1. RES IGA: City of San Luis - Standard Plans

RESOLUTION NO. R2026-040

	A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YUMA, ARIZONA, AUTHORIZING AND APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF YUMA AND THE CITY OF SAN LUIS FOR THE USE OF PRE-APPROVED RESIDENTIAL STANDARD PLANS	
		
WHEREAS, the City of Yuma (City) and the City of San Luis are authorized, pursuant to Arizona Revised Statutes (A.R.S.) §11-952, to enter into intergovernmental agreements for the joint exercise of powers common to the parties; and,

WHEREAS, the City has contracted with Thompson Design Architects PC (Consultant) to develop a set of pre-approved residential standard plans (Plans), including designs for accessory dwelling units, single-family, two-family, and three-family residential units, in accordance with applicable building codes; and, 

WHEREAS, the City of San Luis desires to utilize the City’s Plans to assist in compliance with A.R.S. § 9-461.20 and to make the Plans available for use by residents within the City of San Luis; and, 

WHEREAS, the Intergovernmental Agreement, attached as Exhibit A and incorporated herein by this reference, establishes the terms under which the City will make the Plans available to the City of San Luis for governmental purposes, including plan review, permitting, and construction within the City of San Luis; and,

WHEREAS, in consideration of the use of the Plans, the City of San Luis will pay the City a one-time compensation amount of $28,549.40, representing its population-based share of the total project cost, as established in the Intergovernmental Agreement; and,

WHEREAS, the Intergovernmental Agreement established a six-year term, subject to the terms and conditions contained therein, and provides requirements related to the use of the Plans, compliance with applicable laws and regulations, indemnification, warranties, records, and termination; and, 

WHEREAS, the City Council finds that entering into the Intergovernmental Agreement with the City of San Luis will further intergovernmental cooperation and support the availability and use of pre-approved residential standard plans within the participating jurisdiction. 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Yuma as follows: 

SECTION 1: The City Council finds that approval of the Intergovernmental Agreement between the City of Yuma and the City of San Luis for the use of pre-approved Residential Standard Plans, attached as Exhibit A and incorporated by reference, is in the public interest and will promote a safe and prosperous community. 

	SECTION 2:  The City Administrator is authorized and directed to sign the agreement titled, Intergovernmental Agreement between the City of Yuma and the City of San Luis for the Use of Pre-Approved Residential Standard Plans, on behalf of the City of Yuma.
