DETAILED WRITTEN DESCRIPTION OF THE ACTION TO BE RATIFIED Pursuant to A.R.S. § 38-431.05, the Maricopa County Board of Supervisors proposes to ratify prior instruction/action given by the Maricopa County Board of Supervisors to the Maricopa County Attorney’s Office. The Maricopa County Board of Supervisors held an Executive Session on June 8, 2026, regarding potential litigation against the State of Arizona relating to erroneous conviction statutes, and direction was given to legal counsel to join the City of Tucson in potentially initiating litigation against the State of Arizona. On September 17, 2026, a Verified Special Action Complaint was filed by outside counsel for Plaintiff City of Tucson against the State of Arizona regarding the erroneous conviction statutes. Maricopa County is a named plaintiff in the lawsuit. Because Maricopa County is a named plaintiff, the initiation of the litigation must be ratified by the Maricopa County Board of Supervisors. The proposed ratification is set to be heard at a formal meeting of the Maricopa County Board of Supervisors on October 21, 2026 at 9:30 a.m.
