Jefferson Street, 9th Floor Phoenix, AZ 85003 EXEMPT ARS §11-1134, (A)(2) FCD 1999R016 NON-EXCLUSIVE SEWER LINE EASEMENT Project:112.01.12 Indian Bend Wash Inlet Permit: 2015P004 Item No.: S-2209 THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY, a political subdivision of the State of Arizona, its agents, successors, and assigns, GRANTOR, in accordance with GRANTOR’S Board of Directors Resolution 2018R013 dated October 24, 2018 and 88-5 dated January 16, 1989, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, does hereby grant and convey unto THE CITY OF SCOTTSDALE, an Arizona Municipal corporation, its agents, successors and assigns, GRANTEE, a non-exclusive sewer line easement for the purpose of constructing, operating, repairing, and maintaining a sewer line and appurtenant facilities upon the premises hereinafter described: See attached EXHIBIT “A” and EXHIBIT “B” Attached hereto and incorporated herein GRANTOR reserves the unfettered right to utilize the property for flood control purposes. GRANTOR reserves the right to permit other uses within the easement area as long as any such use does not interfere with the GRANTEE’S sewer line facilities. GRANTEE agrees to indemnify GRANTOR for any and all direct damages GRANTOR may suffer caused by or arising from the proximate result of the activities of GRANTEE its officers, employees, agents or contractors in the exercise of GRANTEE’S rights pursuant to the terms of Page 1 of 8 Exhibit A to Resolution No.13718 Page 1 of 8 this Easement, except such injury or damages caused by or arising from the negligence or willfulness of GRANTOR its officers, employees, agents or contractors. In the event GRANTEE shall have failed to install any facilities within the easement, or in the event GRANTEE shall have removed any such facility, or in the event any such facility shall cease to function, or in the event of any other event giving evidence to GRANTOR that the GRANTEE has abandoned the use of this easement, then and in such event, GRANTOR shall notify GRANTEE, in writing, that GRANTOR considers that the easement has been abandoned. In such event, GRANTEE shall provide confirmation to GRANTOR that the easement has been abandoned, or in the event GRANTEE shall fail to reply that there has been no intent to abandon the easement within thirty (30) days of receipt of the aforesaid notice from the GRANTOR, this easement shall be deemed to be abandoned and GRANTOR shall be permitted to record a revocation of this easement in the public records of Maricopa County. Unless and until such revocation is recorded by GRANTOR, this easement shall remain in full force and effect. This easement is binding and shall run with the land.
