PLAN OF OPERATION / GOOD NEIGHBOR POLICY TERRIBLE’S GAS STATION AND CONVENIENCE STORE LOCATED AT: 1432 SOUTH CRISMON ROAD. APN: 220-82-003. (REFERENCE CASE #’S: ZON25-00895 / DRB25-00903) Terrible’s gas station and convenience store (“Terrible’s”) are seeking to develop a ±1.26-acre vacant lot located at 1432 South Crismon Road (APN: 220-82-003) (the “Property”). Terrible’s, a well-established regional retailer founded in 1959. Over the past several decades, the company has expanded to more than 180 locations throughout Nevada, California, Utah, and Arizona. The brand is recognized for its distinctive architectural identity and contemporary convenience retail format, typically featuring large, modern facilities offering fuel services alongside a variety of food, beverage, and retail items. Under the Mesa Zoning Ordinance, a Plan of Operation / Good Neighbor Policy is required with a Special Use Permit for a service station (i.e., a gas station). Generally, good neighbor policies are aimed at providing a program, or medium, for coordination and resolution of maintenance issues and specified effects a project may have on the surrounding uses. There are no sensitive uses to the subject Property. However, the proposed development will meet or exceed the requirements to ensure on-going compatibility with the respective uses onsite/abutting. The functionality and integrated relationship among the various elements of the larger development area will be governed by a comprehensive set of easements, cross-access agreements, and/or professional management/maintenance agreements (e.g., CC&R’s/POA). This will ensure that the entire development area is well maintained so that the value/appearance is preserved over time for all existing and future users. The property ownership maintenance program and the property owner’s association’s declarations run with the land. Terrible’s will provide contact information to facilitate resolution of any concerns that may arise from their use/business. Terrible’s is committed to operating the facility in a manner that is respectful of neighboring businesses and compatible with the surrounding commercial/retail/office developments. The company will maintain the Property in a clean, safe, and orderly condition and will respond promptly to any concerns raised by neighboring tenants, property owners, or City staff. With regards to the proposed gas station’s (service station) Plan of Operation. • Hours of Operation: The business will be operational 24-hours, 7-days a week. • Number of Employees: Approximately 12-15 employees will be hired for this location with approximately 2-3 employees working during one shift. • Number of Shifts per day: Approximately 3 shifts per day. • Number of fuel pumps: There are 6 fuel pumps/dispensers under the canopy, which means 12 fueling positions (i.e., each dispenser has 2-sides to fill up on. Operational commitments include the following: Site Maintenance. Employees will routinely monitor the Property throughout the day to ensure the site remains clean and well maintained. Trash receptacles will be emptied regularly and any litter within the parking lot or fuel area will be promptly removed. Graffiti Removal. Any graffiti that may occur on the building, equipment, or site features will be removed promptly to maintain the appearance of the Property. Lighting. All lighting on the site will comply with City of Mesa lighting standards and will be designed to minimize light spillover onto adjacent properties while providing adequate illumination for customer safety. Security and Monitoring. The Property will be well lit and monitored by store employees during operating hours. Security cameras are typically installed at Terrible’s locations to monitor fuel pumps, parking areas, and building entrances to enhance safety and discourage loitering or nuisance activity. Landscaping. Landscaping will be installed and maintained in accordance with City of Mesa requirements and will be regularly maintained to preserve the visual quality of the site. Moreover, any noise from the gas station (service station) will be buffered by landscaping, walls, and distance from the public street albeit facing Crismon Road (i.e., a major arterial throughfare). The surrounding area is commercial/retail/office in nature and close to the U.S. 60 freeway. Finally, the overall development area’s internal street network will allow good circulation for both cars and trucks. Easy access to the Terrible’s with minimal disruption to the surrounding due to the major arterial streets abutting the Property and the overall development area as well as the U.S. 60 freeway. With that said, if any concerns arise from the operations of Terrible’s gas station (service station) the procedure for responding to those concerns will be as follows: 1. The associate working there will be the first to respond to any concerns. 2. If any concerns cannot be addressed or solved by the associate, the manager of Terrible’s may become involved in addressing the concern. 3. If concerns remain then the area regional manager of Terrible’s will step in to further address any remaining issues. 4. Any maintenance or design issues may be directed to Terrible’s or via the property owner management company for the overall development area, if necessary. 5. Current contact information will be displayed on site at the fuel station (pumps) and within the convenience store well as with the property owner’s association for the overall development area.
