ORDINANCE NO. 6020 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MESA, ARIZONA AMENDING THE MESA CITY CODE, TITLE 5 - BUSINESS REGULATIONS, CHAPTER 17 - DEVELOPMENT IMPACT FEES TO DISCONTINUE THE PUBLIC SAFETY IMPACT FEE. WHEREAS, the City Council adopted Ordinance No. 5189 continuing the City of Mesa’s (“City”) existing Development Impact Fees at the same rates then assessed to repay debt amounts as permitted by Arizona Laws 2011, Chapter 243 (Senate Bill 1525) amending A.R.S. § 9-463.05 effective January 1, 2012. WHEREAS, Mesa City Ordinance No. 5189 and Mesa City Code Section 5-17-3(B) provided for the automatic cessation of a particular impact fee upon the City receiving Development Impact Fees in an amount equal to the amount of such debt for the particular impact fee category for which the fee was pledged. WHEREAS, as of March 10, 2026, the City has received Public Safety Impact Fees in the amount of the eligible pledged debt for the Public Safety Impact Fee category, as set forth in the Pledged Debt Analysis for Continuation of Impact Fees cited in Ordinance No. 5189; and therefore, the City discontinued the collection of Public Safety Impact Fees on March 10, 2026 in accordance with Ordinance No. 5189 and Mesa City Code Section 5-17-3(B). WHEREAS, the City hereby desires to amend the City’s Impact Fee Schedule in Mesa City Code to remove the Public Safety Impact Fee that was discontinued on March 10, 2026. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MESA, ARIZONA AS FOLLOWS: SECTION 1: RECITALS. The recitals above are fully incorporated in this Ordinance by reference. SECTION 2: DISCONTINUATION. That the Public Safety Impact Fee ceased and was properly discontinued on Tuesday, March 10, 2026, in accordance with Mesa City Code Section 5-17-3(B) and Ordinance No. 5189, and that the Mesa City Code, Title 5, Chapter 17, Table 1 entitled Mesa Development Impact Fees is amended to remove the Public Safety Impact Fee Category as shown in Attachment 1 to this Ordinance. SECTION 3: EFFECTIVE DATE. The effective date of this Ordinance is 30 days after the date of adoption by the City Council.
