The applicant requests a zone change from Rural-43 to IND-2 IUPD on 19.37 acres of vacant land located near the southwest corner of Broadway Rd. and Perryville Rd. in the Goodyear area. This request is not accompanied with a Plan of Development. However, the proposed zone change anticipates that future development will be comprised of light industrial manufacturing and assembly, and storage of equipment and goods for related uses. The proposed IUPD overlay would limit entitled land uses within the IND-2 zoning district such to prohibit more intense uses such as general industrial manufacturing, utility treatment and generating plants, cleaning plants, and packing houses. 2. Furthermore, the applicant is also proposing a deviation from solid screen wall requirements adjacent to residential zoning for the south end of the site. They are requesting chain-link fencing for this portion of the site since it is located next to a vacant parcel owned by the Southern Pacific Railroad Co. Additionally, they are also requesting to deviate from required side setback landscaping. Development will adhere to all other development standards of the IND-2 zoning district. The site will be served by a private well and a septic system. It is anticipated that development will take place in two phases. Precise details of the plans and operations will be submitted with Plan/s of Development (POD). 3. A pre-application meeting was held on December 9, 2025 to discuss a potential zone change for the subject site. On July 7, 2026 a Technical Advisory Committee (TAC) meeting was held with the applicant to discuss the review of the first submittal. Staff asked the applicant about the City of Goodyear’s position and feedback on the proposed development, and about outreach efforts particularly to residents west of the site. 4. The following table shows IUPD deviations from the base IND-2 zoning district. The applicant is increasing the minimum front setback requirement from 20’ to 30’ to coincide with the City of Goodyear’s standard. Additionally, the proposed deviation for chain-link fence in lieu of solid wall screening for the south property line is proposed due to the boundary’s adjacency to the railroad. The applicant has provided a will-serve letter from the Arizona Fire and Medical Authority which indicates that the subject site is within the service area of the Buckeye Valley Fire District. Additionally, the applicant has indicated the site is located approximately five miles from Buckeye Station 707. No response was provided regarding the distance from the nearest MCSO station. Regarding electrical service, there are transmission lines located along Perryville Rd within proximity to the site. 8. Furthermore, the City of Goodyear has informed the applicant that the subject site is not eligible for municipal services such as water and sewer since they are not within Goodyear’s jurisdictional limits. Therefore, the subject site will be served by a private well and septic system until such time that municipal services become available. Right-of-Way: 9. The following table includes existing and proposed half-width right-of-way and the future classification based upon the Maricopa County Department of Transportation (MCDOT) Major Streets and Routes Plan. Its existing classification is “Minor Arterial” with a half- width of 33’. Its future classification is “Parkway” and will require a dedication of 65’ as part of the proposed development. MCDOT has indicated that for the Plan of Development, a traffic study must also be submitted to and reviewed by the City of Buckeye and the City of Goodyear. Adopted Plans: 11. Maricopa County Framework 2040 Comprehensive Plan (adopted May 20, 2026): The subject site is located within the City of Goodyear’s municipal planning area (MPA) with a land use designation of “Business and Commerce”. Therefore, it is within a Municipal Influence Area and is deemed as being within an Urban Growth Area. Although the site does not currently have access to municipal services such as sewer and water, the services are clearly available but for the City of Goodyear’s policy of not extending services outside their corporate limit. Services may be possible in the future as the City of Goodyear’s limits expand and infrastructure is extended to these sites. 12. Until such time that municipal services such as sewer and water are available, certain types of industrial development may be appropriate such as power generation, energy storage, or other types of land uses that are not employee extensive and do not require water and wastewater services. This would align with Framework 2040’s Rural Service Area. 13. Regarding specific policies and goals from Framework 2040, staff identifies the following that the proposed zone change would achieve: Z260023 Page 10 of 14 • Land Use Policy 1.5 states that, “Maricopa County supports coordinating land use and infrastructure planning with state agencies, other counties, municipalities, relevant utilities, federal agencies, and other regulatory bodies”. Staff has received direct communication from the City of Goodyear regarding development standards for setbacks and landscaping, for which the applicant has agreed to implement. • Transportation Policy 1.1 indicates that, “ Maricopa County supports compliance with the County Department of Transportation’s currently adopted Transportation System Plan and its successor plans”. Because the site will be accessed along a future “Parkway” right-of-way, this aligns with this goal. • Transportation Policy 3.4 states, “Maricopa County supports partnerships with federal, state, and local governments and agencies for interjurisdictional traffic operations and management for the benefit of regional safety and mobility.” As previously indicated, a traffic study will be required to be submitted to and reviewed by the both the City of Buckeye and the City of Goodyear. 