Report to the Board of Supervisors
Prepared by the Maricopa County Planning and Development Department
Board Hearing Date: June 9, 2021
Case #/Title: Z2021018 – Akron Lot Split
Supervisor District: 2
Applicant/Owner: Ephrem Jando / Greq LLC
Request: Rezone from R1-8 to R1-8 RUPD
Site Location: Generally located 135’ east of the intersection of Crimson Rd.
and Akron St. in the Mesa area.
Site Size: Approximately 0.56 acres
County Island Status: N/A
Additional
Comments: There is no known opposition. There are no outstanding
concerns from reviewing agencies.
The RUPD overlay district will allow the applicant to complete
a minor land division, creating three lots. The RUPD will permit
a minimum lot width of 64’ where the R1-8 zoning district
requires an 80’ minimum lot width. Without the RUPD to vary
the minimum required lot widths, the newly created lots would
have non-conforming widths per MCZO, Art. 604.4.
Staff approves of the proposed R1-8 RUPD zoning. Lot
development and entitlement often works in a reverse
fashion wherein recorded land divisions are submitted first to
the Maricopa County Assessor’s and Recorder’s offices
without meeting with Planning and Development staff to
ensure new lots created will conform to zoning standards. The
applicant’s request prevents having to complete remedial
entitlement for future parcels which do not meet zoning
district requirements, or alternatively require Board of
Adjustment variances prior to development.
Commission
Recommendation: On 5/13/2021, the Commission voted 10-0 to recommend
approval of Z2021018 subject to conditions ‘a’ – ‘f’:
a. Development of the site shall be in substantial conformance with the Narrative
Report consisting of 3 pages, stamped received March 20, 2021.

b. The following Planning Engineering conditions shall apply:
1. Driveway access to Akron Street must be paved and will require a permit from
MCDOT issued concurrent with building permit(s) required for site
development. Drainage flow along the roadway must be maintained.
2. Engineering review of re-zone cases is conceptual in nature. All development
and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design
Manual; and current engineering policies, standards and best practices at the
time of application for construction.
c. The following R1-8 RUPD standards shall apply:
1. Height: 30 feet
2. Rear yard: 25 feet
3. Lot Area: 8,000 square feet
4. Lot Width: 64 feet.
d. Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this Zone Change as set forth in the Maricopa County
Zoning Ordinance.
e. The property owner/s and their successors waive claim for diminution in value if
the County takes action to rescind approval due to noncompliance with
conditions.
f. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, the property shall revert to the zoning that existed on the date
of application. It is, therefore, stipulated and agreed that either revocation due
to the failure to comply with any conditions, does not reduce any rights that
existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held
on the date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the
Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted.

Report to the Planning and Zoning Commission
Prepared by the Maricopa County Planning and Development Department
Case: Z2021018 - Akron Lot Split
Hearing Date: May 13, 2021
Supervisor District: 2
Applicant: Ephrem Jando
Owner: Greq LLC
Request: Rezone from R1-8 to R1-8 RUPD
Site Location: Generally located 135’ east of the intersection of Crimson Rd. and

Site Size: 24,621 square feet
Density: R1-8 (8,000 Square Feet Per Dwelling Unit)
County Island: No

Project Summary:
1. The site is 24,621 square feet in size located approximately 135 ft east of the intersection
of Crismon Rd. and Akron St. There is an existing active violation case under V202002054
for junk, trash and debris currently in ‘Admin Remedy’ status. The applicant has
completed a compliance agreement with Code Compliance to resolve the non-
compliance issues, and the property is to be brought into compliance by 7/17/2021. The
violation is not related to the zoning request.
2. The applicant is requesting to re-zone the subject parcel. The site is currently zoned R1-8.
He wishes to apply an RUPD (Residential Unit Planned Development) overlay zone. The
proposed R1-8 RUPD zoning will allow for the eventual creation of three lots. Division of
the existing property into three new lots would not meet lot width requirement for the
existing R1-8 zoning district.
3. The proposed deviation for RUPD is a change to the required lot minimum width
requirement within the R1-8 zoning district. Surrounding parcels have matching R1-8
zoning designations. The lots north of the property in the Whetten Park subdivision are an
example of this, zoned R1-8 with and have lot widths less than the 80’ required. Lots to
the north and west, outside the Whetten Park subdivision also have these non-conforming
features with existing homes on them. The applicant does not propose additional
deviations from the R1-8 zoning district, only required lot widths. The proposed lot widths
would be consistent with the surrounding neighborhood.

