Project Summary:
1.
The applicant and property owner, Paul Thomas, is requesting a Zone Change from Rural-43 and
C-2 to C-2 with a Commercial Unit Plan of Development (CUPD) overlay on parcel 503-40-028E.
This is within the Wickenburg Highway Scenic Corridor (WHSC) overlay zoning district. The
subject parcel comprises approximately 2.5 acres and is located along Grand Ave. in the
Wittmann area, approximately ¼ mile northwest of 211th Ave. The owner is proposing to develop
a wholesale nursery that will include limited retail sales. The Maricopa County Zoning Ordinance
(MCZO) allows wholesale nurseries by right in the Rural-43 zoning district but requires at least C-
2 commercial zoning or a special use permit (SUP) for retail nurseries. The proposed zone change
would allow the retail component of the nursery under a unified zoning across the property.
2.
The subject parcel is located in a somewhat transitional area of Maricopa County. On one hand,
Rural-43 remains the predominant zoning district in the area and the applicable land use plans
designate the site for rural land uses. Even so, single-family residences have abounded
throughout the surrounding area since 2000 and the nearby Nadaburg townsite is designated a
Major Activity Center in the Wickenburg Highway Scenic Corridor (WHSC) Plan. Furthermore, the
adjacent Grand Avenue is a major US highway connecting Phoenix to Wickenburg and beyond to
Las Vegas. The existing strip of C-2 zoning that now extends less than 100’ from the Grand Ave.
right-of-way has existed since before the MCZO was adopted in 1969 in anticipation of
commercial development along the highway corridor. Staff notes that this C-2 strip had greater
depth before ADOT widened the highway.

The subject parcel was created in 2026 from the combination of three smaller lots, which the
applicant purchased just prior to combining them. Two of these lots had been owned by the
Arizona Department of Transportation (ADOT) since 2000; the frontmost 112.5’ of these two lots
corresponded with right-of-way for Grand Ave., 56’ of which ADOT had already ceded to MCDOT
for the frontage road in 2006. This 112.5’ strip remained within the assessed area of ADOT’s two
parcels until they were sold to the current owner in 2026. With the sale and subsequent
combination of the lots, the 112.5’ strip no longer possesses an assessor parcel number, and the
applicant’s property is no longer encumbered by right-of-way. The applicant met with Planning &
Development staff for a pre-application meeting on April 28, 2026, and subsequently submitted
the subject Zone Change request on May 14, 2026. The applicant met with staff for a technical
advisory committee (TAC) meeting on June 8, 2026. Planning staff’s comments were minimal;
Engineering and Environmental Services staff signed off with no objections upon completion of
the first review.
4.
The owner currently operates the Dynamite Farm nursery elsewhere in Maricopa County and
plans to relocate to the subject property. Per the project narrative, business operations would be
by appointment only (no regular business hours). The owner would be the sole employee, plus an
occasional volunteer. The owner projects that the number of customers onsite per appointment
would not exceed five. The owner would deliver produce from onsite to customers offsite.
5.
The owner seeks to create an agricultural aesthetic with the proposed development, which would
consist of two farm-style buildings, each measuring 6,480 square feet of floor area plus a 432-
square-foot outdoor covered patio/entryway. The overwhelming majority of the space inside each
building would be dedicated to the keeping of produce, with a small portion (>1,000 square feet)
of at least one building used as office space. The owner would develop an 8’ high block wall
around most of the property. This wall would extend from the front corners of the foremost
building to the side lot lines and then screen the site along the remainder of the side and rear lot
lines. In front of the foremost building, the owner is proposing to install a 4’ high pipe-rail fence

along the side and front lot lines to maximize the agricultural aesthetic of the site as seen from
Grand Ave. An outdoor planting and retention area would be graded toward the rear of the
property behind the rearmost of the two buildings. The owner also intends to install a 25’ tall faux
farm windmill toward the front of the property to further enhance the intended aesthetic.
6.
A single ingress/egress driveway would be provided at the highway frontage road. A parking area
would be provided at the front of the property. Since the combined floor area of the two buildings
approaches 13,000 sf, the MCZO requires that 44 parking spaces be provided (one per each 300
sf of floor area). Due to the minimal number of customers who would be onsite at a given time,
the owner is requesting to waive the required number of parking spaces with the CUPD. The owner
will provide up to 15 parking spaces (including one ADA-compliant space) to accommodate the
projected number of customers. The parking area and the portion of the driveway leading up to it
will both be paved. Past the parking area, the driveway will proceed through a gate installed within
the screen wall toward the rear of the property. Behind this gate, the driveway will be surfaced
with compacted aggregate base course (ABC) surfacing and will terminate at a loading space
positioned just behind the rearmost of the two buildings.