14. City of Goodyear General Plan: Growing Goodyear, Planning our Future (adopted May 21, 2024): The site subject has a land use designation of “Business and Commerce” which indicates “Light industrial uses such as business parks or employment centers are appropriate throughout the Business & Commerce category but should be buffered from residential uses or major transportation corridors”. Furthermore, the land use designation also indicates, “Uses, especially large footprint cross-dock warehousing or distribution centers that generate high volumes of truck trips or land uses that create significant noise, glare, air contaminants, etc., are not appropriate in this category and should be located within the Industrial Category”. 15. Nevertheless, the City of Goodyear did not express opposition but provided a list of conditions that should be implemented by the applicant. Public Participation Summary: 16. The applicant complied with or exceeded the county’s minimum public notification requirements. A communication from one resident within 300’ of the site was received. He expressed a desire to see development occur on the opposite side of Highway 85. A follow up communication took place where the resident also expressed a desire to see more parks and amenities within the area. It was explained to the resident that the proposed zone change is private development proposal pursued being pursued by a private property owner. Outstanding Concerns from Reviewing Agencies: 17. The City of Goodyear has provided a list of conditions consistent with their standards pertaining to architectural design, landscaping, and building setbacks. The applicant has agreed to implement these conditions as part of the IUPD overlay. There are no outstanding concerns from county review agencies in that Planning staff is recommending condition that the IUPD limit entitled uses to only those that can accommodate wastewater disposal via onsite septic system until such time that the site is served by sewer; and a separate condition that the property owner agrees to annexation into the City of Goodyear should it become available at any future time. This is intended to prevent a permanent county island. Z260023 Page 11 of 14 Staff Analysis: 18. IND-2 IUPD zoning change with overlay with the recommended conditions for several reasons. The applicant anticipates PODs for future land uses such as warehousing, storage, and distribution operations that are not employee intensive and that can be supported by well and septic until such time that municipal services are available to the site. The proposed zoning aligns with the City of Goodyear’s Business and Commerce land use designation. The site is accessed via a county-maintained minor arterial with a future classification of “Parkway” and will be near the future SR-30 freeway. 19. Although the present character of the area is rural and agricultural, potential expansion of this type is limited and unlikely. The area to the south is along the railroad. This and proximity to the future SR30 freeway create opportunities for industrial, warehousing, distribution and logistics land uses. Such uses would be in concert with the City of Goodyear’s Business and Commerce land use designation. The IUPD will limit entitled use until public water and sewer is available to the site. 20. The IUPD’s deviations are reasonable. The City of Goodyear has provided a list of conditions which the proposed IUPD will implement. 21. Staff’s recommendation for approval includes requirement for a pre-annexation utilities services agreement. It is understood that initial industrial development may be uses that are more employee extensive and that do not necessitate sewer services. However, industrial development within an urban growth area should ultimately annex into the municipality to ensure an urban level of services for urban development. Recommendation: 22. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve Z260023 subject to the following conditions ‘a’ – ‘i’: a. Development of the site shall be in substantial conformance with the Narrative Report entitled “Perryville Industrial”, consisting of 24 pages, dated August 31, 2026, and stamped received August 31, 2026 except as modified by the following conditions. b. If the City of Goodyear requests to annex the property, the property owner will agree to annexation and cooperate in the annexation process, provided that the property will retain the development rights and use permissions existing prior to annexation. c. The following IND-2 IUPD standards shall apply: 1. Min. front setback: 30’ 2. Min. screening: Chain-link or similar fencing adjacent to the railroad and related uses. 3. Min. landscaping: None required within side setbacks. 