Project Summary: 
 
1. 
The applicants are requesting to establish a Special Use Permit (SUP) for an event venue for up 
to 150 guests on an approximate 4.16-acre parcel in the Rural-43 zoning district in the south 
Phoenix area.  The site is located at the end of 38th Ave., which is a private roadway that has been 
improved by the local property owners. The application is for an existing indoor and outdoor venue 
with a 3,500 sq. ft. indoor event space (behind an existing single-family residence) and a large 
landscaped yard to hold events and ceremonies. A 79-space parking area (with three ADA spaces) 
has been created on the western downhill side of the parcel near the site entrance. The venue is 
located on a hill. A staircase is planned to be installed to connect the parking area to the event 
yard and venue building. The site is on a hill adjacent to South Mountain Park with no residential 
neighbors to the south or east up the slope. There are immediate residential neighbors down 
slope to the north and west.

The application does not limit the days of the week or times of proposed events only indicating 
that all events will be completed by 10:00 pm in conjunction with local noise ordnances. The 
applicant specifically states that the events will primarily be held on weekends to accommodate 
wedding events but will not be limited to weekends, and exact dates and times will be a case-by-
case basis. The venue will employ varying numbers of staff which will be determined by each 
event size and scope though generally it is anticipated that 5-6 event staff will be present per 
event. The application speaks of bedroom availability in the main house structure which can 
accommodate up to 8 guests. Staff notes that the application presented is not for overnight 
accommodation purposes for the event venue, though the owner still has the right to utilize the 
residence for short-term rental uses (j.e. use by the bridal party) but not for public assembly 
related to events.

Zoning violation V202102351 was opened December 14, 2021 due to citizen complaints of a 
commercial business (wedding venue) without proper zoning entitlement in residential zone and 
unpermitted construction (including grading of the parking area). A hearing officer’s order of 
judgment was issued against the property on January 11, 2024 indicating the owner was 
responsible for the zoning violations. The subject SUP application was submitted on July 10, 
2024. A technical advisory committee was held on August 20, 2024.

On May 6, 2025 staff met with the applicant and development team to discuss ongoing issues 
with the application and to help move the application forward. At this meeting staff indicated the 
need for fire department review and determination that there was adequate access for emergency 
response to a commercial / public assembly use. Staff asked the applicant to address with 
surrounding neighbors the utilization of private roadway easements for access to a commercial 
use. Fire safety and access remain staff’s chief concern.

On October 21, 2025 staff followed up with the applicant due to an extended period of inactivity 
and set a deadline of January 1, 2026 for submittal of revised. The applicant resubmitted the case 
on December 24, 2025. Upon review the resubmitted case material did not include 
correspondence with the fire department nor neighbors regarding roadway access. The applicant 
provided subsequently provided a ‘statement of road maintenance responsibility’ indicating they 
would repair or maintain the roadway access. By May 2026 had still not provided the requested 
fire safety letter, but since the SUP is a remedy to the long-standing zoning violation, the case was 
scheduled for today’s Commission hearing. Staff recommends denial due to the outstanding fire 
and access issues.

Immediate access to the parcel is from 38th Ave. which is comprised of a series of private access 
easements. The nearest public right-of-way is along Carver Rd. The 38th Ave. easement serves 27 
residential lots.

Maricopa County Framework 2040 (Updated May  – Rural Development Area: The county’s 
comprehensive plan designates the county island in the south Phoenix area as an Area of 
Municipal / Urban Influence.  The City of Phoenix serves water to the area, thus there is potential 
for an urban level of services for urban intensity uses. However, the subject site is served water 
via shared well and wastewater via onsite septic system – at this time the site is within a rural 
services area.

City of Phoenix General Plan 2025 (Updated 1/21/26): This general plan designates the site as 
large lot with - 0-1 dwelling units per acre.   
 
Public Participation Summary:

The application was submitted on July 10, 2024. Neighbor notification was mailed out to all 
landowners within 300’ of the property at that time. Upon application, a sign posting example was 
provided by the applicant. At the TAC meeting on August 20, 2024, staff learned that the signs 
were not posted yet and staff requested signs to be posted at the entrance to the property and in 
the right-of-way along Carver Rd. for visibility. The application lingered with only engineering 
documents being submitted and minimal correspondence from the applicant during this time.

In May 2025 staff met with the applicant regarding development and engineering requirements, 
staff indicated any new submission would require proof of site posting. Minor engineering 
changes were submitted though no formal resubmission was received during this period. On 
October 21, 2025  staff gave an ultimatum to either provide a full resubmittal or close the case by 
the end of the year. When the applicant finally resubmitted it in December 2025 the submission 
items included sign posting images that did not meet Maricopa County sign size standards for 
type of sign material or size required and indicated as posted on December 7, 2025. While not 
meeting required size, the signs did generate public inquiry on the case and were posted in the 
locations desired by staff. Staff requested correct sign posting be updated which they were ten 
days later on December 17, 2025. Signs were updated with today’s hearing information and 
posted on May 14, 2026.

The applicant held a community meeting on site on October 6, 2025. A sign-in sheet indicates 
there were approximately 20 individuals in attendance. The provided public participation plan 
indicates a discussion of concerns with local neighbors but does not indicate any determined 
outcomes of the meeting or provide any suggestions for remediation practices.

