Report to the Board of Supervisors
Prepared by the Maricopa County Planning and Development Department
Board Hearing Date: July 14, 2021
Case #/Title: Z2021027 - 51st Avenue & Roeser Road
Supervisor District: 5
Applicant/Owner: Shaine Alleman, Tiffany & Bosco / Arizona Sand & Rock Co.
Request: Special Use Permit (SUP) for semi-truck & trailer storage in the
Rural-43 Zoning District
Site Location: Approx. 1,300 ft. west of the NEC of 51st Ave. and Roeser Rd.,
in the Phoenix Area
Site Size: Approximately 24.1 acres
County Island Status: N/A
Additional
Comments: There are no outstanding concerns from reviewing agencies
and Staff is aware of no public opposition. The intersection of
the verified MCDOT ROW and Roeser Rd. is of concern
because it is an unusual configuration with traffic
leaving/entering Roeser Rd. at a low angle. City of Phoenix
jurisdiction lies south of the Mid-Section Line that coincides
with the center line of Roeser Rd. (before it curves south,
approximately 350 ft. west of 51st Ave.). For that reason, the
applicant coordinated with the City of Phoenix as well as
MCDOT to identify necessary improvements at this
intersection. MCDOT has approved the proposed
improvements of this intersection, subject to conditions of
approval c.7-9, below. City of Phoenix Staff stated they have
no objection to the project contingent upon implementation
of the MCDOT conditions of approval.
Commission
Recommendation: On 6/17/21, the Commission voted 6-0 to recommend
approval of Z2021027 subject to conditions ‘a’ – ‘g’:

following conditions.
c. The following Planning Engineering conditions shall apply:
1. Offsite flow from the north and east is blocked by existing berms – no
additional comments.
2. A final drainage report will be required with submittal for building permit.
3. Provide notes requiring retention basins to drain within 36 hours. Basin
revised to be 1-foot deep. Drywells not required.
4. The plans show minor offsite grading to the south of the parcel. This grading
either must be removed, or a letter from the adjacent property owner will
be required prior to approval of a building permit. This can be revised with
Final plan submittal / building permit application.
5. A portion of this parcel is within a zone AE Special Flood Hazard Area (SFHA).
This area should be shown on the plans. A Floodplain Use Permit will be
required as part of the building permit application (no additional
paperwork will be required; it will be generated by PND engineering review
staff).
6. The subject premises is located within the County’s Urbanized Area and will
disturb more than one (1) acre. A Storm Water Pollution Prevention Permit
(SWPPP), issued by the County (PND), will be required prior to issuance of
any building permits required for site development.
See: https://www.maricopa.gov/DocumentCenter/View/6577
7. Minimum 50 ft. wide paved driveway per MAG Detail: 205, Type S be
provided.
8. STOP sign of 30” X 30” in size be provided at the driveway.

and Standards; Floodplain Regulations for Maricopa County; MCDOT
Roadway Design Manual; and current engineering policies, standards and
best practices at the time of application for construction.
11. Engineering review of planning and/or zoning cases is for conceptual
design only and does not represent final design approval nor shall it entitle
applicants to future designs that are not in conformance with Section 1205
of the Maricopa County Zoning Ordinance and Drainage Policies and
Standards; Floodplain Regulations for Maricopa County; and the MCDOT
Roadway Design Manual.

12. Detailed Grading and Drainage Plans and Final Drainage Report showing
the new site improvements must be submitted for the acquisition of building
permits.
d. The following Maricopa County Environmental Services Department (MCESD)
condition shall apply:
1. It should be noted that this document does not approve the referenced
project. Comments are provided only as advisory to Maricopa County
Planning and Development Department to assist staff to prepare a staff
report. Other Maricopa County agencies may have additional
requirements. Final review and approval will be made through Planning
and Development Department procedures. Applicant may need to submit
separate applications to the Maricopa County Environmental Services
Department for approval of proposed facilities regulated by the
Department. Review of any such application will be based on regulations
in force at the time of application.
e. This special use permit shall expire on July 14, 2031, or upon termination of the use
for a period of 90 or more days, whichever occurs first. All site improvements
associated with the special use permit shall be removed within 90 days of such
expiration or termination of use.
f. Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this Special Use Permit as set forth in the Maricopa County
Zoning Ordinance.
g. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, and at the time of expiration of the Special Use Permit, the
property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to
comply with any conditions, or the expiration of the Special Use Permit, does not
reduce any rights that existed on the date of application to use, divide, sell or
possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation
or expiration of the Special Use Permit. The Special Use Permit enhances the value
of the property above its value as of the date the Special Use Permit is granted
and reverting to the prior zoning results in the same value of the property as if the
Special Use Permit had never been granted.