4. Other landscaping a. A minimum 5-foot-wide landscape planter shall be provided along building walls facing the street, increasing to 10 feet at main entries and office areas to soften the building mass. b. A minimum 30-foot wide landscaped area shall be provided along the site frontage. Any required setback area adjacent to a street must be entirely landscaped, excluding necessary driveways. Z260023 Page 12 of 14 c. Landscape islands are required at a minimum width of eight (8) feet, containing at least one (1) tree and three (3) shrubs per parking stall length. 5. Uses: a. Shall be limited to only those acceptable to the Planning & Development and Environmental Services departments for wastewater services via onsite septic systems until such time that the site is served by sewer. b. Prohibited uses: I. General Industrial Manufacturing II. Cleaning Plants, including carpets and dyeing III. Utility Treatment and Generating Plants IV. Farms V. Food Production VI. Packing houses, fruits or vegetables VII. Adult Oriented Facilities VIII. Data Centers with or without compensatory power generation d. The site is within the statutorily defined Territory in the Vicinity of a Military Airport. All buildings shall be subject to noise attenuation as per ARS § 28-8482(B). e. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. f. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the zone change. The zone change enhances the value of the property above its value as of the date the zone change is granted and reverting to the prior zoning results in the same value of the property as if the zone change had never been granted. g. The following Planning Engineering conditions shall apply: 1. A plan of development (POD) is required for this development. Grading and drainage plans, drainage report and a traffic impact study is required with the POD. 2. The site is in a Special flood hazard zone AH, therefore, compensatory volume is required when developing within this type of FEMA flood zone. 3. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Z260023 Page 13 of 14 Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 4. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 5. Maricopa County does not supply water, fire or sewer services. It is the applicant/owner’s responsibility to coordinate and secure water, fire and sewer services for this site. Along with emergency vehicle ingress/egress to site and structures. 6. Sealed final Grading and Drainage (Site Infrastructure) Plans and Sealed Final drainage report must be submitted with the application for Building Permits. h. The following Maricopa County Environmental Services Department (MCESD) conditions shall apply: 1. A Notice of Intent to Discharge application for a septic system is required for any construction. Application must be submitted to the MCESD Onsite Wastewater Program. a) Wastewater is not permitted to discharge to an adjacent parcel’s septic system. b) If conducting food service in unincorporated Maricopa, a grease trap will be required by Onsite Wastewater program. c) Setback requirements must be maintained per Arizona Administrative Code, Title 18, Chapter 9, Article 312, C (Features Requiring Setbacks). i. The following Maricopa County Department of Transportation (MCDOT) conditions shall apply: 1. Perryville Road is classified as an urban principal arterial requiring fee dedication of a 65- foot half street from the section line per the Maricopa County Zoning Ordinance Section 804. a) It is the developer's responsibility to determine if the existing right of way is fee simple, if it is not then the developer will need to provide the right of way in said form. b) Applicant is required to provide, at applicant’s expense, an American Land Title Association (“ALTA”) Owner’s Policy of Title Insurance showing title vested in Maricopa County, a political subdivision of the State of Arizona. c) Dedication shall be completed by time of permit approval. 2. The above comments do not include identification of utilities or underground facilities within or adjacent to the required right-of-way that may have prior rights and/or require relocation. Any additional dedication and offsite improvement requirements will be determined by MCDOT Traffic based on a submitted TIA/TIS and the above roadway classifications. a) If a TIA/TIS has been previously submitted, approval is valid for one year. If review for construction is not underway within this time period, MCDOT may request an updated traffic report to assess any changes in condition. 