Also present Debra Schaffer, Deputy Clerk of the Board; Kelly Gardiner, Minutes Coordinator; Joy Rich, County Manager (remote); Andrea Cummings, Legal Counsel (remote). 1. EXECUTIVE SESSION Vote to convene in Emergency Executive Session to consider the items on the Executive Agenda dated Friday, May 07, 2021, for Board of Supervisors and relevant Special Districts pursuant to the statutory authority listed for each item. Pursuant to A.R.S. § 38-431.02(D), notice is hereby given that an Emergency Session of the Maricopa County Board of Supervisors was held May 7, 2021, at approximately 2:00 pm. at 301 W. Jefferson – 10th floor, Phoenix, AZ, 85003. The meeting was held with members attending either telephonically or in person. Andrea Cummings, Legal Counsel, stated that the emergency was due to the Senate indicating that they would take action against the County and Supervisors if the County does not provide passwords it does not have, and routers that could allow access to sensitive law enforcement data, as well as protected health information and personal data of county citizens. Motion to convene in Executive Session by Supervisor Bill Gates, seconded by Supervisor Clint Hickman Ayes: Jack Sellers, Bill Gates, Clint Hickman, Steve Gallardo Absent: Steve Chucri ~ Supervisor Chucri joined the meeting immediately following the vote into Executive Session ~ Special Meeting Minutes Friday, May 07, 2021 Page 2 of 2 At the Emergency Executive session, the Maricopa County Board of Supervisors considered: Legal advice and litigation regarding compliance with board responsibilities and authority regarding elections; senate subpoena; elections equipment; and related litigation.
