RESOLUTION NO. __________
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MESA,
ARIZONA, APPROVING AND AUTHORIZING THE CITY MANAGER OR
DESIGNEE TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT
WITH THE SALT RIVER PIMA-MARICOPA INDIAN COMMUNITY TO
ACCEPT PROPOSITION 202 FUNDS AND ADMINISTER AWARDED
FUNDS AS PASS-THROUGH GRANTS TO DESIGNATED RECIPIENTS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MESA:
Section 1: Arizona’s Indian Gaming Compact provides that an Indian Tribe make twelve
percent (12%) of its net annual State contribution to cities, towns, or counties for government
services that benefit the public. Private, not-for-profit organizations wishing to access Indian
Gaming Funds (“Gaming Funds”) to provide public benefits must secure sponsorship from a city,
town, or county. This sponsorship must be expressed in a resolution passed by the local
government sponsor.
Section 2: The Salt River Pima-Maricopa Indian Community (“SRPMIC”) provides Gaming
Funds through its State Shared Revenue Grant Program for eligible programs and projects that
benefit the general public. The City of Mesa has sponsored applications for eligible programs and
projects seeking funding from SRPMIC and may receive awarded funds for City programs and/or
serve as a pass-through agency for eligible community organizations.
Section 3: The City of Mesa has no decision-making authority over which organization
receives Gaming Funds from SRPMIC. The final decision-making authority rests with SRPMIC.
Section 4: SRPMIC wishes the City of Mesa to receive and distribute $1,450,000.00 from its
2026 12% revenue award cycle for grants to designated recipients as listed in the
Intergovernmental Agreement between SRPMIC and the City presented to the City Council on
this date (“IGA”).
Section 5: The City Council approves the IGA and authorizes the City Manager, or his
designee, to execute the IGA and any amendments, supplements, or extensions thereto as
necessary to carry out the intent or to facilitate the purpose of the IGA, provided they do not
materially alter the terms or purpose of the IGA as presented to the City Council.
Section 6: The City Council further approves and authorizes the City Manager, or his
designee, to accept awarded Gaming Funds and for the City of Mesa to act as a pass-through
agency for distribution of the Gaming Funds directly to the designated recipients. The City of Mesa
makes no guarantees beyond disbursement of funding to any non-city recipient. Upon the City of
Mesa’s distribution of the Gaming Funds to the non-city recipient, the City of Mesa shall be
considered released from any and all claims, demands, debts, liabilities, or obligations that may
arise in the event that the non-city recipient fails for any reason to expend the Gaming Funds in
accordance with their grant application with the SPRMIC.
