This is a request to replace the current Rural-43 and IND-3 zoning for a 23.5-acre parcel (APN 105- 69-009N) with unified IND-3 IUPD zoning. The northern region of the parcel consists of 2.4 acres with Rural-43 zoning. The remainder of the site (~21.1 acres) is already zoned IND-3 and has been used for industrial storage since the mid-1990s. The current auto salvage/recycling operation began in 2017 when the current owner purchased the property. The IUPD is requested to modify development standards to accommodate business operations for the established auto salvage yard. 2. The operation comprises 16 individual tenant businesses across the site. Customers enter the main entrance using a paved parking lot and use the central hotline in the main office (Building 11) to locate parts, rather than traversing the entire yard. There are 11 gated access points along Broadway Road, which were previously approved by the City of Phoenix when Broadway Road was widened in 2018–2019. Hours are approximately 8:00 a.m. – 5:00 p.m., seven days a week, with no site lighting for after-hours operations. Employment is ~20–30 people. Aggregate enclosed floor area is 6,178 sq. ft.; required parking for a centralized office receiving the public is calculated at 1 space per 300 sq. ft., or 7 spaces. The site provides 32 spaces, of which 2 are designated as ADA spaces adjacent to the main office. Driveway surfaces are shown as gravel (dust-proofing) within the site, with multiple 25' wide driveways at the frontage. The applicant requests allowance to maintain dust-proofed rather than paved surfaces for the 11 existing access points that are not intended to receive the public. Otherwise, a dust control plan acceptable to the Maricopa County Air Quality Department shall be allowed. 3. The perimeter is enclosed by an existing 6' high metal screen fence. The applicant requests allowance to maintain this metal screen wall in place of a solid masonry wall adjacent to rural/residential zoning to the east and west, citing unique site conditions (Salt River floodway to the west; power lines and industrial use to the east). There is an open violation (V202200728) being addressed by this rezone and a separate Plan of Development (PD250055) application being administratively processed concurrently. A Technical Advisory Committee was held on May 19, 2026 where the applicant clarified that no part of the business operation will release significant particulate matter. This was mentioned due to the previous tenants burning debris on- site which triggered high particulate matter indicators at a nearby air quality monitor. The applicant confirmed that none of their tenants will be allowed to burn debris and that the entire site will be surfaced with dust proof material and paved where required. 4. On the next page, the IUPD Table shows the proposed amended zoning district development standards in Bold, which include: • A request for 6' metal screen wall along the entire perimeter, including where a 6' solid masonry wall is normally required. The west side of the site is within Salt River floodway and not developable; the east side contains a narrow RU-43 zoned strip of land that is used for an industrial use and is constrained by overhead powerlines. The metal screen wall is consistent with the surrounding industrial uses. • Allowance for multiple driveways onto Broadway Rd. As the right-of-way is under the jurisdiction of the City of Phoenix, 11 curb cuts were approved by the City of Phoenix and constructed around 2018-2019 during a roadway widening improvement. • Allowance to maintain the existing dust-proof surface of gravel for the 11 driveways not intended for public use. Otherwise a dust control plan acceptable to the Maricopa County Air Quality Department shall be allowed. Z260010 Page 3 of 12 • A Waiver to loading/unloading areas. The business operation is such that does not require loading spaces nor does the operation generate large delivery shipments requiring a loading bay. Framework 2040 Maricopa County Comprehensive Plan (updated May 20, 2026): The comprehensive plan establishes a strategic framework (Municipal-Rural Influence Framework) for managing urban and rural development across the unincorporated county. The municipal and rural influence area classifications serve as guides for determining where urban and rural development is most appropriate. Per the map provided on page 95 of the plan, the subject site Z260010 Page 8 of 12 is within an area of municipal influence due to its location within the Phoenix municipal planning area. However, since the area plan and the Phoenix General Plan designate the site for rural and large lot residential uses, the site is also considered to be within a rural service area. There is currently no assurance of annexation. Therefore, the framework classifies the site as a Rural Service Area. The comprehensive plan recognizes that certain uses may be acceptable in the rural service area upon satisfying acceptable alternative solutions consistent with the plan’s “urban solutions for urban development” strategy with existing services provided by the City of Phoenix for water and sewer. Also, the site is already zoned IND-3 and has been developed for industrial uses the past couple decades. The site is appropriate for limited industrial uses including storage and salvage. 