Project Summary:
1. The Applicant, Shaine Alleman, Tiffany & Bosco, requests a Special Use Permit (SUP) for a
new interim industrial use of a truck storage facility on parcel 104-64-001A, which
comprises approximately 24 acres in the Rural-43 zone (subject property). The subject
property is located approximately 1,300 ft. west of the NWC of 51st Ave. and Roeser Rd.,
in the Phoenix area. According to recent aerial photography, the subject property is flat
and vacant. According to County Assessor’s data, a 100-year floodplain lies on the
southeastern, approximate half of the subject property. City of Phoenix jurisdiction and
existing, R1-8 zoned, single-family residential subdivision (River Walk Villages - Phase 1) lies
adjacent to the southern extent of the 30 ft. wide “pole” portion of the subject “flagpole”
property, and approximately 750 ft. south of the main, or “flag,” portion of the subject
property.
2. According to Assessor’s data, the subject property was created before
December 1, 1987. According to the current deed, the current owner (Arizona Sand &
Rock Company) took possession of the property on April 21, 1958. The current SUP request
was submitted to Planning and Development on March 3, 2021 and a related,
grading/infrastructure permit (B202106616) was submitted to Planning and Development
on May 11, 2021. Permit B202106616 is currently in process and cannot be approved prior
to approval of this SUP request. Staff found no code violations and no outstanding fees
associated with the subject property.
3. The proposed facility would include 450 semi-truck/trailer parking spaces, a retention
basin, and 8 ft. tall chain link fencing at the perimeter of the “flag” portion of the subject
property. Each truck/trailer parking space would be 11 ft. x 56 ft. and would be angled
to 60 degrees, which requires 22 ft. wide, two-way traffic aisles where 48 ft. wide aisles
are proposed (MCZO Art. 1102.8). An 8 ft. x 30 ft. (240 sq. ft.) ADA-accessible “guard
shack” and 30 sq. ft., ADA-accessible portable restroom (i.e. “Porta-Potty”) will be
located near the southeast corner of the “flag” portion of the subject property along with
one standard (9 ft. x 18 ft.) parking space and one ADA-accessible (12 ft. x 18 ft.) parking
space. An ADA-accessible path will connect the ADA-accessible parking space, guard
shack and porta-potty. The guard shack is to provide shelter for a guard who will be on
duty 24 hours a day, 7 days a week to tend the entry gate and provide security.
A generator will provide electrical service for the guard shack. The guard shack and
porta-potty comprise the total proposed lot coverage of approximately 270 sq. ft. or
0.03% where up to 25% lot coverage is allowed (MCZO Art. 503.5.4).
4. As shown below, access to the subject property is provided by 51st Ave., Roeser Rd., two
segments of verified MCDOT right-of-way (ROW) (identified as “existing unimproved dirt
access roads,” below), extending west from Roeser Rd., and then north, along the east
subject property boundary. The access route then enters the southern, approximately
30 ft. x 760 ft. “pole” portion of the subject “flagpole” property from the north/south
running MCDOT ROW to gain access to the main “flag” portion of the property at the
entry gate, located at the north end of the “pole.”

Subject Property Access Route
5. According to the project narrative, the proposed access from the subject property to
Roeser Rd. has been in use since approximately 2005 by other, adjacent industrial users.
Historic aerial photographs confirm the use of the east/west running MCDOT ROW for
apparent mining uses (located to the east of the subject property) since at least 1999
and the north/south running MCDOT ROW since 2004, however, aerial photographs also
show that the pole portion of the subject property was not cleared for use as an access
until 2019.
Access Route Detail (MCDOT ROW at Roeser Rd.)

