Mr. Williams confirmed they are allowed two additional arrays before use fees are required. There being no further comments, Mayor Schoaf closed the public hearing at 7:29 PM. B. Public Hearing: Tierra Verde Shopping Center Rezone DISCUSSED Mayor Schoaf opened the public hearing at 7:29 PM. Mr. Proch stated the applicant held a Citizen Review meeting on August 27, 2026, to receive any feedback on his request. A member of the public and one Council Member attended the meeting. The applicant provided answers to numerous questions about the center or future plans. It is important to note that any future development considerations are independent of the rezone action. Staff supports the inclusion of this property into the same zoning district as the surrounding development, dependent upon the applicant agreeing to the conditions of approval. At this time, staff has not received confirmation of support of the required conditions and is therefore recommending a date specific tabled action. There being no further comments, Mayor Schoaf closed the public hearing at 7:32 PM. C. Non-Conforming Sidewalk & Path Panel Replacement APPROVED Mr. Drunasky stated staff completed a Citywide field evaluation of the condition of existing sidewalks and paths to determine locations of deficient, damaged, heaving, cracking or shifted panels. This evaluation generated an itemized listing of over 90 locations with a total of 259 sidewalk panels that are non- conforming. The Engineering and Public Works/Grounds Departments have removed and replaced some panels each year in areas that the public submitted complaints about and areas that Staff noticed needed attention. However, this is the first comprehensive list of deficient sidewalks that has been produced. The current CIP includes $120,000 for sidewalk and path replacements for this current fiscal year, but this CIP item budget was developed prior to generation of the comprehensive list and only allows for approximately one-quarter of the deficient panels to be corrected. Staff anticipated replacement work may need to extend into additional fiscal year(s) CIP's based on available funding, which will spread the incurred costs over several years. There was some discussion regarding the removal of trees and possible liability issues the City would have if the work isn't done. Mr. Drunasky provided two options for the Council to decide, and they chose Option 2, which will execute a construction contract to replace all non-conforming panels in an amount not to exceed $404,000.00, to include the current CIP budget amount of $120,000.00 and an additional $284,000.000 from Capital Contingency. MOVE TO APPROVE USE OF CAPITAL IMPROVEMENT FUNDS NOT TO EXCEED $404,000 TO REMOVE AND REPLACE NON-CONFORMING, DAMAGED & DEFICIENT SIDEWALK PANELS AT VARIOUS LOCATIONS THROUGHOUT CITY LIMITS AND TO EXECUTE ONE OR MORE CONTRACTS WITH CONTRACTORS EITHER BY DIRECT SELECT OR THROUGH COOPERATIVE PURCHASING AND AUTHORIZE THE MAYOR TO EXECUTE THE REQUIRED DOCUMENTS.