4. This project is located within or adjacent to a programmed MCDOT Transportation Improvement Program (TIP) Project TT0640 – South Arterials Polymer Modified Preservation. The Property is generally located approximately 4 miles south of I-10, and 2 miles west of South Cotton Lane at the nexus of Buckeye and Goodyear’s municipal planning areas. Vicinity Map This application will change the zoning from Rural-43 (RU-43) to General Industrial Zoning District (IND-2) with Industrial Unit Plan of Development (IUPD) overlay to allow for the development of a low-intensity industrial use project, including light manufacturing and assembly, (the “Project”). The development, as envisioned, would include industrial buildings, and paved yards for equipment, goods, and material storage while implementing appropriate screening measures for such uses. These proposed uses would be ideally situated in close proximity to the SR-30 alignment – planned just south of the site – to accommodate the transportation of goods made or stored on the Property. These uses are also compatible with the planned build out of the 2 | P a g e surrounding area in the County between Buckeye and Goodyear with a rail line bordering the Property to the south. In particular, it is within Goodyear’s municipal planning boundary and designated for the Business & Commerce land use designation, which allows for a variety of industrial uses while recognizing the need for appropriate buffers and separation from existing and planned residences. Project Location The IUPD overlay is requested to allow for minor deviations from the IND-2 development standards associated with the Project’s adjacency to the Southern Pacific Railroad on the south of the Property. The IUPD will also restrict and remove the most intensive manufacturing uses otherwise permitted under the IND-2 zoning district, as defined as “Industrial Manufacturing – General” per Chapter 2 of the MCZO to increase compatibility with the surrounding area. This application includes a Conceptual Site Plan, included as Exhibit 1 with this narrative. A precise plan of development will be submitted after the rezoning process is completed. Description of Proposal The proposed Project is envisioned as a phased industrial development intended for a variety of industrial and commercial uses permitted under the IND-2 zoning district. The Conceptual Site Plan envisions two industrial buildings with associated parking, and paved 3 | P a g e outdoor storage areas. The Property is uniquely positioned for this type of development due to its limited frontage, size, adjacency to rail, and position within the Luke Air Force Base (“LAFB”) Graduated Density Concept (“GDC”). The limited frontage and access restrict the possibility for commercial retail development on the Property. The existing and planned development pattern along the Southern Pacific railroad alignment in the vicinity of the Project is consistent with the industrial rezoning. While there are no planned connections to rail at this time, the proximity to the railroad road may be beneficial in the future and influences the overall character of development in the area. The Property is near planned regional transportation improvements, including the SR-30 West segment, proposed just south of Broadway Road and north of Historic US 80, with construction expected to begin in 2046. The SR-30 Center segment is nearby to the east and scheduled for completion in 2033. Loop 303 is also planned to connect to SR-30 at the western edge of the SR-30 Center segment, with portions of that work starting in 2025. Together, these long-term investments support the Project’s industrial use and are shaping land use patterns in the surrounding area. Relation to 303 and SR-30 Improvements The Project is anticipated to be developed for light to medium industrial uses utilizing the Property for warehousing, storage, and wholesale distribution – but will allow for a variety of IND- 2 uses) (See Exhibit 2 – Comparative Use Table). Any future precise plan of development (“POD”) submitted for the Property will be in conformance with the uses and development standards of this document and associated County approvals. Per section 702 of the Maricopa County Zoning Ordinance (“MCZO”), the IUPD will be utilized to limit the entitled uses and allow for variations on the development standards of the Property. This application will remove the more intensive 4 | P a g e industrial uses from the Property while retaining light industrial uses including light manufacturing and assembly to limit the intensity and scale of development on the Property. Given the anticipated scale and character of development, the Project can be appropriately served by on-site water and wastewater systems. The proposed on-site well and septic systems will be evaluated and designed to accommodate the ultimate building sizes, occupancy, fixture counts, and wastewater flows associated with final site design at POD submittal. Uses that would require additional water or wastewater capacity would be required to demonstrate adequate infrastructure capacity through the POD process, or future availability of municipal or private infrastructure to the site. Relationship to Surrounding Properties The Property is currently a vacant parcel that fronts onto Perryville Road – at the western boundary of Goodyear’s municipal planning area, and the eastern boundary of Buckeye’s municipal planning area. The surrounding land uses are described in the table below. Significant IND-2 acreage exists just ¼ mile west of the site within Maricopa County – with approximately 105 acres at the northeast corner of the intersection of Jackrabbit Trail and the railroad. As shown on the below figure, both Goodyear and Buckeye’s general plan land use maps reflect the employment and industrial nature of the area, with significant development already constructed along the Cotton Lane alignment east of the Property. These land use patterns will be supported by the regional planned transportation routes of SR-30 and Loop 303 in coming years. 