The applicant, Sam Davis of Ledcor Group, is requesting a Special Use Permit (SUP) for a proposed fiber-optic utility compound on parcel 503-16-006A. The subject parcel comprises approximately 37 acres and is located approximately one mile northwest of Circle City along the southwest side of Grand Avenue (US 60). The SUP will be for a 90,000-square-foot lease area toward the southwest corner of the subject parcel. 2. The lease area will measure 300’ x 300’ (90,000 sf), most of which will be undeveloped. A new access easement will connect the lease area to Grand Ave., and a linear retention basin will be placed along the south side of the lease area. Development beyond the easement and retention basin will be limited to a fenced area measuring approximately 112’-6” x 128’ (14,400 sf). The fence itself will be an 8’ chain-link fence topped with an additional 1’ of barbed wire and will include a 16’ wide manual cantilever sliding access gate. In response to recommendations from the Arizona State Land Department (ASLD), the developer will screen the fence with neutral or desert color slats. Per the applicant’s narrative, a fence is preferred to a solid wall to maximize unobstructed airflow for equipment cleanliness and operational stability. However, the narrative assures that the facility will not generate noise or other emissions, effectively minimizing its impact on nearby rural residences. 3. Within the fenced area, the developer will install a new utility compound and equipment shelter that will serve as an infrastructure component supporting their existing fiber-optic network. The equipment shelter will be a prefabricated modular unit measuring approximately 24’ x 36’ (864 sf) and 13’ in height. In terms of construction materials, the shelter will be a precast concrete building with an exposed coarse aggregate finish; it will be placed and anchored to a precast concrete slab foundation. One equipment shelter will be installed during initial construction, although a foundation pad will be provided for the installation of a second identical shelter in the future. There will be no antennas, towers, or dishes with the facility. Outside lighting will be provided by one downward-directed wall-mounted LED light fixture at each unit entry door (for three per unit). Each light will have a dawn-to-dusk photocell control. 4. The facility will be unmanned and closed to the public. Access will be limited to authorized service personnel who will visit the site infrequently for maintenance as needed. A single parking space will be provided. Both the parking space and the 16’ wide access driveway within the easement will be surfaced with stabilized decomposed granite. 5. The site is located within the Wickenburg Highway Scenic Corridor (WHSC) overlay zoning district Class 2 intensity level as regulated in MCZO Section 704. Class 2 corresponds with the County jurisdiction from 300’ to ¼-mile (1,320’) out from the Grand Ave. right-of-way. The Class 2 development regulations are minimal, only requiring structures to adhere to a maximum height of 33’ and otherwise requiring development to observe the goals and policies established in the WHSC plan to the extent practicable. Prior to issuance of construction permits, written confirmation will be required from the fire authority having jurisdiction that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Neither Arizona Public Service nor Salt River Project have provided comments regarding this request. The Circle City / Morristown Fire Department operates the fire station nearest to the subject site, located at 380 Debs Circle, approximately 1.5 miles to the southeast. The nearest school, the Morristown Elementary School, is located four miles to the northwest. The nearest MCSO office is located at 13063 West Bell Road in Surprise, approximately 20 miles southeast. Right-of-Way: 8. The following table includes the right-of-way and classification information for existing and future roads that impact the subject site, based upon the Maricopa County Department of Transportation (MCDOT) Transportation System Plan 2040 and Road Information Tool, as well as right-of-way records from the Arizona Department of Transportation (ADOT). MCDOT’s Traffic Division has approved its review of this request due to the project’s small scale and the minimal number of trips that will be generated by the proposed development. During the initial review of the project, MCDOT’s Planning Division noted that the originally planned location of the lease area (which was going to be toward the northwest corner of the parent parcel) was within the preferred alignment for the future Wild Rose Parkway. As a future parkway alignment, MCDOT requires preservation of at least 100’ from the future centerline. This required the applicant to relocate the lease area. In an email dated April 1, 2026, the applicant proposed relocating the lease area to the southwest corner of the parent parcel. Staff notes that the proposed lease area now encroaches within 65’ of a section line, which corresponds with the parent parcel’s south lot line. MCDOT acknowledged this section line in its initial review comments from March 3, 2026. However, in its response to the applicant’s proposed relocation, MCDOT confirmed that the site was now outside the future right-of-way and identified no further concerns with the proposal. Furthermore, MCDOT’s Transportation System Plan does not identify a future roadway alignment corresponding with the section line. Staff, therefore, interprets that the proposed lease area no longer conflicts with existing or future MCDOT-maintained roads. 