10. City of Phoenix General Plan (adopted April 3, 2024): The site is located within the City of Phoenix municipal planning area and the city’s general plan designates the northern portion of the site as “Parks / Open Space-Public” and the southern portion of the site as “Transition from Commerce/Business Park to Residential 3.5 to 5 dwelling units per acre” The request is not consistent with this designation. The application was routed to the City of Phoenix for comment. The City provided comment immediately prior to start of the June 25th Commission hearing, this prompted, despite the positive staff recommendation, the applicant to request a continuance in order to review and respond to the City’s concerns. 11. City of Phoenix Laveen Southwest Growth Study (adopted 1998): The site is located within the City of Phoenix Laveen Southwest Growth Study which designates the site for residential use of 2-5 du/ac. The growth study does not consider existing industrial zones within County jurisdiction. The request is not consistent with this plan. Public Participation Summary: 12. The applicant complied with the Maricopa County public participation process with the required posting of the property and the notification to the adjacent property owners within 300’ of the subject site. The applicant did not receive a response from their public outreach efforts. Staff has not received any notice of opposition or support to the request. Outstanding Concerns from Reviewing Agencies: 13. *Prior to the start of the Planning & Zoning Commission hearing on June 25, 2026, the City of Phoenix provided a memo requesting the commission not approve the request, or consider the following conditions of approval: • New site improvements shall adhere to the RIO PHX Design Guidelines, which includes guidelines for site design, fencing, landscaping, and building design (i.e. natural materials such as rustic metal, stone, etc.) The guide can be found online: https://www.phoenix.gov/content/dam/phoenix/pddsite/dpcuments/riophx/found_ba_p hoenix-rio-salado_guidelines_030426_v18_FNL_DIG.pdf • A minimum 20-foot-wide landscape setback shall be provided along the north property line. The landscape setback shall be planted with minimum 2-inch caliper, drought tolerant, large canopy trees, planted 20 feet on center, or in equivalent groupings, and five 5-gallon shrubs per tree. • A minimum 20-foot-wide landscape setback shall be provided along Broadway Road. Z260010 Page 9 of 12 • Full cut-off outdoor lighting fixtures shall be utilized with a color temperature of 2,700 Kelvin or lower for development projects within 500 feet of the river corridor. • Outdoor light fixtures should light only where necessary and turn off or dim exterior and interior lighting when not required at night to reduce sky glow. • Any open use or storage area, where permitted and visible from Boradway Road or the Rior Salado should be enclosed by a minimum six-foot-high solid masonry wall. • Fencing and walls oriented towards a public street shall have a finished appearance and contain decorative elements including but not limited to adobe, glass, metal (including rusted metal), stone (stone veneer), wood, or other material consistent with a natural environment. Staff Analysis: 14. The historic land use in the area is predominantly industrial along Broadway Rd. west of 39th Ave. Despite some remaining Rural-43 zoned properties surrounding the site, these zoned areas are either Salt River floodway, aggregate mining operations, or similar outdoor industrial uses. 15. The site is within an area of known land subsidence. A geotechnical analysis will be required with construction permitting to identify if any mitigation efforts are needed. 16. Existing development patterns in the region indicate that residential development will not occur along this segment of Broadway Rd. in the foreseeable future. The area has developed into a significant and well-established industrial corridor and staff anticipates no further residential development in any remaining rural zones. This zone change consolidates zoning to IND-3 IUPD and accommodates the existing industrial salvage operation. It is consistent and compatible with the surrounding land use and development patterns. The IND-3 IUPD zoning is appropriate. 17. The City of Phoenix’s requested conditions are not commensurate with the zone change request. The request seeks to consolidate a 2.4-acre portion of the site zoned Rural-43 out of a 23.5-acre parcel already zoned IND-3 resulting in unified IND-3 IUPD zoning across the entire site. The 2.4- acre trapezoid shape along the site’s northern boundary was taken out of the original IND-3 zoning by a previous County Supervisor who wanted the property owner to provide a buffer to what was then referred to an extension of Rio Salado open space and recreation development. The property owner has maintained this trapezoid-shaped zone as Rural-43 for over two decades despite the remainder of the site having base IND-3 zoning (ref.: Z 97-9). To date there is no adopted plan for open space development adjacent to the site and the property owner wishes to make his site whole with IND-3 IUPD zoning. 