Staff has received four letters of opposition from neighbors regarding impacts from continued 
venue operation. A letter of support was provided by an Arizona House of Representatives 
member from District 26, Cesar Aguilar and Quanta Crews which speak to the owners other 
wedding venue business at other locations and the character of the commercial operation but 
does not speak on the current application or the subject parcel of discussion.

Outstanding Concerns from Reviewing Agencies: 
 
15. 
Planning staff is concerned with a commercial event venue accessed via a long, narrow local 
street serving residential lots. Staff is concerned with access for fire and emergency response to 
a public assembly venue at this location. Staff recommends denial due to these fire/emergency 
response and access concerns. 
 
Staff Analysis: 
 
16. 
Staff maintains concern about the proposed wedding venue location.  The proposal does not 
adequately address access and public safety.  Immediate neighbors are concerned with adverse 
impact on the surrounding neighborhood.  
 
17. 
The site is at the dead-end of a private ingress/egress easement along the 38th Ave. alignment. 
The roadway condition is rough with asphalt millings not rolled or that have degraded to that 
appearance. The corner of 38th Ave. & Carver Rd. is a large irrigation canal that runs along the 
south side of Carver Rd. The canal crossing is a concrete bridge approximately 30’ in width. It is 
unknown if this crossing allows for adequate emergency response to the site. The applicant has 
not provided written confirmation from and staff has not received comment from the fire agency 
having jurisdiction.  
 
18. 
Staff has further concern with this segment of 38th Ave., a series of private access easements, 
providing access to a commercial use through a rural residential neighborhood and its impact on 
the neighborhood.  Staff requested the applicant meet with property owners along the roadway 
in order for the applicant to execute access and maintenance agreements to limit roadway 
degradation. A neighborhood meeting did occur but to date no roadway agreement has been 
executed The applicant has provided a ‘statement of road maintenance responsibility’ formatted 
as an open letter to the community and assumes responsibility for the maintenance of 38th Ave. 
from Carver Rd. to the subject property. While the statement does imply improvements it is not 
an agreement between the landowners which would require improvement or repair.  
 
19. 
The parcel uniquely sits on a hill on the side of a small valley. The current home is prominently 
located above the majority of the surrounding neighbors. While the site may be an asset for views 
and photography during events the location will ultimately cause any unfiltered and especially 
amplified noise into the valley below. Staff recommends limiting all amplified noise to indoor use 
only with a maximum decibel volume at the parcel boundary.  
 
20. 
The parcel is the subject of open and verified zoning violation for unentitled land use and 
unpermitted construction. The latter includes grading of the parking area and the renovation of a 
garage building into the event venue building. The venue building will be required to obtain 
building renovation permits that certify public occupancy is allowed prior to operating the event 
venue business on the property. The residence will be permitted for short-term rental but will also 
require commercial permitting if any public assembly is proposed. 
 
21. 
Neighbor opposition to the proposal has been present since prior to the SUP application. 
Neighbors have routinely contacted planning and code enforcement staff to complain of ongoing 
events and event venue operations. There is no known support from the local neighborhood.  
 
22. 
The subject parcel is part of a shared well agreement that does not allow for commercial use of 
the well. This private agreement is a civil matter between landowners. However, staff notes the

submitted plan relies on the existing well infrastructure and no alternative water options are 
proposed for the commercial use.   
 
23. 
Staff is concerned with the venue’s ability to operate in a way that does not adversely impact the 
surrounding residential neighborhood with regard to noise, lighting, traffic and public safety. The 
topography of the valley and the location of the parcel make it prominent feature on the hillside.  
 
24. 
While the use does not warrant roadway improvements per MCDOT, a 79-space parking area 
indicates far greater traffic volume along the private roadway easement than currently exists for 
a single-family residence. The residential neighborhood should not bear burden of road 
degradation and for roadway maintenance to the commercial use.   
 
Recommendation: 
 
25. 
For the reasons outlined in this report, staff recommends the Commission adopt a motion that 
the Board of Supervisors deny SU240005.  
 
26. 
However, if the Commission choses to adopt a motion to recommend approval, staff offers the 
following conditions ‘a’ – ‘m’ for consideration: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Cielo By Legends Special Use Permit“, consisting of 3 sheets, dated February 15, 2025, 
except as modified by the following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Cielo By Legends”, consisting of 7 pages, dated February 12, 2025, and stamped, 
except as modified by the following conditions. 
 
c. 
This special use permit is valid for a period of five years and shall expire on  August 19, 
2031, or upon termination of the use for a period of 90 or more consecutive days, 
whichever occurs first. 
 
d. 
Events shall be limited to Friday – Sunday (and major calendar holidays), 8:00 am - 10:00 
pm.  
 
e. 
At least one (1) employee must be on site at all times during scheduled events. The name 
and telephone number of the employee must be posted and identified at the entrance to 
the site and available to the neighbors and responding officers at all times during 
scheduled events.  
 
f. 
Lighting must be fully shielded so that light is emitted downward no less directed than 20 
degrees below the horizontal plane at the bottom of the light fixture, and shall not exceed 
1,000 lumens as measured outside the special use permit boundary, and shall be shut off 
by 10:00pm nightly.  
 
g. 
There shall be no outdoor amplified noise. Noise shall not exceed 55 decibels as 
measured outside the SUP boundary. 
 
