a. Development of the site shall be in substantial conformance with the Site Plan
entitled “1215 W Hatfield Road”, consisting of one full-size sheet, dated April 1, 2021,
and stamped received April 16, 2021, except as modified by the following
conditions.
b. Development of the site shall be in substantial conformance with the Narrative
Report entitled “1215 W Hatfield Road”, consisting of four pages, dated April 8, 2021,
and stamped received April 16, 2021, except as modified by the following conditions.
c. The following Planning Engineering conditions shall apply:
1. No encroachment into adjoining Federal Patent Easements shall be permitted
unless said easements are abandoned by the County.
2. Historic inflow and outflow drainage locations and characteristics must be

be submitted for approval and acquisition of building permits.
4. Building permits for site improvements/grading must be submitted within 180 days
of Board of Supervisors approval.
5. Engineering review of planning and/or zoning cases is for conceptual design only
and does not represent final design approval. All development and engineering
design shall be in conformance with Section 1205 of the Maricopa County Zoning
Ordinance; Drainage Policies and Standards; Floodplain Regulations for

apply:
1. Must obtain a new Notice of Intent to Discharge (NOID) from onsite MCESD
program and provide water service information when submitting for building
permits.
e. The following development standards shall apply:
1. An east street side yard of zero feet.
2. The use of chain link fences without obscuring materials as screening.
3. The use of crushed asphalt millings without binding agent for dust control.
f. Prior to occupying the existing building or any portion thereof for any use associated

g. Any structure on the site over 200 sq. ft. or over 12-feet in height, including fences
constructed on site prior to January 1, 2000, shall obtain a building/fence permit within
180 days of approval by the Board of Supervisors. Any structure not modified without
any observable defect or public safety concern will not require a building permit;
however, if these structures have been modified and/or have observable defect or
public safety concerns a Certificate of Observable Compliance Permit with a letter
of compliance by a registered professional architect or structural engineer shall be
provided.
h. Within 180 days of approval by the Board of Supervisors and prior to zoning clearance
for construction permits the property owner shall not encroach into the Federal Patent
Easements, rights-of-way or the required 25-feet by 25-feet sight visibility triangles at

Easements prior to the completion of permits no later than one-year from approval
by the Board of Supervisors.
i. This special use permit shall expire on July 14, 2031, or upon termination of the use for
a period of 90 or more days, whichever occurs first. All site improvements associated

a revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
k. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date
of application, subject to conditions. In the event of the failure to comply with any
condition, and at the time of expiration of the Special Use Permit, the property shall
revert to the zoning that existed on the date of application. It is, therefore, stipulated
and agreed that either revocation due to the failure to comply with any conditions, or
the expiration of the Special Use Permit, does not reduce any rights that existed on the
date of application to use, divide, sell or possess the property and that there would be
no diminution in value of the property from the value it held on the date of the Special
Use Permit is granted and reverting to the prior zoning results in the same value of the
property as if the Special Use Permit had never been granted.

Project Summary:
1. The applicant is requesting a Special Use Permit (SUP) for an existing outdoor storage
facility in the Rural-43 zoning district. The “Interim Industrial Use” SUP is limited by the
ordinance to a maximum period of ten years. This site is generally located ¼ mile
southeast of the southeast corner of 15th Ave. and Happy Valley Rd. in the Phoenix area,
a mile north of the Deer Valley Municipal Airport. This site is in a portion of the County
dominated with industrial uses and business parks, a majority of which involves outdoor
storage. Large portions of this area have been annexed into the City of Phoenix and a
few properties within the unincorporated area have SUPs for industrial uses, similar to this
request.
2. The site is currently being used for the storage of construction/landscaping material,
equipment, boats and recreational vehicles in 14 separate fenced off lease areas in the
western portion of the lot and open storage areas in the eastern portion of the site. In
addition, there is one existing 3,884 sq. ft. single-floor building consisting of an office, two
attached garages, and one attached storage shed adjacent to the east property line
used for on-site security and storage. It should be noted that the existing building, built
after 2000, does not have an issued building permit and as a condition of the SUP the
property owner will be required to obtain building permit for this existing structure. The
applicant is planning to add a large garage/shop to repair trucks in the future in the
northern portion of the site. This site has an existing 15,000-gallon water tank that is
permitted by the previous landowner, used for the storage of hauled water.
3. Access to the outdoor storage area, parking area, and office building is via two
driveways along Hatfield Rd. to the north. The business generates very low traffic with
one to five employees who only visit the site briefly to gather equipment or materials.
Furthermore, hours of operation are generally between 6 a.m. to 6 p.m., but may change
depending on the season, Monday through Saturday.
4. The property does have two code violations, which are currently in Legal Action. The first
violation is for a possible business in a rural zoning district (V201801014). The Planning &
Development Department received complaints in June and October of 2018, alleging
the property owner was parking non-accessory vehicles on the property, not obtaining
permits for as-built construction, operating a commercial business, and excavation on
the site without drainage clearance. A second violation followed for the accumulation
of junk, trash, and debris on the property (V201801955). All of these allegations were
verified by the Code Compliance Officer. On August 25, 2020, a hearing was held where
the property owner acknowledged being out of compliance with the Zoning Ordinance,
but stated he was willing to proceed with the entitlement process for this site. Approval
of the SUP will help remedy the zoning violation.
5. As of 2019, the site was encumbered with 33-foot wide Federal Patent Easements along
every property line of the subject lot (Patent Number 1147174). These Federal Patent
Easements were created by the Small Tract Act of 1938, reserved for roadway and public
utilities in portions of the County not developed or developing at the time of enactment.
On December 11, 2019, the Maricopa County Board of Supervisors approved the
abandonment of the east and west Federal Patent Easements on this property with the
reduction of the north and south Federal Patent Easements to 25-feet (PAB-0104), see
attached. The reasoning for not abandoning the north/south Federal Patent Easement,
Z2019015