Adopted Plan:
6. East Mesa Plan: Adopted February 12, 1992, classifies the subject lot as: Urban

Public Participation Summary:
7. The applicant complied with the Maricopa County Citizen Review Process with the
required posting of the site and notification by first class mail to adjacent property owners
within 300’ of the subject parcel, and to other interested parties. The applicant did not
receive opposition or support to the proposal during the public participation process.
Staff received no calls or letters of support/opposition as of the writing of this staff report.
Outstanding Concerns from Reviewing Agencies:
8. N/A
Staff Analysis:
9. Staff recognizes lot development and entitlement often works in a reverse fashion
wherein recorded land divisions are submitted to the Maricopa County Assessor’s and
Recorders’ offices without meeting first with Planning and Development staff to ensure
the new lots created will be conforming to zoning standards and therefore eligible for
building permits and construction. The applicant in this submission aims to have the
entitlement prior to the land division. This in turn prevents having to complete remedial
entitlement for existing parcels which do not meet zoning district requirements, or
alternatively require Board of Adjustment variances prior to development.
10. The applicant has provided new legal descriptions for each of the future parcels. The
only proposed standard change is for minimum lot width. All three future parcels will have
otherwise conforming features of the R1-8 zoning district. Additionally, surrounding
parcels are largely zoned R1-8 and some, like those in the Whitten Park subdivision to the
north, have existing non-conforming lot widths for the R1-8 zoning district due to
Z2021018

development prior to adoption of Maricopa County’s current zoning ordinance. Further,
these lots have typical widths of 70 feet. The allowance for 64 foot widths for the three
future parcels l is substantially conforming to surrounding uses and existing property widths
and areas.
Recommendation:
11. For the reasons outlined in this report, staff recommends the Commission motion for
Approval, subject to conditions ‘a’ – ‘f’:

time of application for construction.

Project Name: Akron Lot Split
General Location: North of Main AKA Apache Trail Blvd and East of Crismon Rd
Case #: Z2021018
Vicinity Map:

Purpose of Request: GREQ, LLC is requesting approval to re-zone the subject parcel into 3 lots zoned R1-
8 RUPD. Per the current planning pre-application meeting comments the only development standard
not currently met for the intended lot split is the required lot width requirement for R1-8 zoning district.
Description of Proposal: The zoning case number for this request is Z2021018. The zoning overlay
request being approved allows GREQ, LLC to install 3 new mobile homes built by a local supplier
(Champion Homes). Upon approval of this R1-8 RUPD overlay the complete construction process will
take 3-6 months.
Development Standard Table:

Relationship to Surrounding Areas: Currently the lots north of Akron inside the Whetten Park
subdivision are R1-8 zoned with less than the 80’ required width, to the west of Akron lot is an R1-8
corner lot with two older manufactured homes on a 17,000 SF lot. To the east of this lot is another
residential R1-8 lot. We will install 3 new manufactured homes built by a local distributor called
Champion Homes. These units will qualify for FHA financing, the most common financing offered to first
time home buyers and backed by Federal Housing Administration. The surrounding area has multiple
homes under construction and new development. The overlay request we have submitted will be
compatible to the subdivision lot widths North of our lot (Whetten Park).
Location and Accessibility: Akron St is a state maintained road with easements for Right of Way, there
will be 1 private driveway per lot design once approved for a lot split.
Circulation: Each lot will be separated by fencing and have its own ingress/egress.
Development Schedule: Upon approval construction will take 10-12 weeks and another 4-6 weeks for
lot preparation, delivery, permits and installation. Total time from approval to construction completion
will be 6 months.
Community Facilities and Services: Akron lots are located in mesa School District #4. There are freeways
within 1 mile access. Safeway groceries is 3 miles away from subject lot. Walmart Supercenter is 2.7
miles away. There is a worship center within walking distance to subject lot just .2 miles away. Subject
lot is also less than 5 miles to Usery Mountain Regional Park providing hiking, camping and boating.
Subject property is just 1 mile to the Skyline Park in mesa and 4 miles to Apache Junction Multi-
Generational Center.
Public Utilities and Services: Refuse is collected by Right Away Disposal. The Sewage will be private