The site is located within the WHSC overlay zoning district Class 2 and Class 4 intensity levels as
regulated in MCZO Section 704. Class 2 corresponds with the County jurisdiction from 300’ to ¼
mile (1,320’) out from the Grand Ave. right-of-way, whereas Class 4 corresponds with County
jurisdiction within 300’ of the Grand Ave. right-of-way. The Class 2 development regulations are
minimal, only requiring structures to adhere to a maximum height of 33’ and otherwise requiring
development to observe the goals and policies established in the WHSC plan to the extent
practicable. The Class 4 development regulations are more specific. In addition to the 33’ height
restriction, the Class 4 standards also establish specific screening regulations, requiring that
parking areas, loading areas, and outdoor storage areas be screened from the highway with a
solid fence and that drought-tolerant landscaping be placed in front of any wall facing the
highway. Loading and outdoor storage areas must also be placed to the rear of any principal
building(s). The Class 4 standards also require a minimum landscape setback of 25’ from the
highway right-of-way, within which natural desert vegetation must be preserved or provided.
Finally, the Class 4 standards restrict direct access to Grand Avenue.
8.
The owner is requesting one variation to the WHSC regulations: to waive the required 25’
landscape setback. Although the nearer of the two buildings would be set back over 62’ from the
front lot line, the main parking area will be set back just 10’ from the right-of-way. However, the
owner will plant a 3’ tall hedge in front of the parking area to screen it from the highway and
mitigate headlamp glare. All other WHSC regulations would be met with the project. Besides the
parking regulations previously discussed, the only additional variations requested to the C-2
standards are to waive the required sight visibility triangles (SVTs) and to restrict the uses allowed
onsite to those that can be accommodated on septic systems.
9.
Below (next page) is the proposed CUPD table from the applicant’s project narrative. Staff’s
recommendation is to limit variation to parking ratio, landscaped setback and sight-visibility
triangle only with regard to wholesale/retail plant nursery and ancillary uses. The CUPD will also
limit entitled uses only to those that can accommodate wastewater disposal via onsite septic
systems.

The property is within the West End Water Company’s service area (established per ACC docket W-1157).
In the project narrative, the property owner states his intention to establish a connection to the
Company’s water infrastructure upon development. However, staff is not aware of any assurance of
service. There is no known sewer service to the site and the property owner intends to develop a septic
system. Prior to issuance of construction permits, written confirmation will be required from the AFMA
that the project has been designed in accordance with their regulations and requirements, and that it will
be served by emergency fire protection service. The AFMA operates the fire station nearest to the subject
site, located at 20303 W. Patton Rd., approximately three miles to the south. The nearest schools, the
Nadaburg Elementary School and the Mountainside High School, are each located within 2½ miles of the
subject site. The nearest MCSO office is located at 13063 W. Bell Rd. in Surprise, over 14 miles from the
subject site. APS has not commented on this request.

