Generally located 0.35 mile to the southwest of New River Rd. and Shangri La Ln. in the New River area Site Size: Approx. 45.54 acres County Island Status: N/A Additional Comments: The request is to remove a timeframe condition to establish permanent entitlement of the resort/guest ranch. The facility has operated since 1959 and has been in place for over 62 years. The facility is a benefit to the New River/Desert Hills Community by hosting community and civic events. Staff received 41 letters/e-mails from area residents in support of the removal of the timeframe condition which were provided as virtual handouts at the Commission hearing. The Commission stated the existing approved Special Use Permit has 16 years remaining. The Commission stated that this application may be too soon for review and should be considered closer to the expiration date. Dennis Zwagerman (applicant) presented that the owner, Mr. Horst Kraus was establishing the ranch for family July 14, 2021 Z2021043 Page 1 of 4 members, he owns the majority of property adjacent to the guest ranch and that the region remains as Rural and undeveloped. There is no know opposition to the application, and no outstanding concerns from reviewing agencies. Commission Recommendation: On 6/17/21, the Commission voted 6-0 to recommend denial of Z2021043. Staff Recommendation: The staff report presented to the Commission included staff recommendation for approval. In the event the Board decides to recommend approval of Z2021043, staff recommends the Board motion with conditions ‘a’ – ‘m’: a. Non-compliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. Agenda Item: 2 – Z2010077 Page 12 of 12 m. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval is temporary and allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value July 14, 2021 Z2021043 Page 3 of 4 of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. Owner: Horst Kraus Request: Removal of condition ‘h’ of Z2010077 for permanent entitlement of a resort / guest ranch Special Use Permit (SUP) in the Rural-43 zoning district Site Location: Approx. 45.54 acres. Municipal Plan: Phoenix - Undesignated Municipal Comments: None to date Support/Opposition: None to date Recommendation: Approve with conditions Z2021043 Page 1 of 7 Project Summary: 1. The purpose of this request is to remove the 25 year time limitation on the current SUP for Shangri La Resort Ranch (Resort) which was approved with case Z2010077, approved by the Board of Supervisors on August 8, 2012. The use was originally entitled circa 1982 per case Z 82-10, but was earlier established circa 1959 thus has been in place for approximately 62 years. The site consists of approximately 45 acres, with approx. 29 acres designated for the SUP and guest ranch. The site is located approximately 0.35 mile to the southwest of New River Rd. and Shangri La Ln. in the New River area. The guest ranch is a year-round, full membership family friendly resort with a clothing optional environment that provides recreational facilities. The facility includes on-site recreational amenities which include a craft room, pools, gym, volleyball court, laundry facilities, tennis court, and a recreation center. The facility also provides various social activities throughout the year. The resort has operated for over 62 years, with the last major amendment approved for a 25-year timeframe. 2. The guest ranch is secured with existing 4’ (h) chain link fencing with three strand barbed wire and extensive dense native desert vegetation which includes Oleanders, Palo Verde, Mesquite, and various cactus plants to screen the facility. The existing desert vegetation ranges in height between 10’ – 20’. Primary access to the guest ranch is via Shangri La Ln. via New River Rd. with a gated entrance and guard house. The existing internal roadway network and proposed driveways for new construction along with parking spaces will be chip sealed. A dust control plan is in place that includes utilization of an on-site water truck that sprays the roads twice a week. 3. The applicant is proposing to remove condition ‘h’ which includes a 25 year time limitation for the Special Use Permit (expiration date of August 8, 2037). The existing condition language is as follows: h. This Special Use Permit shall expire 25 years from the date of approval by the Board of Supervisors, or upon termination of the use, whichever occurs first. The proposed elimination of condition ‘h’, staff also recommends removal of the original 5 year status report condition ‘i’. This will eliminate any confusion with a requirement for another status report due 5 years after the approval of this request. Staff will also amend condition ‘b’ to refence the updated narrative report with new language shown as underlined and bold. Shown below includes the amended conditions in legislative edit format: b. Development of the site shall be in conformance with the Narrative Report entitled “Narrative Report Case #Z2010077 Major Amendment to SUP for Shangri La Resort Ranch”, consisting of 24 pages, dated June 2012, and stamped received June 12, 2008, except as modified by the following conditions. The site shall be in conformance with the modification of conditions Narrative Report entitled, “Narrative Report for Shangri La Resort Ranch Case Number Z2021043, consisting of 4 pages, stamped received April 15, 2021. h. This Special Use Permit shall expire 25 years from the date of approval by the Board of Supervisors, or upon termination of the use, whichever occurs first. Deleted Z2021043 Page 2 of 7 i. The applicant shall submit a written report outlining the status of the development at the end of five (5) years from the date of approval by the Board of Supervisors. The status report shall be reviewed by staff to determine whether the Special Use Permit remains in compliance with the approved conditions. Daisy Mountain/New River Area Plan: The land use plan was adopted April 7, 1999, and displays the region as Rural (0-1 d.u./ac). The Rural category denotes areas where single family residential development is desirable, but urban services for sewer, water and fire protection, etc. are limited. Comprehensive Planning has determined the guest ranch use is in conformance with the Rural land use designation and has been in operation since 1959. 