from traditionally illuminated billboards to be an improvement. Digital billboards
mitigate illumination trespass into adjacent neighborhoods and into the nighttime sky. The louver
technology that will be employed in their design will minimize glare and direct the billboard’s
messages to only the freeway traffic. The new ability to control the time the boards are illuminated
would be a vast improvement to what is offered in the billboards’ current state.

The request to modify the height of the west billboard to 50 feet is justified since this would
account for the raised elevation of the I-10 Freeway main travel lanes. Allowing the two billboards
to be 531 feet from each other is a justified request and would have a minimal effect since these
are the billboard locations that have existed for the last decade. The request to increase the height
of the east billboard to 90 feet and its billboard face dimensions to 1,200 sq. ft. is arguably
justified, given the unique site aspects. Most importantly, the applicant has documented that
increasing the east billboard’s height and sign face area would have a negligible impact since the
surrounding area is of a heavy industrial nature for quite some distance to the east and south.
The nearest residential neighborhood is a multi-family apartment complex located over ½-mile to
the northwest on the opposite side of an elevated freeway interchange that will screen the
billboards from view.

Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors

Purpose of Request
The applicant requests a Special Use Permit for the digital conversion of both faces on the
eastern billboard (the “E Billboard”) and the single face on the western billboard structure (the
“W Billboard”) along the 202 Freeway (the “202”). Both billboards are on parcel # 301-85-065B
(the “Property”). Please see Exhibit 1 and 2 for property aerial. This 5-acre parcel is located in
unincorporated Maricopa County and is currently zoned IND-3 (Heavy Industrial). The
surrounding area is heavily industrial with the closest residential a half mile away. Please see
Exhibit 3 for surrounding zoning and Exhibit 4 for surrounding uses (Exhibit 9 shows the
distance to closest residential).
The height of the W Billboard is currently 30’ and will be increased to 50’. The E Billboard is
currently 60’ and is being requested to raise to 90’. The size of the W Billboard will be modified
from 10’6”x36’ (378 sf) to 14’x48’ (672 sf) in size which is allowed by right per the Zoning
Ordinance. This request is also to modify the E Billboard faces from the current 14’x48’ (672 sf)
to 20’x60’ (1,200 sf).
The E Billboard cannot be seen effectively from the 202 freeway travel lanes today because of
the elevation of the interchange and large ADOT right of way separating the sign from the
travel lanes. These hardships are consistent with the 2012 variance request for this same
property. BA2011030 was approved by the Maricopa County Board of Adjustment on March 8,
2012 allowing the eastern sign to be at the 672 sf and 60’ in height. The Board felt that the
combination of the raised freeway constructed adjacent to the Property and the distance the
freeway was constructed at the site renders the sign unreadable to the vehicle traffic on the
202 freeway at the allowed height and size.
The SUP is required due to the spacing requirements within the 2021 Text Amendment to
Section 1403.3.1, and to the fact that the billboards on this site are legal non-conforming.
Description of Proposal/Justification for Deviations
The property is located directly adjacent to the 202 freeway and onramp just south of the SEC
of the large freeway interchange. The billboards are along the northern perimeter closest to
the freeway as possible. The Property is currently being used for outdoor storage. The property
can be accessed off Fairview St and Weber Dr. There is no residential zoning or units within a
half mile of the Property.
The applicant is proposing the E Billboard to be raised to 90’ in height because of the Property’s
location near the I-10 Interchange causes there to be an inordinate amount of ADOT right of
way. Please see Exhibits 5 and 6 for renderings of the sign. The interchange blocks any views
for east bound traffic onto the 202 from south bound I-10. A crane was placed on the site to
determine the correct height for safe viewing by oncoming traffic, it was determined the board
should be raised to the 90’. The faces will also be upgraded to 20’ x 60’ (1200 sf) sign faces.
Other than these requested variations, all other development standards of the Maricopa
County Zoning Ordinance apply. The billboards will meet the outdoor light control provisions
listed in Article 1112 of the Zoning Ordinance and the commercial off-site digital billboard
development standards of Article 1403.3.1.J of the Zoning Ordinance.
The larger sized billboard face and height of the E Billboard will be consistent with other signs in
the immediate vicinity and will not have any negative impacts because of the industrial nature
of the interchange area. Exhibit 9 shows the closest residential use to be 2,600’ away across
the interchange.
The W Billboard is currently single faced and 30’ tall. This proposal is requesting a height
increase to 50’ and the west face will be changing to a single faced digital sign.
The SUP is required because the existing billboards are now considered to be Legal Non-
Conforming (“LNC”) because of the passage of the 2021 text amendment for billboards. The
signs are legal non-conforming due to the following:
1. Distance less than 1,000 feet from another Billboard - The spacing between the
two signs is 531’.
2. Digital freeway billboard located more than 300 feet from a freeway travel lane –
the W Billboard is located 615’ from the main traveled lane; the E Billboard is located
750’ away from the Loop 202 main traveled lane. The W Billboard is 171 feet from
the I-10 off-ramp and the E Billboard is 345 feet from the 202 on-ramp. Please see
Exhibit 7 for distances. The distance from the Property to the freeway is due to
several conditions: The Property’s location with respect to the I-10 & 202 stack
interchange, the fact that the stack interchange is not symmetrical due to the difficulty
of its location with respect to the Indian Tribal Lands directly south, arterial streets
between the Property and the freeway and ADOT right-of-way between the Property
and freeway due to the design of the interchange, which is a large stack
interchange (Exhibit 7). The ramps are approximately 1,500’ in length that
provide ample viewing time for oncoming traffic. The Outdoor Advertising Association
of America states that 8 seconds is the safe viewing time for a digital billboard. With a
vehicle moving at 55 mph, the vehicle will travel 80’ per second which gives them
about 18 seconds of viewing time which is as efficient as a main travel lane along a
freeway. If not for the large interchange, the two boards would be fronting the main
travel lanes. The large swath of ADOT ROW at the major interchange has
created a hardship for the property owner to utilize their property rights as other
properties along freeways.