MCDOT’s Traffic Division has approved its review of this request. Due to the project’s proximity
to an Arizona Department of Transportation (ADOT) right-of-way, MCDOT advised the applicant
to notify ADOT of the proposed project through the Red Letter process. ADOT’s Red Letter inbox
is one of the areas of interest registered to receive notification of zoning applications in review
with Planning & Development. ADOT responded to staff’s routing of the case. ADOT states that,
at this time, it is not requesting a traffic impact analysis or statement (TIA/TIS), having
determined that the project will not have a significant impact on ADOT facilities.
Framework 2040 Maricopa County Comprehensive Plan:
13.
The subject site is located within Maricopa County’s White Tank / Grand Avenue Area Plan, which
designates it as being within the Single Family – Rural land use area. This land use designation
supports rural residential development at densities of up to one dwelling unit per acre. The site is
also located within the City of Surprise’s municipal planning area (MPA). Surprise’s general plan
designates the site as being within the City’s Neighborhood character area and Rural Residential
Overlay character sub-area. Because the site is located within an MPA, the Comprehensive Plan’s
Municipal-Rural Framework considers it to be within the County’s Area of Municipal Influence.
Even so, both the applicable area plan and municipal general plan designate the site for rural land
uses.
14.
Generally, the Framework considers sites designated for rural uses by the applicable County area
plan as being within the Rural Service Area as opposed to the Urban Growth Area. However, a site
designated for rural land uses can be considered within the Urban Growth Area if the applicable
municipal general plan designates the site with an urban land use, the site meets the applicable
requirements of the Urban Solutions for Urban Development (USUD) strategy, and the site has an
assurance of annexation from the applicable municipality. That said, Surprise’s general plan
designates the site for rural land uses. Neither the owner nor Surprise have expressed interest in
annexation. The property is not adjacent to Surprise jurisdiction nor along municipal utilities,
suggesting that Surprise would likely have little interest in annexing the site in the foreseeable
future. With these facts known, it can be concluded that, per the guidelines of the Framework, the
site is in fact within the Rural Service Area.
15.
Per the USUD strategy, urban commercial uses generally require that adequate water and sewer
infrastructure will be available upon development, as well as adequate roadway infrastructure,
police protection, and fire protection. Being within the Rural Service Area, there is no existing
sewer infrastructure serving the site, and the nearest MCSO station is over 14 miles away. At best,
the site benefits from direct access to a MCDOT-maintained frontage road along a major US
highway and a fire station located approx. 4½ miles away. The site is within the service area of
the West End Water Company, and the owner’s narrative states an intention to establish a
connection upon development, although staff is not aware of any assurance of service.

Although urban utilities and infrastructure are limited at the project site, they are not likely to
hinder the feasibility of the proposed nursery. Staff notes that, per the project narrative, the
nursery would operate mostly as a wholesale nursery with a limited retail component. As
discussed in a previous paragraph, the MCZO allows wholesale nurseries by right in all zoning
districts, including Rural zoning districts. Although retail nurseries require C-2 zoning at minimum,
they generate little traffic, little demand for drinking water or septic use, and are generally
considered an appropriate rural retail use. In fact, Framework 2040 explicitly names commercial
plant nurseries as examples of rural retail uses – one of the few nonresidential land use
categories generally considered appropriate in rural service areas.
Public Participation Summary:

The applicant complied with the requirements of the citizen review process by posting the site
and sending notification by first class mail to interested parties and adjacent property owners
within 300’ of the site. Two signs were posted onsite in accordance with applicable regulations.
Staff received no public comment regarding the application. In addition to the ADOT memo
discussed previously, Luke Air Force Base and the MCSO both responded to County notices
confirming that they have no concerns with this request.

Staff Analysis:
19.
Staff believes that a plant nursery will be an appropriate land use at this location. Although the
site is within a Rural Service Area, nurseries generally require minimal new infrastructure, utilities,
and public services. Such uses generate low volumes of traffic and can generally be
accommodated on septic systems due to the low number of employees and patrons onsite at
any given time. As for water, whether a public water system (PWS) would be required is
determined by the Environmental Services Department (MCESD) based on the number of people
served or the number of service connections made per day. A PWS does not necessarily require
a connection to a water service provider; an onsite well can meet this requirement if certain
criteria are met. That said, the site is within the jurisdiction of the West End Water Company and
the project narrative attests that a connection is planned. Finally, the site is within the jurisdiction
of an established fire authority, that being the North County Fire & Medical District, a division of
the Arizona Fire & Medical Authority.
20.
In summary, the envisioned use of the site is generally compatible with the Rural Service Area.
The site’s location along the frontage road of an ADOT-maintained U.S. highway also supports
the establishment of a limited commercial use. That said, because of the limited services
presently available to the site, and considering that the project narrative and plan of development
specifically propose a plant nursery, staff believes it would be appropriate to limit the uses
allowed onsite to uses that can be accommodated on septic systems, as determined by MCESD,
until sewer serves are established.
21.
Staff believes the requested CUPD development standards are justified. The standard parking
regulations require more parking than is necessary to support the proposed use. Furthermore, the
minimal traffic that will be generated by the use, together with ample spacing between the right-
of-way line and the edge of pavement, justify waiving the required SVTs. Finally, the requested
waiver of the WHSC landscape setback requirement is arguably negated by the numerous