7. City of Phoenix General Plan: The City of Phoenix General Plan identifies the region as within the Phoenix North Area as undesignated. Public Participation Summary: 8. The applicant posted the property and notified all property owners within 300’ of the subject site in accordance with the Maricopa County Public Participation Guidelines. To date, no support or opposition has been received. Outstanding Concerns from Reviewing Agencies: 9. None received. Staff Analysis: 10. Shangri La Guest Ranch was initially approved in 1959 and was purchased by Kraus Investments in 1997. Shangri La Guest Ranch is a family-oriented clothing-optional, private establishment with over 19,200 sq. ft. of recreational space. The facility is affiliated with the American Association for Nude Recreation Western Region, The Naturist Society and Trade Association for Nude Recreation. 11. The removal of condition ‘h’ from the amended SUP case Z2010077, would prevent the termination of the special use permit, conveying a permanent entitlement for a guest ranch. All development of the site since its inception has complied with Maricopa County policies and procedures, Special Use Permits convey a temporary entitlement for Z2021043 Page 4 of 7 residentially zoned properties, but the guest ranch at Shangri La has remained in use since its inception in 1959. The use has been in place for approximately 62 years. The surrounding land uses and development patterns are established and not expected to appreciably change. The use is appropriate and compatible with the surrounding community. The facility has been a benefit to the community for the duration of its existence for the New River/Desert Hills community by hosing community and civic events. No new entitlement, use, or structure is being requested with this application. Staff believes the applicant has demonstrated an appropriate justification for the removal of remaining timeframe duration to keep the guest ranch as a permanent entitlement. Recommendation: 12. For the reasons outlined in this report, staff recommends the Commission motion for Approval, subject to modified condition ‘b’, deletion of conditions ‘h’ and ‘i’ with conditions ‘a’ – ‘m’. a. It is understood that the Resort, after the removal of the 25 year expiration stipulation will continue to be subject to a SUP and, therefore, any amendments, including enlargements or other changes, to the existing Resort will be submitted to the County as an amendment to the Resort’s SUP per the then current County Zoning Ordinance. Justification for the Request: Shangri La Resort Ranch (Resort), as a clothing optional community, is private and gated, and access is only permitted to members and invited guests. The Resort first received a Special Use Permit (SUP) approval from Maricopa County (County) in 1959. Over the last 62 years the Resort has expanded and flourished after receiving additional approvals from the County. The Kraus Family owns the Resort and has owned the Resort for over 23 years. There are currently 160 home sites and a total number of 200-250 residents at any one time, most of whom are full time. In addition, currently there are about 20-25 Resort members that reside in properties located throughout the New River/Desert Hills Community. The entire resort has a fence along the perimeter, with landscape screening. The screening consists of oleander and/or natural desert vegetation. The existing landscaping within the resort is native vegetation. The fencing consists of primarily three strand barb wire, four feet high. The main gate area is iron with automated gate and stucco archway. The natural desert vegetation surrounding the perimeter of the resort is either Oleanders, which are 10-15 feet tall, or Palo Verde and Mesquite trees, 15-20 feet in height, along with Saguaro, Ocotillo and various indigenous cactus plants. The Resort itself is 45.34 acres, however, the Kraus Family has purchased an additional 15 parcels directly adjoining the Resort totaling an additional 28.60 acres. These parcels are located on the north, west, south and east sides of the Resort as highlighted on the attached Maricopa County Assessors Map and almost completely surround the Resort. These 15 parcels, are or will be developed consistent with the existing Rural 43 zoning, and in addition to the above fencing and landscaping provides additional buffering from the surrounding neighborhood. 1 Shangri La Resort Ranch is family owned and family managed which means that most of the income from the Resort stays in the community. The Resort is not only family owned but family members also live in or close to the Resort. The father, three daughters, one grand daughter and one son-in-law, along with other hired local employees, manage the ongoing operation and maintenance of the Resort. Supplies and materials are purchased from businesses in the community. Over the years, the Resort has become a civic and economic asset to the New River/Desert Hills Community. The Kraus Family plans to maintain the Resort so that it will continue to be a civic and economic asset to the New River/Desert Hills Community far into the future. For example, the Resort’s “Swim-Camp-Days” for children in the area during June and July each year has been a great success and created an immense amount of goodwill among their neighbors. The residents remain clothed for this event. The Kraus Family, along with the residents, will continue to be supportive of businesses and other organizations in the community by purchasing supplies and food from them, using local contractors and participating in and supporting their organizations. Like other County SUP’s the Resort was approved by the County with an expiration date. The expiration date for the Resort is currently set for August 8, 2037. The multi-million dollar investment in the Resort, including a sewer and water system, along with many, many other improvements has been substantial. Due to the large investment and the success and longevity of the Resort it is not only logical, but very important, that the expiration date be removed. The County has supported the Resort as it continued to grow and improve over the years. There are no unresolved issues with the County. The Resort has a proven record over the years of protecting and preserving the health, safety and welfare of the Resort’s residents, as well as the surrounding properties and the greater area of New River/Desert Foothills. Therefore, it is requested the County agree there is no need for an expiration date for the SUP for the Resort, especially since any enlargement or changes to the existing Resort will have be approved by the County at a public hearing. Resort Amenities: 1. Water & sewer treatment and distribution/collection systems; 2. 