CALL TO THE PUBLIC
Citizens desiring to speak on any issue within the jurisdiction of the public body may do so
at this time. Comments shall be limited to three (3) minutes per person and shall be
addressed to the City Council as a whole. At the conclusion of the Call to the Public,
individual City Council Members may (1) respond to criticism made by those who have
spoken, (2) direct staff to review or follow up on the matter, and/or (3) direct that the
matter be put on a future agenda.
Jimmy Farley with Coco's Towing stated that they distributed 445 cases of water this year.
He thanked the Fire and Police Department for their continued support over the years. 
Brent Peak, a citizen, shared his concerns about the Rinchem warehouse in Surprise and
its potential effects on El Mirage residents. 
Ashlee Palmer, a citizen, shared her concerns about the ICE detention center located in
Surprise. 
Allyssa Estavillo, a citizen, shared her concerns about the ICE detention center located in
Surprise.
Miguel Santiago Ramirez, a citizen, shared his concerns regarding FLOCK cameras and

automatic license plate readers. 
Anthony Ante, a resident, shared his concerns regarding data centers and FLOCK cameras. 
James Ellis, a citizen, stated he submitted a public records request for the city's flock audit
assistance logins and internal audit logins and has not received any correspondence from
the El Mirage Police Department or the Mayor. 
Jason Chavez, a citizen, expressed concerns about FLOCK cameras, the ICE detention
center, and the Rinchem warehouse.
Jenny Collier, a citizen, shared her concerns regarding the Department of Homeland
Security detention center in Surprise. 
Pablo Ante, a resident, stated there are cracks and holes on Frio Street between Soledad
Street and Ash Street all the way down to Luna Street and Thunderbird Road. There is no
street lighting, which is a safety issue. He also expressed concerns regarding the ICE
detention center and the FLOCK cameras. 
 
5.
CONSENT AGENDA 
All items listed under the Consent Agenda will be voted on with one motion. If discussion
is desired regarding any Consent Agenda Item, that item will be removed from the
Consent Agenda and voted on separately.
 
1.
Consideration and action to approve the minutes of the Work Session and Regular Council
meeting held Monday, August 17, 2026. (City Clerk)
 
2.
Consideration and action to adopt Resolution R26-09-18 authorizing the City of El Mirage
to enter into an Intergovernmental Agreement (IGA) with Maricopa County to accept
$436,547 in Community Development Block Grant (CDBG) funds administered by the
Maricopa County Human Services Department. (Administration)
 
3.
Consideration and action to authorize the City Manager to enter into a contract with
HiveTechnology Inc. for project management software and approve the purchase in an
amount not to exceed $32,080 for fiscal year 2027. (Administration)
 
4.
Consideration and action to accept a Vehicular Non-Access Easement for the Castle Steel
property, located at 12210 W. Olive Avenue, El Mirage, Arizona 85335, restricting
vehicular access across designated portions of the property’s Olive Avenue frontage.

5.
Consideration and action to approve three Maps of Dedication for City properties.

6.
Consideration and action to approve Contract EM26-CSM01 with Jani-works for custodial
services for City facilities in an annual amount not to exceed $139,428 for FY27 through

Vice Mayor Parsons moved to approve Consent Agenda Items 5.1 to 5.6,
seconded by Councilmember Dorcey.

Consideration and action to authorize the City Manager to enter into budgeted goods and
services contracts, according to the attachments, to allow Public Works to perform their
duties during FY 26/27. (Public Works)
Nick Russo, Public Works Director, presented the background on a continuation item of
regular goods and services that was presented earlier in the summer. Public Works makes
numerous purchases throughout the year, including many goods and service contracts that
require council approval. Public works seeks opportunities to use state or municipal
contracts to reduce solicitation costs and gain purchasing efficiency through volume. All
purchases comply with the city's purchasing code, section §30.23. There are four services
listed for this council action: electrical repairs for well sites and water reclamation facility,
replacement trash receptacles, wastewater plant pumps and motors, and environmental
compliance reporting and data management. 
Councilmember Eldridge asked whether trash receptacles are on hand, how many are
available, how many will be purchased, and if the resident damages the receptacles, how
it will be mitigated. Mr. Russo stated that there are 84 trash cans available, that the
projection is to purchase 1,200 cans per year, and that there is a fee schedule for trash
receptacle replacement, but it is uncommon for residents to destroy the trash cans. 
Councilmember Norton-McDaniel asked whether the rates are comparable to previous
years, whether these are the same companies we have used in prior years, and whether
we charge the sanitation company for disposing of trash cans if they are at fault. Mr.
Russo stated that most goods and services have increased in price due to inflation, and
the wastewater pumps have seen the largest increase due to supply chain issues. These
are the same companies used in past years and are familiar with our sites. Mr. Russo was
not aware of any instances in which the sanitation provider disposed of trash receptacles. 
Councilmember Gentry asked if there have been a lot of electrical repairs. Mr. Russo
stated that the request for $40,000 in water and $25,000 in wastewater is based on the
previous year's repairs. 
Vice Mayor Parsons moved to authorize the City Manager to enter into budgeted
goods and services contracts, according to the attachments, to allow Public
Works to perform their duties during FY 26/27, seconded by Councilmember
Dorcey.

