Call to Order  
Mayor Nicholls called the City Council meeting to order at 5:32 p.m.

Invocation/Pledge
	Pastor Tom Sawyer, Grace Bible Fellowship, gave the invocation. Kayla Warren, Fire Support Services Chief, led the City Council in the Pledge of Allegiance.  

Final Call  
Mayor Nicholls made a final call for the submission of Speaker Request Forms from members of the audience.

	•	Motion Consent Agenda

Motion Consent Agenda Item C.12 – Contract Award: Partnership Development and Implementation Management Services for the Yuma Innovation District (Authorize the award of a professional services contract with WT Partnership of Austin, Texas for Partnership Development and Implementation Management Services for the Yuma Innovation District, in an amount not to exceed $270,000.00) (RFQ-26-226) (Admn/Purch)

Discussion
	•	The project does not involve creating a university. The focus is on workforce development, attracting startups, and building an innovation hub within a broader district designed to support entrepreneurial activity. (McClendon/Reichelt/Mayor Nicholls)
	•	Arizona Western College and the major State universities support the innovation hub effort, noting its educational benefits. Each institution has its own entrepreneurial initiatives, and the hub would complement them. Together with regional partners, these efforts contribute to a community‑wide culture of innovation. 	•	The City aims to complement and not compete with local colleges and universities. It is appreciated that the full City Council will be involved in setting priorities for the innovation district, ensuring a collaborative, groupdriven effort. (Smith)
	•	While amenities like pickleball are not specifically planned for the innovation hub, the concept includes a mix of uses such as coffee shops, bookstores, housing, and other activities. Looking at it, in the Brownfields area, it is like extending Main Street across Giss Parkway, creating new opportunities for retail, development, and recreation as part of a multi‑use environment. Motion (McClendon/Smith): To approve the Motion Consent Agenda as recommended. Voice vote: approved 7-0.

B.      Executive Sessions

Executive Sessions may be held at the next regularly scheduled Special Worksession, Regular Worksession and City Council Meeting for personnel, legal, litigation and real estate matters pursuant to A.R.S. § 38-431.03 Section A (1), (3), (4), and (7). (City Atty)

C.      Approval of Staff Recommendations

	•	Authorize the purchase of grass seed to the lowest responsive and responsible bidders, Wilbur Ellis of Phoenix, Arizona for $150,914.00, Ewing Irrigation of Phoenix, Arizona for $15,495.20 and Helena Agri Enterprises for $6,500.00 from Los Angeles, California. (RFB-26-349) (Pks & Rec/Purch)

	•	Award to the most responsive and responsible bidder a one-year contract for overhead door and gate system maintenance and repair services with an option to renew for four additional one-year periods, depending on the appropriation of funds and satisfactory performance, for an estimated annual expenditure of $30,000.00 as-needed to On Tack Overhead Doors LLC., Yuma, Arizona. 	•	Authorize the purchase of various products offered from Amazon Business utilizing Omnia Partners cooperative purchase agreement at an estimated annual amount of $500,000.00. (CPA-27-016) (Fin/Purch)

	•	Authorize the purchase and delivery of Ferrous Chloride from Pennco, Inc., San Felipe, Texas, utilizing a Cooperative Purchase Agreement from the City of Mesa. This contract is valid for one year with the option to renew for four additional one-year periods, one period at a time, depending on the appropriation of funds and satisfactory performance on an as needed basis with a total estimated annual expenditure of $503,000.00. 	•	Authorize the purchase of a Hydro Vacuum Combination Sewer Cleaner Vehicle utilizing a cooperative purchase agreement through Houston-Galveston Area Council for an estimated expenditure of $672,326.77 to Rush Truck Centers of Yuma, Yuma, Arizona. (CPA-27-024) (Utl/Purch)
	•	Authorize the purchase of a 10-yard dump truck utilizing a cooperative purchase agreement through Houston-Galveston Area Council, for an expenditure of $227,392.26 to Rush Truck Centers of Yuma, Yuma, Arizona. (CPA-27-021) (Pub Wrks/Purch)

