The applicant indicated that the zone change will be to facilitate a future auto mall. The applicant team is working closely with the City of Mesa and plans to eventually annex into the city. City staff have provided their full support for the proposed zone change and confirmed that this will be a piece of a larger commercial district within the city. Aside from support from Mesa no other public comment was received. There are no outstanding concerns from reviewing agencies. Commission Recommendation: On 6/22/23, the Commission voted 6-0 to adopt a motion recommending the Board of Supervisors approve Z2023027 subject to conditions ‘a’ – ‘f’: a. Development of the site shall be in conformance with the zoning exhibit entitled “Signal Butte & SR24“, consisting of 1 full-size sheet, dated May 8, 2023, and stamped received May 18, 2023, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Rezone Narrative Berge Auto Mall”, consisting of 3 pages, dated May 18, 2023, and stamped received May 18, 2023, except as modified by the following conditions. c. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in July 27, 2023 Z2023027 Page 2 of 3 accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. d. The Following Planning and Development Engineering conditions shall apply: 1. Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to number of proposed building lots/units, drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the county for further review and/or entitlement. 2. A traffic impact study must be submitted with future entitlement (POD) applications(s). 3. Right-of-way dedication along 222nd Street and Signal Butte Road may be required to accommodate road improvements required for site development. 4. Portions of Signal Butte Road are within the jurisdiction of the City of Mesa. The applicant will be responsible for coordinating with the city to review any traffic impact, right-of-way dedication, permitting or roadway improvement requirements within its jurisdiction. 5. The application is responsible for coordinating any requirements with ADOT given the site’s proximity to SR-24. 6. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. e. Noncompliance with these listed conditions or with any Maricopa County Regulation shall be considered a zoning violation in accordance with the Maricopa County Zoning Ordinance and grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. f. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. The zone change request covers seven properties, six of which are currently zoned Rural-43 and one is zoned Rural-43 with a special use permit (Z2021163) for RV and boat storage. Along with the zone change request, the applicant is also requesting that the previously approved SUP be repealed so that there are not multiple layers of entitlement cases over a portion of the subject properties. The proposal is only for a zone change at this time, so no details about potential access or site design have been provided for the proposed auto mall. The applicant has been working closely with the City of Mesa on these properties and they will eventually be annexed into the city to be part of a larger mixed-use development. Mesa staff has given their full support for the proposed zone change. 2. Of the seven parcels included with the zone change request, only one, APN 304-34-204B, has recent case history outside of the subject request. That parcel was subject to SUP 2021163 for a RV and boat storage facility which was approved by the board of supervisors (BOS) on October 19, 2022. There was a preapplication meeting, PA2023001, held on the current request on January 24, 2023. The applicant did not report any response generated from their public participation efforts. Staff likewise has not received any public feedback on the case outside of support from the City of Mesa. Outstanding Concerns from Reviewing Agencies: 8. N/A. Staff Analysis: Z2023027 Page 6 of 8 9. The applicant’s proposal is for a zone change from Rural-43 to C-3 with no overlay or associated plan of development. Staff typically would be hesitant of general C-3 zoning, however, the City of Mesa has provided documentation of their support for the proposal and has indicated that the site will eventually be annexed into the city as a part of a larger planed mixed use area. Mesa also indicated that they intend to provide all utilities and services to the site. Staff notes that the site has direct freeway access at the intersection of Signal Butte Rd. and SR-24 which lends to high intensity commercial uses. The applicant also requests that recently approved SUP Z2021163 be repealed to avoid unnecessary complexities having layered zoning entitlements over a portion of the subject site. Additionally, the SUP was for RV and boat storage, which is an allowed use in C-3 zoning and thus rendering the SUP redundant. Staff has no concerns over the proposed zone change. The proposed development will consist of auto dealerships located at Signal Butte Road, between Williams Field Road & the future SR-24. The Property is approximately 24.61 acres that will be included in the approximately 114-acre Auto Mall being developed by The Berge Family. The applicant is requesting this entitlement to be sunset as C-3 zoning allows for such use. Relationship to Surrounding Properties The proposed development will complement the surrounding area and add to the future Berge Auto Mall complex. The area is mostly vacant, with a few residential lots just north of the subject parcels. The Berge Family has been working with the City of Mesa to develop this mixed-use development since 2019. Over time, the Berge family has acquired additional land to be included in the overall development. The applications include: • Berge Auto Mall (ZON22-00267) which is located north of AZ 24, south of East Williams Field Road and on both sides of Signal Butte Road. • Horne – Gateway Auto Mall (ZON22-00435) which is located south of AZ 24, north of East Pecos Road and on both sides of Signal Butte. Attached are the related proposed zoning exhibits for each case. We understand that the County is concurrently reviewing applications for these two projects.
