1. INVOCATION – INVOCACIÓN
Supervisor Gallardo introduced Judge Enrique Medina, Justice of the Peace for the
Downtown Justice Court. Judge Medina offered the invocation.
2. PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Judge Enrique Medina also led the assemblage in the Pledge of Allegiance to the Flag.
Supervisor Gallardo thanked Judge Medina for his service this morning. He commented
that he had known the Judge for many years. In introducing his background Supervisor
Gallardo said that Judge Medina had served as the first executive director of the
Independent Redistricting Commission. He also served as the Executive Director of the
Arizona Fair Housing Center. In addition, he has served as the city manager for some
small municipalities. The Board of Supervisors appointed Judge Medina to the Justice
of the Peace position in 2017.
Finally, Supervisor Gallardo noted that September is Hispanic Heritage month and in
inviting someone to offer the prayer and pledge at this Board meeting, he felt that Judge
Medina would be an excellent representative to highlight Hispanic Heritage. Again,

4. PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -
PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE
CONTROL Y CUIDADO DE ANIMALES
Chairman Hickman provided the following information about the pet of the day:
“Rocko is one of the many dogs staff would love to see find his forever home. He is a
beautiful chocolate pittie/lab mix and has been at the shelter since June 15, 2020, which
feels like a very long time to such a good boy!
Rocko is about 4 years old, which is a wonderful age to adopt because he is young
enough to still spend most of his life with his new owners, while at the same time he
has a chance to settle down. He already knows a couple basic commands, is playful
and energetic. He is also very friendly with people, loves to get attention and leans into
petting. Rocko would like to be the only dog at home and have all the owners full
attention to himself. If you are interested in meeting Rocko you can book an
appointment to see him at pets.maricopa.gov or call 602-506-PETS (7387).
The “Empty the Shelter” event ended on Monday, August 31st, but there is an upcoming
Labor Day special event starting the coming Friday through Monday. Most animals are
only $25 or $50, depending on their size. Puppies and Shelter Super Heroes are
excluded.

The Chairman also read an update regarding a previously adopted dog, Gus, a 10-
year-old dog that was adopted in June. The new owner wrote: “We went down to ACC
and met Gus and the wonderful lady who showed him to us. That lady, whoever she
was, was kind, empathetic towards Gus and I could see she really cared. She
encouraged without being pushy.... in short... she was his advocate and we very much
appreciated her thoughts and her caring nature. Gus has been home for almost 12
weeks. He stopped shaking after 2 days. He sleeps in the bedroom with us and the
other dogs; has a great personality and we call him Gus the Explorer. He wags his tail
and sometimes runs when he plays; his limp seems to not be so bad and he really
seems happy.”
Chairman Hickman asked Ms. McCarroll if there were any announcements or changes
to agenda. Ms. McCarroll responded that there were no changes or correction to be
announced.

5. PROCLAMATION
Approve the Proclamation -- Unity Pledge - September 2, 2020 (C-06-21-149-X-00)
Chairman Hickman announced the next item, indicating that County Attorney, Allister
Adel had taken this Unity Pledge and was doing some wonderful things in the County
Attorney’s Office. He then called on Supervisor Gates to introduce this item.
Supervisor Gates thank the Chairman for moving this item onto the agenda. He stated
that unity is something that is a very important concept. Often when an issue arises in
a family, they unify; the same is true in a community setting. This is very important at
this time as the community is facing the pandemic, and as the Governor, the County,
including the Public Health Department and other organizations have unified to deal
with the first pandemic to be dealt with in 100 years.
He stated that unity is something that progresses over time in society. A good example
is the inclusion and acceptance of the LBGT community. He commented that he
believes this pledge is an example of inclusion and this proclamation demonstrates that
Arizona’s largest community is committed to inclusion. Inclusion is important to our

