Report to the Board of Supervisors Prepared by the Maricopa County Planning and Development Department Board Hearing Date: July 14, 2021 Case #/Title: Z2021003 - Riverwalk Supervisor District: 4 Applicant/Owner: Malik Brown, Bowman Consulting Group / Riverwalk Olive Loan LLC Request: Rezone site from R-4 and C-1 to R1-6 RUPD Site Location: Generally located on the NEC of Olive Ave. and 99th Ave. in the Sun City area Site Size: Approx. 15.3 acres County Island Status: No Additional Comments: The applicant seeks a rezone from R-4 and C-1 to R1-6 with a RUPD overlay in order to develop the site as a single-family residential subdivision consisting of 90 dwelling units. The subject property is located within the White Tank/Grand Avenue Area Plan, which designates the site as a retirement community. The rezone is consistent with existing subdivisions adjacent to the site and the proposed development will be age restricted via deed restrictions, which is appropriate for developments in the Sun City area. The rezone with overlay will have no adverse impact on the Comprehensive Plan or the White Tanks Grand Ave area Plan. Staff received one letter from ADOT stating that the agency had no concerns and one letter from Luke Air Force Base Community Initiatives Team, stating that the proposed density meets Luke AFB’s Graduated Density Concepts guidelines. Staff has not received any other correspondence or calls concerning the requested zone change and there is no known opposition. Commission Recommendation: On 6/17/21, the Commission voted 6-0 to recommend approval of Z2021003 subject to conditions ‘a’ – ‘i’: a. Development of the site shall be in substantial conformance with the Narrative Report entitled “Riverwalk”, consisting of 25 pages, dated April 23, 2021, and stamped received April 23, 2021, except as modified by the following conditions. July 14, 2021 Z2021003 Page 1 of 3 b. The following Planning Engineering conditions shall apply: 1. No development approval is inferred by this review, including, but not limited to number of proposed building lots, drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 2. The traffic study is under review at MCDOT. MCDOT comments will be provided to the applicant as part of the preliminary plat review (case number S2021007). 3. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. c. All buildings subject to noise attenuation as per State law and Maricopa County requirements. d. The master developer shall notify future homeowners that they are located within the state-defined “territory in the vicinity of a military airport” with the following language: “You are buying a home or property in the ‘vicinity of a military airport’ as described by State of Arizona statute ARS §28-8481. Your house should include sound attenuation measures as directed by State law. You will be subject to direct over flights and noise by Luke Air Force Base jet aircraft in the vicinity. Luke Air Force Base executes over 200,000 flight operations per year, at an average of approximately 170 overflights per day. Although Luke's primary flight paths are located within 20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to and from the Barry M. Goldwater Gunnery Range and other flight training areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends. For further information, please check the Luke Air Force Base website or contact the Maricopa County Planning and Development Department.” Such notification shall be recorded on all Final Plats, be permanently posted on not less than a 3 foot by 5 foot sign in front of all home sales offices, be permanently July 14, 2021 Z2021003 Page 2 of 3 posted on the front door of all home sales offices on not less than an 8½ inch by 11 inch sign, and be included in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report and conveyance documents. e. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. f. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. g. Concurrent with recordation of subdivision plat/s deed restriction shall be recorded establishing all lots as age restricted so at least one household resident shall be 55+. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. i. The following R1-6 RUPD standards shall apply: 1. Minimum Lot Area: 3,600 sq. ft. 2. Minimum Lot Width: 45’ 3. Maximum Lot Coverage: 60% 4. Minimum Front Yard Setback: 10’ 5. Malik Brown of Bowman Consulting Group, on behalf of Riverwalk Olive Loan LLC, requests a zone change from R-4 with Senior Citizen Overlay and C-1 to R1-6 with an RUPD overlay on approximately 15.3 acres, generally located on the NEC of Olive Ave. and 99th Ave. in the Sun City area. In order to facilitate the development of the site as a 90 lot single-family, age-restricted residential subdivision. Primary access to the site will be via a gated entry from 99th Ave. The interior streets of the Riverwalk Subdivision are anticipated to be private. A concurrent preliminary plat containing 90 single-family lots is in process separately with the county as case S2021007. The project is anticipated to be completed in a single phase. 2. The applicant has applied for an RUPD overlay as part of this zone change to implement variations to the R1-6 base zone development standards. The following table lists the development standards to be varied under the R1-6 RUPD overlay in (bold). In addition to the initial notification letter sent on February 23, 2021 the applicant sent out an updated letter to property owners and areas of interest on March 22, 2021 in response to staff comments made during the Technical Advisory Committee meeting. 