SPECIAL COUNCIL MEETING AND COUNCIL EXECUTIVE SESSION
JUNE 16, 2026
MINUTES
City Council Chambers
530 East Monroe Avenue
Buckeye, AZ 85326
IMMEDIATELY FOLLOWING THE REGULAR COUNCIL MEETING
1. Call to Order/Roll Call
Mayor Orsborn called the meeting to order at 6:22 p.m.
Members Present: Councilmember Youngker, Councilmember Berry, Councilmember Beard,
Councilmember HagEstad, Councilmember Heustis, Vice Mayor Goodman, and Mayor Orsborn.
Members Absent: None.
Departments Present: City Manager Doug Sandtrom, Deputy City Manager Dave Roderique, Deputy
City Manager Jared Askelson, Deputy City Manager James Shano, City Attorney Tosca Henry,
Deputy City Clerk Summer Stewart, Public Works Director Amy Murray, Water Resources Director
Terry Lowe, and Chief Government Affairs Officer John Raeder.
2. Convene into Executive Session
At 6:23 p.m. a motion was made by Councilmember Heustis and seconded by Vice Mayor Goodman
to convene into Executive Session pursuant to: a) A.R.S. Section 38-431.03 (A.3) and A.R.S.
Section 38-431.03 (A.4) for discussion or consultation for legal advice with the attorney or attorneys
of the public body and for discussion and consultation with the attorney or attorneys of the public
body in order to consider its position and instruct its attorneys regarding the public body’s position
regarding litigation in the City of Buckeye vs. Rubcorp Distribution LLC, a Delaware limited liability
company, Maricopa County Superior Court Case No. CV2025-011076, including discussion of
litigation strategy, settlement discussion, and settlement authority; and, b) A.R.S. Section 38-431.03
(A.3) for discussion or consultation for legal advice with the attorney or attorneys of the public body
regarding strategic water policies and the City’s application for an Alternative to Designation of
Assured Water Supply. Motion passed unanimously.
3. Reconvene into Public Meeting
At 7:37 p.m. a motion was made by Vice Mayor Goodman and seconded by Councilmember Heustis
to reconvene into the Public Meeting. Motion passed unanimously.
4. Action Items
4.A Discussion and possible action regarding litigation strategy, settlement discussion,
and/or settlement authority in City of Buckeye vs. Rubcorp Distribution LLC, a
Delaware limited liability company, Maricopa County Superior Court Case No. CV2025-
011076.
A motion was made by Councilmember HagEstad and seconded by Vice Mayor Goodman to reject
the settlement offer from defendants and direct the city attorney to proceed with settlement
negotiations as discussed during executive session. Motion passed unanimously.

4.B Discussion and possible action regarding the City’s application for an Alternative to
Designation of Assured Water Supply.
No discussion or action was taken.
5. Adjournment
There being no further business to discuss, Mayor Orsborn adjourned the meeting at 7:38 p.m.
