Development of the site shall be in substantial conformance with the Site Plan entitled “Wranglers Roost SUP Site Plan“, consisting of 3 full-size sheets, dated March 31, 2026, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Narrative Report”, consisting of 28 pages, stamped received March 5, 2026, except as modified by the following conditions. c. This special use permit is valid for a period of five years and shall expire on October 21, 2031, or upon termination of the use for a period of 90 or more consecutive days, whichever occurs first. d. Events shall be limited to 8AM-11PM Fridays and Saturdays, and 8AM-10:30PM Sundays and federally recognized major calendar holidays (New Year’s Day, Birthday of Martin Luther King, Jr., Presidents’ Day, Memorial Day, Juneteenth National Independence Day, Independence Day, Labor Day, Veterans Day, Thanksgiving & Christmas) e. At least one (1) employee must be on site or able to be made physically available on site at all times during scheduled events. The name and telephone number of the employee must be posted and identified at the New River Rd. entrance, in a conspicuous location to the site at all times during events. This is intended to allow neighbors who wish to make noise or other complaint and responding officers to be able to make contact with an appropriate property representative during an event. f. String-style bistro lighting, and palm tree lighting up to 30’ high, shall not exceed 1,000 lumens as measured outside the special use permit boundary and shall be shut off nightly by 11:00 PM. g. All other outdoor lighting must be fully shielded so that light is emitted downward no less than 20 degrees below the horizontal plane at the bottom of the light fixture. h. There shall be no noise that exceeds 65 decibels or the background ambient noise level of the surrounding neighborhood, whichever is greater, as measured outside the Special Use Permit boundary. i. The following engineering conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design required for permitting of the site’s drainage infrastructure. October 21, 2026 SU240007 Page 2 of 4 3. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the application for Building Permits. The plans must be in accordance with the Commercial Checklist. See link: https://apps.pnd.maricopa.gov/plansubmittalchecklist 4. The above comments do not include identification of utilities or underground facilities within or adjacent to the required right-of-way that may have prior rights and/or require relocation. 5. Prior to the Building Permit Approval, the Drainage Access and Maintenance Easement must be recorded and the recordation information added to the plans. 6. Prior to the Building Permit Approval for site improvement, the entire Special Use Permit (SUP) area must be identified and the area must physically drain to the Retention Basin. The Drainage Area Map must accurately show what area drains to the Retention Basin. The contributing area must be updated to include the proposed parcel boundary adjustment area and other areas of the SUP. j. Prior to issuance of a building permit for the restroom building, the SUP area must be consolidated into a single parcel. k. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. l. Noncompliance with any of the conditions assigned to the approval of this Special Use Permit by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. m. The purpose of this special use permit is to allow the property owner to lease the site for the purpose of lessee to host private invitation-only outdoor events. These events shall not be open to the general public and thus shall not charge an admission/entrance fee to the attendees. n. The historic home structure is not permitted for public assembly use unless a certificate of occupancy is issued for the structure. Prior to occupying the existing residence or any portion thereof for public assembly, the applicant shall obtain a building permit demonstrating compliance with commercial building code as applicable and shall obtain a certificate of occupancy for the renovated building prior to any public assembly occupancy. If certificate of occupancy is obtained, no additional SUP revision or amendment is required. o. Attendance on-site is limited to a maximum of 100 persons total at any given time during events. This number is cumulative of all parcels that comprise the special use permit site. p. All driveways and parking areas shall be paved or surfaced to control dust in a manner acceptable to the Maricopa County Air Quality Department. q. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated October 21, 2026 SU240007 Page 3 of 4 and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. r. Prior to hosting any events on site all accrued non-compliance penalties accrued against the subject parcels and all adjacent parcels under related ownership or control (geographic area currently covered by APNs 202-29-085B, 202-29-085C, 202-29-086, 202-29-087A, 202-29- 087B, 202-29-087C, 202-29-088D, 202-29-088E) shall be brought current and paid in full; and all verified violations on said parcels shall be verified compliant and closed. October 21, 2026 SU240007 Page 4 of 4 Report to the Planning and Zoning Commission Prepared by the Maricopa County Planning and Development Department Case: SU240007 – Wranglers Roost Hearing Date: September 10, 2026 (Continued from June 11 and July 23, 2026) Supervisor District: 3 Applicant/Owner: Reid Stewart, Imagine Properties LLC Request: Special Use Permit (SUP) for event venue rental in the Rural-43 zoning district Site Location: Generally located approximately 1,214’ northeast of the NEC of New River Rd. & 27th Avenue in the New River area Site Size: 75,276 sq. ft. Density: N/A County Island: No County Plan: New River Area Plan – Rural Densities (0-1 d.u./ac.) Municipal Plan: N/A Municipal Comments: None received to date Support/Opposition: 43 in support / 13 in opposition Recommendation: Approve with conditions SU240007 Page 1 of 11 Project Summary: 1. The applicant is proposing a Special Use Permit (SUP) for an event venue operation on an approximately 1-acre site zoned Rural-43 in the New River area. The site is located on the north side of New River Rd. between 23rd Ave. and 27th Ave. The Maricopa County Zoning Ordinance (MCZO) under Article 1001.1.10 allows for Special Event Venues with a special use permit on a site of at least three acres. This application predates the current ordinance requirement (effective 1/9/26). 