8. The applicant has provided a Final Citizen Participation Results Report stating that they have not received any letters of opposition or concern. Staff received one letter from ADOT stating that the agency had no concerns and one letter from Luke Air Force Base Community Initiatives Team, stating that the proposed density meets Luke AFB’s Graduated Density Concepts guidelines. Staff has not received any other correspondence or calls concerning the requested zone change application. Outstanding Concerns from Reviewing Agencies: Z2021003 Page 4 of 7 9. N/A. Staff Analysis: 10. Staff supports the proposed rezone of the site from C-1 and R-4 to R1-6 RUPD. The R1-6 RUPD is compatible with the existing subdivisions adjacent to the west of the site and the subdivisions of similar character further east of the site. The proposed development proposes a less intense lower density development than the multifamily residential developments north of the subject property. Additionally, the proposed development is age restricted via deed restrictions, which is in character with the type of development appropriate for the Sun City area. The proposed rezone follows the retirement community land use designation of the area plan, which will allow the creation of a community that matches the preferences of residents in the Sun City area. Recommendation: 11. For the reasons outlined in this report, staff recommends the Commission motion for Approval, subject to conditions ‘a’ – ‘i’. a. SITE PLAN E. PRELIMINARY LANDSCAPE PLAN I. INTRODUCTION Residential Pursuits Investments, LLC (“RPI”) is seeking a zone change with overlay from R-4 and C-1 to R1-6 Residential Unit Plan of Development (“RUPD”) to allow construction of a high quality 90-lot age restricted subdivision on a 15.31 gross acre site located at north and east of 99th Avenue and Olive Avenue (the “Property”). The Property is located in unincorporated area of Maricopa County (the “County”), lies in the southeast quarter of Section 29, Township 3 North, Range 1 East, and identified as Assessor’s Parcel Number 142-62-694 thru 711. It is surrounded by New River Wash on the east, and single family residential to the west, New River Wash and Olive Ave to the south, and Brook Hollow Apartments and Sunwood Apartments to the north. A Vicinity Map is attached as Appendix A an Aerial Map is attached as Appendix B, and the Legal Description is attached as Appendix C. The property is currently vacant land consisting of three main parcels. The northernmost parcel was previously platted as Riverwalk Condominiums but never constructed. The southern two parcels are vacant. II. PURPOSE OF REQUEST RPI intends to transform this vacant land into a high-quality age restricted community called Riverwalk Village (the “Property”), consisting of 90 detached residential lots at a density of approximately 5.88 DU/acre (gross) with open space featuring passive and active amenities. The Property would add variety to the lot sizes available in the area and increase the diversity of home ownership opportunities that is consistent with the west valley’s growth. The current land use designation is Retirement Community, and the current zoning are R-4 and C-1. RPI is requesting to rezone the site from R-4 Multiple-Family Residential Zoning District and C-1 Neighborhood Commercial Zoning District to R1-6 RUPD. Table A below summarizes the Property Data. Table A: Property Data A.P.N. 142-62-694 thru 711 Current Land Use Undeveloped / Vacant Existing Comprehensive Plan Retirement Community Land Use Designation Current Zoning District C-1 & R-4 Proposed Zoning District R1-6 RUPD Gross Property Area 15.31 Acres Net Property Area 15.31 Acres Total No. of Lots 90 Gross Density 5.88 DU/acre Supervisor District 4, Clint Hickman III. DESCRIPTION OF PROPOSAL Riverwalk is a proposed age-restricted community consisting of 90 single-family detached homes. The proposed density is approximately 5.88 DU/acre based on the gross area. This request is to rezone the property from R-4/C-1 to R1-6 RUPD. The purpose of modifying the R1-6 standards is to provide a sizeable centralized open space Riverwalk Page 4 Decemeber 22, 2020 March 23, 2020 Revised April 23, 2021 and amenity areas with pedestrian connectivity. The design of the community is consistent with the homeowner desires for less maintenance of yards all while having access to a shared community amenities and sizeable open space areas that are maintained by the homeowner’s association. The minimum lot dimensions will be 45 feet wide by 80 feet deep, with a minimum lot size of 3,600 square feet. The R1-6 zoning district’s development standard for minimum area per dwelling unit is 6,000 square feet. With 90 lots on 15.31 acres, the project will provide at least 6,000 square feet per dwelling unit when considering both the area of the lot and the Property open spaces. The Property will include approximately 4.05 acres of open space, which is more than 26% of the gross area. The central open space is anticipated to be 1.36 acres of the 4.05 acres of total open space and will have pedestrian paths that link to the open space amenities. The RUPD Development Standards are shown below in Table B. A graphical depiction of the site plan is included as Appendix D. This entry will include an elegant entry monument as well as gated entry, bordered by lushly landscaped open space areas, with a variety of trees, shrubs, and