On 6/8/23, the Commission voted 7-0 to adopt a motion 
recommending the Board of Supervisors approve Z2023035, 
subject to conditions ‘a’ – ‘g’:  
 
a. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Rezone Narrative”, consisting of 11 pages, dated May 9, 2023 except as modified 
by the following conditions. 
 
b. 
IUPD overlay is applied to restrict the use of the site until the site is served by a public 
sewer system. Until such time, uses on the site are limited to those that can be 
accommodated by septic systems properly permitted by the Maricopa County 
Environmental Services Department. 
 
c. 
Administrative approval of a Plan of Development will be required prior to approval and 
issuance of construction permits to develop and establish use of the site. Prior to 
issuance of a building permit, written confirmation will be required from the emergency 
fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection

service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
d. 
Prior to approval of the initial final plat or precise plan of development approval, the 
applicant shall provide the Maricopa County Planning and Development Department with 
an executed pre-annexation service agreement with the City of Chandler that identifies the 
detail for when the proposed project will be annexed and the provision of water and sewer 
service.  In lieu of pre-annexation service agreement the developer must provide a ‘will 
serve’ letter from the certificated water and sewer provider(s) or approval from MCESD. 
 
e. 
Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.  
 
f. 
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions.  
 
g. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
shall revert to the zoning that existed on the date of application.  It is, therefore, stipulated 
and agreed that either revocation due to the failure to comply with any conditions, does 
not reduce any rights that existed on the date of application to use, divide, sell or possess 
the property and that there would be no diminution in value of the property from the value 
it held on the date of application due to such revocation of the Zone Change. The Zone 
Change enhances the value of the property above its value as of the date the Zone Change 
is granted and reverting to the prior zoning results in the same value of the property as if 
the Zone Change had never been granted.

Project Summary: 
 
1. 
The applicant is requesting to rezone a Rural-43 zoned parcel to IND-2 to accommodate uses that 
are consistent with the parcel’s designation in the City of Chandler General Plan Future Land Use 
Map and Chandler Airpark Area Plan. The site is located just southwest of the Chandler Airpark 
and 700’ south of Pioneer Park. Prior owners received a Special Use Permit (SUP) Z91-61 to house 
a public riding and boarding stable. The City of Chandler did not object to this SUP as the applicant 
agreed to an avigation easement for the site. Originally approved in 1992, this SUP expired in 
2002. Subsequently, public boarding stables became an allowed use in the Rural-43 zoning 
district, negating the need for another SUP. There is an active building permit for the site, 
B202012715, to construct a 1,267’ CMU wall – however, the applicant has not submitted plans 
for this project since November of 2020.

While several parcels along McQueen Rd. are still within Maricopa County jurisdiction, much of 
the surrounding area has been incorporated into the City of Chandler. The parcels south and 
southwest of the subject site are part of a larger industrial redevelopment taking place within 
Chandler. These projects include the approved Schrader Farms Business Park, and the pending 
Ryan Commerce Center, Hamilton Commerce Center, Arizona Commerce Center, and the Air 
Center Business Park across McQueen Rd. These sites are being or may be developed for major 
employment, knowledge-based, and light industrial type uses. The subject rezone would 
ultimately culminate in similar type development and, eventually, incorporation into the City of 
Chandler.

City of Chandler General Plan (adopted April 14, 2016): Employment - Major employers, 
knowledge-based industries, and industrial/business parks are allowed within Employment. A 
compatible mix of industrial support uses and residential densities as an integral component may 
be considered. Light industrial business parks may be considered in campus-like settings 
containing knowledge-based employers, corporate offices, manufacturing, and warehouse and 
distribution. A compatible mix of industrial support uses and residential densities may also be 
considered as an integral component of a planned mixed-use development. 
 
a. Chandler Airpark Area Plan (adopted October 14th, 2021): Innovation District - supports 
research & development, technical, creative, & other technology-forward businesses. Low to 
moderate intensity flexible, creative office, & business park developments are appropriate to 
this land use category. Residential uses of any type are prohibited in this district.

The applicant complied with the Maricopa County Public Participation Process with the required 
posting of the property and the notification to the adjacent property owners within 300’ of the 
subject site. Staff has not received any notice of opposition or support to the request. The 
applicant provided an email from a City of Chandler staff member with instructions on beginning 
the annexation process in relation to this project, but staff has not directly received 
communication from the City of Chandler.

Staff supports this rezone application as it matches the City of Chandler’s General Plan 
Employment designation and the Chandler Airpark Area Plan Innovation District designation. The 
surrounding area has been or is in the process of being developed for similar type land-uses 
allowed in the IND-2 zoning district. The applicant is intending on pursuing annexation into the 
City of Chandler once an end-user has been secured.