2. Wranglers Roost is a historic stagecoach stop and area landmark dating back to the territorial era. The site previously received special use permits for a guest ranch and rodeo facility operation in 1986 and received subsequent additional approvals and time extensions in 1990 and 1996. The guest ranch and rodeo grounds were part of a larger approximately 26-acre ranch that has since been split into smaller parcels via unregulated land divisions and those previous special uses discontinued. The current site is approximately just under two acres in size though is currently entirely surrounded by parcels from the same ownership group. It’s important to note that the site straddles two parcels that if consolidated would cover approximately five acres thus meeting ordinance requirement for event venues to sit on sites of at least three acres. 3. The parcel has been the subject of open violations dating back to 2019 under V201900098 for operating a commercial wedding/event venue business. The violations were originally opened for investigation due to citizen complaints of excessive noise and lighting. The light issue stems from the use of commercially available ‘string’ style bistro lighting which has been erected across the majority of the yard and a portion of the parking area to illuminate the space for nighttime use. Noise complaints were responded to by the Maricopa County Sherriff’s Office (MCSO) including reports of multiple instances of response to calls in the same night. It’s important to note that the applicant has not hosted any special events since entering into an agreement with the County in July 2024. Since that time the applicant has been leasing dwellings on the greater property as short-term rentals (STR) but the STRs have not been for special events. An SUP or Commercial zoning is required for a special event venue. 4. The applicant is now requesting an SUP to lease out the facility for weddings and other special events. The site consists of a large open yard and pool area for congregation. A gazebo and smaller outbuilding surround the yard area. The historic residence is not included in the operational scope, as the proposed event venue is entirely outdoors with the exception of the proposed restrooms. (It’s important to note the historic residence is available for short-term rental to a wedding party but cannot be used for public assembly unless it gains benefit of a completed commercial construction permit.) The application states one employee will manage the parcel for showings, cleanings and changeovers. At the same time, each user is generally free to operate their event being mindful of proposed light and noise curfews of 12:00 AM. Note that staff’s recommendation is for more limited hours of event operation. 5. The proposal is to install an ADA compliant restroom building which will be served via existing well and septic system. The restroom will be constructed as an additional building on the site. The proposed use includes 47 parking spaces with three additional ADA spaces. At present, overflow parking is available via neighboring parcels though it is not included in the request and is located outside of the identified SUP area. Parking areas will be dust-proofed per Maricopa County Air Quality standards. Note that staff will recommend all driveways and parking area be paved / surfaced. New River Area Plan (Updated November, 2019): The parcel is listed as Rural Densities which allow residential uses at a minimum of 1 dwelling unit per acre. Public Participation Summary: 10. The applicant has completed the required public notification. Public right-of-way frontage, in front of and at the entrance to the site was posted in two locations along New River Rd. The applicant sent letters to all property owners within 300‘of the parent parcels. During the technical advisory committee, staff recommended a larger notification radius to alleviate any concerns that notice was insufficient due to fact that all immediately surrounding properties were owned or controlled by the same or related parties. Ultimately an acceptable notification radius extension was not agreed upon. The applicant expressed concerned with being held to notification requirements more extensive than those applied to other similar applications. 11. The applicant has provided a statement that a neighborhood meeting was held on November 25, 2024 at the subject location. The statement indicates that nine persons were in attendance though no names or addresses were provided. The results of the meeting were not provided. 12. Staff has received 43 letters/emails of support and 13 letters/e-mails in opposition to SU240007. The concerns raised include: lighting, noise, traffic and loss of rural atmosphere. Outstanding Concerns from Reviewing Agencies: 13. N/A Staff Analysis: 14. Staff has concerns with the business plan as presented for Wranglers Roost. The application requests the availability to lease the parcel to individuals to host private events without the oversight of traditional venue operations such as employees or security. The violation history and public comments that have been received indicate a level of carelessness for existing ordinances and regulations such as noise and light. Staff recommends all events require an onsite staff member to ensure facility regulations are enforced and to act as a liaison for any potential neighbor issues that may arise. 