Project Overview  
The City of Mesa is requesting the annexation – transfer of right-of-way of 0.38± acres located 
approximately 1,250± feet south of the southwest corner of South Signal Butte Road and East 
Williams Field Road, that was previously dedicated to Maricopa County.  
This annexation - transfer of right-of-way was included as part of the offsite improvements for the 
Destination at Gateway Auto Mall. This right-of-way transfer will allow for the property owner to 
construct all of the required off-site improvements consistent with the standards for the City of 
Mesa Engineering and Transportation departments.

Site Context 
The purpose of this agenda item is for the City Council to consider an ordinance for the proposed 
annexation - transfer of right-of-way of 0.38± acres dedicated to Maricopa County.  
Per A.R.S. § 9-471(O), a county right-of-way may be transferred to an adjacent city or town by 
mutual consent of the governing bodies of the county and city or town if the property transferred 
is adjacent to the receiving city or town and if the city or town and county each approve the 
proposed transfer as a published agenda item at a regular public meeting of their governing 
bodies. The right-of-way is adjacent to the City of Mesa. 
Upon approval of the annexation – transfer of right-of-way (by both the City and the County) 
according to the procedures in A.R.S. § 9-471(O), the City of Mesa will be responsible for the 
maintenance of the right-of-way. 
Site History: 
 
May 17, 1990: City Council annexed 625± acres, including the Signal Butte right-of-way, 
into the City of Mesa (Ordinance No. 2514). 
 
June 17, 2024: City Council approved a General Plan amendment, rezoning and 
development agreement for 116.8± acres directly adjacent to the subject right-of-way for 
the development of the Destination at Gateway Auto Mall (Case No. ZON22-00267, 
Ordinance No. 2514). 
Impact Analyses 
Fiscal Impact: 
Upon annexation – transfer of right-of-way, the City of Mesa will be responsible for maintenance 
of the Signal Butte Road right-of-way. 
Utilities: 
All necessary utility improvements within the Signal Butte Road right-of-way will be constructed 
by the developer of the Destination at Gateway Auto Mall. 
Compliance with City Standards: 
If annexed, all roadway improvements proposed on Signal Butte Road as part of the Destination 
at Gateway Auto Mall will be constructed within City of Mesa right-of-way and built to City of Mesa 
standards.