160 living spaces for lease including cabin, efficiency, and park model rentals, full hookup RV sites, water and electric RV sites, and tent camping; 3. Hot tub, sauna, and 2 pools (one large and 1 for regulation water volleyball); 4. Pickleball, tennis and basketball courts. 5. Horseshoe pits, hiking trails, and children's playground; 6. Laundry facility; 7. A café open on the weekends; 8. A large clubhouse and meeting area with fireplace, dance floor, indoor dining, place for card games and other social gatherings, conference room, library, and large screen television with sound system. 9. Meeting space for resident members, and the clubhouse can be reserved by visiting clubs and organizations as well. 2 SHANGRI LA RESORT RANCH & HORST FAMILY OWNERSHIP O HF HP HP HP HG STATE TRUST LAND SHANGRI LA RESORT RANCH HP HP HP HP Maricopa County GIO, Maricopa County 5/14/2021 1:05:58 PM HP = HORST FAMILY OWNERSHIP Maricopa County Planning & Development Department Date: May 13, 2021 James Philbin, PE Planning & Development Memo To: Darren Gerard, AICP, Planning Manager, Department of Planning & 501 North 44th Street, Suite 200 Development Phoenix, Arizona 85008 Phone: (602) 372-4362 www.maricopa.gov/planning Attn: Warren Rivera, Planner, Planning & Development Services email address: James.Philbin@maricopa.gov cc: Michael Norris PE, Engineering Manager, Planning and Development From: James Philbin, PE, Plans Examiner Engineer, Planning & Development Subject: Z2021043 – Shangri La Ranch Resort – SUP Modification of Condition. I have been a member of Shangri La Ranch since 1985 and a longtime resident. Shangri La has been an outstanding fixture of the New River area since the mid 50s and an enthusiastic contributor in many areas to the local community. For several years, New River Road is regularly cleaned up by members and residents along that portion of the highway adopted by the Ranch. Members are volunteers and officers of the local Rotary Club as well as the Kiwanis Club in this community. Members volunteer at a local food bank and volunteer for our "Don't Dump in our Desert" cleanup program. In addition, the Ranch offers Summer Swim Camp for local residents and many of the residents are members of local churches. In short, Shangri La Ranch has been an enthusiastic good neighbor to this community for three quarters of a century and looks forward to many more to come. Please remove the time limit for the special use permit. From: David Thompson To: Rachel Applegate (PND) Subject: SUP Change - Case Number Z2021043 Date: Tuesday, June 15, 2021 11:41:03 PM Attachments: Shangri La SUP Change - Z2021043.docx Case Number - Z2021043 Project Name - Shangri La Resort Ranch Attached is a letter in SUPPORT of this SUP and the changes described with one additional item that has been discussed with the principals involved. Thank you. David Thompson 623-465-2977 Re: Z2021043 – Shangri La Ranch Resort. “Removal of condition ‘h’ of Z2010077 for permanent entitlement of a resort / guest ranch Special Use Permit (SUP) in the Rural-43 zoning district” This letter is in SUPPORT of the proposed changes to the SUP. Preface: Shangri La Resort is indeed a jewel of community participation as described in the supporting documentation for this change to the current SUP, and normally there would be no objection to the idea that permanence be allowed. However, there are areas that are not clear and easily understood by people in the community. Problem: The narrative description that is required to be met is not available for view: ” b. Development of the site shall be in conformance with the Narrative Report entitled “Narrative Report Case #Z2010077 Major conformance with the modification of conditions Narrative Report entitled, “Narrative Report for Shangri La Resort Ranch Case Number Z2021043, consisting of 4 pages, stamped received April 15, 2021.” Therefore, it is impossible to understand what is allowed by the current SUP. The current SUP does not expire until 2037; which brings the question of, “Why now?”This timing brings immediately to mind the current flux in the real estate marketplace. Values are increasing daily and asking prices are being exceeded on a regular basis. The fear is that making the SUP permanent for the property will encourage the sale of the property and subsequent land use contrary to the current lifestyle of the area. The best way to maximize profit on real estate during a bubble is to move quickly at the beginning before the marketplace settles. Discussion: In personal discussions with the principals it becomes clear that the family business is seeking very long term plans to continue the business through generations of family control, as well as a permanent home for Shangri La, within the community. The principals have agreed to add an additional clause that negates the SUP upon the transfer of the property to entities other than heirs and family. This clause would remove the any impetus for a rapid sale after the SUP is made permanent while meeting the familial goals of the request; as well as to provide the surrounding community stability and confidence in this long term area business. Therefore: The LNRDHD PAC stands in support of these changes to the SUP for the permanence of Shangri La. David Thompson Chairman.
