Project Summary: 
 
1. 
The applicant, Jamie Hartig of Ledcor Group, is requesting a Special Use Permit (SUP) for a 
proposed fiber-optic utility compound on parcel 506-09-081B. The subject parcel comprises 
approximately 27 acres and is located at the southwest corner of Forepaugh Peak Road and the 
Arizona and California Railroad, approximately two miles north of US 60. The site is located in an 
area of northwestern Maricopa County midway between Wickenburg and Aguila. The SUP will be 
for a 90,000-square-foot lease area toward the west lot line of the subject parcel. 
 
2. 
Access to the lease area will follow a proposed 30’-wide ingress/egress easement that will begin 
at Forepaugh Peak Road near the northeast property corner. From the east lot line, the easement 
will pass an existing fiber-optic utility compound that was previously entitled with the Board of 
Supervisors’ approval of SUP Z2020013 on July 22, 2020. The compound proposed herein is 
unrelated to the existing compound, which has its own access easement to/from the main road. 
Passing the existing compound, the easement will proceed along the interior side of the north lot 
line until approximately <300’ short of the west lot line, at which point, the easement will proceed 
due south to the lease area.

The lease area will measure 300’ x 300’ (90,000 sf), although most of this area will be 
undeveloped. A small retention basin will be placed toward the northwest corner of the lease area, 
but otherwise, development beyond the easement will be limited to a fenced area toward the 
southeast corner of the lease area measuring approximately 108’ x 133’-4” (14,400 sf). The fence 
itself will be an 8’ chain-link fence topped with an additional 1’ of barbed wire and will include a 
16’ wide manual cantilever sliding access gate. Per the applicant’s narrative, a fence is preferred 
to a solid wall to maximize unobstructed airflow for equipment cleanliness and operational 
stability. However, the narrative assures that the facility will not generate noise or other 
emissions, effectively minimizing its impact on nearby rural residences. 
 
4. 
Within the fenced area, the developer will install a new utility compound and equipment shelter 
that will serve as an infrastructure component supporting their existing fiber-optic network. The 
equipment shelter will be a prefabricated modular unit measuring approximately 24’ x 36’ (864 sf) 
and 12’-9” in height. In terms of construction materials, the shelter will be a precast concrete 
building with an exposed coarse aggregate finish; it will be placed and anchored to a precast 
concrete slab foundation. One equipment shelter will be installed during initial construction, 
although a foundation pad will be provided for the installation of a second identical shelter in the 
future. There will be no antennas, towers, or dishes with the facility. Outside lighting will be 
provided by one downward-directed wall-mounted LED light fixture at each unit entry door (for 
three per unit). Each light will have a dawn-to-dusk photocell control. 
 
5. 
The facility will be unmanned and closed to the public. Access will be limited to authorized service 
personnel who will visit the site infrequently for maintenance as needed. A single parking space 
will be provided. Both the parking space and the 16’ wide access driveway within the easement 
will be surfaced with stabilized decomposed granite (except within the Forepaugh Peak Road 
right-of-way, where the driveway connection will be paved with asphalt as MCDOT requires).

Because the proposed facility will be unmanned, there will be no demand for water or wastewater 
connections. Although the applicant has not yet obtained a will-serve letter or assurance of service from 
the fire authority having jurisdiction, the applicant has presented staff with an email from Ken Diamond,

Fire Marshal and Fire Plans Examiner with the Rural Metro Fire Department. Mr. Diamond confirmed to 
the applicant that he had spoken to the Aguila Fire District and received confirmation that the site is 
within its service area. Prior to issuance of construction permits, written confirmation will be required 
from the fire authority having jurisdiction that the facility has been designed in accordance with their 
regulations and requirements, and that emergency fire protection service will be provided to the facility. 
Neither Arizona Public Service nor Salt River Project have provided comments regarding this request. 
 
The Aguila Volunteer Fire Department located nine miles to the west, operates the fire station nearest to 
the subject site. The nearest school, the Aguila Elementary School, is also located nine miles to the west. 
The nearest MCSO office is located at 13063 West Bell Road in Surprise, approximately 54 miles from 
the subject site.

MCDOT’s Traffic Division has approved its review of this request. Due to the small scale and 
minimal number of trips that will be generated by the proposed development, MCDOT has 
determined that adequate right-of-way infrastructure is available to support the project and that 
no regional-level infrastructure improvements will be necessary to accommodate the site. 
 