h. 
The following Engineering conditions shall apply:

1. For building permit issuance, the retention basin must provide 1-foot of freeboard. If a 
berm is used to provide freeboard, it must be a minimum of 8-feet wide and have a 
defined weir outfall. 
2. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of 
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for 
construction. All plans and reports should be developed and formatted to document 
that the project is designed to meet all County regulations, ordinances and design 
standards. It is incumbent upon the engineer to demonstrate compliance with all 
regulatory requirements and County design standards. 
 
i. 
Prior to occupying any building or any portion thereof for any public assembly use 
associated with the Special Use Permit, the applicant shall obtain a commercial 
construction permit meeting applicable commercial building code requirements and shall 
obtain a Certificate of Occupancy authorizing public assembly. 
  
j. 
Prior to issuance of a building permit or operation of the facility, written confirmation will 
be required from the emergency fire protection jurisdiction having authority that the 
facility has been designed in accordance with their regulations and requirements, and that 
emergency fire protection service will be provided to the facility. Prior to issuance of the 
certificate of occupancy, local fire protection jurisdiction review and approval will be 
required. 
 
k. 
Noncompliance with any of the conditions assigned to the approval of this Special Use 
Permit by the Maricopa County Board of Supervisors may be grounds for revocation in 
accordance with the requirements and procedures as set forth in the Maricopa County 
Zoning Ordinance.  
 
l. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the Special Use Permit, the property may be considered for revocation  
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, or the expiration of 
the Special Use Permit, does not reduce any rights that existed on the date of application 
to use, divide, sell or possess the property and that there would be no diminution in value 
of the property from the value it held on the date of application due to such revocation or 
expiration of the Special Use Permit.  The Special Use Permit enhances the value of the 
property above its value as of the date the Special Use Permit is granted and reverting to 
the prior zoning results in the same value of the property as if the Special Use Permit had 
never been granted. 
 
m. 
The applicant shall maintain 38th Ave. from Carver Rd. to the site including dust-proofing.

Purpose of Request 
 
The property at 3801 W. Carver Rd. is currently zoned as Rural-43. The owner is requesting a Special Use Permit 
to allow the use of the property for an outdoor event and hospitality business within this zoning designation. 
The Rural-43 zoning district typically permits agricultural and residential uses. However, the owner believes that 
the property's unique characteristics, location, and natural beauty make it suitable for hosting outdoor events and 
providing hospitality services. By obtaining a Special Use Permit, the owner seeks to utilize the property in a 
manner that deviates from the typical uses allowed under the Rural-43 zoning. 
Description of Proposal 
Overall, the owner's proposal encompasses a special use permit request to establish an outdoor event and 
hospitality business on the property. The plan includes the construction of a new parking lot with permeable 
paving, the utilization of the existing house for accommodation and event hosting, designated landscape areas for 
outdoor activities, and an indoor event space within the retrofitted building. 
 
Section 1 - Parking Lot: 
Upon reaching the end of the road and passing through the gated entrance, you will find the proposed parking lot 
area situated to the north of the property. This area will feature water retention elements and tall fencing to 
effectively screen the parking lot from neighboring properties. The owner intends to enhance the parking lot with 
the addition of new trees and vegetation, providing shade and contributing to the overall aesthetics of the venue. 
In regard to the parking lot surface, the owner is seeking a deviation from County code article 1102.7.1. The 
deviation is specifically to utilize an alternative permeable surfacing material such as crushed gravel or 
decomposed granite, which will be treated with an anti-dust solution. This choice of permeable surface material is 
aimed at maintaining the property's water handling capabilities, considering its proximity to mountain runoff. In 
addition, it aligns with the owner's commitment to minimizing the heat island effect by avoiding the use of dark 
asphalt paving. 
 
Section 2 - House: 
Continuing past the parking lot area, you will come across an existing small home on the property. The house 
features three bedrooms with a total of six beds and two and a half bathrooms. It includes a kitchen and a 
spacious open-plan living area, capable of accommodating up to eight overnight guests. This space is intended to 
serve as accommodation for guests as part of wedding packages or other types of stays. The open-plan layout 
also lends itself well to hosting conferences and team-building retreats. 
 
Adjacent to the house, there are proposed ADA parking spaces to ensure accessibility. Additionally, there is an 
existing storage garage on the property that will be utilized for storage purposes and sorting incoming deliveries. 
A hidden location for a dumpster is also planned to responsibly manage waste on the premises. 
 
Section 3 - Landscape Area: 
The remaining portion of the property is designed with various outdoor activity areas in mind. This includes small, 
designated spaces for different purposes, existing terraced areas, and a seating area. There is also a natural 
wash that runs through the property, which will be preserved in its natural state. Furthermore, an outdoor fireplace 
will be available for gatherings and relaxation. 
 
Section 4 - Indoor Event Space: 
On the property, there is a 3500 square foot building that was originally a garage but has been retrofitted into an 
indoor event space. This space is equipped with restrooms, a bar, storage facilities, a bridal room, and a grand 
staircase that provides an elegant setting for photography and other purposes.

There will be one delivery entrance. The truck will drive straight onto the property to the storage 
garage area and can then forward pull around the front of the house and back out the way It came In.  
Environmental/neighborhood impact:  
The proposed outdoor event and hospitality business on the property aims to have minimal environmental impact 
and maintain a harmonious relationship with the neighborhood. The property's existing features, such as its 
proximity to South Mountain and the East Laveen trail, provide a beautiful natural backdrop for outdoor activities. 
 