5 | P a g e Project Context The Property is approximately 2.8 miles from the LAFB 65 LND noise contour, and as such falls within the 1-3 mile guidance of 0-6 dwelling units per acre. Combined with the adjacency to the planned regional transportation routes, the location of the Property within the GDC will continue to inform the development patterns of the general area in the future – supporting the movement of goods from various industrial activities along newly established transportation corridors. Existing residences in the greater vicinity are located largely north of Broadway Road within Goodyear’s jurisdiction. However, several county residences are located west of Perryville Road across the street from the Project along Chipman Road. In addition to the residences, there appear to be other rural and agricultural uses located along this section of Chipman Road. The Project is not expected to negatively impact these existing rural residential uses in the area, and the proposal is not a departure from future land use plans for the surrounding area. As noted in the Context Map above, this community is already surrounded by planned industrial/employment areas to the east and west that will be connected by the future SR 30 as well as the railroad line.. This Project utilizes the IUPD mechanism to establish increased setbacks along Perryville Road to further compatibility with existing land uses in the vicinity. As shown on the conceptual site plan, the intent is to develop the Property as a light industrial and storage yard site with small-scale industrial buildings, which can be serviced by on-site well water and septic. Permitted and Prohibited Uses This application will permit all uses under the IND-2 permitted use list per Chapter 6 – Zoning Districts Uses Table, Accessory Uses and Use Standards and Conditions of the Maricopa County Zoning Ordinance (12.10.2025) except that the following uses are prohibited: 6 | P a g e • Industrial Manufacturing - General • Cleaning Plants, including carpets and dyeing • Utility Treatment and Generating Plants • Farms • Food Production • Packing houses, fruits or vegetables • Adult Oriented Facilities A comparative use table is included as an exhibit to this narrative (see Exhibit 2). Development Standards The Project will comply with the general requirements for development within the county’s industrial zoning districts. Modifications are implemented to deviate from the standard screening requirements on the southernmost property boundary, due to the existence of the railroad and no sensitive uses at this location. Additionally, the front setback has been increased from 20 to 30 feet, in recognition of the City of Goodyear’s development standards. Walls and Perimeter Screening The Project will follow the wall and perimeter screening requirements in Section 506 of the MCZO as they pertain to the IND-2 district, except that an alternative requirement is proposed for the southern boundary of the site. The adjacent parcel to the southern property line is owned by Southern Pacific Railroad and has an existing railroad. As such, that parcel is not considered a sensitive use that would require screening otherwise required for industrial zoning districts in the 8 | P a g e County. The Applicant proposes a minimum 6 foot high chain-link or similar fence along this property line. Additional screening requirements are noted below – modeled after the section 506 standards: • Adjacent to any rural or residential zone, automobile parking shall be screened from view, except along the southern property line. • External facing access gates shall be constructed of view-obscuring material to provide effective site screening. • The perimeter of any portion of the site which any outdoor use of any industrial nature is permitted shall be enclosed to a height of not less than six feet by building walls, walls or fences of any view-obscuring material, except along the southern property line where open wire fencing is permitted as an alternative. • No outdoor industrial use or enclosure thereof shall encroach into any required setback area adjacent to any street, nor shall any storage products or materials exceed the height of any such enclosure. Fencing, walls, circulation and retention may be developed within the perimeter setbacks of the Property, except that the landscape setback along Perryville Road will be maintained as a landscape buffer along the frontage. As noted through this narrative, the deviation from standards IND-2 screening requirements on the south portion of the Property, are due to the unique circumstance of the Southern Pacific Railroad parcel adjacent to the Project. The configuration of this parcel places an existing railroad approximately 300 feet from the southern property line and provides approximately 400 feet of separation to existing and future uses south of the Property. As such, the standard screening requirements adjacent to RU-43 are not necessary. 