Staff would note that there is no Plan of Development or zoning overlay included with this 
application. Staff does carry slight concern over the interim land uses of the site between an 
approval of this application and incorporation into the City of Chandler. The lack of public 
infrastructure currently available on-site does limit the applicant to interim land uses. However, 
IND-2 zoning does allow for the erecting of structures that may otherwise not be allowed within 
Chandler jurisdiction, such as billboards. Staff would not be supportive of this application if the 
sole purpose of the rezone would be to allow for such a land use. However, given the synergy 
between the proposed zoning and nearby land uses within the City of Chandler, staff still supports 
this application if annexation is pursued at maximum speed without major interim land uses that 
would require city services being processed by Maricopa County.  
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors

The applicant is requesting to rezone the subject property from County RU-43 to Ind-2 to be consistent 
with the City of Chandler General Plan Future Land Use Map and accommodate uses consistent with the 
Ind-2 district.    
Location 
 
The property is located southwest of the southwest corner of E Ryan Road and S McQueen Road (APN: 
303-33-011B), as shown on the attached aerial map (Tab 1). It is approximately 12.02 acres and is currently 
operated as an equestrian center with public riding and board stables. The property is located in the 
unincorporated area of Maricopa County but is covered under the City of Chandler General Plan and 
Planning Area. 
Current General Plan and Zoning 
 
The Property is currently zoned County RU-43 (Tab 2). The City of Chandler General Plan Future Land Use 
Plan Map designates the property as “Employment,” which is intended to strengthen the City of 
Chandler’s economic base by expanding growth areas and identifying a variety of employment areas for 
future growth (Tab 3). Major employers, knowledge-based industries, and industrial/business parks are 
allowed within this land use category. Industrial is the proper zoning district that aligns with the 
Employment Land Use category.

North: Residential subdivision/Church (RU-43) 
East: Equestrian Center (RU-43) 
South: Planned industrial (Current zoning: Chandler PAD) 
West: Planned Industrial (Current zoning: Chandler AG-1) 
Project Overview 
 
The proposed rezone is requested to align with the City of Chandler General Plan Future Land Use Map 
and to better reflect the development pattern in this area. The Property is located within a county island 
that is adjacent to an area that is developing with industrial uses around it. As shown on the exhibit below, 
the property has industrial zoning to the south (Schrader Farms Business Park – PLH20-0030), and pending 
applications on file with the City of Chandler to rezone land to industrial to the west and east (see map 
below).  The Arizona, Hamilton, and Ryan Commerce Centers are proposed pursuant to Case No. PLH22-
0028. The Air Center Business Park is the subject of Case No. PLH22-0051.

The proposed rezone will position the Property for future development consistent with the City of 
Chandler’s General Plan and the Airpark Area Plan’s Innovation District. When an end user materializes 
that require city services, the Property will annex into the City of Chandler and pursue site plan (PDP 
application) with the City of Chandler. The Applicant has discussed this site with City of Chandler Planning 
and Development Department and understands the types of uses that are anticipated within the 
Innovation District of the City’s Airpark Area Plan. In the interim, the Property may be utilized for uses 
that are permitted within the Ind-2 district and do not require additional utilities.  
 
Access and Circulation 
 
Currently, the Property is accessed via a dirt road extending east from McQueen Road to the southern 
perimeter of the Property. However, the property immediately south of the subject site is approved to be 
developed as the Schrader Farms Business Park, which would include the installation of a new collector 
road (Canary Way), which will extend east from McQueen Road along the Southern perimeter of the 
subject site. Additionally, Hamilton Road will be installed in the first phase of development of the new 
Ryan Commerce Center west of the Property. In short time, there will be two improved access roads able 
to serve this project.

The proposed rezone is consistent with the City of Chandler’s General Plan and the development pattern 
in this area. The Ind-2 zoning district will accommodate industrial uses that are compatible with existing 
and proposed development in the area and will help achieve the goal of expanding employment 
opportunities around the Chandler Airpark.

The annexation process?! Here I thought I was being phished and then I see the firm’s
name was changed.
Congratulations on becoming a partner!
In the past couple of years, we run the annexation and rezoning case concurrently so if the
rezoning will not be approved the annexation can be withdrawn.  Please see my flowchart
below (this is my training exhibit so please don’t distribute). Generally after first review of
the zoning case, we try to get the annexation scheduled for the first of three City Council
meetings (Public Hearing- step 6 below). The complete process is outlined in our
Annexation application. If a property was to annex and develop under the initial City Zoning,
they can be processed in approximately 2-3 months. An annexation and rezoning typically
6 months.
Your first step will be Pre-Tech. Let me know if you have additional questions or concerns.

Engineering Review has reviewed the first plan and report routed for review on 
03/27/2023, for the subject application and has No Objections pending the 
establishment of suitable access and subject to the following conditions:
1.
Any new site improvements will require a Plan of Development and Traffic 
Impact Study. 
2.
McQueen Road is within the jurisdiction of the City of Chandler. The applicant 
will be responsible for coordinating with the City to review any traffic impact, 
right-of-way dedication, permitting or roadway improvement requirements 
needed to provide suitable access to the site, including the east/west access 
to McQueen Road that is also within the City limits.
3.
Without the submittal of a plan of development, no development approval will 
be inferred by the engineering review, including, but not limited to drainage 
design, access and roadway alignments. These items will be addressed as 
development plans progress and are submitted to the County for further review 
and/or entitlement.
4.
Engineering review of planning and/or zoning cases is for conceptual design 
only. All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and 
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway 
Design Manual; and current engineering policies, standards and best practices 
at the time of application for construction.
All plans and reports should be developed and formatted to document that the 
project is designed to meet all County regulations, ordinances and design 
standards.

It is incumbent upon the engineer to demonstrate compliance with all 
regulatory requirements and County design standards.