Regarding overnight guests, the environmental impact is expected to be low as the existing house will be utilized 
without significant alterations. The primary addition to the property will be the construction of a parking lot. To 
mitigate environmental concerns, the owner is requesting a deviation to implement a permeable and anti-dust 
paving solution, utilizing crushed gravel or decomposed granite. This choice of paving material aligns with 
sustainable practices by promoting water permeability and reducing the heat island effect associated with 
traditional asphalt surfaces. 
 
The property is bordered on two sides by a large single privately owned lot that is currently vacant. There are two 
large lot residences to the north and west of the property. The owner intends to provide screening of the parking 
lot area and plant shade trees to mitigate light pollution and control sound. By utilizing natural screening elements 
and following noise ordinances, the owner aims to address any concerns related to noise from the venue. 
Additionally, the property's elevated position, approximately 10'-0" to 20'-0" above the surrounding properties, can 
help reduce sound propagation. Measures such as creating speaker zones and implementing sound reduction 
techniques will further mitigate any potential noise issues. 
 
The intention behind the proposal is to maintain a connection to the preserve and honor the rural roots of Laveen 
by preserving open spaces and focusing the business on outdoor activities as much as possible. By embracing 
the natural surroundings and implementing sound and light control measures, the owner seeks to ensure that the 
venue remains in harmony with its environment and minimizes any negative impacts on the neighborhood. 
Hours of operation/employees:  
The proposed wedding venue will operate within specific hours and employ a varying number of staff members 
based on the event. The owner, who possesses experience in the outdoor event business, has developed a 
business plan that includes measures to ensure compliance with codes and noise ordinances. 
 
The venue's events will be limited in terms of the number of attendees to manage the impact on the property and 
the surrounding area. Additionally, all events will conclude by 10 PM, in accordance with local regulations 
governing noise and event duration. 
 
As a predominantly weekend business, the venue will primarily operate on weekends to accommodate wedding 
ceremonies and related events. The exact hours of operation may vary depending on specific event schedules 
and requirements. 
 
The number of employees will vary based on the size and nature of each event. On average, there will be 
approximately 5-6 staff members present to assist and manage guests, ensuring a smooth and enjoyable 
experience for everyone involved. 
 
During the typical high season in Arizona, which occurs from fall through spring, the venue's house will be 
available for private overnight rentals. This allows guests to extend their stay and enjoy the amenities and 
surroundings of the property. Guests renting the house are also expected to adhere to all noise ordinances in 
order to maintain a peaceful environment for both the venue and the surrounding neighborhood.

disabilities. This will consist of a single van accessible space and four other ADA parking spaces located near the 
house. Pathways will allow for accessible travel on the site to all area and buildings. Additionally, a drop-off zone 
will be available for guests attending events, providing convenient access for those who may require assistance. 
To facilitate deliveries and waste management, the property will have drive-through access for delivery trucks, 
ensuring efficient and convenient service. A designated area for waste management, such as a dumpster access 
point, will also be provided to maintain cleanliness and proper waste disposal practices. 
 
The overall design and accessibility features of the property aim to enhance the visitor experience, minimize 
traffic disruptions, and ensure efficient operations while respecting the needs and convenience of both guests and 
the surrounding neighborhood. 
 
Circulation System 
The circulation system of the property is designed to provide convenient access and a seamless flow for guests 
and vehicles. The arrival to the property begins at the entry gate, which leads to the parking lot. From the parking 
lot, an outdoor stairway is provided to connect the parking area to the level of the house and the uppermost 
landscape area. This allows guests to easily access the event spaces and provides an opportunity for a scenic 
walk up towards the Preserve, offering a beautiful view and setting as they prepare to attend the event. 
 
In addition to the stairway, a driveway is present on the property. The driveway runs past the entry to the parking 
lot and continues to wrap around the house, passing by the storage garage. It then proceeds around the front of 
the house, ultimately leading back out to S 38th Avenue. This driveway configuration ensures a smooth flow of 
vehicles and allows for convenient access to different areas of the property. Since the roadway access to the 
property dead-ends at the entry gate, there is a small turn around in front of the gate area. 
 
The design of the circulation system aims to provide efficient and well-connected pathways for both guests and 
vehicles, ensuring ease of movement and creating a pleasant and accessible experience for everyone attending 
events at the venue. In order to address concerns for the health, safety, and continued accessibility, the owner 
will have a neighborhood meeting to discuss S. 38th Street as it is not a county roadway and is maintained

surrounding property owners of the intent as outlined in the Citizen Participation Plan. This step demonstrates the

An event center is incompatible with Rural‑43 zoning and the established residential 
character of this neighborhood. Homes in this area rely on private shared wells, septic 
systems, and unmaintained dirt roads—none of which can support commercial event‑venue 
activity. Loud events at this property have already generated numerous complaints to 
MCSO, disrupting the quiet rural environment that residents value. 
The applicant has been operating an event venue illegally since 2020 and has performed 
unpermitted construction, grading, and drainage alterations that have contributed to 
erosion and stormwater impacts on 38th Avenue. During prior enforcement proceedings, 
the owner denied operating a commercial business, yet the current SUP request confirms 
otherwise. The applicant has repeatedly ignored county directives and continues to operate 
without regard for zoning, safety, or neighborhood impacts. 
At a recent neighborhood meeting hosted by the applicant’s representative, every attending 
resident opposed this proposal. 
For these reasons, I respectfully request that the Special Use Permit be denied.

