BACKGROUND
General Plan
The General Plan Land Use Element designates the property as rural neighborhoods. This
category includes relatively large lot single-family neighborhoods. Densities in Rural
Neighborhoods are usually one house per acre (or more) of land.
Character Area Plan
The subject property falls within the Desert Foothills Character Area Plan. The Desert Foothills
Character Area Plan Character Area Plan is intended to preserve the Natural Desert, promote
connected areas of desert open space, and seek to balance rural lifestyle with the unique and
fragile upper Sonoran Desert.
Zoning
The site is zoned Single-family Residential Environmentally Sensitive Lands Foothills Overlay The
(R1-43 ESL FO) zoning district(s) allows for Single-family dwellings and uses incidental or
accessory thereto, together with required recreational, religious, and educational services. The
surrounding property is also zoned Single-family Residential Environmentally Sensitive Lands
Foothills Overlay {R1 -43 ESL FO).
Context
The subject property is located at the corner of E. Quail Track Drive and N. 60'” Street alignment.
The site is generally west of N. 64'” Street and South of E Pinnacle Vista Drive.
The subject 66-foot right-of-way was dedicated in 1953 (western 33 feet) and in 1957 (eastern 33
feet), as part of larger dedications to facilitate perimeter access around the north half of the south
half of Section 33 of Township 05N Range 04E of the Gila and Salt River Base and Meridian. The
area was annexed into the City of Scottsdale in 1983 under ordinance 1611. No street
improvements were ever constructed on this portion of N. 60*” Street alignment. Surrounding
properties are single-family residential. Please refer to context graphics attached.

City Council Report | 60*'' Street Abandonment
Per Arizona Revised Statute ARS 28-7205 vacated roadways vest with the owners of the abutting
land. With approval of this abandonment, the eastern 33-feet of the 60'^ Street right-of-way will
automatically be attributed to the parcels east of the abandonment area (6012 E Quail Track
Drive, APNs: 212-11-018D, 212-11-018C). However, the owner of the eastern parcels does not
want the additional land and has agreed to deed the land over to the western parcels (5932 E Quail
Track Drive, APNs: 212-11 -305,212-11-008N) via recordation of a quit claim deed to the applicant
(owner of western parcels) as referenced in the resolution for this abandonment.

Attachment 1A

AB-0002-2026 60th Street Abandonment
This request is for the abandonment of a right of way (ROW) and utility easement
located between two older horse properties in north Scottsdale. The 66-foot wide
ROW/easement runs from Quail Track Drive to Pinnacle Vista Road aligning with the •
60th Street corridor. The reason for this request is to achieve better compliance with
the existing building codes.
The neighbors within 750 feet and all of the utility companies supplied by the City were
contacted with no dissent. The only City Department with a concern is Water and
Sewer who have requested a 20-foot utility easement on the eastern edge of the
existing ROW/utility easement. This new 20-foot easement would serve the northern
parcel at 6012 E. Quail Track should it be sold separately In the future.
The owners of the two parcels at 5932 E. Quail Track would like to combine their two
properties and thus would not require an easement should the City bring sewer service
in the future.
The two residential properties adjoining the easement consist of two parcels each.
5932 E. Quail Track, Scottsdale, AZ 85266 contains both Parcel #212-11-305 and
Parcel #212-1-008N. The property at 6012 E. Quail Track, Scottsdale, AZ 85266
contains Parcel#212-11-018D and Parcel #212-11-0180.
These two properties were developed in the late 1970’s and early 1980’s and fencing,
horse arenas and a workshop/hay barn were built in what is now the Right of Way.
These structures have been used and well maintained since then. They are not an
impediment to wildlife or a public endangerment.
It would be prohibitively expensive to remove the encroaching structures and their loss
would greatly damage the property values. The abandonment would bring these
properties closer to compliance with CURRENT City code and hopefully lead to legal
non-compliance.
Consideration for the abandoned one-acre right of way and easement would be valued
at $1/per square foot, the City of Scottsdale’s established value. This would amount to
a payment of $43,560 .