15. Staff recognizes the potential impacts a wedding and event venue creates for the surrounding residential neighborhood. Noise and lighting can have larger impacts on surrounding residences as events are generally held in the evening. Staff proposes a limit to events only occurring on weekends (Friday, Saturday or Sunday). While potentially burdensome on the applicant, this will give the neighborhood an expectation of times the venue can operate with the least impacts to the local community. 16. While the parcel is/was part of a larger ranch, the requested SUP area only encompasses the small approximate acre on which the historic building sits. Forty-seven parking spaces have been provided (3 ADA spaces). Due to parking provided and event venue size, staff recommends limiting events to 100 guests and staff. 17. The string style bistro light fixtures referenced within consist of many unshielded bulbs that do not direct light in any specific direction. While similar fixtures are generally used for accent or ambiance lighting, these have been specifically installed to utilize higher intensity bulbs which illuminate the space for the outdoor venue purposes. Multiple letters of opposition reference SU240007 Page 7 of 11 these lights specifically as they provide light trespass and glare in the community. Staff is amenable to such ambiance lighting when used only during specified hours to light the event space. Continued regular use not associated with event hours has been cited in neighbor letters and is the source of much neighbor contention. 18. Noise, specifically amplified music, has been cited as a reason why neighbors became aware of and are opposed to the venue. Unmitigated amplification with no limit on maximum decibel or time limit can be expected to lead to continued noise complaints. While staff respects the applicant’s request to operate a venue, they still have an obligation to be a good respectful neighbor. The application does not propose any indoor music or dancing facilities, all instances would occur outdoors. The applicant’s desire to allow music until midnight is out of character with the rural neighborhood. Staff proposes a limit on all noise to not exceed 55 decibels measured outside the SUP boundaries. 19. Finally, staff is recommending a five-year SUP timeframe. This allows all parties to reconvene on the matter in five years to allow for more discourse to determine if the outdoor event venue use has proved to be a good neighbor and appropriate for the area. If so, the applicant may then seek a SUP time extension. 20. Staff believes an event venue operating at the historic landmark can be appropriate and in concert with the surrounding rural residential neighborhood if subject to conditions limiting the hours of operations, protecting nighttime skies, restricting noise decibel and crowd size, etc. In previous decades the site successfully housed an activity / entertainment center for the New River community. 21. The case was presented at the July 23, 2026 Commission hearing. The applicant indicated to the Commission a desire to amend the recommend conditions. The Commission continued the case to today’s hearing and instructed staff to further refine the recommended conditions of SUP approval. 22. It should be noted that as of January 9, 2026, the county’s zoning ordinance requires a minimum three-acre area for an event venue SUP. Staff considers the subject application which has been pending for two years, to be grandfathered regarding the minimum three-acre land area requirement. Recommendation: 23. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve SU240007 subject to the following conditions ‘a’ –‘r’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Wranglers Roost SUP Site Plan“, consisting of 3 full-size sheets, dated March 31, 2026, except as modified by the following conditions. b. Discussion of Recent Changes in the area of your request that support the application request: Recently there has been a new truck stop built on New River Road and I 17 to support tourist and the community. The Wrangler’s Roost has in fact always been a guest ranch and restaurant. The property has a tradition of sharing and introducing the desert to people and that should be preserved. Wranglers Roost always tells guest about other things to do in the area and promotes the commerce in the area that adds to the tax base. E. The site is able to use hauled water. With the number of events being limited to less than 60 days per year (serving 25+ persons), and the fact that there are not 15 water connections to the well, the need for a Public Water System is not required. Wastewater - A private septic system serves the site and will remain. Disposal of wastewater goes into said private septic system. The current septic system that will be located within the new proposed SUP boundary has one 1,250-gal tank This will accommodate 595 gallon per day for estimated design flow (1250/2.1 = 595 gpd). Per a septic analysis provided by Shawn Whitmer, Professional Engineer with AdvANTAGE Consulting Services (4248 E. Rainbow Drive, Gilbert, Arizona 85297), the following septic capacity calculations apply to an event center of this type: • Total attendees = 100 Total Parking Spaces = 28 Dance hall flow factor = 100 people x 5 gal/day per person = 500 gal/day or Park (temporary Use Picnic flush toilets only) = 20-gal x parking space Therefore: 20-gal x 29 parking spaces = 580 gal/day use higher amount Design Flow = 580 gal/day Minimum Septic Tank Size = Design Flow x 2.1 factor = 580 gal/day x 2.1 = 1,218 gallons In conclusion: Existing system has sufficient capacity for the event center. Crystal Creek water, Dynamite