ORDINANCE NO. 23-26
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF BUCKEYE,
ARIZONA, DECLARING AS A PUBLIC RECORD THAT CERTAIN DOCUMENT
ON FILE WITH THE CITY CLERK ENTITLED THE “CHAPTERS 5, 12, AND 15
– ASSOCIATE JUDGE AMENDMENTS”; ADOPTING THE “CHAPTERS 5, 12,
AND 15 - ASSOCIATE JUDGE AMENDMENTS” BY REFERENCE; AND
AMENDING THE CITY CODE OF THE CITY OF BUCKEYE CHAPTER 5,
MUNICIPAL COURT REGULATIONS, ARTICLE 5-1, DEFINITIONS, SECTION 5-
1-1, DEFINITIONS, ARTICLE 5-2, MUNICIPAL COURT ORGANIZATION,
SECTION 5-2-2, QUALIFICATIONS OF JUDGES, SECTION 5-2-3, JUDGES,
GENERALLY, SECTION 5-2-5, POWERS AND DUTIES OF PRESIDING JUDGE,
ARTICLE 5-3, JUDICIAL SELECTION ADVISORY BOARD, SECTION 5-3-1,
ESTABLISHMENT; PURPOSE, SECTION 5-3-2, MEMBERSHIP, ARTICLE 5-5,
HOME DETENTION/ELECTRONIC MONITORING PROGRAM, SECTION 5-5-1,
HOME DETENTION/ELECTRONIC MONITORING PROGRAM; CHAPTER 12,
TRAFFIC CODE, ARTICLE 12-3, PARKING, STANDING AND STOPPING,
SECTION 12-3-4, PARKING PROHIBITED IN SPACES RESERVED FOR THE
PHYSICALLY DISABLED, SECTION 12-3-8, RESPONSE TO PARKING
VIOLATION COMPLAINT; DEFAULT JUDGMENT; PENALTIES, SECTION 12-3-
11, IMMOBILIZED AND IMPOUNDED VEHICLES – RELEASE; CHAPTER 15,
BUILDING REGULATIONS, ARTICLE 15-1, GENERAL PROVISIONS, SECTION
15-1-2, CIVIL CODE ENFORCEMENT FOR VIOLATIONS OF CITY CODE;
PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; AND
PROVIDING FOR SEVERABILITY.
WHEREAS, that certain document entitled the “Chapters 5, 12, and 15 - Associate
Judge Amendments”, of which at least three paper copies or one paper copy and one electronic
copy are on file in the Office of the City Clerk and open for public inspection during normal
business hours, is hereby declared to be a public record and said copies are ordered to remain
on file with the City Clerk; and
WHEREAS, the Mayor and Council are authorized by City Code Chapter 2, Article 2-5,
Section 2-5-4 to adopt or amend all ordinances necessary or proper for the carrying into effect
of the powers vested in the City; and
WHEREAS, the Mayor and Council of the City of Buckeye, Arizona, believe that it is in
the best interest of the City to amend particular sections of the City Code of the City of Buckeye,
to promote the health, safety, and welfare of the City's residents, by establishing a new judicial
position of associate judge and conforming related city code sections to include the associate
judge position and to expand the non-voting membership of the City of Buckeye Judicial
Selection Advisory Board.
BE IT ORDAINED by the Mayor and Council of the City of Buckeye, Arizona, as follows:
Section 1. The recitals set forth above are hereby incorporated as if fully set forth
herein.
Section 2. That certain document entitled “Chapters 5, 12 and 15 – Associate Judge
Amendments”, of which at least three paper copies or one paper copy and one electronic copy

are on file in the office of the City Clerk and open for inspection during normal business hours, is
hereby referred to, adopted and made a part hereof as if fully set out in this ordinance.
Section 3. The City Code of the City of Buckeye is hereby amended by amending
Chapter 5, Municipal Court Regulations, Article 5-1, Definitions, Section 5-1-1, Definitions,
Article 5-2, Municipal Court Organization, Section 5-2-2, Qualifications of Judges, Section 5-2-3,
Judges, Generally, Section 5-2-5, Powers and Duties of Presiding Judge, Article 5-3, Judicial
Selection Advisory Board, Section 5-3-1, Establishment; Purpose, Section 5-3-2, Membership,
Article 5-5, Home Detention/Electronic Monitoring Program, Section 5-5-1, Home
Detention/Electronic Monitoring Program; Chapter 12, Traffic Code, Article 12-3, Parking,
Standing and Stopping, Section 12-3-4, Parking Prohibited in Spaces Reserved for the
Physically Disabled, Section 12-3-8, Response to Parking Violation Complaint; Default
Judgment; Penalties, Section 12-3-11, Immobilized and Impounded Vehicles – Release;
Chapter 15, Building Regulations, Article 15-1, General Provisions, Section 15-1-2, Civil Code
Enforcement for Violations of City Code as fully set forth in the public record entitled “Chapters
5, 12 and 15 – Associate Judge Amendments” and incorporated herein.
Section 4. All ordinances and parts of ordinances in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance or any part of the “Chapters 5, 12, 15 – Associate Judge Amendments” adopted
herein by reference is for any reason held invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect the validity of the remaining portions
thereof.
Section 6. The Mayor, City Manager, City Attorney, and City Clerk are hereby
authorized and directed to take all steps and execute all documents necessary to carry out the
purpose and intent of this Ordinance.
PASSED AND ADOPTED by the Mayor and Council of the City of Buckeye, Arizona, this
6th day of October 2026.
