ORDINANCE NO. _________ 
 
AN ORDINANCE EXTENDING AND INCREASING THE 
CORPORATE LIMITS OF THE CITY OF MESA, MARICOPA 
COUNTY, ARIZONA, PURSUANT TO ARIZONA REVISED 
STATUTES TITLE 9, CHAPTER 4, ARTICLE 7, AND 
AMENDMENTS THERETO, BY ANNEXING CERTAIN COUNTY 
RIGHT-OF-WAY ADJACENT TO THE EXISTING CITY LIMITS OF 
THE CITY OF MESA. 
 
Whereas, Arizona Revised Statute (“A.R.S.”) § 9-471(O) provides for transferring 
county right-of-way or roadway to an adjacent city by mutual consent of the governing 
bodies of the county and city if the county right-of-way being transferred is adjacent to 
the receiving city and if the governing bodies of the city and county each approve the 
proposed transfer at a public meeting of their governing bodies. 
 
Whereas, pursuant to A.R.S. § 9-471(O), the City of Mesa (“City”) desires to annex into 
the City that certain Maricopa County right-of-way located adjacent to the City, 
along South Signal Butte Road approximately 1,250± feet south of the southwest corner 
of South Signal Butte Road and East Williams Field Road, legally described in Section 
1 below and shown on the map attached to this Ordinance as Exhibit A (“Right-of-
Way”). 
 
Whereas, the Right-of-Way consists solely of county right-of-way or roadway with no 
taxable real property, and the entire length of the Right-of-Way is adjacent to the 
corporate boundaries of the City. 
 
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MESA: 
 
 
 
Section 1: 
That the Right-of-Way described below and shown on the map attached 
as Exhibit A, incorporated herein by this reference, is hereby annexed and transferred to 
the City of Mesa and the present corporate limits are hereby extended and increased to 
include the Right-of-Way upon approval by the Maricopa County Board of Supervisors 
at an upcoming public meeting: 
 
A portion of the northeast quarter of Section 35, Township 1 South, Range 7 East of the 
Gila and Salt River Meridian, Maricopa County, Arizona, more particularly described as 
follows: 
 
Commencing at the east quarter corner of said Section 35, being marked by a 2” 
Maricopa County Department of Transportation aluminum cap flush, from which the 
northeast corner of said Section 35, being marked by a 3” City of Mesa brass cap in

handhole, bears north 0 degrees 35 minutes 19 seconds west, 2636.82 feet (basis of 
bearing); 
 
Thence along the east line of said northeast quarter, north 0 degrees 35 minutes 19 
seconds west, 1318.41 feet to the north line of the southeast quarter of said northeast 
quarter; 
 
Thence along said north line, north 89 degrees 23 minutes 45 seconds west, 50.01 feet to 
the Point of Beginning; 
 
Thence departing said north line and 50.00 west of and parallel with said east line of the 
northeast quarter, south 00 degrees 35 minutes 19 seconds east, 659.19 feet; 
 
Thence north 89 degrees 23 minutes 31 seconds west, 25.01 feet; 
 
Thence 75.00 west of and parallel with said east line of the northeast quarter, North 00 
degrees 35 minutes 19 seconds west, 659.18 feet to said north line of the southeast 
quarter of the northeast quarter; 
 
Thence along said north line, south 89 degrees 23 minutes 45 seconds east, 25.01 feet to 
the point of beginning.  
 
Said portion of land containing 16,480 square feet, or 0.3783 acres, more or less, and 
being subject to any easements, restrictions, and/or rights-of-ways of record or 
otherwise.  
 
Section 2: 
Following approval of the Maricopa County Board of Supervisors, the 
Right-of-Way is transferred to the City of Mesa and shall be treated by the City of Mesa 
as newly annexed territory 
 
Section 3: 
County Action. That the City Clerk is hereby authorized and directed to 
forward a copy of this Ordinance and the map attached as Exhibit A to the Maricopa 
Board of Supervisors. 
 
Section 4. 
Recitals. The recitals above and the exhibit attached hereto are fully 
incorporated into this Ordinance by reference.  
 
Section 5. 
Effective Date. That this Ordinance shall take effect upon the occurrence 
of all of the following:  
 
a. 
Adoption of an ordinance by the County Board of Supervisors 
transferring the Right-of-Way to the City;  
b.  
A copy of this Ordinance and the Ordinance approved by the County,

together with Exhibit A, being filed and recorded in the Office of the 
County Recorder of Maricopa County, Arizona; and  
c.  
Thirty (30) days following the adoption of this Ordinance by the City 
Council.
