Report to the Board of Supervisors
Prepared by the Maricopa County Planning and Development Department
Board Hearing Date: July 14, 2021
Case #/Title: Z2021024 - Ameripark RV & Boat Storage Facility
Supervisor District: 2
Applicant/Owner: Jonathan Strawther, SimonCRE / Woo Enterprises Inc
Request: Zone Change from C-2 to C-3 CUPD
Site Location: Generally located on the SWC of Ellsworth Rd. and Apache
Trail, in the Mesa area.
Site Size: Approx. 7.5 acres
County Island Status: No
Additional
Comments: The applicant seeks a rezone from C-2 to C-3 with a CUPD
overlay in order to develop the site as an RV/Boat Storage
facility. The subject property is located within the East Mesa
Area plan, which designates the site as Urban
Residential/High Density (0-25 du/ac) and the City of Mesa
General Plan designated for Neighborhood land uses. The
rezone is located within a corridor along Apache Trail
primarily zoned C-3, as such the proposed rezone is in concert
with the existing land use patterns of the area along Apache
Trail. The rezone with overlay will have no adverse impact on
the East Mesa Area plan or the City of Mesa General Plan.
Staff received one letter from the City of Apache Junction
stating they had no concern. Staff has not received any other
correspondence from any municipalities or calls concerning
the requested zone change and there is no known
opposition.
Commission
Recommendation: On 6/17/21, the Commission voted 6-0 to recommend
approval of Z2021024 subject to conditions ‘a’ – ‘f’:
a. Development of the site shall be in substantial conformance with the Narrative
Report entitled “Mesa Ameripark RV/Boat storage Facility”, consisting of 5 pages,
dated May 11, 2021, and stamped received May 11, 2021, except as modified by
the following conditions.
b. The following Planning Engineering conditions shall apply:

1. Retention Basins shall have a maximum side slope of 4:1.
2. Drainage review of planning and/or zoning cases is for conceptual design
only and does not represent final design approval nor shall it entitle
applicants to future designs that are not in conformance with Section 1205
of the Maricopa County Zoning Ordinance and the Maricopa County
Drainage Policies and Standards.
3. All development and engineering design shall be in conformance with
Section 1205 of the Maricopa County Zoning Ordinance and current
engineering policies, standards and best practices at the time of
application for construction
c. Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this Zone Change as set forth in the Maricopa County
Zoning Ordinance.
d. The property owner/s and their successors waive claim for diminution in value if
the County takes action to rescind approval due to noncompliance with
conditions.
e. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, the property shall revert to the zoning that existed on the date
of application. It is, therefore, stipulated and agreed that either revocation due
to the failure to comply with any conditions, does not reduce any rights that
existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held
on the date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the
Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted.
f. The following CUPD standards shall apply:
1. Max Building Height: 25’
2. Parking Spaces Required: 5 Spaces (4 regular 1 ADA)
3. Minimum Site Screening: 8’ vinyl panel fence to be installed for the entire
perimeter fence, including property line abutting any rural or residential
zone boundary.

Project Summary:
1. Jonathan Strawther of SimonCRE, on behalf of Woo Enterprises, requests a zone change
from C-2 to C-3 with a CUPD overlay for approximately 7.5 acres to enable the site to be
developed as an RV & Boat storage facility. The site is generally located on the southwest
corner of Ellsworth Rd. and Apache Trail in the Mesa area. The existing development on
the site consists of a billboard on the west side of the site that was approved under Plan
of Development Z2011039, and a Wireless Communication Facility on the eastern portion
of the site which was approved under Special Use Permit Z1996011.
2. The applicant has applied for a CUPD overlay as part of this zone change to implement
variations to the C-3 base zone development standards. The following table lists the
development standards to be varied under the C-3 CUPD overlay in (bold).

Adopted Plans:
7. East Mesa Area Plan (adopted February 1992): The subject site has been identified on the
County Area Plan as Urban Residential/High Density (0-25 du/ac). Per the area plan,
neighborhood commercial development may be located within the area at arterial
street intersections, if demand permits. The subject site is also within the City of Mesa
General Plan.
8. Mesa 2040 General Plan (adopted 2014): The subject site is designated for Neighborhood
land uses.
Public Participation Summary:
9. The applicant complied with the Maricopa County Public Participation Process with the
required posting of the property and the notification to the adjacent property owners
within 300’ of the subject site. Staff has not received any notice of opposition to the
request. Staff received two (2) letters from Larry Kirch, Director of Development Services
for the City of Apache Junction. The City of Apache Junction stated that there were
approximately 22 other sites of similar use in the area, however they had no concerns
and were not opposed to the requested zone change.
10. Additionally the applicant received correspondence from four (4) individuals who
responded to the initial notification letter. A summary of this correspondence was
included in the Citizen Participation Results Report. It should be noted that none of the
individuals who responded to the applicant are opposed. Martin C. Lauber, with ADOT
Regional Traffic Engineering Group, responded to the outreach letter on December 9th,
2020. Mr. Lauber requested access to the proposed site to be solely be off of Ellsworth
Road and requested a note on the site plan stating, “Access to E. Main Street has been
denied by ADOT” to reinforce ADOT’s access controls. The applicant has added a note
on the site plan to that effect