County Manager regarding the workforce in the County, and to people who choose to
live in Maricopa County. He noted that when people unify, it is possible to do more as
a team, and the inclusion of our LGBT friends will help Maricopa County to be an even
greater region.
Supervisor Gates read the proclamation. A copy of the proclamation is printed here and
is on file with the Clerk of the Board's Office and retained in accordance with LAPR
retention guidelines.
PROCLAMATION
Unity Pledge - September 2, 2020
WHEREAS, Civil rights serve as the foundation of our free society and deserve our
most vigilant protection. In just the past few years, we have seen remarkable
advancements in the rights of Lesbian, Gay, Bisexual, and Transgender (LGBT)
Americans. Yet, despite these victories, we still have a long road ahead. Bias and
discrimination are not easily defeated, and we must remain diligent in the fight for true
equality; and
WHEREAS, In an effort to show support to our LGBT citizens, and to showcase
Maricopa County as a county welcoming to all people, the Maricopa County Board of
Supervisors is proud to sign the ONE Community UNITY Pledge, a public declaration
of support for equal treatment in employment, housing and public accommodations;
and
WHEREAS, It’s time for LGBT inclusive non-discrimination policies in the workplace, in
housing, and in public accommodations. For our part, Maricopa County celebrates
diversity and supports workplace equality. We are committed to fostering, cultivating,
and preserving a culture of diversity, inclusion, fairness, and equality; and
WHEREAS, We celebrate our employees regardless of age, color, disability, ethnicity,
family or marital status, gender identity or expression, language, national origin,
physical and mental ability, race, religion, sexual orientation, veteran status, and
other characteristics that make our employees unique; and
WHEREAS, It is time to ensure equality for all Arizona employees, residents, and
consumers. It’s the right thing to do. It’s good for business. It’s good for the business
of Arizona.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors, sign the UNITY
Pledge on behalf of Maricopa County.
DATED this 2nd Day of September 2020.

/s/ Steve Chucri, Supervisor, District 2
/s/ Bill Gates, Supervisor, District 3

Supervisor Gates made a motion to approve the Unity Pledge Proclamation. The
motion was seconded by Supervisor Gallardo.

Supervisor Gallardo thanked Supervisor Gates and the Chairman for placing this item
on the Board’s agenda. He stated, that as many know, he is a member of the LBGT
community. He noted the importance of treating everyone with respect and dignity and
that all are welcome here. He stated that Angela Hughey is a friend of his who has
dedicated her time to an organization called One Community. She has brought this
proclamation to a number of organizations and businesses in Arizona, and so many
large corporations have signed this Unity Pledge. He stated it was time for government
to join in this statement also, providing the best services to all, and welcoming all the
citizens of the County.
Supervisor Gallardo added that the County’s personnel policies already outline
inclusion and this proclamation confirms what is already in place. Maricopa County
welcomes and receives everyone, and he stated he is very glad to see this proclamation
on the agenda. It is not about politics, it is about sending the best message forward not
only to the 14,000 Maricopa County employees, but to the entire community. He said
that we have always been open for business, but this proclamation is just a statement
confirming that.
Supervisor Sellers stated that one of the strengths of the community is being as
inclusive as possible. He concurred with other remarks that this is a good proclamation
to bring forward at this time.
Supervisor Chucri noted that he was also a friend of Ms. Angela Hughey. He
commented that he had been asked as the President and CEO of the Arizona
Restaurant Association to also consider this proclamation. Many of the members stated
that they already practiced this inclusion daily as a number of the employees are
members of the LBGT community. He pointed out that no one should stand for
discrimination of any kind. This is actually a unity pledge. He added that there is one
fundamental truth and that is, “We are all God’s children.” He further stated that we are
not here to judge others. Also commenting on the issue of religion, he said that there
have been court cases even up to the US Supreme Court about how religion may be a
part of this discussion. He then stated that his paternal grandfather was stabbed to
death on the streets of Lebanon, in front of this father when he was 13 years old. He
was stabbed because he was a Catholic. But he said that he did not see that
controversy or inner struggle in this proclamation. Therefore, he stated that he supports
the proclamation and understands what Ms. Hughey is doing and agrees that it is the
right step forward.
Chairman Hickman thanked all of the Supervisors for their well-spoken comments. He
added that good businessmen always want to draw the very best as employees.
People need to be engaged in their workplace and be treated well. Everyone needs to
know that they are a part of the Maricopa County community, citizens, constituents, and
voters. There is a place for everyone in this community and that is what this pledge is
about.