9 | P a g e Conceptual Site Plan Location and Accessibility Site access will be established from Perryville Road, classified as a minor arterial with one lane in either direction. Perryville Road is the only adjacent road to the Project. Access to the proposed internal phases and future lots will be established from a private drive with gated access easements. The southern parcel boundary abuts a parcel owned by Southern Pacific Railroad and has an existing train track located roughly 300 feet from the property line, and there is a rail crossing of Perryville Road south of the Project. Circulation System Offsite circulation was analyzed through the TIS which has been submitted to the County with this rezoning application. All access to the Project will come off of Perryville Road, and access will align with Chipman Road. Onsite circulation is proposed through a shared access road that will service the various uses on-site. 10 | P a g e Development Schedule The Project is anticipated to be developed in phases. Two conceptual buildings are proposed as shown on the Conceptual Site Plan. After rezoning approval, a precise POD will be submitted for the Project. Storm water detention is anticipated to be provided along the southern property line and is depicted on the Conceptual Site Plan. The Property is partially within FEMA Zone “AH” and Zone “X.” To address floodplain concerns, a detailed hydrologic and hydraulic analysis will be conducted to design appropriate mitigation measures. These may include grading adjustments, stormwater detention basins, and elevated FFEs as required by the future POD process and associated engineering plans and reports. Consistency with IUPD Criteria The IUPD request is consistent with the County’s criteria of approval under the conditions set forth in Article 702.6 of the MCZO. The use(s) of the site will conform to the permitted uses as listed in the use regulations of the zoning district in which it is located. All uses within the IUPD are permitted within the underlying IND-2 Zoning District. The IUPD will only remove, not add, potential uses from the IND-2 permitted use list. The proposed development will not adversely affect adjacent properties or the permitted uses thereof. The proposed development will not adversely affect adjacent properties. The Project is located adjacent to ROW, agricultural uses, vacant land, and a parcel owned by Southern Pacific Railroad. The closest residential uses are located west of Perryville Road. The Property will be 11 | P a g e fully screened with a 6-foot wall per the IND-2 standards on the North, East, and West sides of the property. No screening will be required along the southern property boundary, due to the adjacent railroad running parallel to that property line. The proposed development was designed, and will be constructed, in a manner consistent with sustainable development practices. The Project is intended to accommodate low-water usage. All construction will meet current codes and standards. For a site subject to an IUPD, the project will have access to a major street or highway, rail service or other means of transportation. The Property will have one access point on Perryville Road. The Project will provide a 65- foot half-street ROW on this roadway along the western boundary of the site and will construct the half-street roadway cross-section per MCDOT’s requirements along this frontage. A Traffic Impact Statement (TIS) is submitted with this application under separate cover for review by the County. Additional traffic reports may be required pending a future POD submittal for the Property. For a site subject to an IUPD, the project will not adversely affect the public health, safety, and general welfare by causing or producing objectionable effects that would impose hazard to adjacent or other properties by reason of smoke, soot, dust, radiation, odor, noise, vibration, heat, glare, toxic fumes or other undesirable conditions. The Project will not adversely affect the public health, safety, and general welfare of adjacent properties. The Property is located away from sensitive uses – with significant separation from existing residential uses. Through the exclusion of heavy industrial uses, setbacks and screening, the IUPD will ensure compatibility with the surrounding area. All uses will be subject to the standards use standards of the MCZO and will not produce hazards on surrounding properties. Compliance with Comprehensive and General Plans Maricopa County There is no land use category assigned to the Property under the Maricopa County Comprehensive Plan. – Framework 2040 (the “Comprehensive Plan”). The Project is consistent with the Urban Solutions for Urban Development (USUD) Strategy of the Comprehensive Plan, as informed by the Municipal-Rural Influence Framework. The Project is located within an Area of Municipal Influence – specifically within the Goodyear Municipal Planning Area – and should be evaluated based on the infrastructure requirements of the USUD strategy. As such, this application includes information regarding the infrastructure readiness of the site, as detailed below: 12 | P a g e Water and Sewer (Wastewater): The Property is currently located outside of an incorporated municipality and is not eligible for annexation due to lack of contiguity. The property owner was informed by City of Goodyear that the Property was not eligible for municipal water or wastewater service while in unincorporated County jurisdiction. The proposed development therefore will utilize private well and septic systems as an interim and site-specific means of