is to stay in compliance with state statute ARS §28-7210, because these easements
contain existing utilities and ditches. Furthermore, by maintaining the north/south Federal
Patent Easements the roadway is compliant with federal requirements. Even though the
Federal Patent Easements have been reduced and abandoned on the subject property,
these were only half-widths of 66-foot wide Federal Patent Easements which still exists on
the surrounding parcels adjacent to the subject site’s property lines. Moreover, there are
existing Federal Patent Easements surrounding the property that the County classifies as
roadways, which makes the subject site a through-lot with north/south front yards and
east/west street yards. Since both the north and south Federal Patent Easements have
been reduced to 25-feet and there are existing fences inside the north Patent Easement,
there will be a Condition included in this SUP request to remove any structure within these
easements and not develop inside these easements.
6. The applicant is requesting to vary the required screening of the site. Currently, there is a
mix of fencing with six to eight-foot solid walls and six-foot-tall chain link fences without
screening on adjacent parcels. Most of the land uses to the east and west are industrial
in nature. Moreover, the property to the south, in Phoenix, is zoned for commerce parks
and to the north lies a 230-foot wide SRP Power Line Easement with nursery uses. Another
request by the applicant is to vary the east street side yard to zero-feet from the required
20-feet for properties in the Rural-43 zoning district. This is justified by the fact there are
two existing sheds being used for the storage of tools and equipment inside this required
setback. Furthermore, since the east street side is adjacent to a Federal Patent Easement
that is only recorded at this location but not developed as a roadway reducing the east
street side setback will have a minimal impact. Arguably, since there is a 33-foot Federal
Patent Easement east of the east property line of the site where development is not
allowed plus a 20-foot wide street side yard on the adjacent properties to the east will
also act as a 53-foot wide setback on those properties, thus the impact of eliminating the
east street side yard on the subject site would be minimal. Still another request is to vary
the commercial paving requirements from asphalt pavement/concrete to crushed
asphalt millings without a binding agent to eliminate dust pollution from the site. The
justification for this request is that crushed asphalt without a binding agent for dust control
is permitted for residential driveways in Maricopa County. Additionally, a stockpile of
crushed asphalt millings is kept on-site, and any missing surfacing materials will be
replaced on a regular basis for this site.

Adopted Plan:
10. Phoenix 2015 General Plan (adopted March 14, 2015): The General Plan for Phoenix
designates the land-use of the site as Commerce/Business Park. The goal of this land-use
designation is to encourage employment opportunities and major business parks. Land-
uses generally consist of professional offices, research/development, wholesale/storage
warehouses, utility centers, manufacturing/processing centers, ancillary eating and retail
establishments. The proposed use of the site as outdoor wholesale storage would be
compatible with land-uses found in Commerce/Business Park designation. In addition,
one of the goals for unincorporated portions of the Municipal Planning Area of Phoenix
is to have land-uses that match the General Plan designation, in order to facilitate future
annexations into the City, which this SUP request will accommodate if approved.
Public Participation Summary:
11. The applicant complied with the Maricopa County Citizen Review Process with the
required posting of the site with notification by first class mail to adjacent property owners
within 300-feet and the areas interested parties of the subject site. As of the writing of this
report neither staff nor the applicant has received any comments or concerns for this SUP
request.
Outstanding Concerns from Reviewing Agencies:
12. There are no outstanding concerns from reviewing agencies. The City of Phoenix has
been notified regarding this SUP request, and as of the writing of this report staff has not
received comments or concerns.
Staff Analysis:
13. The applicant is requesting a SUP for an existing business that has been in operation for
many years at this site. The property owner, when purchased this property, was under
the impression that this was a commercial area and was able to place an outdoor
storage facility on this site. However, the property owner failed to realize that industrial
or commercial development on this site will require zoning entitlement, and structures
over 200 sq. ft. will require permitting. The property owner should have completed a due
diligent search of what a commercial/industrial development would entail on a lot in the
rural zoning district. These mistakes have resulted in a code violation, followed by a court
hearing, where the property owner demonstrated an admission of guilt and a willingness
to proceed with all entitlement and permitting steps to rectify the property owner’s
mistake. The existing land-use and business has been in operation for 11-years without
entitlement and only received complaints three-years ago. This SUP request would
ensure that the development of the site would abide by regulations and requirements of
the Zoning Ordinance, Americans with Disabilities Act, and International Building Codes.
Moreover, the SUP would contain conditions to ensure that any existing/new structure or
grading would require permits and other conditions designed to lessen the impact of this
development. Moreover, a condition to limit this interim industrial SUP to ten-years would
provide an opportunity for staff, the Commission, and the Board to evaluate the impact
of this development on the immediate area over a decade long period. (The ordinance
limits an ”Interim Industrial Use” SUP to a maximum period of ten years.) Therefore, staff
recommends approving this interim industrial SUP with conditions listed on the next page.

intersection of driveways, and shall remove all encroachments into the Federal Patent
Easements prior to the completion of permits no later than one-year from approval
by the Board of Supervisors.
i. This special use permit shall expire on July 14, 2031, or upon termination of the use for
a period of 90 or more days, whichever occurs first. All site improvements associated
with the special use permit shall be removed within 90 days of such expiration or
termination of use.
j. Noncompliance with any Maricopa County Regulation shall be grounds for initiating
a revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