6. As detailed above, the intersection of the verified MCDOT ROW and Roeser Rd. is of
concern because it is an unusual configuration with traffic leaving/entering Roeser Rd.
at a low angle. City of Phoenix jurisdiction lies south of the Mid-Section Line that coincides
with the center line of Roeser Rd. (before it curves south, approximately 350 ft. west of
51st Ave.). For that reason, the applicant coordinated with MCDOT and the City of
Phoenix to identify and provide improvements at this intersection including a new stop
sign, new striping to define the vehicle travel/turning path, and a new 25 ft. SVT at the
Z2021027

southwest side of the intersection (as shown above). MCDOT has approved the proposed
design of this intersection, subject to 3 conditions of approval, which are cited in the
attached “no objection” Engineering memo, and in the conditions of approval for this
request. City of Phoenix Staff stated they have no objection to the project contingent
upon implementation of the MCDOT conditions of approval. The proposed elimination of
the three, 25 ft. SVTs that would apply in addition to the 25 ft. SVT that is proposed are the
subject of a development standard modification request, described below.
7. The same Mid-Section Line that coincides with the centerline of Roeser Rd. also coincides
with the property boundary at the south end of the 30 ft. wide “pole” making that the
front of the property because it is the shortest side with access and, accordingly, the
north is the rear of the property (MCZO Chapter 2, “Lot Line, Front” and “Lot Line, Rear”).
A second Mid-Section Line coincides with the west property boundary and, as discussed
above, verified MCDOT ROW runs along the east subject property boundary, making the
east and west boundaries street sides (MCZO Art. 503.4.1.c). Mid-Section Lines are
associated with 40 ft. half-width, future right-of-way (FROW) and required yard setbacks
are measured in addition to FROW (MCZO Arts. 1105.1.4 and 1105.2). Therefore, the total,
required front yard setback is 80 ft. from the south end of the 30 ft. wide “pole” and the
total required street side yard setback is 60 ft. from the west property boundary
(MCZO Arts. 503.4.1.a and 503.4.1.c). The required rear yard setback is 40 ft. from the
north property boundary and the required street side setback is 20 ft. from the east
property boundary (MCZO Arts. 503.4.1.c and 503.4.3). It bears noting that the south
boundary of the main “flag” portion of the subject property and the west side of the 30 ft.
wide “pole” are interior sides where a 30 ft. required yard setback applies
(MCZO Art. 503.4.2).
8. Several development standard modification requests are included with the proposal, as
described below and as allowed under the SUP process (MCZO Art. 1301.5). Required lot
width is measured at the back of the front setback, which is 80 ft. north of the south end
of the 30 ft. wide “pole,” resulting in a lot width of 30 ft. where 145 ft. is required
(MCZO Chapter 2 “Lot Width” and Art. 503.5.2). 6 ft. tall solid screening is typically
required to enclose an outdoor truck storage use where 8 ft. tall chain link fencing is
proposed for the current use (MCZO Arts. 902.2.19 and 902.9.3). Perimeter fencing of up
to 8 ft. in height is allowed by-right in rural, commercial and industrial zones, however, the
current proposal for less than solid screening comprises a development standard
modification request (MCZO Art. 1111.5.3.). 25 ft. Sight Visibility Triangles (SVTs) are
typically required for commercial and industrial uses where a subject property driveway
meets a public street (MCZO Arts. 1111.4.2 and 1111.4.3). In this case, 2 SVTs would be
required at the south end of the 30 ft. wide “pole” where the on-site driveway meets the
verified MCDOT ROW, however, it appears that SVTs would be infeasible and would serve
little or no purpose in that location. Instead, one SVT is proposed on the southwest side of
the intersection of the verified MCDOT ROW and Roeser Rd. This comprises a
development standard modification request for one SVT proposed in an alternative
location (at the intersection of the MCDOT ROW and Roeser Rd.) where two SVTs would
be required and not providing two SVTs where the on-site driveway meets the public
street (i.e. provision of 1 SVT where 4 SVTs are required). Pavement is typically required for
all driveways and parking areas for commercial and industrial uses (MCZO Art. 1102.7.1)
and asphalt millings compacted with an emulsifier is the minimum surface treatment Staff
considers “pavement” to satisfy this requirement where crushed asphalt is proposed as
the surface treatment for the “flag” portion of the subject property, which comprises the
Z2021027

final development standard modification request. The entire access route from
Roeser Rd. to the subject property gate will be paved with crushed asphalt compacted
with a liquid emulsifier.