I am writing as a community member to formally express my opposition to the Special Use Permit 
Request associated with Case Number SU240005. 
It is my understanding that this Special Review Application did not pass review in August 2024. Despite 
this, a posted notice has been circulated, prompting this formal response. 
I oppose this special use request for the following reasons: 
 Lack of supporting infrastructure: The proposed use is not supported by adequate infrastructure 
to safely or responsibly accommodate increased activity. 
 Ingress and egress limitations: Access to the site is extremely limited. Increased traffic would 
severely disrupt and compromise immediate residential neighbors’ ability to safely access their 
private properties. 
 Water supply concerns: The site is serviced by a shared well, which does not have sufficient 
capacity to sustain increased or commercial-level use without negatively impacting 
surrounding residents. 
 Septic system limitations: The existing septic system is not designed or approved for commercial 
use and does not accommodate the scale or intensity of the proposed activity. 
 Light and noise pollution: The proposal would introduce excessive light and noise, significantly 
diminishing the quality of life for nearby residents. 
 Wildlife disruption: The proposed use would negatively impact local wildlife and disrupt the 
natural balance within the designated zone. 
 
Additionally, my parents, who are elderly, are the immediate neighboring residents located directly north 
of the subject property. Since the company/ owner has acquired the property, they have experienced 
repeated disturbances due to late-night parties and excessive noise, which have required multiple calls 
to law enforcement. These events frequently continue until 2:00 a.m., particularly on Saturday nights.

This has had a significant and ongoing impact on the surrounding community. My father is a pastor who 
delivers sermons every Sunday morning, and the persistent late-night activity has directly interfered with 
my parents ability to rest and maintain their normal household routines. These issues underscore the 
incompatibility of the proposed use with a residential area and raise serious concerns about 
enforcement, noise control, and long-term neighborhood impacts should the special use be approved. 
 
Given these concerns, I strongly urge Planning and Development to deny this special use request and to 
uphold the prior determination from August 2024. The proposal is incompatible with the existing 
residential character of the area and poses unnecessary risks to infrastructure capacity, environmental 
resources, and community well-being.

An event center is a completely incompatible and irresponsible use for a property zoned as Rural-
43 within an established residential neighborhood with large lot single family residential 
bordering all four sides of the property and South Mountain Park within ¼ mile of the property.  
If you are not familiar with the area, the site lies between Carver Mountain and South Mountain 
in a valley that is primarily part of Maricopa County with small patches of land that is incorporated 
as City of Phoenix. Speaking for myself and my neighbors, the attraction of this area is the 
relatively quiet rural nature that is also relatively close to downtown Phoenix. Loud parties/events 
that have been held at this location have resulted in numerous calls/complaints to MCSO. 
 
In this regard, all infrastructure in the area is designed solely for single family zoning and use. 
Many of the roads outside of the main arterial through the area are gravel/dirt roads that receive 
very little to no grading or maintenance (38th Avenue included). Water for the homes in the area 
is supplied by private wells, often well that are shared between neighbors as there is no municipal 
water supply on 38th Avenue. Many of these shared wells have agreements and stipulations on 
their use, limiting the water obtained for single family and residential use and excluding 
commercial and agricultural/livestock use; I suspect that this issue is pertinent to this 
property/applicant and has been overlooked or ignored. Similarly, there is no sanitary sewer 
services in the area and all the homes in the area rely upon septic systems. I am very concerned 
that if approved or if this applicant is allowed to continue operation of the event venue that the 
groundwater will be affected by excessive withdrawal and/or contamination due to an undersized 
septic system. 
 
Based upon these concerns, I respectfully request that this application for a Special Use Permit 
(SUP) be denied. 
 
Furthermore, you and the county supervisors should be aware that the applicant and property 
owner has been illegally operating an event center shortly after the residence and shop was 
purchased from the prior owner in October of 2020. Unpermitted work that has been performed 
at the site has previously been documented by Planning and Development personnel and has 
included modifications to a pre-fabricated garage that may have included removal or alterations 
of shear members or bracing, grading and drainage work performed to construct a rudimentary 
parking lot that likely raised grades by more than 12-inches and may have altered historic 
stormwater runoff by increasing discharge and/or altering discharge locations off the lot (recent 
runoff from storm events after these modifications has severely eroded 38th Avenue and increase 
sediment deposits in other areas of the neighborhood. 
 
During an initial hearing regarding these complaints and meetings with Planning and 
Development that was presided over by a judge/magistrate (forgive me for not knowing the 
title/position), the owner claimed that all of the activities were family gatherings and were not 
commercial events. Despite the neighbors knowing for certain this was false, and stating such,

the owner was adamant that this was not a commercial operation. Now the truth has been 
revealed with this SUP application, this is an expansion of the owner event venue business which 
includes other locations in the Phoenix area. 
 
Recently, the owner mailed/delivered flies to the residents in the area for a “neighborhood 
meeting” to try and sell the area on their plans. I understand this to be an attempt to meet 
requirements that Planning and Development has as part of the SUP process. Approximately 30 
to 40 people attended this event. Theo owner was not there; she sent an employee/business 
partner in her stead. Make no mistake, every member of the community that attended was 
OPPOSED to this event venue and commercial business operating at this site. 
 