Consideration and action to convene as the Board of Adjustment for the purpose of holding
a Public Hearing to consider variances for the property at 14206 N. Palm Street, El Mirage,
AZ 85335 (APN 501-28-050B) from Section 154.053 – Zoning Standards of the Mixed
Urban (MU) District to: 1) allow an existing lot width of 31.5 feet where 40 feet is required;
and 2) allow a proposed 9-foot rear setback where 10 feet is required. (Development
Services)
Vice Mayor Parsons moved to convene as the Board of Adjustment for the
purpose of holding a Public Hearing to consider variances for the property at
14206 N. Palm Street, El Mirage, AZ 85335 (APN 501-28-050B) from Section
154.053 – Zoning Standards of the Mixed Urban (MU) District to: 1) allow an
existing lot width of 31.5 feet where 40 feet is required; and 2) allow a proposed
9-foot rear setback where 10 feet is required, seconded by Councilmember
Dorcey.

Jose Macias, Senior Planner, presented a variance request for a single-family dwelling

located at 14206 N. Palm Street in El Mirage. The applicant is seeking approval of this
variance for an existing dwelling that is classified as legal nonconforming because it does
not comply with current zoning standards. The property measures 3,565 square feet, is
located within the mixed-use urban zoning area, and is included in the Downtown
Revitalization Plan and Opportunity Zone. The lot is currently vacant, and the property
owners are prepared to proceed with demolishing the existing structure and constructing a
new single-family dwelling. The lot does not meet the current zoning standards, and the
proposed new home does not comply with the rear setback requirements. A variance is
required for the property owner to proceed with the home's reconstruction. Staff and the
Technical Advisory Committee (TAC) have thoroughly reviewed the application and
determined it is appropriate to proceed with public hearings. The stipulation requires that
the applicant proceed with the construction of the residential dwelling within six months
of approval. One letter and one phone call were received for public comment, and neither
expressed support for nor opposition to the project.
Mr. Martinez stated that the lot was purchased 10 years ago and that he would like to
build a house on it.
Jeff Lach, resident, asked if this was a one-time setback for this lot only. He stated that he
owns a building with a 20-foot setback and has been unable to build on it due to the
easement.
Justin Pierce, City Attorney, stated that when a variance is requested by the Board of
Adjustment, it is for a specific lot. Additional properties would have to go through the same
process. 
Councilmember Dorcey asked whether the house would face east or west. Mr. Macias
stated the house would face east toward Palm Street.
Councilmember Eldridge asked whether the house would affect the alleyway. Mr. Macias
stated it would not affect the alleyway.
Mayor Hermosillo closed the public hearing at 7:02 p.m.
Councilmember Norton-McDaniel stated that, based upon what the law says in regard to
when the Board of Adjustment can and cannot legally grant a variance, this is not
something that, according to the statute, would apply for a variance to be granted. 
Mr. Pierce stated that, after significant research into whether the requested variance
would be self-imposed, the determination ultimately rests with the Board in this case. The
fact that, as it currently exists, it is non-conforming and the proposed use and proposed
changes bring it closer to the current standards.
Councilmember Dorcey stated that this project falls within the realm of what's reasonable
and would not be a detriment to anyone in the neighborhood. 
Mayor Hermosillo stated that the project's intent is to reinvest not only in the property but
also in the neighborhood. 
Councilmember Gentry asked whether the Board would be in violation of the statute if the
variance was approved. Mr. Pierce stated it would be defensible if the Board chose to grant
the variance.
Mayor Hermosillo moved to approve the requested variance for 14206 N. Palm
Street, APN 501-285-050B, to allow the existing 31.5-foot lot with a proposed
9-foot setback, seconded by Councilmember Dorcey.

7.
CITY MANAGER'S COMMENTS & SUMMARY OF CURRENT EVENTS
The City Council may not act upon any matter in the City Manager's summary, but may
have general comments or questions.
Crystal Dyches, City Manager, shared updates regarding community events, 75th
Anniversary activities, resident reminders, and upcoming Council Work Sessions. The El
Mirage Job Fair held on August 24, 2026, was very successful. The El Mirage Cares
Candlelight Vigil will be on September 18, 2026; the Fall Fiesta is on October 22–24,
2026; and the 75th Anniversary Parade is on October 2, 2026. Resident reminders
included that fall bulk trash registration is now open and that there is one more free swim
and gym on Sunday at the YMCA on September 6, 2026. Residents can follow what is
being built and capital projects through the city's interactive development tools. Upcoming
Council Work Sessions include: September 15, 2026, E-Bikes and E-Scooters; October 6,
2026, Traffic Safety; and Downtown Revitalization, tentatively scheduled for November.
Ms. Dyches also provided an update on upcoming City Council Meetings due to the
November General Election.  The October City Council Meetings will be held in the El
Mirage Police Department Blue Honor Room, and the November 3rd City Council Meeting
will be moved to November 17th.
 
8.
MAYOR'S COMMENTS and COUNCIL SUMMARY OF CURRENT EVENTS
The Mayor and City Council may not discuss or act upon any matter in the summary
unless the specific matter is properly noticed for legal action.
Councilmember Dorcey attended the League of Cities and Towns Annual Conference. 
Councilmember Gentry attended the League of Cities and Towns Annual Conference.