18. The 23.5-acre site and surrounding areas have historically operated as outdoor storage or industrial uses for decades. Further, the RIO PHX plan has never been adopted by the City as an official planning document and rather remains a study. The request for a landscape setback along Broadway and Salt River frontages would serve no benefit as the adjacent uses are already industrial in nature. The requirement for site screening would screen the site from similar industrial oriented uses that surround the site, which would receive no benefit from the site screening requirement requested by the City. The applicant is requesting the existing solid steel site screening remain, which would fulfill the County’s requirement and some of the City’s request for alternative site screening materials apart from masonry walls. This project does not intend to operate overnight negating the need for outdoor lighting; however, The County’s outdoor light control provision requires shielded outdoor lighting and prohibit light trespass onto adjacent parcels. Stipulation ‘j’ has now been added as a condition of approval if outdoor lighting is proposed in the future. Additionally, the IND-3 IUPD further controls site development to continue Z260010 Page 10 of 12 its current and historic use and prevents development of more intense and/or locally unwanted land uses allowed by base IND-3 zoning. The Broadway Rd corridor historically has hosted heavy industrial uses, and staff notes that mining, salvage and industrial operations line the length of W. Broadway Rd. from 9th Ave. to 43rd Ave. (except for three blocks to the south between 35th Ave. and 38th Ave. that houses an R1-6 subdivision within the City of Phoenix). This corridor is both City of Phoenix and unincorporated county. Future residential development along this section of the Broadway industrial corridor is not realistic in the foreseeable future. The existing IND-3 and proposed IND-3 IUPD zoning is in concert with the corridor’s land use and development patterns and is appropriate zoning. 19. The owner will need to obtain administrative approval of a plan of development and subsequently complete required construction permits in order to resolve the zoning violation. Recommendation: 20. *Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve Z260010 subject to the following conditions ‘a’ – ‘j’: a. Development of the site shall be in substantial conformance with the Zoning Exhibit entitled “POD for Auto Salvage & Recycling“, consisting of 2 full-size sheets, dated & stamped received June 1st, 2026, except as modified by the following conditions. b. The Development of the site shall be in substantial conformance with the Narrative Report entitled “Maricopa County Zone Change Request Broadway Auto Salvage & Recycling”, consisting of 5 pages, dated May 29, 2026, and stamped received June 1, 2026, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Approval of this case applies to the Zone change only. See Plan of Development case PD250055 for determination and stipulations relating to the Plan of Development. 2. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 905 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 3. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. d. The following IND-3 IUPD standards shall apply: 1. Minimum Site Screening: 6’ high metal panel wall 2. Minimum Loading / Unloading Spaces: Waived 3. Maximum Number of Driveways: 11 Existing curb cut entrances along Broadway Rd. as approved by City of Phoenix 4. Minimum Paving: Gravel for driveways that do not receive the public, otherwise a dust control plan acceptable to the Maricopa County Air Quality Department shall be allowed. 5. Permitted Uses: Until such time as the site is served by sewer, uses are limited to automobile salvage and recycling, and other uses acceptable to the Maricopa County Z260010 Page 11 of 12 Environmental Services Department (MCESD) that can be accommodated by on-site septic systems. e. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. f. Noncompliance with any of the conditions assigned to the approval of this Zone Change by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. g. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. i. Prior to Plan of Development approval, a licensed engineering investigation of the site shall be conducted and submitted identifying any land subsidence or earth fissuring which affect the site and the report shall include suggested mitigation. The Plan of Development shall have a note that the property is within an area of known land subsidence and/or earth fissuring. Further, notice that the property is in area of known land subsidence and/or earth fissuring and a definition of both land subsidence and earth fissures shall be displayed on the front door in the sales office, written in the covenants, conditions and restrictions (CC&Rs), and written in any disclosure statements for conveyance documents. However, if said report concludes negative impact regarding land subsidence and/or earth fissuring the required notification should include such results. j. All outdoor lighting shall comply with Section 812 of the Maricopa County Zoning Ordinance Outdoor Light Control Provisions. The vast majority of the property, APN 105-69-009N, is zoned IND-3 for heavy industrial uses. The property consists of a total of 23.5 acres, whereas 21.1 acres are already zoned IND-3. Only the northernmost 2.4 acres of the subject property along the Salt River are zoned RU-43, creating inconsistent zoning across the property. This proposal will seek to consolidate the zoning on the property to IND-3 IUPD. There is an open violation associated with the property, V202200728, which this rezoning (along with a separate Plan of Development application PD250055) is seeking to address and rectify. Description of Proposal The property has been used as an industrial storage yard since Broadway Road was first constructed along the southern boundary of the site in the mid 1990s, as shown in historical aerial imagery from 1996. Maricopa County Historical Aerial Photography 1996 Dec – 1997 Feb 2 The current auto salvage and recycling operation started in 2017 when the current property owner, Moe Lathgani, purchased the property. Maricopa County Historical Aerial Photography 1997 Sept – 1997 Nov The auto salvage and recycling operation spans the entirety of the 23.5-acre property, and provides for 16 individual tenants each with their own business operations. These auto salvage and