Finally, you should understand that the applicant/owner has ignored all directives that resulted 
from the aforementioned hearing and has continued to operate at she sees fit. Based upon the 
past four to five years of behavior, you and the commissioners should not be surprised when you 
are told that they will comply but fail to do so and are ignored; her track record is consistent in 
that regard.

known as Cielo by Legends. 
 
 
My home, located approximately 230 feet from the proposed venue site (Parcel No. 300-09-072A), would be 
directly impacted by the approval of this permit. I built my home in 2021 with the intention of retiring in a 
peaceful, secluded rural community where my children and grandchildren could gather and enjoy the quiet 
character of the neighborhood. For the most part, that vision has become a reality. However, on days when 
events are hosted at the venue, the atmosphere changes dramatically. The single road providing access to the 
property becomes congested with event-related traffic, vehicles frequently travel at excessive speeds, and loud 
music can often be heard from passing cars as guests arrive and depart. These disturbances are inconsistent 
with the rural residential environment that attracted my family to this area and significantly diminish our ability 
to peacefully enjoy our property. 
 
 
My primary concerns are as follows: 
 
 
1. Traffic and Access Impacts 
 
 
The proposed venue is accessed by a single easement road that serves neighboring properties. This road was 
not designed to accommodate the volume of traffic associated with weddings, parties, and other large events. 
Event guests, vendors, service vehicles, and rideshare traffic would create congestion and increase safety 
concerns for residents who depend on this route for daily access to their homes. 
 
 
2. Private Road Maintenance

The access road is privately maintained. Increased traffic from commercial events will accelerate wear and tear 
on the roadway and create additional maintenance costs and burdens for property owners who were never 
intended to subsidize a commercial event operation. 
 
 
3. Loss of Privacy and Quiet Enjoyment 
 
 
Wedding and event venues typically generate amplified music, large gatherings, vehicle traffic, outdoor 
lighting, and activity extending into evening hours. These impacts would directly affect nearby homeowners 
and substantially diminish the privacy and peaceful enjoyment of our properties. 
 
 
4. Incompatibility with Rural Residential Character 
 
 
This area is zoned and developed as a rural residential community. I chose to build my custom home in this 
location specifically because it offered a quiet, low-density environment removed from commercial activity, 
excessive traffic, and event-related noise. Approving a commercial wedding venue in close proximity to 
existing homes would fundamentally alter the character of the neighborhood and set a precedent inconsistent 
with the area's intended use. 
 
 
5. Impact on Neighboring Property Owners 
 
 
The benefits of this proposed venue would accrue to a single property owner, while the burdens of traffic, 
noise, congestion, privacy loss, and roadway impacts would be imposed on surrounding residents. I 
respectfully submit that these impacts outweigh any benefit provided by the proposed Special Use Permit. 
 
 
For these reasons, I respectfully request that the Board of Supervisors deny Case No. SU240005.

neighborhood. The property is bordered by large-lot homes and privately held land, and residents chose this area for its 
quiet, rural environment. Loud commercial events at this site have repeatedly disrupted the neighborhood and

The area’s infrastructure cannot support commercial operations of any kind.

38th Avenue is an unmaintained dirt road not designed for high-volume traffic.

single-family residential purposes only and explicitly prohibiting commercial or agricultural use.

There is no sanitary sewer system; this and all surrounding properties depend on septic systems sized for 
residential use. A commercial event venue poses a serious risk of groundwater depletion and contamination due 
to excessive water demand and an undersized septic system. 
 
For these reasons alone, the Special Use Permit should be denied. 
 
However, the applicant’s documented history of violations makes approval even more inappropriate. Since purchasing 
the property in October 2020, the owner has operated an event venue illegally and without permits. County Planning 
and Development staff have already documented unpermitted construction, including alterations to a pre-fabricated 
structure and grading activities that appear to have raised site elevations and altered stormwater runoff. These changes 
have contributed to erosion on 38th Avenue and increased sediment deposition throughout the neighborhood. 
 
During an earlier enforcement hearing, the owner insisted that the events were merely “family gatherings,” despite 
overwhelming evidence to the contrary. The current SUP application confirms what residents have known all along: this 
is part of a broader commercial event-venue business with multiple locations in the Phoenix area. 
 
The applicant recently held a “neighborhood meeting,” Approximately 30–40 residents attended, and every single 
attendee opposed the commercial use of this property. 
 
Most concerning is the owner’s consistent pattern of ignoring county directives and continuing operations as she sees 
fit. Over the past four to five years, she has repeatedly disregarded enforcement actions, zoning requirements, and the 
judgment issued against her. There is no reason to believe she will comply with conditions of approval if this SUP is 
granted. 
 
I’d also like to point out that there was an event venue that was denied near the 43rd Ave and Carver area that was on a 
main, paved road with limited residential housing which would be more conducive for an event venue than this property 
and it was NOT approved.   
 
Given the zoning incompatibility, infrastructure limitations, environmental risks, and the applicant’s long record of 
non-compliance, I respectfully urge you to deny Case Z240005.