The unique construction of the interchange of the Loop 202, I-10 and Pecos Road created a
raised stack of the freeway that blocks safe viewing for eastbound traffic. E billboard’s current
60’ height is not visible from optimal viewing distances of around 800’. In addition, the
freeways unique construction caused by the Indian Reservation to the south and multiple
freeway interchanges has created a hardship where the Property is located as far as 750’ away
from the west bound travel lane of Loop 202, given the requirement to adjust the entire
interchange north from the Property.
The E billboard will be directing advertising toward the main lanes of the 202 Freeway and the
on ramps as described above. The attached site plan demonstrates how the main travel lanes
of the freeway is 750 feet away from the board and 345’ from the freeway on-ramp. East
bound traffic will only have approximately 800’ or 9 seconds when traveling at 55 mph to see
the board. The height of the interchange blocking the E board at the current 60 feet in height
and the distance between the property and main travel lanes allows for less than optimum
viewing time for oncoming traffic. The requested 30 foot increase in height and the increase to
a 20’ x 60’ (1,200 sf) billboard is consistent with the purpose of the Zoning Ordinance since the
end result will be the billboard is visible to the adjacent traffic at 30 feet above the visible
surface at the interchange and will be readable to passing traffic. These requested increases
will provide for a safer viewing time for oncoming traffic.
Relation to Surrounding Properties
The Property is bounded by the Loop 202 Freeway and onramps to the north, I-10 and 202
ramps to the west, and heavy industrial uses to the east and south. The property to the
southwest of the site is zoned with an IND-3 zoning district. The nearest residential to the
Property is approximately a half mile away on the other side of the interchange (Exhibit 9). The
industrial parcels to the south and east consist of mostly outdoor storage, marijuana dispensary
and manufacturing with large truck bays. The property to the north is owned by ADOT and
used as right of way to the 202.
North – 202 Freeway and ADOT ROW. No adverse effects are expected.
South – IND-3. No adverse effects are expected.
East – IND-3. No adverse effects are expected.
West – IND-3 and the I-10. No adverse effects are expected.
New digital faces on the Property will allow local businesses of the east valley to advertise to
viewers. A new, quality billboard at this site will add improvement to the property and allow
for messaging to the east valley.
Location and Accessibility
The Property is a County island just south of the Loop 202 and is currently accessible along
Fairview St and Weber Dr.
Circulation System
The billboards are accessed from either Pecos Rd or Weber St, connected via 56th St. The
driveway and parking space for maintenance is surfaced with asphalt to mitigate dust pollution.
The driveway and parking will only be used to replace the static faces with digital, and then only
occasionally for maintenance. A benefit of digital panels is that maintenance is much lower and
typically occur only a few times a year.
Development Schedule
Once a permit is issued by Maricopa County the digital faces will be ordered and delivered
within 4 weeks of being ordered. The construction process can be done in three to four days.
Community Facilities and Services
The Property is within the Kyrene School District. The closest elementary school is Kyrene de la
Mirada Elementary School approximately 3 miles north at 5500 W Galveston St. The closest
park is the Pecos Park in the City of Phoenix approximately 1,200’ to the west.

The Maricopa County Environmental Services Department (MCESD) has reviewed
documents received from the Maricopa County Planning and Development Department
for the above referenced project. This project is a request to Reduce spacing
requirements for two billboards on property to convert to digital at APN # 301-85-
065B. According to the submitted documents, water and sewer services will not be
needed, MCESD has no concerns.
Based on the above, MCESD raised no objection to this project to the Planning &
Development Department in Accela Automation on June 29, 2022 and the project
may proceed at this time subject to the following stipulations:

It should be noted that this document does not approve the referenced project.
Comments are provided only as advisory to Maricopa County Planning and
Development Department to assist staff to prepare a staff report. Other Maricopa