Water and others. Wastewater disposal goes into the private septic system Fire Protection: Daisey Mountain Fire Department on New River Road Natural Gas: Southwest Gas Telephone is Century Link, Verizon, AT&T, Sprint and more. Hello Sir, I would like my email to be included in the public comments for the SUP for Wrangler’s Roost. I have lived in New River for a combined total of 22 years. I have taught at New River school, volunteered with many events in our community, and enjoy most every part of the living out here. One of my neighbors hates everything about Wrangler”s Roost! He is doing everything in his power to shut this establishment down. He sent letters to many neighbors around the area, but did not send one to me as he knew how I supported this business! That’s not fair and it’s sneaky! Send the letter to all involved or none. Wrangler’s Roost has been around for many, many years! I took my older kiddos for a tour and hot lunch there many years ago. Now with our two youngest kiddos we listen to the fun wedding music on the weekends. Or shall I say used to , as this neighbor has a cease and desist order against Wrangler’s Roost. The music is fun, wedding music ,celebrating a wonderful time in a couple’s lives. The music is usually only on a Friday or Saturday evening and is always off by 10:00 PM. Maybe a couple of times, it went until midnight , but that’s rare. This neighbor is not used to our way of life out here in New River, tries to change things that have been done around here for generations, he installed gates on his property so the delivery drivers can’t turn around on his property, wants to pave our dirt road, and complains about the previous owner of his property who was a great older gentleman. Wrangler’s Roost holds much history, has historical buildings and used to be a Pony Express stop! Please allow Wrangler’s Roost to host events again with a SUP, with stipulations, as the music needs to be off by 10:00 or 11:00pm. No foul language on a microphone, limit the attendance to whatever the fire Marshall agree’s to. We all need to work together in this tough world to help each other out and not be so against each other!! Thank you for your time and consideration. I am writing in response to a letter received from Marko Dapcevich regarding the above referenced business. We are residents of New River and live slightly to the E of Wrangler's Roost on the opposite side of the Road ‐ 23rd Dr. We have owned property for about 6 to 8 years now, and built our home about 2 years ago. Part of our attraction to New River was its authenticity and rustic charm, including Wrangler's Roost. We have never met the Stewarts, but we share their vision of protecting and maintaining the minimal amounts of history that still exists‐‐and being able to share it with the public. Although I understand the Stewart's have neglected to pay some expenses on their place, which I understand, and agree, is not acceptable. It would be nice if there were some small amount of funds or tax breaks available to them to help maintain and protect this historic location for future generations to explore and learn about. I have reached out to Mr. Stewart and suggested having some type of open house and/or fundraiser to help either annually or maybe even monthly. I am not sure this is legal under his license, but I think it would help. In any event, I feel this place has been here far longer than any of the property owners around or near to them, and was here when most, or maybe all, bought their land or homes. As such, it should be grandfathered in (so to speak) and people should be happy to help keep it alive as a historical site. If my vote counts, I vote to grant them their required license and let them continue their business ‐ since they were here first ‐ and it was not a secret what they do. There are other places around here that are far worse, but again, those places have been here for many many years too, and we all chose to accept them when we purchased our property. PS ‐ although people do prefer a dark sky, having lights on 2 ‐ 3 days per week for an event, is not a big deal ‐ and should be understandable as otherwise their place is dark and a bit hard to find. Thank you. Please feel free to reach out to me if need be. I can be reached at 602‐399‐2411. I have attended many events at Wranglers Roost over the years between different owners. Wranglers Roost is a unique and endearing landmark that has been open to the public for a variety of events over the years. This community has benefitted from this historic site and will continue to benefit under the stewardship of Reid & Heidi Stewart. I know the Stewart's to be good, conscientious and community minded people. Dear Mr. Lorentzen, I am writing to ask that you approve the special use permit (case #SU240007) to allow Wrangler’s Roost to operate as a wedding and special event venue. This historic property has a rich heritage of serving our community over the past 200 years. It has been a stage coach stop, a hotel housing travelers and the teacher for the local one room schoolhouse, a dude ranch, and an event venue. Personally, as a kid growing up in the ‘70’s in the subdivision just north of Wrangler’s Roost, I remember getting to swim in the pool during the off season. There is unique value in having a local, historic property meaningful to so many in our community that is available to host events. My family celebrated both my husband’s 50th birthday party and my son’s wedding at Wrangler’s Roost. The property is perfect for Western themed events, is local, family owned, accessible, and friendly. It would be a great service to our community to keep Wrangler’s Roost operating as a wedding and special event venue. Please approve the special use permit to allow Wrangler’s Roost to continue serving the people of our community. Thank you, Heather Fowler, DVM 