recycling operations on site accept and store wrecked vehicles on site, and salvages the auto parts from the vehicles to be recycled and reused for other vehicles. The site contains 11 access points along Broadway Road to service these 16 tenants. Each access point along Broadway Road is gated to restrict access outside of business hours. Since Broadway Road is controlled by the City of Phoenix, each of these access points were approved by the City of Phoenix when Broadway Road was widened in 2018-2019. Each operation area contains a small mobile office for their business, as well as a various covered workspaces. The main office is centrally located and identified as Building 11 on the site plan. The main office contains a central hotline connecting each business. So, customers seeking a specific auto part can search across all 16 businesses at the main office. They do not need to explore the entire property. Rather, customers can park at the main entrance and search for their auto part at the main office. 3 This combined auto salvage and recycling operation employs approximately 20 to 30 people, and provides for a needed service to the community by offering discounted used and recycled auto parts. Hours of operation for these businesses are generally daylight hours (roughly 8:00 am to 5:00 pm) seven days a week. The property does not contain site lighting to support the businesses being out after hours. Relationship to Surrounding Properties On-site: IND-3 (21.1 acres) and RU-43 (2.4 acres)/Automobile recycling uses North: Salt River/undeveloped open space (Phoenix) South: Broadway Road then IND-3/Industrial material storage uses East: IND-2/Industrial material storage uses West: RU-43/Vacant undeveloped land Location and Accessibility The property maintains direct access from Broadway Road, which is a fully improved arterial street controlled by the City of Phoenix. This proposal will maintain and utilize the 10 existing 25-foot-wide driveways accessing Broadway Road. Each divided section of the property will maintain controlled access directly from Broadway Road to bring in new salvaged vehicles directly into the property. All parking will be contained adjacent to the main office, which will provide centralized parking (30 spaces) for employees and customers. Circulation There are no additional improvements planned for the circulation system. Broadway Road has been fully built-out by the City of Phoenix and there are no additional improvements necessary. Any future proposed improvements will be coordinated with the City of Phoenix. Development Standards The development standards for this project will comply with all requirements in the IND-3 Zoning District with the exceptions noted below: Walls and Perimeter Screening (Section 506) • We are requesting to allow a 6-foot metal screen wall around the perimeter of the property, including adjacent to the abutting rural and residential zoning boundaries to the east and west of the property where a 6-foot solid masonry, concrete, or earthen product wall would otherwise be required. The property to the west is almost entirely within the floodway of the Salt River, which will not permit the development of any residential homes. It should also be noted that this property is owned by the Arizona Sand and Rock Company that is likely to mine the property via a Special Permit, which, although would not require a rezoning, would constitute a similar industrial use to the auto salvaging and recycling business. Additionally, a small portion of the property immediately east is also zoned RU-43 (approximately 40 feet). However, this property is used for industrial purposes, much like the majority of the remaining property that is zoned IND-2. This sliver of property zoned RU-43 along the north side of the property is not viable for residential development since it does not have frontage along Broadway Road. There are also powerlines running through the middle of this portion of the property zoned RU-43, which would further restrict any future development of residential homes. 4 Driveways (Section 802.7.12.) • We are requesting to allow for multiple driveways providing access to Broadway Road along the frontage of the property. Broadway Road is owned and controlled by the City of Phoenix and previously approved and constructed 11 curb cuts for access to the subject property when Broadway Road was widened between 2018-2019. The developer will coordinate any future improvements along the Broadway Road frontage with the City of Phoenix consistent with past practices. Loading and Unloading Regulations (Section 803) • We are requesting to waive the requirement to provide loading and unloading areas for any commercial and industrial buildings. As an auto salvage and recycling operation, salvaged vehicles are towed onto the property and stored anywhere there is available space. This operation does not have large shipments of inventory being delivered to or from the property that would necessitate a singular designated loading and unloading space. Development Schedule This project will be developed in one phase immediately after Rezone and Plan of Development approval. The City of Phoenix objections to rezoning case Z260010, which are predicated on the City of Phoenix General Plan, the RIO PHX Study Area, the City of Phoenix Trail Network Map, and the Laveen Southwest Growth Study, do not adequately reflect the established industrial character along this portion of the Broadway Road corridor, the historic use of the subject site, or the findings contained within the Staff Report. Rather, as astutely recognized in the Staff Report, the requested zoning consolidates existing