Adopted Plans:
13. Estrella Area Plan (Adopted: January 21, 1992): This plan identifies the subject property as
Open Space. This designation is to identify areas that should be left as undeveloped open
space and recreational areas; however, development may be appropriate when in
compliance with hillside or floodplain development regulations. Hillside standards do not
apply to the subject property and the proposed development is subject to floodplain
development regulations. Furthermore, the requested SUP entitlement is limited to a
period not to exceed 10-years. Extension of the SUP for another 10-year period is possible
with approval by the Board of Supervisors. Therefore, should the use be determined to be
incompatible with the OS designation, or onerous for any other reason, the Board of
Supervisors may deny extension of the SUP. Accordingly, Staff finds the proposed interim
industrial use to be compatible with the OS designation.
14. City of Phoenix General Plan (Adopted: October 1985 and most recently revised
May 13, 2021): This plan identifies the subject property as residential 3.5 to 5 du/acre –
Traditional Lot. The Traditional Lot land use category provides for a variety of suburban
lifestyles with planned single-family residential communities, which include open space,
recreational and cultural opportunities, including schools, churches and public facilities.
This category would provide single-family, town home, patio home and duplex type units.
This category identifies three sub-categories of 2 to 3.5 du/acre and 5 to 10 du/acre.
Public Participation Summary:
15. The applicant complied with the Maricopa County Citizen Review Process with the
required posting of the site and notification by first class mail to adjacent property owners
within 300' of the subject property and interested parties. Staff is not aware of any
opposition regarding the proposal.
Outstanding Concerns from Reviewing Agencies:
16. The City of Phoenix expressed concerns about the intersection of the verified MCDOT
ROW and Roeser Rd. and for that reason, the applicant coordinated with MCDOT and
the City of Phoenix to identify and provide improvements at this intersection. The City of
Phoenix staff stated they have no objection to the project contingent upon
implementation of the MCDOT conditions of approval, identified below.
Staff Analysis:
17. The proposed semi-truck & trailer storage use is allowed in the Rural-43 zone as an Interim
Industrial Special Use per MCZO Art. 1301.1.22, and the proposed use appears
appropriate for the surrounding development and land use patterns, which historic aerial
photos show to be characterized by apparent mining activities (dating from at least
1982) and outdoor industrial storage (dating from at least 2003), both located to the east
Z2021027

of the subject property and west of 51st Ave. The existing residential development to the
south of the subject property (River Walk Villages - Phase 1) dates from 2001. Staff notes
some concern regarding the proposed introduction of new truck trips to and from the
subject property via the access route from 51st Ave.; however, the Applicant proposes to
pave the access route and make improvements to the route’s intersection at Roeser Rd.
Those improvements, along with the limited number of anticipated truck trips (i.e. 10-15
truck trips per 12-hour daylight period) described in the project Traffic Impact Statement,
result in minimal, apparent transportation impacts and negative effects on the
residences that exist to the south of the subject property. The applicant notes that this is
not the first industrial use of the access route, meaning the proposed truck traffic is not a
new use of the access route, although it does represent a slight increase in the intensity
of that use. MCDOT and the City of Phoenix have no objection to the proposed use of
the access route, provided certain conditions of approval are met, as identified below.
Recommendation:
18. For the reasons outlined in this report, staff recommends the Commission motion for
Approval, subject to conditions ‘a’ – ‘g’.
a. Development of the site shall be in substantial conformance with the Site Plan
entitled “51ST Avenue & Roeser Road”, consisting of 1 full-size sheet, dated
April 20, 2021 and stamped received May 24, 2021, except as modified by the
following conditions.
b. Development of the site shall be in substantial conformance with the Narrative

report. Other Maricopa County agencies may have additional
requirements. Final review and approval will be made through Planning
and Development Department procedures. Applicant may need to submit
separate applications to the Maricopa County Environmental Services
Department for approval of proposed facilities regulated by the
Department. Review of any such application will be based on regulations
in force at the time of application.
e. This special use permit shall expire on July 14, 2031, or upon termination of the use