aesthetic enhancements the owner intends to incorporate into the design of the nursery. The
CUPD appropriately liberalizes these development standards for a wholesale/retail plant nursery
land use.
Recommendation:
22.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z260021 subject to the following conditions ‘a’ – ‘j’:
a.
A Plan of Development is approved subject to site plan entitled “Dynamite Farm,”
consisting of two full-size sheets, dated July 24, 2026, and stamped received July 27,
2026. The Plan of Development may be amended administratively under separate
application as long as the amendment complies with the established CUPD development
standards as approved by the Board of Supervisors. Staff may determine slight
refinements to remain in substantial conformance with the approved site plan. Minor and
major amendments to the site plan will be determined in accordance with Chapter 3 of
the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Dynamite Farm,” consisting of eight pages, and stamped received July 27, 2026,
except as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply:
1.
The site contains an area of regulated floodplain in its southwest corner. Any
development/grading in the floodplain will require a floodplain use permit issued
concurrent with building permit(s) required for site development.
2.
Given the site’s proximity to the US-60, the applicant shall inquire of any concerns
with ADOT via their red-letter process (email redletter@azdot.gov).
3.
Driveway access to County road(s) will require a permit from MCDOT issued
concurrent with building permit(s) required for site development. Drainage flow
along the roadway must be maintained.
4.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section 905
of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.
5.
Based on the conceptual design nature of the information submitted, changes to
the site layout may be necessitated by the final engineering design of the site’s
drainage infrastructure.
6.
Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with
the application for Building Permits
d.
The following C-2 CUPD WHSC standards shall apply but only for a wholesale/retail plant
nursery use and ancillary uses:

1.

e.
The CUPD overlay is applied to restrict the use of the site. Until such time as the site is
served by sewer, uses on the site shall only be those acceptable to the Maricopa County
Environmental Services Department (MCESD) that can be accommodated by septic
systems. A public water system and public sewer system shall be required prior to
establishment of any non-residential use that requires potable water.
f.
Prior to issuance of a building permit, written confirmation will be required from the
emergency fire protection jurisdiction having authority that the facility has been designed
in accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy,
local fire protection jurisdiction review and approval will be required.
g.
The owner shall submit construction permits to establish the land use and for site
improvements as shown on the site plan and receive final inspection status from Planning
& Development Department Inspections Division establishing the use prior to the
operation of business. Violation of this condition may be grounds for revocation as set
forth in the Maricopa County Zoning Ordinance.
h.
Noncompliance with any of the conditions assigned to the approval of this Zone Change
by the Maricopa County Board of Supervisors may be grounds for revocation in
accordance with the requirements and procedures as set forth in the Maricopa County
Zoning Ordinance.
i.
The property owners and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
j.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
may be considered for revocation to the zoning that existed on the date of application. It
is, therefore, stipulated and agreed that either revocation due to the failure to comply with
any conditions, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation of the
Zone Change. The Zone Change enhances the value of the property above its value as of
the date the Zone Change is granted and reverting to the prior zoning results in the same
value of the property as if the Zone Change had never been granted.

Business Narrative – Dynamite Farm was in operation in Surprise AZ for a number of years
as an organic market farm producing about 40 varieties of fresh vegetables to farms
markets and private homes in the Greater Phoenix area. Primarily customers were from
the Weet side of Phoenix and many were within 5 miles of the farm. The farm was located
near 178th ave and Dynamite BLVD.
People with autoimmune diseases are a primary customer of clean organic fresh local
grown vegetables because they are clean of all chemicals and other elements that cause
medical issues.
We are moving our farm to this location so we can be in proper zoning as a C-2 Plant
Nursery. Our farm starts plants by seed and provides them to customers as small plant
starts or a harvested vegetables from our farm. Our farm is pure organic using “Back to
Eden” natural growing techniques (no chemicals, no pesticides, no fertilizer) producing
clean natural healthy vegetables.
We deliver our produce to other farms for their farmers markets. At this time we no longer
directly participate in local farmers markets, however our produce is provided to vendors
who are selling our products at farmers markets and other customers.