810 W. Circle Mountain Rd. New River, AZ. 85087 1 To Whom It May Concern, I am writing in strong support of granting a Special Use Permit for Wrangler's Roost. I have personally visited the property on multiple occasions and have witnessed firsthand the extraordinary transformation of what was once an abandoned and dilapidated structure into a beautiful and historically respectful venue. The owners have invested significant resources, labor, and vision into preserving and restoring this property, thereby reclaiming an important piece of local history that might otherwise have been lost. In addition to visiting the property, my own son and daughter-in-law held their wedding at Wrangler's Roost. The event was marvelous in every respect. The venue provided a beautiful setting for a cherished family occasion, and our experience demonstrated the care and professionalism with which the property is operated. Our family will always have treasured memories associated with that special day. The restoration of Wrangler's Roost has not only preserved a historic property but has also enhanced the surrounding area. Rather than allowing a deteriorating structure to remain an eyesore, the owners have improved the appearance and value of the neighborhood while creating a venue that serves families and the community. I understand that some neighbors have raised concerns regarding noise from occasional wedding events. I believe those concerns deserve respectful consideration. However, it is my understanding that the owner has demonstrated a willingness to be a good neighbor by agreeing to lower music volumes and shorten the hours during which amplified music is played. Such accommodations reflect a sincere effort to balance the needs of neighboring residents with the operation of the venue. No property use is entirely without impact. The question is whether the overall benefits outweigh the occasional inconveniences. In my opinion, they clearly do. Wrangler's Roost represents exactly the kind of private investment, historic preservation, and community enhancement that local governments should encourage. I respectfully urge the County to grant the requested Special Use Permit and allow Wrangler's Roost to continue operating under reasonable conditions that preserve both neighborhood peace and the many benefits this venue provides. Thank you for your consideration. Respectfully submitted, John W. Hello Mr. Lorentzen, We are neighbors of Reid and Heidi Stewart, who are in the processes of applying for a special use variance (SUV) for their property at 2504 W New River Road in New River Arizona. My wife and I have resided on the property next door at 2305 W New River Rd since 2017. The Stewarts have been exemplary neighbors over this past decade. Their property in questions, known as Wranglers Roost, is a historic site with buildings dating from the 1800s. If it were not for the Stewarts, it is likely we would have lost this history because they have preserved them and love sharing them with the community. My wife and I have attended several events where they have opened their property for community gatherings. If there were any cause for complaint, we would be the first to know since our property overlooks Wranglers Roost. It would be a loss to the community to bar Wranglers Roost from social gatherings. Having known the Stewarts over the past decade, I can testify that they are honest people with a love for their community. They love to serve those in need and are often the first to step up. Please consider our testimony when weighing your decision for this variance. Please use caution when corresponding outside the county. Mr. Lorentzen, I am sorry it took so long to provide this to you. It turns out it was a little more complicated than I had anticipated. You may recall I rescinded my previous comment in regards to the Wranglers Roost SUP 240007. Below is the comment I wish to replace it with. Please confirm that you have received this and that the previous comment is replaced with this. Thank you. I am writing today to express my opposition to special use application 240007 filed by Roan Construction for the Wranglers Roost at 2500 New River Road in New River. The location for this proposed event venue is very rural and low Density. In New River there are no streetlights. There are only two lane roads and the maximum speed limit is 45 miles per hour. There are more dirt roads than paved. It is low density, very quiet, and dark. Saguaro cactus outnumber people. Events are by nature loud, late and bright affairs. With them come lots of people, traffic, DJ’s, bands, cheering, etc. That activity does not fit in with the characteristics of New River and its rural zoning. There are no businesses even remotely similar to this in the rural zoning of New River. Businesses in the rural zoning of New river consist of a feed and tack store, some nurseries, and animal related businesses. People live in New River for the quiet, dark skies, and wonderful views that the RU43 zoning allows them. A business that generates traffic, noise, and lights is not conducive to this area and does not belong here. A very commercial business like an event venue belongs in commercial zoning, not a rural one. Another concern, if an SUP like this is granted, is the lack of protection provided by Maricopa County. The County has not addressed the relevant concerns of the neighbors going back nearly a decade. In that time PND has not enforced their orders to comply as well as their cease and desist order. MCSO has not enforced the dark skies provisions of the zoning code even though they are mandated to do so. Finally, MCAO has refused to prosecute any nuisance or the P23 noise ordinance. It would be unfair for the County to allow an event venue when the area residents would have no hope of the County monitoring, regulating, or enforcing