Special Use Permit Narrative
Purpose of the Request
The purpose of this submittal is to request the approval of a Special Use Permit (the “SUP”)
application for the subject property currently owned by Arizona Sand & Co. and consisting
of 24 acres generally located northwest of the northwest corner of 51st Avenue and
Roeser Road (the “Property”). The Property is identified by the Maricopa County
Assessor’s Office as APN 104-64-001A and owned by Arizona Sand & Rock Company. For
the Property locations and surrounding context, please see Exhibit 1-Regional Context
Aerial Map and Exhibit 2-Context Aerial Map.
Over the past several years, large online retailers, such as Amazon, have greatly increased
its online sales and services to its customers. With the pandemic occurring over the past
year, the increase in online sales to customers has skyrocketed these sales even more. This
has greatly changed the way that consumers receive their goods, opting to order goods
online instead of going to a brick and mortar store. This has resulted in online retailers
needing additional areas to store overflow inventory that is not regular rotated and/or
sold.
The Property provides a prime location for the allowance of an overflow storage area for
inventory that is securely stored in truck trailers. This application will further describe why
this location is ideal and will also provide the development standards for allowing this use
on the Property.
Description of the Property
The Property is currently within the jurisdiction of Maricopa County and is zoned Rural-
43 (RU-43). A portion of the Property is designated “Open Space” within the Maricopa
County Estrella Area Plan. The Property is currently vacant and has not been developed
or used in the past.
The following is the surrounding land use context:
• North:
o Jurisdiction: Maricopa County
o Zoning: RU-43
o Land Uses: These properties consist of the Salt River wash area.
• East:
o Jurisdiction: Maricopa County
o Zoning: IND-3, Heavy Industrial
RU-43 (used as Sand & Gravel Pit with Mining Exemption)
51st Avenue & Roeser Road
Special Use Permit Application – Z2021027

3
o Land Uses: These properties have been used as an open pit mine and
large crane storage and operation that is location directly adjacent to the
existing residential neighborhood to the south.
• West:
o Jurisdiction: Maricopa County
o Zoning: IND-3
o Land Uses: The properties east and south east have been used as an open
pit mind and have access roads directly adjacent to the residential
neighborhoods that operate large loading trucks on it.
• South:
o Jurisdiction: Maricopa County & City of Phoenix
o Zoning: RU-43
o Land Uses: Directly south of the Property is a 23 acre property is being
operated by Cemex as an open pit mine. Directly south of Cemex’s property
is the River Walk neighborhood.
Overall, the surrounding properties have been operated and used as heavy industrial
areas for several decades. The River Walk neighborhood was developed approximately
10-15 years ago and has co-existed with the heavy industrial uses that surround the
neighborhood on most sides. The existing unimproved dirt roads on the north and west
sides of the River Walk neighborhood have been used by mining trucks for many years
and were present before the neighborhood was developed.
The Loop 202 Freeway is located approximately 1 mile to the west and the industrial area
where overall inventory would be provided to and from the Property is located
approximately 1 mile to the north. Thus, the Property is perfectly located close to prime
access areas that are associated with the proposed use.
Special Permit Use Request
This application request is for a SUP to enable the Property owner to use the Property as
an additional storage area that will contain secured overflow inventory from nearby
warehouses. As shown on the Site Plan, the storage area will consist of trailer parking
spaces to accommodate the truck trailers that will be stored on the Property. There are
large drive aisles between the three parking areas totaling no less than 48’ and no more
than 83.5. The large drive aisles will allow the vehicles to adequately maneuver throughout
the Property.
Additionally, a “turn around route” has been marked on the Site Plan to provide a forward
driving turn-around path for any potential vehicles that are not part of the SUP use and
need to turn around to exit the site. Since, the Property will have a guard on the Property