areas of turf. The centralized amenity area will feature a pool with lounge seating, outdoor barbecue area, and a restroom building with shaded seating and outdoor showers. Adjacent to the amenity is a community green space providing residents with a usable turf area with sidewalks for pedestrian connections. Much of the community is surrounded by broad landscape areas that provide a buffer from the perimeter streets outside of the community and serve as retention for the development. All internal drives will include four-foot sidewalks on both sides to establish pedestrian connectivity throughout the neighborhood, and to ensure convenient access to the amenity and open space areas. Riverwalk Page 5 Decemeber 22, 2020 March 23, 2020 Revised April 23, 2021 New landscaping along 99th and Olive Avenues consists of staggered rows of street trees to buffer the community and to provide pedestrian shade for the sidewalks. Planting areas inside the community will use the same material plus additional accented areas of colorful plants. A large, turfed area will be the main community gathering area central to the site and will also act as the central retention area for the development. Another retention area will be located in the northeast corner of the Property which will be landscaped with turf. There is an existing metering station in that area which will be screened with landscaping. IV. RELATIONSHIP TO SURROUNDING AREA The Property is bordered by 99th and Olive Avenues to the west and south, respectively. It is north and west of the City of Peoria, east and south of the unincorporated community of Sun City. It is located 1 mile west of Loop 101 Freeway, 2 miles north of the Glendale Municipal Airport and 2 miles south U.S. Route 60. The property located at the east boundary is the New River Wash, owned and maintained by Flood Control District of Maricopa County. Located to the north of the property is the Sunwood Apartments and Brook Hollow Condominium, zoned R-4. The Sun City Unit 8 lies to the West beyond 99th Avenue, zoned R1-6. Both 99th and Olive Avenues are fully improved with two lanes in each direction and dedicated left turn lanes, with curb and gutter. Sidewalk has been constructed along Olive Avenue, but not along 99th Ave. The dedicated Right-of-Way (ROW) for Olive Ave meets the ultimate street section requirement of 65’ half street, 130’ full street width. There is 55’ of Right- of-Way dedicated for the east half width of 99th Ave, 110’ total for the total width. MCDOT granted approval to keep the ROW at 55’ rather than expanding it to 65’ for principal urban arterial. Table C shown below outlines the surrounding zoning and land uses. An Aerial Location Map is also included as Appendix B. LOCATION AND ACCESSIBILITY The existing arterial roadways that will serve the Property are 99th Avenue and Olive Avenue. 99th Avenue and Olive Avenue are designated as Urban Principal Arterial per Maricopa County Department of Transportation’s Major Streets and Routes Plan (2011). 99th Avenue has a north-south alignment and provides two lanes in each direction separated by a raised median. There are a curb and gutter on both sides of 99th Avenue, but no bicycle or pedestrian facilities. Olive Avenue has an east-west alignment and provides two lanes in each direction. There is a painted median throughout the Property limits and no bicycle lanes. Olive Avenue has curb and gutter and sidewalks in both directions. The Loop 101 freeway, US State Highway 60 are the existing regional transportation that serve the Property. Loop 101 is located 1 mile east of the Property with full interchanges with access to U.S. Route 60 or 2 miles from the Property. VI. CIRCULATION SYSTEM The traffic circulation is outlined in the Riverwalk Residential Development Traffic Impact Analysis (“TIA”) prepared November 2020, which is submitted with the rezone application. The site entrance will be on 99th Avenue with a gated entry into the community. It will be constructed with 20’ wide entry and exit lanes separated by a landscaped median. The site access driveway is recommended to provide a stop sign on the new westbound approach from the site to 99th Avenue. The internal streets are considered local public roads constructed to the Maricopa County Urban Local Residential cross section. A secondary emergency access from Olive Avenue will be located at the south end and constructed of 4-inch compacted decomposed granite to meet the Sun City Fire District design standards and the adopted fire code. The intersections at Olive Avenue/99th Avenue and Caron Drive/99th Avenue were evaluated for the TIA. The intersection at Olive Avenue/99th Avenue is controlled by a traffic signal. The signal provides a protected-permitted phase for the eastbound left-turn onto 99th Avenue. The proposed Property, the intersection will operate an acceptable level of service during AM/PM peak hours for the years studied, 2021 and 2025. The Property is anticipated to generate a total of 953 weekday daily trips (entering and exiting) with 75 during the AM peak hour and 100 during the PM peak hour. No improvements are recommended at the intersection of 99th Avenue and Olive Avenue as the intersection will operate at an adequate LOS (LOS D or better). A northbound right-turn lane with a minimum storage length of 160 feet is recommended at 99th Avenue and Caron Drive. The proposed site access driveway is recommended to provide a STOP sign on the new westbound approach for traffic exiting the site.