the code or any conditions placed on the SUP. 1 Please do not allow for a very commercial use that does not belong in a very rural area. An event venue is not an appropriate use for this area. -- Marko Dapcevich Mayor Emeritus 503-956-6240 2 Appropriateness: This proposal is not a good fit for a rural area. Event venues result in noise, lights, and traffic. This is not a good fit regardless of the time or day. This request is not for a small cottage industry. There would be large events held outside. Zoning laws exist for a reason. Quoting the zoning code, “The principal purpose of this zoning (RU-43) is to conserve and protect farms and other open land uses, foster orderly growth in rural and agricultural areas, prevent urban and agricultural land use conflicts…” This use is a direct conflict. If someone wants a commercial business they should buy commercial property. In a 1.5 mile radius there are no similar business. There is a handful of cottage businesses. The most commercial operation is a church. There is no unmet need for an event venue in New River. There are 7 within a 20 minute drive. It’s also unfair to the venues that are on appropriately zoned commercial property. The proposed times of operation conflict with the time residents would choose to enjoy evenings outdoors. A precedent should not be set. We have already seen similar venues in the area operating without a SUP and don’t need to open the door for numerous such enterprises. An event venue in the area will have an impact on property values and other uses like an airbnb. Enforcement: For 10 years Maricopa County did not enforce their ordinances, orders, and agreements. Even though required to enforce the zoning code MCSO flatly refused to do so. In March of 2022 MCSO Captain Brandimart issued an order NOT to enforce. For equally long P&D did not enforce their orders. P&D did not enforce its Cease and Desist for three years. The results were the same from the Assessors office, Board of Supervisors, Ombudsman, and County Manager. This SUP should not be approved without a monitoring and enforcement mechanism in place. The SUP should include verbiage that the SUP Shall be revoked if conditions are not meant. Due Dilligence: If the county does wish to consider recommending this SUP some due diligence is needed. This would include: • A review of the notification process. The CPP says the level of citizen interest and area involvement will vary depending on the nature of the application and the location of the site. The target area for early notification will be determined through a coordinated effort of the owner or authorized agent and staff. In this case that only included the minimum. As staff noted in their report these are all family and associates of the applicant. Staff was aware from police reports and public comment that people heard the activities of the WR from a mile or more away yet chose to allow for notification only 300 feet from the property even after agreeing that the notification area should be expanded. I believe staff erred by only allowing the minimum. It has been nearly two years since this application was filed. New houses have been built, houses have been bought and sold and tenancy has rotated. If this board is considering approving this SUP then notice should be expanded, redone and insured it is correct. • Staff noted “the violation history and public comment that has been received indicate a level of carelessness for existing ordinances and regulations such as noise and light ordinances”. The county should confirm that any orders, directives, agreements, stipulations, and directives are currently being complied with before a recommendation to move forward is considered. Conditions: If this board chooses to move forward with an approval recommendation further consideration should be given to the conditions staff recommends. • Days of operation should not include Sunday. Sunday is a work/school night and should be treated like any other work/school night. • Hours of operation should not allow until 10:PM. It’s a rural area and people tend to be in bed before 10:PM. 8:PM would be more appropriate. • If the recommendations stand as written it would allow for lights at a height of 35 feet. Limit of height of lights should be included. • The five-year stipulation should be reduced. This is not an inconvenience to the applicant as long as he follows the conditions. It would provide additional comfort to the residence if he does not. • The conditions reference the noise ordinance. MCSO refused to enforce that for five years. When they did submit for charges MCAO refused to prosecute. One year later MCSO submitted for charges again. MCAO waited almost a year to file charges and then, on May 6 2024 MCAO moved to dismiss based on it being a flawed ordinance. I have addressed the BOS and they have refused to revise the ordinance. The citizens of New River have no protection from P-23. The county needs some sort of enforcement mechanism besides P-23. • Wording should be changed from “may” to “shall”. Noncompliance with any conditions shall result in revocation. • Staff proposes a limit to 65 decibels off property. According to Yale University 60-65 decibels is the sound of a normal conversation. Imagine trying to have a normal conversation over a conversation level noise in your own yard. A suburban area at night is 40 decibels. 65 decibels is 2.5 times louder. Of course RU-43 is rural, even quieter. 