I am writing to formally protest and oppose Special Use Permit Application SU240005 for the 
proposed wedding and events venue on Parcel No. 300-09-014A. 
I am the owner of Maricopa County Parcels 300-09-075 and 300-09-076, which are located 
within approximately 45 feet from the proposed venue site. As one of the closest neighboring 
property owners, I respectfully request that this letter be included in the official record and 
considered by Planning Staff, the Planning & Zoning Commission, Supervisor Gallardo, and 
the Board of Supervisors. 
My opposition is based on several significant concerns regarding compatibility, safety, 
infrastructure, property rights, and the long-term impact this commercial use would have on 
our neighborhood. 
First and foremost, this proposal is incompatible with the existing Rural-43 zoning and the 
residential character of the area. This community consists of large-lot residential properties

adjacent to South Mountain Park and Preserve. Property owners invested here with the 
expectation that neighboring properties would remain residential in nature and consistent 
with the area's rural character. A commercial wedding and events venue is fundamentally 
different from the residential uses that surround it. 
The proposed venue would bring regular commercial activity into a quiet residential 
neighborhood, including large gatherings, amplified music, event traffic, vendors, rideshare 
vehicles, deliveries, outdoor lighting, and late-night activity. These impacts are not consistent 
with the peaceful residential environment that currently exists. 
Traffic and access present another serious concern. Access to the property requires travel 
along approximately one-half mile of private roadway and easements through an existing 
residential neighborhood. These roads were designed to serve local residents, not 
commercial events with dozens or potentially hundreds of guests. 
The roadway contains several safety challenges, including narrow sections, limited 
maneuvering space, flood-prone areas during storm events, a bridge crossing near the SRP 
Western Canal, poor nighttime visibility, lack of street lighting, and road conditions that are 
privately maintained rather than built to commercial standards. Introducing wedding and 
event traffic onto this roadway will increase risks for residents, visitors, and emergency 
responders. 
Emergency access and fire safety are also major concerns. The property is located adjacent 
to South Mountain Park and Preserve, an area that is particularly vulnerable to wildfire risk. 
Increased vehicle traffic, outdoor events, and commercial activity near the preserve create 
additional concerns regarding emergency response capability and fire protection. The 
surrounding infrastructure was never designed to support a commercial entertainment venue 
of this nature. 
As one of the nearest property owners, I am particularly concerned about the direct impacts 
on my property. The proposed venue would introduce noise, headlights, parking activity, 
outdoor lighting, and late-night events within close proximity to my land. These impacts 
would substantially interfere with the quiet enjoyment of my property and diminish the rural 
atmosphere that attracted me to this area. 
My family has invested in these parcels with plans to construct two luxury custom homes. 
One of the primary reasons for acquiring these properties was their unique setting by South 
Mountain Park and the scenic mountain views that define this area. The introduction of a 
commercial event venue would negatively affect those views, reduce privacy, alter the 
character of the neighborhood, and undermine the value of our investment. 
This area is valued for its natural beauty, dark skies, open space, and tranquility. Those 
qualities are increasingly rare in Maricopa County and deserve protection. A wedding and 
events venue hosting large gatherings, outdoor activities, amplified music, and evening

events is simply not compatible with the preserve environment or the surrounding residential 
community. 
I also understand that a substantial number of neighboring property owners oppose this 
application. See the attached protest for 65 Acres we received from John Garretson delivered 
to Maricopa County in opposition where over 3/4 of the neighbors contiguous to the 
proposed Wedding venue appear in opposition with property values far exceeding that of the 
proposed commercial Wedding Venue property.  Based on discussions within the 
community, it appears that a significant majority of the adjacent property owners share 
concerns regarding traffic, safety, noise, property values, and the long-term impact on the 
neighborhood. 
Commercial event facilities are better suited for locations specifically planned and equipped 
for commercial activity, with public roads, adequate infrastructure, lighting, municipal 
services, and emergency access designed to accommodate large gatherings. This property 
and its surrounding neighborhood do not possess those characteristics. 
For all of these reasons, I respectfully request that the Planning & Zoning Commission 
recommend denial and that the Maricopa County Board of Supervisors deny Special Use 
Permit Application SU240005.

I am writing in opposition to Special Use Permit SU240005. 
 
I have lived on this road for approximately 20 years and built 
my home here because it is a rural residential area. The 
proposed use is not compatible with the character of our 
neighborhood and would negatively affect the surrounding 
residents. 
 
Our road is a dead-end residential road with limited 
infrastructure and no urban services. The area was not 
designed to accommodate commercial-scale events, frequent 
large gatherings, or significant increases in traffic. 
 
Residents have already experienced impacts associated with 
event activity at this property, including: 
 
Excessive traffic on a narrow rural road. 
Increased dust and vehicle speeds on largely unpaved 
roadways. 
Noise from music and gatherings that disrupt neighboring 
properties. 
Litter and trash associated with visitors. 
Large numbers of unfamiliar vehicles and visitors entering a 
residential neighborhood. 
Safety concerns for residents, children, pets, and emergency 
access. 
 
Additionally, this property shares access to a private well 
system with neighboring properties. Increased activity and 
occupancy raise concerns regarding water usage, 
infrastructure impacts, and the suitability of the property for 
ongoing event operations. 
 