4
7 days a week and 24 hours a day, someone will always be there to direct these vehicle
needing to turn around.
The trucker trailers will be secured on site and contain the “product overflow” as needed.
The Property will also have vacant trailers that are rotated on an as needed basis. Some
truck trailers will contain inventory in order to fulfill shipments whenever the warehouse
lacks a particular product.
To illustrate with an example, if Widget A is needed for a major shipment and the
warehouse does not have enough Widget A in stock, a truck will drive to the Property and
hitch a trailer containing Widget A in order to retrieve the inventory to be used at the
fulfillment warehouse. Because this is an overflow area, it is anticipated that approximately
10-15 trucks will visit the Property on any given day. This flow of trucks is significantly less
than what is already occurring with the existing heavy industrial uses to the east, south,
and west of the Property, with their constant flow of truck trailers and loading trucks
utilizing the unimproved dirt roads adjacent to the River Walk neighborhood.
To alleviate dust and sound concerns that could be created by vehicles visiting the
Property, any of the right of way easement that the vehicle will drive on to access the main
“flag” portion of the Property will be covered with asphalt millings compacted with liquid
asphaltic binder/emulsifier (i.e. chip seal). This also includes the right of way easement
connect the Property to Roeser Road and 51st Avenue to the west. This transportation
access and improvements are described further below under “Location and Accessibility”.
The main “flag” portion of the Property, containing the truck parking areas, will only be
covered with crushed asphalt millings and not be required to use a liquid asphaltic
binder/emulsifier.
A portable guardhouse that is approximately 8’ x 30’ will be placed at the southeast
entrance to the main “flag” are of the Property. The guardhouse will be ADA-accessible.
The guardhouse will also have a self-supported electrical generator for any of its electrical
needs. The guardhouse will be staffed 7 days a week and 24 hours a day.
Since there will only be one (1) security guard on the Property at any given, and the fact
that the SUP is for an interim use, it is not justified to provide a permanent bathroom on
the Property. As such, adjacent to the guardhouse will be an ADA-accessible portable
restroom and an ADA-accessible parking space. These areas will be have an ADA-
accessible connective path between them.
The Property truck storage area will be encompassed by an 8’ chain-link perimeter fence
as shown on the Site Plan. A one foot (1’) deep retention basin has been provided at the
southern portion of the Property as shown on the Site Plan. Additional details regarding
the Property retention can be found in the Preliminary Drainage Report and Plan provided
with this SUP Application.

Proposed Modifications to RU-43 Development Standards
The underlying zoning on the Property is RU-43. For purposes of this SUP, the south
boundary line (on “flag pole” portion of the Property) is considered the front of the lot,
the south boundary line (on the “flag” portion of the Property) is considered the interior
side yard of the lot, the north boundary line is considered the rear of the lot, and east and
west boundary lines are considered the sides of the lot.
As part of the SUP, the Applicant is requesting a modification to a few of the development
standards to accommodate this interim storage use. Below is a table outlining the
proposed modifications to the RU-43 development standards (shown in bold).

The “flagpole” portion will not have buildings on it and is an existing remnant portion of
property left over from ASLD land transfers. The lot width development standard
modification is merely to allow for an existing condition and will have no negative effects
on any adjacent properties. Thus, this modification is justified.
The sole purpose of the interior side yard setback standard modifications is to allow for
the placement of the guardhouse to be as close as possible to the main entry location to
the major portion of the Property at the southeast corner of the “flag portion” of the
Property. It is crucial that the proposed interim storage use is guarded on a continual
basis and that the guardhouse be as close as possible to the entry point.
The modification of these development is justified to allow the placement of the
guardhouse at this critical location to provide that protection and security. One of the
main purposes of building setbacks is to provide appropriate buffering to adjacent
properties that may not be compatible and/or need appropriate buffering. Since the
adjacent properties that will affected by these modified setback standards are heavier
industrial uses than the proposed SUP use, and the fact that there are no negative effects
to these adjacent properties from these modified standards, these modified standards are
justified for the proposed SUP interim storage use.
Location and Accessibility
Access to the Property is from a driveway that existed for decades on Roeser Road located
approximately 355’ west of 51st Avenue. From the Roeser Road driveway, an east/west
right of way easement exists along the south side of the industrial crane yard. Currently,
this east/west right of way is being used by the industrial trucks accessing the heavy
industrial uses that are east of the Property.
Historical aerials (as early as 1980) show that the Roeser Road ROW easement has
consistently been used as industrial (nonresidential) access roads and currently continues
to provide access to the Crane Company and the Rio Grande Gravel Pit properties to the
east of the Property.
There are two (2) public right of way easements to the Property, which have been
discussed with both Arizona State Land (ASLD) and the Maricopa County Department of
Transportation (MCDOT) to determine the proper ownership, jurisdiction, and legal right
for access use. ASLD indicated that they have no ownership nor jurisdiction of these
easements. MCDOT provided the recorded easement documents provided with this
Application, which state that the public has access to these right of ways.
Exhibit 3 – Right of Way Recorded Easement Documents, provided with this SUP
Application, demonstrate that the ROW easements to the Property are publicly accessible
for use as part of this SUP.
51st Avenue & Roeser Road
Special Use Permit Application – Z2021027