	•	Authorize the purchase of a 2026 John Deere Model 324P loader with a grappler utilizing a cooperative purchase agreement from Sourcewell at an expenditure of $142,919.08 to RDO Equipment Co. of Yuma, Yuma, Arizona. (CPA-27-020) (Pub Wrks/Purch)

	•	Authorize the purchase of a 2027 Peterbilt Model 537 McNeilus 8-yard truck, utilizing the cooperative purchase agreement from Houston-Galveston Area Council, for an estimated expenditure of $250,338.08 to Rush Truck Centers of Yuma, Yuma, Arizona. (CPA-27-019) (Pub Wrks/Purch)

	•	Authorize the purchase of an Elgin Broom Bear Street Sweeper utilizing a cooperative purchase agreement from Sourcewell at an estimated expenditure of $483,889.89 to Norwood Equipment LLC, Phoenix, Arizona. (CPA-27-022) (Pub Wrks/Purch)

	•	Authorize the purchase of two 2027 Peterbilt Model 537 5-yard dump trucks utilizing a cooperative purchase agreement through Houston-Galveston Area Council at an expenditure of $189,560.10 per truck for a total of $379,120.20 to Rush Truck Centers of Yuma, Yuma, Arizona. 	•	Authorize the purchase of two 2027 Peterbilt Model 520 McNeilus Side Loaders utilizing a cooperative purchase agreement through Houston-Galveston Area Council, for an expenditure of $499,722.44 per truck and a total of $999,444.88 to Rush Truck Centers of Yuma, Yuma, Arizona. Motion (Morris/Watts): To adopt the Resolution Consent Agenda as recommended.

An ordinance of the City Council of the City of Yuma, Arizona, amending Yuma City Code Title 3, Chapter 39 addressing appointed Judicial Officers within the Municipal Court (by separating appointed Judicial Officers into categories by subsection to align with Court rules) (Muni Court)

	•	Public Hearing -Variance Appeal

MC 2026-141 – VAR-45199-2026 – 1921 S. 6th Avenue (The City Council will hear and decide this variance appeal in a quasi-judicial capacity as a statutory board of adjustment pursuant to Arizona Revised Statutes (A.R.S.) § 9-462.06 and Yuma City Code (Y.C.C.) § 154-02.02) (Cmty Dev/Cmty Plng)

Motion (Morris/Smith): To recess the August 5th City Council meeting and reconvene as a quasi-judicial body sitting as a statutory Board of Adjustment to hear the Variance Appeal on property located at 1921 S. 6th Avenue. Voice vote: approved 7-0. City Council Recessed at 5:45 p.m.

The August 5, 2026, Variance Appeal Minutes were covered separately.

City Council reconvened at 6:37 p.m.

	•	Announcements and Scheduling

Announcements

Smith and Mayor Nicholls reported on events and meetings they have attended during the last two weeks and upcoming events of note.

	•	Summary of current Events 

Reichelt reported the following events:
	•	August 14 – Gallery Reception at the Yuma Art Center
	•	September 12 – Father/Daughter Ball
	•	October 24 – 10th Annual Mayors’ International Bike Ride







	•	Call to the Public

Carlos Adams, City resident, spoke regarding his campaign experience, resident feedback, and perceptions of fear in speaking out. He noted strong writein support, and announced his transparency meeting. 

Branden Freeman, nonresident, questioned the City’s spending on outside legal counsel, citing high costs and limited transparency, and asked City Council to review and improve documentation and approval practices.

Harvey Martin, City resident, stated he was wrongly arrested for false reporting and asked the Council to request a Department of Public Safety investigation.


	•	Executive Session/Adjournment

There being no further business, Mayor Nicholls adjourned the meeting at 6:55 p.m.  No Executive Session was held.