Requested Use:
The farm has historically been operated by one person Paul Thomas for the planting,
growing, and harvesting of all produce. Occasionally we will have one volunteer assist to
learn more about organic farming in Arizona.

Description/Location of buildings, screening, wall/fence details and location.
Our design intent is for the farm to appear as a classic farm barn building. We plan to have
8’ block wall fence around the property due to the problems we had with vandalism at our
previous location where we just had wire farm fence. This block wall fence will provide the
screening requested by the county.
We would like to request rather than have block wall at the front property line, we would like
to have traditional horse corral fence. There would still be block wall screening from the
corners of the building to screen everything from the building to the back of the lot.
This would add to the agricultural look and appearance of our site along the Wickenburg
corridor.
Additionally, we have designed our buildings to be traditional agricultural farm barn
buildings. We plan to add a 25’ tall faux farm windmill. The intent of our building and
landscape design is to reinforce our farm look and culture alone the Wickenburg corridor.

Parking Spaces –
We are requesting a waiver on parking spaces. Our current planned warehouse sq ft would
require about 44 spaces, however this is way to many for our use. We are requesting a
waiver to require only the minimum parking needed for the area of the buildings dedicated
to office use. With the planned size of the office (between 900 SF and 1,000 SF), this will
only require up to four parking spaces, although up to 15 will be provided.. We anticipate
around 2 to 5 customers a week visiting our site with mostly being only 1 customer on site
at a time.
Development Standards –
Due to low traffic volume and trip generation, we are requesting reducing the number of
parking spaces and waiving the sight visibility triangles. The frontage road pavement is set
well back from the property line, allowing sufficient visibility even without the SVTs.
Additionally, we request reducing the landscape setback required by the Scenic Corridor,
these regulations will be offset by the other aesthetic improvements that will be made to
the property. A 3ft hedgerow at the front of the property to screen parking headlights, a
windmill, and an equestrian barn appearance look to the building.

Relationship to Surrounding Properties -
This property is located on a Grand Avenue access road with all the properties along this
access road being designated C-2 for the front section of the property and R43 in the back.
We are requesting our lot be designated C-2 Plant Nursery.
Some of the existing neighboring lots are full of burned out buildings or junk. Others are
small businesses located in old buildings with their lots containing no screening and full of
materials or debris.
Circulation on and off site.
There would be daily entrance to the site in the early morning sunrise timeframe to check
irrigation and perform planting. Harvesting operation is primarily on Friday and would
result in 1-3 deliveries to our customers (farmers market vendors or customers). Very low
circulation on and off site is expected.
We plan to have concrete driveway from the road to the front gate and transition to asphalt
pavement for parking and onsite delivery truck access to the barn.
Development Schedule - Timeframe for Construction.
Our construction timeframe is as follows.
1. Site dirt work and elevation/drainage work. 0-2 months

We produce clean organic vegetables and plants to support the nutrition and health needs
of the local community. Locally grown allows vegetables to be much fresher and retain
healthy nutrients.
Maricopa County Comprehensive Plan Compatibility -
This property is within the City of Surprise’s municipal planning area; both the City’s
general plan and the County’s White Tanks / Grand Ave. area plan designate the site for
rural land uses, so the site is considered to be within a rural service area. It may be noted
that, since commercial plant nurseries and related uses are considered rural retail uses,
fewer urban services are required to support the proposed use than would normally be
required for commercial zoning. Generally commercial uses require connections to water
and wastewater service providers, direct access to adequate roadway infrastructure, and
service from fire and police services. Water connection will be provided by an established
water provider (West End Water Company), the WEWC connection will be ready at the time
of development. Due to the low number of employees and customers onsite, the
development can be accommodated on septic. Finally, the site will be served by
established fire and police districts (AFMA and MCSO, respectively) and have direct access
to the Grand Ave. frontage road, ensuring that the site will be served by the required
roadway and public safety infrastructure.

A Notice of Intent to Discharge application for a septic system is required for any