7
There is no adequate access from the Property to any arterial street, so the existing
driveway from the County ROW to Roeser Road is the only access. The driveway being
used to access Roeser Road was constructed as early as 2005-2006 for the industrial users
when Roeser Road was paved.
As noted in the Traffic Impact Study by Y2K, and provided with this SUP Application, the
expected daily traffic is 10-15 trucks. This will result in 1 truck per peak hours and is an
insignificant amount of industrial truck traffic compared to the industrial traffic already
using the County ROW easements and Roeser Road driveway. Additionally, the TIA noted
no other negative impacts from the proposed SUP truck traffic.
As part of this SUP Application, the following list of improvements are proposed and
shown on the Site Plan.
• The existing County ROW’s are unimproved, dirt roads. This SUP Application will
require improvement of the east/west and north/south County ROW’s with asphalt
millings compacted with liquid asphaltic binder/emulsifier (i.e. chip seal).
• Addition of a stop bar, centerline stripe at the center of the existing 65’ wide Roeser
Road driveway to direct trucks for perpendicular movements out of the driveway
onto Roeser Road.
• Install a “Stop Sign” at Roeser Road driveway egress to remind trucks to stop and
look before proceeding.
• Added SVT triangle to the Site Plan to ensure no visual impediments
These requirements will mitigate any traffic concerns for the SUP use.
As noted above, the east/west right of way is an unimproved, dirt road. As part of this
application, the east/west right of way will be covered with asphalt millings compacted
with liquid asphaltic binder/emulsifier (i.e. chip seal), which will significantly reduce any
issues of dust and noise that are associated with this unimproved dirt road. This will
greatly improve the situation for the residential neighborhood to the south by decreasing
the dust and noise in the area.
At the west end of the east/west right of way, there is another right of way easement that
extends north to the Property’s main area entrance. Currently, this north/south right of
way is being used by the industrial trucks accessing the heavy industrial uses that are east
of the Property. Additionally, this north/south right of way is an unimproved, dirt road. As
part of this application, the north/south right of way will be covered with asphalt millings
compacted with liquid asphaltic binder/emulsifier (i.e. chip seal), which will remove any
issues of dust that comes off of the right of way.
As noted above, the Loop 202 Freeway is located approximately 1 mile to the west and
the industrial area where overall inventory would be provided to and from the Property is
51st Avenue & Roeser Road
Special Use Permit Application – Z2021027