Adopted Plan:

Framework 2040 Maricopa County Comprehensive Plan (adopted May 20, 2026): The subject 
site is not located within any of Maricopa County’s Area Plans, so the Comprehensive Plan 
designates it as being within the Rural Development Area (RDA). Because the site is not located 
within a municipal planning area (Wickenburg’s planning area is the nearest, at approx. 1.8 miles 
to the east), there is no assurance of annexation with any municipality, and the Comprehensive 
Plan’s Municipal-Rural Framework considers the site to be within the County’s Area of Rural 
Influence. Furthermore, since the Framework designates the site as both being within the Area of 
Rural Influence and having a rural land use, it considers the site to be within the Rural Service Area 
as opposed to the Urban Growth Area. Per the Urban Solutions for Urban Development strategy, 
urban commercial uses generally require that adequate water and sewer infrastructure will be 
available upon development, as well as adequate roadway infrastructure, police protection, and 
fire protection. Being within the Rural Service Area, there is no existing water or sewer 
infrastructure serving the site, and the nearest MCSO station is over 50 miles away. At best, the 
site benefits from direct access to a MCDOT-maintained rural minor collector and a fire station 
located approx. nine miles away. However, the lack of significant urban infrastructure should not 
be of detriment to the proposed land use, which essentially amounts to a rural utility use. The 
unmanned fiber-optic facility will generate no water demand, no wastewater, and virtually no 
traffic. Furthermore, it will be self-secured with a barbed-wire fence.

Public Participation Summary:

The applicant complied with the requirements of the citizen review process by posting the site 
and sending notification by first class mail to interested parties and adjacent property owners 
within 300’ of the site. Two signs were posted onsite in accordance with applicable regulations. 
Staff received no public comment regarding the application. 
 
Outstanding Concerns from Reviewing Agencies:

Staff Analysis:

Staff supports the applicant’s request for an SUP. For the reasons discussed in paragraphs 7 and 
9 of this report, the proposed use does not require conventional urban services such as water or 
wastewater infrastructure. In fact, since the facility will be unmanned, there is no need for a well 
or septic system either. The proposed use arguably requires fewer services than a rural residence. 
In many ways, the fiber-optic compound is similar to a wireless communication facility, albeit 
without the tower, antennas, or emissions (staff also notes that WCFs are allowed by right in all 
zoning districts except when the towers and/or antenna arrays exceed required dimensions). Put 
another way, a fiber-optic compound is arguably a less intense use than some that are allowed 
by right in the Rural-190 zoning district. As far as screening goes, staff believes the request for a 
chain-link fence in lieu of a solid wall (which is generally required for WCFs to be permitted by 
right) is reasonable due to the need for sufficient ventilation, the minimal noise that would be 
generated by the use, and the minimally obtrusive aesthetic nature of the utility systems that 
would be screened behind the fence. Finally, staff believes the proposed fiber-optic utility 
compound provides a vital community benefit to Maricopa County by enhancing 
telecommunications infrastructure in a very remote area of the County. 
 
Recommendation: 
 
13. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve SU260019 subject to the following conditions ‘a’ – ‘i’: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Wickenburg ILA,” consisting of five full-size sheets, dated June 23, 2026, and stamped 
received June 25, 2026, except as modified by the following conditions. Staff may 
determine slight refinements to remain in substantial conformance with the approved site 
plan.  Minor and major amendments to the site plan will be determined in accordance with 
Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “MMI-Wickenburg AZ,” consisting of five pages, dated February 3, 2026, and 
stamped received June 25, 2026, except as modified by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply: 
 
1. The site contains areas of regulated floodplains (FEMA Zone A). Any development in 
the floodplain will require a floodplain use permit issued concurrent with building 
permit(s) required for site development.

2. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 905 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for 
construction. 
 
3. Based on the conceptual design nature of the information submitted, changes to the 
site layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure. 
 
4. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the 
application for Building Permits. 
 
5. No use is anticipated outside of the disturbed area. Any additional improvements that 
increase disturbed area will require additional retention. 
 
d. 
This special use permit is valid for a period of 30 years and shall expire on October 21, 
2056, or upon termination of the use for a period of 90 or more days, whichever occurs 
first. All site improvements associated with the special use permit shall be removed within 
90 days of such expiration or termination of use. 
 
e. 
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
f. 
The owner shall submit construction permits to establish the land use and for site 
improvements as shown on the site plan and receive final inspection status from the 
Planning & Development Department Inspections Division establishing the use prior to 
commencing operations. Violation of this condition may be grounds for revocation as set 
forth in the Maricopa County Zoning Ordinance. 
 
g. 
Noncompliance with any of the conditions assigned to the approval of this Special Use 
Permit by the Maricopa County Board of Supervisors may be grounds for revocation in 
accordance with the requirements and procedures as set forth in the Maricopa County 
Zoning Ordinance. 
 
h. 
The property owners and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions. 
 
i. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner. The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions. In the event of the failure to comply with any condition, and at the 
time of expiration of the Special Use Permit, the property may be considered for revocation  
to the zoning that existed on the date of application. It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, or the expiration of 
the Special Use Permit, does not reduce any rights that existed on the date of application 
to use, divide, sell or possess the property and that there would be no diminution in value

of the property from the value it held on the date of application due to such revocation or 
expiration of the Special Use Permit. The Special Use Permit enhances the value of the 
property above its value as of the date the Special Use Permit is granted and reverting to 
the prior zoning results in the same value of the property as if the Special Use Permit had 
never been granted.

PURPOSE OF REQUEST 
On behalf of Middle Mile Infrastructure, LLC (MMI) – LTS Managed Technical Services LLC is requesting a 
Special Use Permit (SUP) for a new utility compound for in-line amplifying (ILA) fiber optic utility 
equipment shelter(s). The equipment shelter is ~864 square feet (sqft) and is unmanned / unoccupied. 
The shelter is prefabricated off-site as a unit and is shipped and installed at the site and will contain the 
equipment to support the fiber optic network. 
 