Outstanding Concerns from Reviewing Agencies:
11. N/A.
Staff Analysis:
12. The requested zone change with CUPD overlay is consistent with the development found
along Apache Trail. The north and south 200’ of Apache Trail is existing C-3, as such the
proposed rezone would not be introducing commercial activity or uses that are out of
character of the area along Apache Trail. The site is located at the intersection of two
arterial streets with the western boundary of the lot itself backing up to the east side of
the Loop 202. Staff has not received any opposition to the proposed project from
residents in the area. As such, while the proposed zone change is not in alignment with
the County Area Plan or the City of Mesa General Plan, the proposed project is in
character with existing land uses along Apache Trail.
Recommendation:
13. For the reasons outlined in this report, staff recommends the Commission motion for
Approval, subject to conditions ‘a’ – ‘f’.
a. Development of the site shall be in substantial conformance with the Narrative
Report entitled “Mesa Ameripark RV/Boat storage Facility”, consisting of 5 pages,

CURRENT ZONING: C-2 Intermediate Commercial
REZONE REQUEST: C-3 CUPD
Purpose of Request
The purpose of this request is to apply for a zone change with overlay from the Maricopa County
Planning & Development department, as it relates to receiving the necessary approvals for the
construction of an RV & Boat storage facility on a 7.5-acre vacant parcel lot in Mesa, AZ.
We are requesting for the screening standards and setback requirements to be varied for this
project. Due to the southern property line adjacent to a rural/residential zone, the cost for 1120
LF of 6-foot solid material would not be ideal for our project. We are requesting to install 8-foot
vinyl panel fence in lieu of the 6-foot solid material wall. The 8-foot vinyl panel fence would be
the fencing height/materials used for the permitter fencing. We are also requesting a 0-foot
setback variance to replace the existing southern owner’s fences to match the proposed 8-foot
vinyl panel fence. We will reach out to the twelve adjacent property owners along the southern
boundary and notify them of the request.
Lastly, we are requesting to have 5 total parking spaces (4 parking space & 1 ADA parking
space) for our proposed project. Due to our site having 24/7 electronic access, the use of onsite
personal is not needed nor required. Patrons will have the ability to gain access to the site by
using electronic methods and will not be obtaining permission from an individual(s) onsite. No
employees will be onsite, unless conducting routine maintenance to the electrical server room.
Description of Proposal:
The subject property is currently undeveloped land located on the southwest corner of E. Apache
Trail (Main St.) and S. Ellsworth Road, and adjacent east to Red Mountain Freeway (Loop 202).
An existing cell tower is located toward the east side of the property adjacent Ellsworth Road
and an existing billboard is located toward the west side of the property adjacent to the Loop
202. The subject property will be serviced by the City of Mesa for both water and sewer, SRP
will provide the electric services, police services will be provided by Maricopa County Sheriff’s
Department, and fire services will be provided by Rural Metro Fire Department.
Proposed development for the approximately 7.5-acre site entails the construction of a new 240-
stall RV & Boat storage facility; will include grading, drainage, utility and paving requirements.
A 160 SF modular building structure will be positioned toward Ellsworth Road, consisting of an

ADA bathroom and a storage/electrical server room The property will have 5 parking spaces (4
regular spaces/1 ADA parking). A sewer dump station will be installed west of the proposed
electrical storage structure. Design for the RV & Boat storge facility will be consistent with
Maricopa County guidelines.
The RV & Boat storage facility will be 24/7 operational & access, Monday through Sunday. No
employees will be onsite, unless conducting routine maintenance to the electrical server room.
Patrons will have the ability to gain access to the site via electronically without onsite permission
or coordination.
Relationship to Surrounding Properties
The site is presently undeveloped raw land and is zoned C-2 – Intermediate Commercial
The site is surrounded by existing multiple-family residential uses to the south and east that are
zoned R-5. A McDonald’s located to the north and east is zoned C-3. A retail center located to
the north across the street is zoned C-2. A title max to the east across the street is zoned C-3. A
tire shop to the east across the street is zoned C-3. A self-storage facility to the east across the
street is zoned R-5. Loop 202 is located to the west of the property without a zoning district.
The zoning and characteristics of the surrounding properties are as follows:
North: C-2 (Intermediate Commercial)/ C-3 (General Commercial)
South: R-5 (Multiple-Family Residential Zoning District)
East: C-3 (General Commercial)/ R-5 (Multiple-Family Residential Zoning District)
West: No Zoning District; Loop 202
This development will benefit the area because the residents of these developments/businesses
will need a place to store personal possessions and vehicles that either do not “fit” on their
property or are not allowed to be parked/stored due to CC&R restrictions. The proposed zoning
change will be consistent with the surrounding areas.
*Note: We reached out the City of Apache Junction Development Services Director and the City
of Apache Junction does not have any objection to this project located outside the City limits of
Apache Junction.
Location and Accessibility
Access to the site is via an eastern roadway: Ellsworth Road, which runs north-south along the
east side. It provides for regional access via the Loop 202 and is located approximately 1/5-mile
to the east of the Loop 202.
Circulation System
As noted above, access to the site is via Ellsworth Road, which runs north-south along the east
side of the proposed development. Ellsworth Road is located 1/5-mile to the east of the Loop
202.
A Traffic Statement is included with the Rezone with Overlay submittal.