16. ROSE ESTATES
Case #: CPA2019013

approval of CPA2019013 subject to conditions ‘a’ – ‘d’:

c. The total number of residential dwelling units on the site shall not exceed 440.
d. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the uses existing on the date of application, subject to
conditions. In the event of the failure to comply with any condition, the property shall revert
to the land use designation that existed on the date of application. It is, therefore, stipulated
and agreed that either revocation due to the failure to comply with any conditions, does not
reduce any rights that existed on the date of application to use, divide, sell or possess the
property and that there would be no diminution in value of the property from the value it held
on the date of application due to such change of the land use. The land use enhances the
value of the property above its value as of the date the land use change is granted and
reverting to the prior land use designation results in the same value of the property as if the
land use change had never been granted. (C-44-21-041-X-00)

and/or entitlement.

2. Any approval and progression in the entitlement process is contingent on progression of
MCDOT TIP TT0248 which includes extension of Williams Drive across the Agua Fria River
to Deer Valley Road which is intended to provide access to the site.
3. A Traffic Impact Study must be submitted as part of the Preliminary Plat application.
4. Any new development on the subject premises must provide for at least two (2) paved

revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
j. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting if this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, the property shall revert
to the zoning that existed on the date of application. It is, therefore, stipulated and agreed

that either revocation due to the failure to comply with any conditions. Does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation of the Zone Change. The Zone Change enhances the
value of the property above its value as of the date the Zone Change is granted and reverting
to the prior zoning results in the same value of the property as if the Zone Change never

Motion to approve by Supervisor Steve Chucri, seconded by Supervisor Bill Gates

Supervisor Chucri asked a question about the process related to duplicate warrants.
Ms. McCarroll explained that there is a two-step process that takes place prior to an
item being placed on the agenda for replacement.
 First, there is a review to see if the check has already been cashed.
 Then, there is a stop payment order issued on that check.
 After these two steps, the item goes on the agenda to replace the warrant
 She added that there is not always an explanation of whether the mail was
misdirected, or if someone placed the check in their drawer and forgot about it.

Supervisor Gates commented on item no. 71 that some have wondered about the
spending of CARES Act monies. This agenda item is for $1.6 million with over
$103,000 to the Daisy Mountain Fire District for Covid-19 reimbursement related
expenses. In much of District 3, Daisy Mountain is the fire protection. The Fire
Department is doing incredible work also with the County’s Covid-19 Response
programs.
Chairman Hickman concurred with those remarks adding that some Supervisorial
Districts have very large municipalities with fire departments, others have large
stretches of unincorporated land where the fire districts serve an important role. He
expressed his appreciation for the fire districts in reaching out to assist with various
functions during the pandemic. He added that it is good to see the money going to
areas for emergency response and to the people who are providing that service.

Supervisor Gallardo commented on the passing of Ronnie Lopez. He noted that many
of the local elected officials of his generation were greatly influenced by the legacy of
Ronnie Lopez, calling him a pillar in the community. He stated that he had served as
the Chief of Staff to Governor Bruce Babbitt and help to establish the large national
organization, Chicanos Por La Causa. Mr. Lopez was also instrumental in getting Ed
Pastor, a former County Supervisor, elected to a US Congressional seat. He was
always open to sharing advice and guidance. Supervisor Gallardo noted that he knew
the family well and expressed his condolences to the family. He considered Mr. Lopez
to be a great servant to his entire community.
Supervisor Gallardo also wished everyone a safe and happy Labor Day Weekend, but
reminded all to take extra precautions and follow the best guidelines for safety as the
pandemic continues.
Supervisor Sellers commented that he had attended several meetings including the
MAG Transportation Policy meeting and the Valley Metro Regional Transit Board
meetings. He had attended the recent Bridge Forum meeting in Tempe and planned
to attend the one next week. He commented that it is an interesting organization that
is moving in a positive direction. He also noted that he had represented Maricopa
County at the Rio Reimagined ceremony the previous day. This ceremony celebrated
that this project became the 20th Urban Waters Federal Partnership project. Maricopa
County is a key player in that project in which Senator McCain was involved. It is
exciting now to have a Federal Partnership to help move the project forward.
Chairman Hickman stated that he participated in a Get-Out-The-Vote event the
previous evening in Sun City. Many of those in attendance brought their grandchildren
and great-grandchildren, emphasizing the importance of elections. He had an
opportunity to speak and explain the role that Maricopa County plays in the election
process. He also reflected on his own first opportunity to vote where he voted for
Ronald Reagan for his second term. He recounted the special opportunity he had to
meet President Reagan as a Senior in High School. The Chairman also commented
on another speaker at the event who relayed that he had started as a volunteer in a
political campaign and is now a paid staffer for a Congresswoman.