industrial zoning on the property, accommodates an established industrial salvage operation, and is consistent with surrounding land use and development patterns. While both the City of Phoenix General Plan and Laveen Southwest Growth Study suggest a combination of Parks/Open Space and Transition from Commerce/Business Park to Residential 3.5 to 5 dwelling units per acre, the subject property has continuously been used for heavy industrial purposes for over 3 decades – long before the City of Phoenix adopted the referenced plans. Approximately 90% of the site is already zoned IND-3 for industrial purposes. We are only rezoning an approximately 2-acre sliver of land along the Salt River from RU-43 to IND-3 to accommodate the existing (and historic) industrial use of the property. So, the property owner already has the right to operate the auto salvage and recycling yard, with only a minor exception of the 2-acre portion of land on the north side of the property, which is adjacent to the Salt River and well separated from Broadway Road. July 10, 2026 Page 2 Furthermore, as recognized in the Staff Report, residential development is not anticipated along this segment of Broadway Road because the area has evolved into a well-established industrial corridor. Thus, the plans referenced by the City of Phoenix, which call for rural residential development in this area, do not accurately reflect the existing development pattern that has emerged along this segment of Broadway Road and are not grounded in sound land use planning principles. The vast majority of the Broadway corridor between 51st Avenue and 12th Street consists of heavy industrial uses – particularly other similar auto salvage uses like the current operation on the subject property. We also strongly oppose the suggested stipulations of approval proposed by the City of Phoenix. The City's reliance on the Draft RIO PHX Design Guidelines is misplaced. The document has not been formally adopted by the Phoenix City Council. Furthermore, the subject property is outside the study area identified within the draft document itself. The geographic applicability of these draft guidelines is between 19th Avenue and 32nd Street east to west and between I-17/I-10 and Broadway Road north to south. So, not only are the RIO PHX Design Guidelines still in draft form and have not even been adopted by the City of Phoenix, the subject site is 3 miles away from the area of applicability. Accordingly, the Draft RIO PHX Design Guidelines should not be used as the basis for imposing zoning stipulations on a County rezoning case located outside the geographic applicability of the guidelines. The City of Phoenix requests for 20-foot-wide landscape setbacks along the north and south property lines, as well as a 6-foot-high solid masonry wall along Broadway Road and Salt River (Rio Salado) far exceed the established conditions up and down Broadway Road, including the vast majority of the properties located within the incorporated limits of the City of Phoenix. The property owner is not requesting annexation into the City of Phoenix, and as such, the continued operation and any future development of the site will remain in compliance with all Maricopa County development standards and those adopted in the IUPD Overlay. The north property line is adjacent to the Salt River floodway, which cannot be developed and is owned by the City of Phoenix. So, if the City is planning to locate a trail along the south bank of the Salt River as indicated on their Trails Network Map, although which is not yet designed nor funded, the City of Phoenix can establish a 20-foot-wide landscape buffer entirely on their own property without encroaching onto the subject property. The south property line is adjacent to Broadway Road and is directly across from an equivalent IND-3 zoning district, which contains a similar industrial outdoor storage use as the subject site. This industrial use across Broadway Road, nor virtually any other industrial use along Broadway Road and adjacent to the Salt River – including those in within the City of Phoenix – contain 20-foot-wide landscape setbacks or 6-foot- high solid masonry walls. Furthermore, the City of Phoenix is requesting a stipulation requiring enhanced decorative elements to be added to fencing and walls oriented towards a public street. This, again, far exceeds the standard that has been applied and is established along Broadway Road for the vast majority of properties within the City of Phoenix itself. July 10, 2026 Page 3 This imagery exemplifies the existing conditions of the numerous industrial uses along the Broadway Road corridor, including those within the City of Phoenix that maintain a substantially lower standard than that of which the City of Phoenix is requesting of the subject site. Moreover, these requests by the City of Phoenix are further inconsistent with both recent U.S. Supreme Court decisions and Arizona Statutes which do not allow takings in which there is no causal nexus or need for dedication caused by the entitlement request. For the foregoing reasons, we respectfully request that Maricopa County continue to rely upon the findings and recommendation contained within the Staff Report and decline to incorporate the additional stipulations requested by the City of Phoenix. The requested IND-3 IUPD zoning is consistent with the historic use of the property, compatible with surrounding land uses, and appropriately reflects the established industrial character of the Broadway Road corridor. Additionally, County Staff concluded in the Staff Report that the IND-3 IUPD zoning is appropriate given the context of this request provided herein.
