RESOLUTION NO. 94-26
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF BUCKEYE,
ARIZONA, DECLARING AS PUBLIC RECORDS, AND APPROVING AND
ADOPTING THE FOLLOWING CITY OF BUCKEYE POLICIES: STRATEGIC
WATER PLANNING, RECLAIMED WATER, WATER ACQUISITIONS AND
FUNDING, WATER CONSERVATION, AND WATER ALLOCATIONS IN
DESIGNATED AREAS; PROVIDING FOR REPEAL OF CONFLICTING
RESOLUTIONS AND PROVISIONS; AND PROVIDING FOR SEVERABILITY.
WHEREAS, those certain documents entitled City of Buckeye Policy on: Strategic Water
Planning, Reclaimed Water, Water Acquisitions and Funding, Water Conservation, and Water
Allocations in Designated Areas (collectively, the “City Water Policies”), of which at least three
paper copies or one paper copy and one electronic copy are on file in the office of the City Clerk
and open for public inspection during normal business hours, are hereby declared to be public
records and said copies are ordered to remain on file with the City Clerk; and
WHEREAS, the City Council has determined that it is in the best interest of the City to
adopt the following City Water Policies in order to formalize and ratify existing practices and
establish a consistent framework to guide the City’s future water-related operations and
decisions in furtherance of the City’s commitment to sustainability.
BE IT RESOLVED by the Mayor and Council of the City of Buckeye, Arizona, as follows:
Section 1. The recitals set forth above are hereby incorporated as if fully set forth
herein.
Section 2. Those certain documents entitled City of Buckeye Policy on Strategic
Water Planning, Reclaimed Water, Water Acquisitions and Funding, Water Conservation, and
Water Allocations in Designated Areas, of which at least three paper copies or one paper copy
and one electronic copy are on file in the office of the City Clerk and open for public inspection
during normal business hours, are hereby referred to, adopted, and made a part hereof as if
fully set out in this Resolution.
Section 3. All resolutions and parts of resolutions in conflict with the provisions of
this Resolution are hereby repealed.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this
Resolution is for any reason held invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity of the remaining portions
thereof.
Section 5. The Mayor, City Manager, City Attorney, and City Clerk are hereby
authorized and directed to take all steps necessary to carry out the purpose and intent of this
Resolution.