50 decibels would be more appropriate. • Staff recommends that one employee must posted at the new river road entrance. The requirement should require also visible from new river road. A liaison should be visible. Conclusion: The county has a responsibility to the entire community. The county needs to look at the greater good and weigh the pros and cons to all parties involved. Lastly, preference should be given to the people who are living in the area because they enjoy the quite, peaceful, dark evenings. This is why people live here. A SUP should not be issued. But if it is the county needs to confirm that all conditions of the SUP are met and the properties are in compliance with all current county orders, agreements, and regulations. If a commercial enterprise is placed in a rural district it should have to adapt to the rural nature as opposed to the residents adapting to the commercial nature of the business. Anything different is patently unfair to the people and lifestyle of the residents. As a homeowner near the Wrangler Roost property, I am not supportive of the permit to allow for venues. This will create traffic, drinking and increase potential risks of accidents for the 27th Ave/New River intersection. This unwanted noise is disruptive to a quiet, rural neighborhood. Additionally, it will add trash in the surrounding areas and have concerns as to how they will manage the clean ups of large events. In my observation, from reading the articles on the violations and in observing him build homes in the neighborhood there is a lack of consideration and respect for neighbors and are not mindful of county regulations during the building process. Good morning Mr. Lorentzen, I have been advised that Reid Stewart and/or Wrangler's Roost has applied for a Special Use Permit to use the property on New River Road as a wedding and event venue. My address is 48162 N 23rd Ave, New River, AZ 85087. My property is approximately 1,000 feet from Wrangler's Roost and I have lived here for 25 years. For years, starting perhaps in 2014, Wrangler's Roost has been used as a wedding and special event venue. Consistently, the music has been so loud that with my doors and windows closed, I can hear the music during the events, often well up until midnight. The music is so loud that the western wall of my house sounds like someone is pounding against it. At one point, in perhaps 2019, several neighbors met with Reid to discuss the problem to see if we could reach an amicable agreement. Nothing came from that meeting. Many of the neighbors have called MCSO for years because of the loud noise and have contacted Reid about it. He has consistently lied about the use ‐ even under oath at a hearing held before Maricopa County Planning and Zoning in July 2021, which I attended and was also attended by my neighbor, Marko Dapcevich. At a hearing this spring, the neighborhood became aware that the Maricopa County noise ordinance is so poorly written that it does not apply to people 1,000 or more feet away from the source of the noise. Imagine what Reid will do if given free rein to have his paid guests blast their music as loud as they want, now realizing he is unfettered by the poorly‐written ordinance. For the sake of maintaining a quiet neighborhood, one which allows homeowners the quiet enjoyment of their property, I am requesting that you deny the Special Use Permit. We live in a rural area; bought our homes because of the quiet, and many of us commuted miles to our work because when we came home, we wanted a peaceful environment. If we wanted to listen to someone else's music, we would have bought next to the Roadrunner. Please contact me if you have any questions or want further information. New River is a place where families come for the country environment and the opportunity to raise children in a very wholesome environment. Horse properties, Ranches, and residential homes are all interspersed in the community, as it has been for decades. New River is a peaceful community, where the neighbors are friendly, helpful, and responsible. The Stewart clan presents a very different picture. We put up with the noise, and the drunkenness, for a while, apparently the Stewarts have an Alcoholic Beverage license. The last thing any neighborhood needs is more drunk drivers on the road as they leave the parties happening on the Stewart property. One evening, our family was at home, enjoying a movie together, when we started hearing vulgar four-letter words being loudly, and proudly, broadcast by the latest Stewart party. I went outside, and saw that there were over one hundred people, yelling along with the ‘musicians’. The noise and vulgarity were overwhelming. I found a phone number for the property and called them. To my surprise, Mrs. Stewart answered the phone. It turns out that she was just as appalled as I was. However, Mr. Stewart did nothing, the onslaught continued. After waiting for an hour, I called the Sheriff. The responding Deputy shut the party down, then drove to our property to advise us of the results. The Deputy informed us that he had to deal with many drunken individuals and a very upset property owner, Mr. Stewart. The next morning, I received a text from Mr. Stewart, he informed me that he had spoken with one of our neighbors and had managed to smooth over the situation. He went further to say that ‘at least the neighbor had the courage to talk to him’. I realized then that he had absolutely no interest in becoming a part of this community. 