10. MCDOT has not yet established a construction timeline for Wild Rose Parkway. Currently, the only right-of-way serving the parent parcel is US 60, an ADOT-maintained US highway. ADOT did not SU260001 Page 6 of 10 respond directly to Planning staff except to acknowledge receipt of staff’s routing notice. The applicant, however, has demonstrated proof of correspondence with ADOT. On April 2, 2026, ADOT acknowledged receipt of the applicant’s Traffic Impact Assessment (TIA) pre-submittal form. Like MCDOT, ADOT confirmed that the project will have minimal to no impact on their facilities and will therefore not require a TIA or TIS. However, ADOT also advised that it does not support new driveway access directly to US 60. Instead, ADOT recommends utilizing existing driveways to access the proposed site. On April 3, 2026, ADOT further advised that if the project affects its right-of-way in any manner (including access), then a permit will be required from ADOT. The applicant’s current site plan does show the proposed access easement connecting directly to US 60 via a new point of access. However, the applicant’s narrative states that they are working with ADOT for an acceptable access arrangement. Framework 2040 Maricopa County Comprehensive Plan 11. The subject site is located within Maricopa County’s White Tank / Grand Avenue Area Plan, which designates it as being within the Single Family – Rural land use area. This land use designation supports rural residential development at densities of up to one dwelling unit per acre. The site is also located within the City of Surprise’s municipal planning area (MPA). Surprise’s general plan designates the site as being within the City’s Neighborhood character area. Because the site is located within an MPA, the Comprehensive Plan’s Municipal-Rural Framework considers it to be within the County’s Area of Municipal Influence. 12. Generally, the Framework considers sites designated for rural uses by the applicable County area plan as being within the Rural Service Area as opposed to the Urban Growth Area. However, a site designated for rural land uses can be considered within the Urban Growth Area if 1) the applicable municipal general plan designates the site with an urban land use, 2) the site meets the applicable requirements of the Urban Solutions for Urban Development (USUD) strategy, and 3) the site has an assurance of annexation from the applicable municipality. Surprise’s general plan applies the Neighborhood character area broadly to urban, suburban, and rural neighborhoods. The plan does include a Rural Residential Overlay sub-character area, but does not apply it to the subject site. That said, neither the owner nor Surprise have expressed interest in annexation. The property is not adjacent to Surprise jurisdiction nor along municipal utilities, suggesting that Surprise would likely have little interest in annexing the site in the foreseeable future. With these facts known, it can be concluded that, per the Framework’s guidelines, the site is within the Rural Service Area. 13. Per the USUD strategy, urban commercial uses generally require that adequate water and sewer infrastructure will be available upon development, as well as adequate roadway infrastructure, police protection, and fire protection. Being within the Rural Service Area, there is no existing water or sewer infrastructure serving the site, and the nearest MCSO station is nearly 20 miles away. At best, the site benefits from frontage along a major ADOT-maintained US highway and a fire station located less than two miles away. 14. Although urban utilities and infrastructure are limited at the project site, they are not likely to hinder the feasibility of the proposed land use, which essentially amounts to a rural utility use. The unmanned fiber-optic facility will generate no water demand, no wastewater, and virtually no traffic. Furthermore, it will be self-secured with a barbed-wire fence. SU260001 Page 7 of 10 Public Participation Summary: 15. The applicant complied with the requirements of the citizen review process by posting the site and sending notification by first class mail to interested parties and adjacent property owners within 300’ of the site. Two signs were posted onsite in accordance with applicable regulations. Staff received no public comment regarding the application. In addition to previously-discussed correspondence from ASLD, ADOT, and MCDOT, the Arizona Game & Fish Department (AGFD) provided a list of general recommendations for the developer. Luke Air Force Base responded to County notice confirming that it has no concerns with this request. Outstanding Concerns from Reviewing Agencies: 16. N/A Staff Analysis: 17. Staff supports the applicant’s request for an SUP. For the reasons discussed in paragraphs 7 and 9 of this report, the proposed use does not require conventional urban services such as water or wastewater infrastructure. In fact, since the facility will be unmanned, there is no need for a well or septic system either. The proposed use arguably requires fewer services than a rural residence. In many ways, the fiber-optic compound is similar to a wireless communication facility, albeit without the tower, antennas, or emissions (staff also notes that WCFs are allowed by right in all zoning districts except when the towers and/or antenna arrays exceed required dimensions). Put another way, a fiber-optic compound is arguably a less intense use than some that are allowed by right in the Rural-43 zoning district. As far as screening goes, staff believes the request for a chain-link fence in lieu of a solid wall (which is generally required for WCFs to be permitted by right) is reasonable due to the need for sufficient ventilation, the minimal noise that would be generated by the use, and the minimally obtrusive aesthetic nature of the utility systems that would be screened behind the fence. Finally, staff believes the proposed fiber-optic utility compound provides a vital community benefit to Maricopa County by enhancing communications infrastructure in a very remote area of the County. 18. Staff notes that the SUP area will be limited to the 300’ x 300’ lease area and will not include the access easement that will, directly or indirectly, provide access to US 60. The routing of the access easement as depicted on the site plan may not be final and will be subject to ultimate approval from ADOT. The recommended conditions of approval include one condition requiring that ADOT approval be obtained prior to issuance of building permits. Recommendation: 19. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve SU260001 subject to the following conditions ‘a’ – ‘i’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Whittman ILA,” consisting of five full-size sheets, dated June 3, 2026, and stamped received July 30, 2026, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. SU260001 Page 8 of 10 b. Development of the site shall be in substantial conformance with the Narrative Report entitled “MMI-Whittman AZ,” consisting of five pages, dated July 29, 2026, and stamped received July 30, 2026, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. The parcel, 503-16-006A, contains areas of a FEMA designated special flood hazard area. Proposed utility shelter does not appear to encroach into the floodplain. Any encroachment or grading of the floodplain will require a flood use permit and a building permit. 