DESCRIPTION OF PROPOSAL 
MMI proposes to install a new utility compound and equipment shelter that acts as an infrastructure 
component supporting their existing fiber-optic network. The equipment shelter is ~864 sqft, 
prefabricated “double wide” modular unit. The initial installation will be for (1) “double wide” shelter 
with a second one proposed for future installation. The shelter is approximately 24’x36’x12’-9”.

The equipment shelter is a precast concrete building with an exposed coarse aggregate finish, that is 
placed and anchored to a precast concrete monolithic slab foundation at the required frost depth for 
soil conditions. The prefabricated unit is shipped to the site in two modular halves, and is then installed 
and sealed together on site. There are no antennas, towers, or dishes at the site or for this shelter. 
 
The utility compound and equipment shelter is an unoccupied/unmanned facility that is not open to the 
public and is fenced with an access gate that will be locked at all times. Access is only permitted by 
trained and authorized service personnel on an infrequent basis (ex. Site maintenance, emergency 
repairs, etc.). The utility compound will be surrounded by a 8’ chain-link security fence with 1’ (3-strand) 
of barbed wire. The outside lighting on the site is (1) downward directed wall mounted LED light fixture 
at each entry door (three total). Each light will have a dawn to dusk photocell control. There will be no 
proposed signate at this location. 
 
The proposed site has an existing approved an SUP (case Z2020013) on the subject parcel for another 
fiber-optic utility compound. This SUP was for an approximately 10,000-square foot area toward the 
northeast corner of the parcel. This SUP application is unrelated to that previous request. 
 
RELATIONSHIP TO SURROUNDING PROPERTIES 
The parcel has a single-family rural residence and some ancillary structures, but otherwise features large 
area of vacant space. The site is in a sparsely populated, but not entirely remote part of Maricopa 
County on a vacant parcel. The surrounding parcels are low-intensity (residential/agricultural) with 
ample spacing between structures. The land to the north and west is mostly open space. No emissions 
or noise generation will be created from the normal operations of this equipment shelter. 
 
The fiber infrastructure requires placement of line amplifiers that helps improve the network by 
providing additional signal stability, help carry information, and reduce latency. These routes are part of 
the fiber optic backbones that help facilitate modern day communications.   
 
LOCATION AND ACCESSIBILITY 
The location of the utility compound has been chosen because of its proximity to the existing fiber optic 
cable route and its minimal impact to the adjacent road. The compound will be accessed from an access 
easement off of Forepaugh Peak Road. 
 
CIRCULATION SYSTEM (ON & OFF-SITE) 
Visits to the site will be infrequent and primarily for scheduled maintenance visits (typically quarterly 
through the year). This will not impact the existing traffic patterns of the area. The compound is not 
open to public access. 
 
DEVELOPMENT SCHEDULE (PHASING) 
The project is a small standard design and is built in one construction phase (4-6 weeks). The site is 
grubbed / graded, site work prep and foundations are poured, the equipment shelter is installed and 
final site work is completed. A second foundation pad will be poured for a future shelter installation.

COMMMUNITY FACILITIES AND SERVICES 
The equipment shelter is located in a rural area with no schools or parks in close proximity. The shelter 
itself is a private building that is not accessible to the public. 
 
PUBLIC UTILITIES AND SERVICES 
There will be no water or sewage utility required or provided. No waste or trash will be accumulated or 
generated with this proposed development. This is an unoccupied / unmanned facility with no plumbing 
or waste generation. The shelter will be serviced by the Aguila Fire District and by the District 4 Sheriff’s 
Office. 
 
OTHER / ADDITIONAL INFORMATION 
A portion of the utility compound is located within floodplain (Zone A). We are working with the local 
flood district on a floodplain permit that will be concurrently reviewed with the building permit. The site 
will be elevated to the regulatory flood elevation determined by the engineer (BFE + 2’).

Justification of Standards

Parking Spaces – The utility compound and equipment shelter is unmanned / unoccupied and is visited 
infrequently and generally only for maintenance and emergency repairs. No ADA spaces are proposed as 
no public access is available to the site. 
 
Paved Parking – No paved parking is being proposed for this site as the stabilized decomposed granite 
on the site is appropriate for parking. Additionally, the site will remain unmanned with no regular 
employees with the exception of quarterly maintenance. 
 
Screening – The equipment shelter requires as much unobstructed airflow possible for equipment 
cleanliness and operational stability. Additionally, this is a small site in a remote portion of Maricopa 
County with no significant impact on the surrounding properties. Chain-link fencing would be 
unobtrusive and appropriate. 
 
Total height of the chain-link fencing would be 8’ with 1’ of proposed barbed wire for 9’ in total height. A 
total fence height of no greater than 10’ is being proposed. 
 
1’ of barbed-wire is proposed in order to provide a layer of security to the site to prevent unintentional 
damage of valuable equipment and prevent access and/or theft of sensitive information.