All of the homeowners on our street who have discussed this 
matter oppose the permit. We chose to live in this area 
because of its rural residential character, privacy, and quiet 
enjoyment of our properties. Granting this permit would 
fundamentally change the nature of the neighborhood and 
place the interests of a single property owner above those of 
the surrounding residents who have invested years and, in 
many cases, decades in their homes. 
 
For these reasons, I respectfully request that Maricopa County 
deny Special Use Permit SU240005.

Dear Mr. Lorentzen & County Supervisors: 
 
I am in opposition of Wedding Venue SU240005 at 3801 W. Carver Road.  
 
The precedence has already been established and should be followed without exception in the 
case. On September 23, 2021, Supervisor Gallardo and the complete Board of Supervisors voted 
8-0 against case# Z2019135, the Enchanted Garden Wedding Venue, which was to be located on 
W. Carver Road and approximately S. 44th Avenue. This proposed venue was going to be a clean 
sheet design on a main arterial road and FAILED to meet the necessary threshold approval 
requirements to approval. SU240005 Legends pales in its efforts to meet, let alone exceed criteria 
for approval. Supervisor Gallardo did a site visit during case Z2019135 and told the residents of 
the area that a wedding venue was incompatible with the area and that it would not happen. 
 
An event center is a completely incompatible and irresponsible use for a property zoned as Rural-
43 within an established residential neighborhood with large lot single family residential 
bordering all four sides of the property and South Mountain Park within ¼ mile of the property.  
If you are not familiar with the area, the site lies between Carver Mountain and South Mountain 
in a valley that is primarily part of Maricopa County with small patches of land that is incorporated 
as City of Phoenix. Speaking for myself and my neighbors, the attraction of this area is the quiet 
rural nature that is also relatively close to downtown Phoenix. Loud parties/events that have been 
held at this location have resulted in numerous calls/complaints to MCSO.  
 
In this regard, all infrastructure in the area is designed solely for single family zoning and use. 
Many of the roads outside of the main arterial through the area are gravel/dirt roads that receive 
very little to no grading or maintenance (38th Avenue included), to which the owners of 3801 W 
Carver Rd are supposed to maintain, but have failed to do so as other neighbors have footed the 
bill to keep up on the grading and maintenance. Water for the homes in the area is supplied by 
private wells, often wells that are shared between neighbors as there is no municipal water supply 
on 38th Avenue. This home is on a shared well with an agreement that clearly states that it cannot 
be used for commercial use. I suspect that this issue is pertinent to this property/applicant and 
has been overlooked or ignored. The applicant has not been truthful within their application that 
states that they are on city services for water. Similarly, there are no sanitary sewer services in 
the area and all the homes in the area rely upon septic systems. I am certain that this 2-bedroom 
home’s septic system is not designed or able to handle the water volume generated by large 
venue generated parties. I am very concerned that if approved or if this applicant is allowed to 
continue operation of the event venue that the groundwater will be affected by excessive 
withdrawal and/or contamination due to an undersized septic system. 
 
Furthermore, you and the county supervisors should be aware that the applicant and property 
owner have been illegally operating an event center shortly after the residence and shop was 
purchased from the prior owner in October of 2020. Unpermitted work that has been performed 
at the site has previously been documented by Planning and Development personnel and has 
included modifications to a pre-fabricated garage that may have included removal or alterations 
of shear members or bracing, grading and drainage work performed to construct a rudimentary

parking lot that likely raised grades by more than 12-inches and may have altered historic 
stormwater runoff by increasing discharge and/or altering discharge locations off the lot (recent 
runoff from storm events after these modifications has severely eroded 38th Avenue and increase 
sediment deposits in other areas of the neighborhood. Sometime on or around June 1st 2026, 
they brought in 2 truckloads of dirt and buried a culvert in a wash without an approved Grading 
and Drainage Plan. A major concern, also addressed by the County, is the issue of fire safety. The 
venue does not have a fire suppression system, which is required per the NFPA 72 with an 
occupancy load of 100 or more, which their application is stating an occupancy of up to 150 
guests. This building is clearly not safe for the wedding venue they are trying to operate.  
 
During an initial hearing regarding these complaints and meetings with Planning and 
Development that was presided by a Hearing Officer, the owner at first falsely claimed that all of 
the activities were family gatherings and were not commercial events but then finally admitting 
that it was a wedding venue. At this hearing, the Hearing Officer ordered a judgement against this 
owner and was told that any violation would be subject to a fine. I have personally sent numerous 
emails from this hearing through now, which can be verified through Donna Gerron, showing with 
pictures all the events that she has had at the property. We did in fact talk to some of the people 
heading up there and they did confirm paying for the venue. The owner did get a recorded 
violation on April 30, 2025.  
 
Recently, the owner mailed/delivered flies to the residents in the area for a “neighborhood 
meeting” to try and sell the area on their plans. I understand this to be an attempt to meet 
requirements that Planning and Development has as part of the SUP process. Approximately 30 
to 40 people attended this event. The owner was not there; she sent an employee/business 
partner in her stead with no answers. Make no mistake, every member of the community that 
attended was and is OPPOSED to this event venue and commercial business operating at this site. 
The owner has ignored all directives that resulted from the aforementioned hearing and has 
continued to operate as she sees fit. She does not care about the neighborhood or neighbors and 
is only driven by financial gain.  
 
Based upon these concerns, I respectfully request that this application for a Special Use Permit 
SU240005 be denied.