1 As has been documented, the parties have continued for years. The Sheriff has had varying degrees of effectiveness in dealing with the situation. The Stewarts have apparently racked up Thousands of dollars in fines and legal fees, and still, they are thumbing their noses at our community. Before you grant permission to the Stewarts to continue to assault this community, please try to envision the following. Imagine that the Stewarts opened an event venue in the Anthem business district. Do you think the Anthem Community Council would put up with the noise, vulgarities, and drunkenness? Anthem would shut them down after one night, as they should. Why would anyone think that any community should be subject to the Stewart’s fantasy of building an event venue in the heart of a wonderful residential community? Dear Andrew Lorentzen, We are writing to you to please not issue a Special Use Permit to Reid Stewart at Wranglers Roost for any reason, especially for hosting weddings or other events that have loud music and a loudspeaker blasting every word they are saying. We have been putting up with this loud music and loud disc jockey with the microphone turned up to the max for many years. We even had a neighborhood meeting with Mr. Reid to ask him to please turn down the music. He did not. We have been calling the sheriff on every occasion to get them to stop. They did not stop. We could not sit out on our patio and have and enjoy our evening because it was so loud, we had to go inside and close the doors and windows. And the vibration of the music continued to be felt in our home. This is a community that surrounds Wranglers Roost. A large number of people are experiencing discomfort or negative impacts due to the loud music and loudspeaker. You can't enjoy an evening on a weekend because you can't carry on a conversation with your guests. Mr. Reid has been getting away with this problem for years. The sheriff goes over and asks them to turn it down. But most of the time when they leave the music gets turned back up. His property is not zoned for a business like this. Over the past five years I have seen a great increase in traffic on New River Road and the additional traffic for his venue has caused unnecessary safety issues. The noise has been a bother to our peaceful area, and all the bright outdoor strung lights are many times left on for days or weeks. Golf balls from Wranglers Roost sometime appear on our easement. I would prefer if the activities no longer happen. My neighbors have filed complaints concerning his unapproved filling in of the solid rock washes next to our easement. He buried broken drywall, old furniture and demolition debris, was cited by Maricopa Enviromental Dept. but has continued with such activity anyway. Look up the records. I can easily hear the music during their large event venues. It is a distraction from our normal quiet evenings. More concerning is that Mr. Stewart has owned 2 lots in our neighborhood since we moved in. He has shown a disregard for the by-laws of our community and has refused to participate in the costs of shared wells and road maintenance. From his past history it seems like he feels above the law and will tend to act only in his own self interest. Rob Mason 2520 W. Please use caution when corresponding outside the county. Dear Mr Lorentzen, My name is Karyn Vanderlip and I am a resident of New River, Arizona where I own a house. I am writing to voice my concern about the Wrangler's Roost requesting a Special Use Permit SU240007 to host weddings and events. In the past, when they were operating, the noise from the events was unbearable. Even though my property is well beyond the 1,000 feet source of noise, the DJ and music could be heard outside and inside my home with the doors and windows closed until 11pm or 12 midnight. On these nights it was difficult to sleep with the sounds of the music and bass thumping, the DJ announcements and party noise (yells and whooping). We moved out to this rural community to enjoy the dark and peaceful nights, and with this type of business operating, that will disappear. We have had a lot of new neighbors who have moved up here since his operation was shut down, and they have no idea that this was a problem. I am also including two pictures of the SUP notice posted on the outside wall of their property. This is very deceiving as it is difficult to see. Even though I drive past the property every day I was unaware of it. I had to drive by a couple of times to find it after my neighbor alerted me to it. Generally people drive 55mph or more on New River Rd and will never notice the sign or it's importance. Therefore, I do not think the community surrounding his property ( and beyond) will be aware of his plans to host events. If this SUP is granted there will be many surprised people. This business does not belong in a rural, residential neighborhood, where sound travels miles and miles, and we will be condemned to listen to his DJ's, music and parties every weekend. Please feel free to contact me if you need any more details or information. The music is too loud and they play it way too late, and when you ask them to be considerate they do nothing. I vote NO. Andrew, This correspondence is in reference to the Wranglers Roost Special Use Permit, SUP application. My property is adjacent to the Wrangler Roost Property. The events that have been held there have not created any problems or issues, nor have they generated any noise concerns. Wranglers Roost is an important part of our small community. I am in full support and in full agreement for the approval of the SUP applications, so that these events can be continued. Thank you Gerald LaPolla 2515 W. I live off of 27th Ave & New River Road. There is only noise on the weekends (Friday and Saturday). Wrangler Roost only plays music until 10:00 PM. Let the guy make a living. It's nice to sit on my patio and listen to the music and happy people. If you want to discuss noise I can hear the Roadrunner Bar & Grill from my home as well. If you are going to go after the Wrangler Roost then you need to check out the noise from the Roadrunner as well. Wrangler Roost is bringing business to New River and I am sure his taxes help out our community as well. Let Mr. Stewart, makes a living doing something he enjoys. This is not a business that runs every night or even every weekend. The people who are complaining need to put themselves in Mr. Stewart position and how would they feel about the community trying to shut their business doors. Let him stay open and make a living just like the rest of us who work out here. Sincerely, Cindy Hedge 1