2. Site is in proximity and access is via US 60 and requires ADOT approval via the redletter@azdot.gov process. ADOT approval must be obtained prior to building permit issuance. 3. Engineering review of entitlement cases is conceptual in nature. All development and engineering design shall be in conformance with Section 905 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 4. The County does not provide fire service, therefore, it is incumbent that the applicant seek service and approval of plans from the jurisdictional fire service provider. d. This special use permit is valid for a period of 30 years and shall expire on October 21, 2056, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. e. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. f. The owner shall submit construction permits to establish the land use and for site improvements as shown on the site plan and receive final inspection status from the Planning & Development Department Inspections Division establishing the use prior to commencing operations. Violation of this condition may be grounds for revocation as set forth in the Maricopa County Zoning Ordinance. g. Noncompliance with any of the conditions assigned to the approval of this Special Use Permit by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. h. The property owners and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. SU260001 Page 9 of 10 i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. The equipment shelter is ~864 square feet (sqft) and is unmanned / unoccupied. The shelter is prefabricated off-site as a unit and is shipped and installed at the site and will contain the equipment to support the fiber optic network. DESCRIPTION OF PROPOSAL MMI proposes to install a new utility compound and equipment shelter that acts as an infrastructure component supporting their existing fiber-optic network. The equipment shelter is ~864 sqft, prefabricated “double wide” modular unit. The initial installation will be for (1) “double wide” shelter with a second one proposed for future installation. The shelter is approximately 24’x36’x12’-9”. The equipment shelter is a precast concrete building with an exposed coarse aggregate finish, that is placed and anchored to a precast concrete monolithic slab foundation at the required frost depth for soil conditions. The prefabricated unit is shipped to the site in two modular halves, and is then installed and sealed together on site. There are no antennas, towers, or dishes at the site or for this shelter. The utility compound and equipment shelter is an unoccupied/unmanned facility that is not open to the public and is fenced with an access gate that will be locked at all times. Access is only permitted by trained and authorized service personnel on an infrequent basis (ex. Site maintenance, emergency repairs, etc.). The utility compound will be surrounded by a 8’ chain-link security fence with 1’ (3-strand) of barbed wire and screened with a neutral/desert color slats. The outside lighting on the site is (1) downward directed wall mounted LED light fixture at each entry door (three total). Each light will have a dawn to dusk photocell control. There will be no proposed signate at this location. RELATIONSHIP TO SURROUNDING PROPERTIES The site is in a sparsely populated, but not entirely remote part of Maricopa County on a vacant parcel. The surrounding parcels are low-intensity with ample spacing between structures. There are a few residential properties to the west, open space north and south, and small commercial uses to the east. No emissions or noise generation will be created from the normal operations of this equipment shelter. The fiber infrastructure requires placement of line amplifiers that helps improve the network by providing additional signal stability, help carry information, and reduce latency. These routes are part of the fiber optic backbones that help facilitate modern day communications. LOCATION AND ACCESSIBILITY The location of the utility compound has been chosen because of its proximity to the existing fiber optic cable route and its minimal impact to the adjacent road. The compound will be accessed from an access easement off of HWY 60. No direct access to US-60 proposed and CIRCULATION SYSTEM (ON & OFF-SITE) Visits to the site will be infrequent and primarily for scheduled maintenance visits (typically quarterly through the year). This will not impact the existing traffic patterns of the area. The compound is not open to public access. Applicant is working with ADOT for access approval to service road adjacent to US-60 DEVELOPMENT SCHEDULE (PHASING) The project is a small standard design and is built in one construction phase (4-6 weeks). The site is grubbed / graded, site work prep and foundations are poured, the equipment shelter is installed and final site work is completed. A second foundation pad will be poured for a future shelter installation. COMMMUNITY FACILITIES AND SERVICES The equipment shelter is located in a rural area with no schools or parks in close proximity. The shelter itself is a private building that is not accessible to the public. PUBLIC UTILITIES AND SERVICES There will be no water or sewage utility required or provided. No waste or trash will be accumulated or generated with this proposed development. This is an unoccupied / unmanned facility with no plumbing or waste generation. The shelter will be services by the Circle City-Morristown Fire District and by the District 4 Sheriff’s Office. Precautions should be taken to wash and/or decontaminate all equipment utilized in the project activities before entering and leaving the site. Please review the Arizona Department of Agriculture’s website for a list of prohibited and restricted noxious weeds and the Arizona Native Plant Society for recommendations on control methods. If trenching or digging of holes will occur, trenching/digging and backfilling crews should be close together to minimize the amount of open trenches/holes at any given time. Avoid leaving trenches/holes open overnight. Where trenches/holes cannot be back-filled immediately, escape ramps should be constructed, which can be short lateral trenches or wooden planks sloping to the surface.
