Staff Summary (background) In 2018, state statutes were modified to require local jurisdictions to allow small cell wireless facilities to be located in city and town rights-of-way. In response to that, staff prepared, and the Council adopted several documents to govern the placement of such facilities along our streets. One of the documents adopted is titled "Wireless Facilities Standard Terms and Conditions." This forty-seven-page document covers a wide range of issues and requirements to be met by any entity desiring to use the Town's right-of-way for this purpose. The current and proposed new ordinance require compliance with the items listed in the Terms and Conditions document. Staff, in conjunction with a consultant hired to update all the Town's ordinances and related documents associated with the approval, installation, and maintenance of wireless telecommunications towers and antennas, has identified one minor change to be made to the Town's Wireless Facilities Standard Terms and Conditions for small wireless facilities to be located in Town rights-of-ways. The one change needed is to update the submission requirements in Sec. 6.9.2 to reflect our current process of receiving all applications and associated documents electronically. The attached resolution with the updated terms and conditions is the same as previously approved by the Town Council with this one modification.