providing the necessary services. Should municipal or private water or wastewater infrastructure become available to the Property in the future, the Applicant would evaluate connection to such systems in accordance with the applicable requirements of the serving jurisdiction. This evaluation may be tied to annexation opportunities as development in the area progresses. The Applicant acknowledges that any increased infrastructure needs for other uses would need to be addressed through the POD or future POD amendment process. Roads (Transportation): The Property fronts Perryville Road and will construct required half-street improvements along its frontage in accordance with MCDOT standards – to be determined at the POD phase of the project. Primary access is provided directly from Perryville Road and aligns with the planned Chipman Road intersection. A Traffic Impact Statement has been submitted demonstrating the transportation impacts of the proposed development and will be subject to revisions at the time of POD submittal and review. In addition, the Property benefits from its proximity to the planned SR-30 corridor, Loop 303, and the adjacent Southern Pacific Railroad, making the site particularly well suited for industrial and employment uses. While some of these regional transportation projects have a long development horizon, this Project seeks to locate appropriate uses to where future transportation infrastructure is planned. Flood Control: The Project will incorporate on-site stormwater detention facilities and will address floodplain conditions through future engineering analysis and design. Development of the Property will comply with FEMA requirements and applicable County drainage standards through preparation of detailed hydrologic and hydraulic studies during the Precise Plan of Development process. Existing irrigation infrastructure adjacent to Perryville Road will be relocated or improved as necessary to accommodate development. Police and Fire Service: Emergency services will continue to be provided by the Arizona Fire & Medical Authority (AFMA) and the Maricopa County Sheriff's Office, consistent with existing service responsibilities in the area. The proposed industrial uses are expected to generate service demands comparable to other employment developments planned throughout western Maricopa County and will not require the establishment of new public safety facilities. Two fire stations exist in proximity to the Project; Buckeye Fire Station 707 is approximately 5 miles to the Northwest, and Goodyear Fire Department Station 184 is approximately 5 ½ miles to the Northeast of the Project. A will-serve letter from AFMA has been submitted to the County with this application. Dry Utilities: The Project will finalize its dry utility providers at POD approval. Providers are anticipated to include: 13 | P a g e • Electric: Arizona Public Service • Natural Gas: Southwest Gas or Kinder Morgan • Telephone: Lumen or Century Link • Refuse: Private hauler utilizing the Rainbow Valley Transfer Station & Northeast Regional Landfill Annexation: Annexation is not proposed at this time because the Property is not currently contiguous with incorporated municipal property. The Applicant will continue to monitor opportunities for future annexation as surrounding properties develop, and municipal boundaries and infrastructure are extended in the area. If annexation becomes feasible and appropriate in the future, the Applicant will evaluate annexation and connection to available municipal services consistent with the requirements of the applicable jurisdiction. The Project supports the goals and policies of the Comprehensive Plan. Specific goals and policies are noted below: Economic Growth Goal #1: Foster a diverse and balanced economy to promote ong-term economic stability and economic resiliency. The request promotes economic diversity in the County by introducing industrial land uses that complement existing and planned development in the area. Bringing employment uses to currently vacant land will support the long-term economic stability and vitality of the County. Economic Growth Goal #2: Support the growth of opportunity in the local and regional economies. The proposed general industrial zoning will facilitate employment-generating land uses that contribute to the regional economy by providing opportunities for industrial and business development. Such uses support regional economic function by accommodating logistics, manufacturing, and other employment-based activities. Land Use Goal #1: Achieve a coordinated pattern of development. The proposed rezoning supports a coordinated pattern of development by recognizing the Property’s location within an area planned for a transition toward employment and industrial uses. While the immediate vicinity includes agricultural, rural residential, and vacant properties, the Property is within the Business & Commerce land use designation of Goodyear’s General Plan, which includes unincorporated areas as part of its municipal planning area. This designation supports employment and light industrial uses, consistent with the proposed Project. As such, this rezoning implements planned land use for the Property rather than an isolated introduction of industrial uses. The Property’s adjacency to the