Purpose and Recommendation 
 
The purpose of this report is to request Council approval of a Right of Way Occupancy 
License (License) for MMR Fiber Solutions Communications, LLC (MMR Fiber Solutions) 
for an initial five-year term, with one automatic five-year renewal, provided the licensee is 
not in default. 
 
Staff recommend that the Council authorize the City Manager to execute this License on 
behalf of the City. 
 
Background & Discussion 
 
MMR Fiber Solutions has applied for a License to work within the City’s rights-of-way and 
easements to install, operate, and maintain an underground dark fiber optic cable 
communications network to support business connectivity. 
 
Alternatives 
 
City Council could consider different licensing language.  Furthermore, City Council could 
choose not to authorize this license.   
 
Fiscal Impact 
 
The City has received a $4,000 license application fee, which covers the City’s cost for 
processing the license. There will be an annual ROW Underground Conduit Fee of $1.89 
per lineal foot of the City’s rights-of-way occupied for a dark fiber network, with a CPI 
escalator applied each year.
