The applicant is proposing an 800 sf ADU to be setback 5’ from the northern lot line. However, the 
required front yard is formed by the 40’ minimum front setback line which runs the length of the 
north lot line.  Buildings such as the proposed ADU are prohibited within the required front yard.  
The applicant requests variance to permit a 5’ front setback line.

State Statute / County Zoning Ordinance Tests - ARS § 11-816.B.2 and MCZO Article 303.2.2 states the 
Board of Adjustment may, “Allow a variance from the terms of the ordinance if, owing to peculiar

conditions, a strict interpretation would work an unnecessary hardship and if in granting the variance the 
general intent and purposes of the zoning ordinance will be preserved.”

Statutory Test -1 Does the applicant’s property contain any peculiar condition– Discuss and 
explain what is/are the peculiar conditions facing the property and include reference to the 
Maricopa County Zoning Ordinance Regulations or Development Standards to be varied.   
 
“Despite the 1.2-acre size, the "buildable envelope" is severely restricted by a unique combination 
of topographical and legal constraints: 
• Environmental Constraints (Natural Wash): The property is substantially encumbered by a large 
natural wash that surrounds the east and south borders of the lot. Development within or too near 
the wash is restricted by drainage regulations, effectively “shrinking” the usable acreage of the lot. 
• Utility Easement (Communal Well): A communal well is located on the southeast corner of the 
property which carries a mandatory 100-foot setback for any habitable structures or septic 
components. There is also an easement to allow accessibility running along the south and west 
border of our lot. This "exclusion zone" renders the majority of the rear and side yards unbuildable. 
• Pre-Existing Infrastructure: The central and rear portion of the lot is occupied by the primary 
residence and a pre-existing shop. The pre-existing septic system and it's required 100% reserve 
area are located in the front-central area, further limiting foundation placement. 
• Topographical Hardship: Due to the wash and the well radius, the only remaining stable "high 
ground" capable of supporting an 800-square-foot foundation is located within the northern front-
yard area."

Statutory Test 2 – Does applying the requirements of the Ordinance to the applicant’s property 
create an Unnecessary Hardship – Explain how the peculiar condition identified in #1 causes an  
unnecessary hardship to the property when the requirements of the Maricopa County Zoning 
Ordinance are applied.  Explain how the that the peculiar condition of the property came to be and 
whether the condition was created by the applicant or someone in the property’s line of title. 
Explain the proposed use of the property with the variance request. Identify and explain all 
peculiar conditions on your property in regard to the following areas: slope, narrowness, 
shallowness, irregular shape, location, washes, vegetation, and easements, etc. Explain how 
enforcement of the Zoning Regulations or Development Standards would impose a hardship on 
the property. 
 
“A strict application of the 40-foot front setback (Section 502) would work an unnecessary hardship 
by depriving the property owner of the right to build a secondary dwelling—a privilege commonly 
enjoyed by other 1.2-acre RU-43 properties with fewer environmental constraints. This hardship is 
not self-imposed; it is a direct result of the site’s natural topography and the legal safety 
requirements of the community water source. The 800-square-foot size is the minimum necessary 
for a functional, ADA-compliant living space. The 5-foot setback is the minimum variance required 
to keep the structure out of the wash and maintain the 100-foot safety buffer from the well."

Statutory Test 3 – General Intent and Purpose of the Zoning Ordinance – Discuss the purpose 
of the zoning requirement from which the variance is being sought. Then, discuss and explain 
how, provided statutory tests #1 and #2 are satisfied, the granting of the requested variance 
would preserve the general intent and purpose of the Zoning Ordinance. 
 
“• Preservation of Character: With a 1.2-acre lot, the addition of an 800-square-foot unit, a 2,520-
square-foot primary residence, and a 2,000-square-foot shop results in a total lot coverage of 5,320-
square-feet, which equals a 10.18% lot coverage, well below the 30% maximum allowed in Section 
502. This maintains the open, rural character of the RU-43 district.

• Visual Harmony: As a flag lot, the property is set back from the main road and sits behind another 
residence. The proposed 5-foot setback will not be visible to the general public and will not create 
a "crowded" appearance from the street. 
• Privacy and Screening: The ADU is positioned to act as a visual buffer between our property and 
the neighbor to the north, increasing privacy for both parties. Also, due to the position of our lot, the 
ADU will not be in close proximity to any neighbor’s primary living space or high-use outdoor areas. 
• Public Safety: This placement ensures the structure remains on high ground, avoiding the flood 
risks associated with the wash, protects the community’s water supply by respecting the 100-foot 
well radius, and does not impede access for emergency vehicles and utility maintenance." 
 
 
Findings:

The applicant has the burden of proving to the Board that, in accordance with the standard set 
forth in ARS §11-816.B.2 and MCZO Article 303.2.2, the property requires a variance. To grant the 
relief, the applicant must prove, and the Board must find and identify, a physical condition of the 
applicant’s property that is peculiar and not common to the area or the universe of the zoning 
district. Also, any such peculiarity must not have been created either by the applicant or anyone 
in the chain of title. If the Board determines that there is no such peculiar physical condition, its 
inquiry stops, and the application must be denied. 
 
If the Board identifies a peculiar physical condition of the applicant’s property which is not self-
imposed, then the applicant must prove, and the Board must find and identify, an unnecessary 
hardship imposed upon the property due to the strict application of the requirements of the zoning 
ordinance which the applicant wishes to have varied such that there is no viable use of the 
property without the variance.  
 
If the Board identifies a peculiar physical condition of the property which is not self-imposed, and 
that in applying the requirements of the zoning ordinance to the property, because of the peculiar 
physical condition, an unnecessary hardship exists, the applicant must prove, and the Board must 
find and identify, how the granting of the variance will preserve the general intent and purpose of 
the zoning ordinance. 
 
In order to approve the variance the Board must make findings and articulate them in motion 
memorializing the above.   
 
15. 
Based upon what the applicant has submitted and the staff analysis in this report, staff offers the 
following positive and/or negative observations the Board may consider in its findings: 
 
• 
A wash running through the southern and eastern perimeter of the property push development 
of the parcel to the northeast. 
• 
The north lot line is considered the front lot line because an access easement terminates at 
the north lot line in the northwest corner of the parcel.  The north lot line is the front lot line 
but there is not a street that physically provides frontage along the length of the north lot line. 
• 
These two factors may be considered peculiar conditions facing the property that when the 
ordinance’s front setback requirement is applied creates an undue physical hardship not selt-
created that prevents reasonable development of the lot. It would significantly reduce the 
buildable area of the lot for development of detached accessory structures in relation to the 
actual street frontage.

And further, if the Board finds the applicant has satisfied the statutory test, and has stated its 
findings on the record, the grant of this variance will memorialize the following:

Variance approval establishes a 5’ front (north) setback line for APN 211-68-019C.

Variance Request: RU-43 Development Standards 
1) Regulation to be Varied: We are requesting a variance from the RU-43 Development 
Standards (Section 502), which mandates a minimum front yard setback of 40 feet. We 
propose a reduction to a 5-foot front yard setback to allow for the construction of a 
detached approximately 800-square-foot Accessory Dwelling Unit (ADU). 
 
Proposed Use: The proposed use is the construction of a permanent, approximately 800-square-
foot detached ADU on a 1.2-acre lot. This unit is intended to provide essential housing for family 
members requiring close care and supervision. The structure is designed to be subordinate to the 
primary residence in both scale and function, adhering to the intent of "Guest Houses" and 
"Secondary Dwellings" defined in Chapter 2. 
 
Peculiar Conditions of the Property: Despite the 1.2-acre size, the "buildable envelope" is