Southern Pacific Railroad, proximity to existing industrial and employment areas, and location relative to planned regional transportation improvements support its suitability for employment and industrial uses. 14 | P a g e Additionally, the IUPD will act as a mechanism to manage the transition between the planned employment uses and existing rural properties by removing higher-intensity industrial uses, increasing the Perryville Road setback, and establishing tailored screening and development standards for the Project. This coordinated pattern of development is additionally supported by the adjacency to the Southern Pacific Railroad. While the railroad parcel is zoned RU-43, it is used solely for rail transportation, and its alignment within the area has created a corridor for industrial and employment uses within Goodyear and Buckeye. The broader land use pattern contemplated for the area in conjunction with the Project supports the Comprehensive Plan’s goals for a coordination pattern of land uses and development. Cost of Development Goal #3: Require that new development pays its proper and reasonable share of the costs of new infrastructure, services, and other public improvements. Development of the site will be responsible for providing or contributing to necessary infrastructure improvements, ensuring that the Project does not create an undue fiscal burden on the County. Specifically, the Project will complete half-street improvements along Perryville Road. Goodyear In addition to supporting the policies and goals of the Comprehensive Plan, the Project is generally compatible with the underlying land use as envisioned in Goodyear’s Municipal Planning Area. The Property is assigned the Business and Commerce land use designation under the Goodyear General Plan – 2035 (“General Plan”). Light Industrial Park (I-1) zoning is permitted under this land use designation which, in turn, allows for a variety of manufacturing, assembling, processing, and outdoor storage uses under the Goodyear Zoning Ordinance (Section 3-4-1). To ensure compatibility with the City’s established development character (as the development is within the Goodyear Municipal Planning Area) and the high-quality design expectations for employment areas, the City requests that the following standards from the Goodyear Zoning Ordinance and Industrial Design Guidelines be incorporated as stipulations of approval. 1. Perimeter Screening and Walls To mitigate visual impacts on surrounding properties and rights-of-way, the City requires robust perimeter screening: North, East, and West Boundaries: A solid masonry wall is required. These walls must be at least six (6) feet in height, and taller if outdoor storage or truck courts are contemplated. The site is adjacent to residential districts, thus the wall should be constructed of slump block, brick, or masonry with a stucco or mortar wash finish designed to match the main building. Railroad Adjacency: The City would not protest chain-link fencing along the boundary adjoining the railroad right-of-way. 2. Frontage Landscaping Standards High-quality landscaping along the street frontage is essential to maintaining Goodyear’s community image: Depth and Coverage: A minimum 30-foot wide landscaped area shall be provided along the site frontage. Any required setback area adjacent to a street must be entirely landscaped, excluding necessary driveways. Planting Density: Landscaping must include at least one (1) tree for every thirty (30) feet of street frontage to provide shade for adjacent sidewalks. Visual Softening: A minimum 5-foot-wide landscape planter should be provided along building walls facing the street, increasing to 10 feet at main entries and office areas to soften the building mass. 3. Architectural Treatment Requirements The proposed industrial structures should avoid a "big box" or monotonous appearance through the following treatments: 2 Massing and Articulation: All structure elevations must implement massing reduction techniques, including a lateral shift or offset in the facade of at least two (2) feet. Rooflines and parapets on buildings exceeding 100 feet in length must incorporate vertical variation or horizontal offsets at intervals not exceeding 50 feet. Materials: Consistent architectural treatment is required on all four sides of the building. For buildings with metal or steel exteriors, these surfaces must be architecturally altered through the use of veneers or facades (stone, brick, or stucco) to minimize metal surfaces visible from the street. Tilt-up Construction: Any pre-cast or tilt-up concrete walls shall incorporate reveals, recessed panels, or other architectural features to provide texture and relief. 4. Parking Lot and Circulation Design The City seeks to ensure parking areas are safe, functional, and well-screened: Screening: Parking areas must be screened from street view by masonry walls or berms with a minimum height of three (3) feet. It is the developer’s responsibility to ensure that car headlights are screened from facing toward any nearby residential development. Internal Layout: Public and visitor parking areas must be physically separated from truck delivery, maneuvering, and staging areas. Customer parking should be located near the main public entry and away from loading docks.
