(TEXT OF BILL BEGINS ON NEXT PAGE) S.B. 1307 - 1 - Be it enacted by the Legislature of the State of Arizona: 1 Section 1. Section 11-424.01, Arizona Revised Statutes, is amended 2 to read: 3 11-424.01. Salaries of constables; definitions 4 A. At the regular June meeting of the several boards of supervisors 5 preceding a general election, the boards shall fix the salaries of all 6 precinct officers, other than justices of the peace, for those officers 7 CONSTABLES to be elected for the four-year period commencing on the first 8 day of the following January. 9 B. In precincts with an average of one hundred or fewer total 10 documents served per year by a constable over the previous four years, AS 11 REPORTED ON THE CONSTABLE STANDARDIZED DAILY ACTIVITY LOGS, a constable is 12 entitled to receive an annual salary of not more than sixteen thousand 13 five hundred dollars $20,000. 14 C. In precincts with an average of more than one hundred total 15 documents served per year by a constable over the previous four years, AS 16 REPORTED ON THE CONSTABLE STANDARDIZED DAILY ACTIVITY LOGS, the constables 17 shall be paid as follows: 18 1. In precincts with five thousand or fewer registered voters, 19 annual salaries of not more than sixteen thousand five hundred dollars 20 $20,000. 21 2. In precincts with more than five thousand registered voters but 22 fewer than ten thousand registered voters, annual salaries of not more 23 than twenty-six thousand dollars $30,000. 24 3. In precincts with ten thousand or more registered voters but 25 fewer than twelve thousand registered voters, annual salaries of not less 26 than twenty-nine thousand four hundred thirty-seven nor more than forty 27 thousand dollars $36,000 OR MORE THAN $45,000. 28 4. In precincts with twelve thousand or more registered voters but 29 fewer than sixteen thousand registered voters, annual salaries of not less 30 than thirty-six thousand one hundred nor more than fifty thousand dollars 31 $41,000 OR MORE THAN $56,000. 32 5. In precincts with sixteen thousand or more registered voters, 33 annual salaries of not less than forty-eight thousand two hundred 34 ninety-four nor more than sixty-seven thousand dollars $55,000 OR MORE 35 THAN $75,000. 36 D. The board of supervisors shall determine, subject to subsections 37 B and C of this section, the salary of a constable appointed to fill a 38 vacancy caused otherwise than by expiration of the term. Nothing in This 39 subsection shall be deemed to DOES NOT authorize an increase or decrease 40 in the salary during the term of office of a constable appointed to fill a 41 vacancy. 42 E. The board of supervisors shall withhold a constable's salary 43 during the time that a constable is suspended from performing the 44 constable's duties without pay pursuant to section 22-137. 45 S.B. 1307 - 2 - F. For the purposes of this section: , 1 1. "Registered voter" means a qualified elector of a precinct who 2 is registered on June 1 of each year. 3 2. "STANDARDIZED DAILY ACTIVITY LOG" MEANS A LOG OF A CONSTABLE'S 4 WORK-RELATED ACTIVITIES, INCLUDING ALL OF THE FOLLOWING: 5 (a) A LISTING OF ALL PROCESSES SERVED. 6 (b) THE NUMBER OF PROCESSES ATTEMPTED TO BE SERVED BY CASE NUMBER. 7 (c) THE NAMES OF THE PLAINTIFFS AND DEFENDANTS. 8 (d) THE NAMES AND ADDRESSES OF THE PERSONS TO BE SERVED EXCEPT AS 9 OTHERWISE PRECLUDED BY LAW. 10 (e) THE DATE OF PROCESS. 11 (f) THE DAILY MILEAGE. 12 APPROVED BY THE GOVERNOR JUNE 20, 2023.