8
located approximately 1 mile to the north. Thus, the Property is perfectly situated close
to prime access areas that are associated with the proposed use.
Currently, the dirt roads surrounding the River Walk neighborhood to the south are not
treated and are simply unimproved dirt roads that create a significant amount of dust and
noise. The improvements being provided to the right of way easements to the Property,
associated with the SUP, will provide a significant benefit to the residential neighborhood
to the south and decrease the existing dust and noise from the trucks.
Relationship to Surrounding Properties
The Property is located in a predominately heavy industrial area. Property zoned IND-3
borders the Property to the west and to the east. The IND-3 zoned property located on
the southern portion of the Property’s eastern boundary is used as a crane and truck
storage yard. The property located on the northern portion of the Property’s eastern
boundary is used to store trailers and industrial equipment for mining operations. The
property located directly south of the Property is used for mining purposes.
Beyond the immediate uses to the north, east, west, the general area is dominated by
sand and gravel pit uses and other heavy industrial uses.
Beyond to the south is located the River Walk Villages, which are single-family residences
constructed in phases between 2002 and 2006. With these homes coming after the heavy
industrial uses being already established for several decades, the River Walk Villages have
grown accustomed to the existence of these industrial uses and co-existed with these
uses for many years. Even with the minimal traffic associated with the SUP, the Applicant
is proposing to improve the access roads to the Property with proposed crushed asphalt
along the entirety of the already existing unimproved, dirt driveways. This great
consideration will greatly reduce the already existing dust dispersion and noise of the
existing trucks that use these dirt roads.
Development Schedule
The Property will be developed in one phase and intends to move forward with the
proposed use as soon as the necessary entitlements are obtained.
Estrella Planning Area Consistency
The Property is located within the Estrella Planning Area. Maricopa County’s Land Use
Plan states a primary goal of the Estrella Planning Area is to:
“Minimize land use conflicts between the existing
agricultural/rural land uses and new urban level residential,
commercial, and industrial uses.”
51st Avenue & Roeser Road
Special Use Permit Application – Z2021027

9
The proposed development incorporates this planning goal by creating a retention area
at the Property’s south portion of the Property. Additionally, the surrounding land uses
have been developed as industrial uses for many years. Therefore, the proposed use will
not conflict with the surrounding area. With the SUP improvements to the current
unimproved dirt roads, the approval of this Application will be an improvement to the
area.
Public Utilities and Services
Due to the interim use, as described above, the proposed SUP is not in need of any water
or sewer utility services to the Property. Electricity services are being coordinated by the
Property owner with Salt River Project and will be used to provide electricity for Property
lighting.
Fire services will be provided by the Laveen Fire District. Police services will be provided
by the Maricopa County Sherriff’s Office.
Public Outreach and Response to Citizen Input
The Applicant will conduct a thorough public outreach effort for the proposed rezoning
application during the Application period. These efforts will include letters to property
owners within 300’ of the Property and the interested parties list as set forth by Maricopa
County. The proposed outreach process is addressed in detail within the attached Citizen
Participation Plan.
Conclusion
The proposed SUP will allow for uses which are compatible with the surrounding area
while improving an already existing and heavily trafficked unimproved, dirt driveway. The
SUP will not materially impact the River Walk Villages, rather, the SUP will provide certain
improvements to the area as outlined herein. We look forward to continuing to work with
the County on this SUP.

Sean,
Here is the traffic statement approval with stipulations. Please provide the site plan redlines to the
developer for revisions.
Chris,
As this is a special use permit application, county development provisions do not require curb, gutter
and sidewalk improvements. Therefore, I required site access be installed to MAG 205 detail. Please
let me know if you have any questions or concerns.

Sean,
I spoke to our traffic services group and they don’t propose any additional signage from what Raj is
stipulating. I would note that the applicant would be required to construct a standard City P1255-1
50’ minimum driveway onto Roeser Rd. to clearly define the access control location. We would like
to see curb, gutter & sidewalk provided to 51st Ave to complete these improvements for pedestrian
and ADA compliance so as not to have peds walking in the street. However, I’m not sure if this is
something that can be required by MCDOT as part of the Use Permit application and will defer to

you?
Thanks
Chris

Subject: Z2021027 - 2nd Round Submitted
Good morning Gentlemen,
The second round documents were submitted to me yesterday and I uploaded them to AA.
The Drainage Report is so large I had to break it into 2 parts to upload.
The 2-week due date for your comments is 5/14 please.
If you happen to be able to provide comments sooner, that would be ideal.
Chris and Raj: Please see the proposed modifications to the Y intersection at Roeser Rd. on the site
plan.
The narrative discusses the intersection on pages 6 – 8.
Chris, I hope it’s OK to forward this revised information to you in this manner.
I don’t presume to present you with a deadline, but if you happen to be able to provide comments
by 5/14 (or sooner), again, that would be ideal.
Please don’t hesitate to let me know if you need anything else from us.
Thank you!
Sean Watkins
