RECOGNITION OF FRAN MCCARROLL, CLERK OF THE BOARD OF SUPERVISORS Recognition of Fran McCarroll, Clerk of the Board, for years of dedicated service as the Clerk of the Board of Supervisors. (C-06-21-316-X-00) ~ This item was heard prior to item #4. ~ Chairman Hickman shared some comments regarding Ms. McCarroll’s tenure at the County. He made note of the following: The Clerk of the Board is the only County Officer who is appointed, not elected. Formerly, Ms. McCarroll taught Junior and Senior High School – Science, English and Journalism She has served 21 Supervisors during her time at the County. Ms. McCarroll oversees the Office of the Clerk of the Board One accomplishment she is proud of is the automation of the agenda system from hand- carried paper to the current electronic system. Ms. McCarroll has become the repository of all things “Maricopa” such that many times she is the first person called regarding research Ms. McCarroll is known as a dedicated public servant The Chairman commented that in her coming retirement he hoped Ms. McCarroll would be able to enjoy traveling and time with her husband and family. Chairman Hickman then read a letter from Melissa Buckley, Vice President-Elect of the Arizona County Clerks Association. Ms. Buckley commented on her leadership and dedication to the organization and her willingness to share with others from her knowledge and experience. The Chairman then introduced a short video showing pictures of Ms. McCarroll and a number of the Clerk of the Board’s staff who have served in the Office over the past years. Formal Meeting Minutes Wednesday, December 9, 2020 Page 3 of 89 Supervisor Gallardo commented that he first got to know Ms. McCarroll years ago when he worked as an employee in the Elections department. He said she has always been great to work with and has set the “gold standard” for Clerks of the Board. He thanked her for her service, her friendship, and the way she has been always available to do research and answer questions. Supervisor Chucri noted that Ms. McCarroll had served at the County during some difficult times but helped to keep things intact during those times. He noted that her position is like a lynch pin of the Board’s responsibilities and the Board could count on her to do things the right way and on time. He likened her work to a slow and steady hand that continues to provide guidance. He stated that the procedures she had developed are the groundwork for stability going forward. Supervisor Gates said that Fran is the institutional knowledge of the Board of Supervisors over several decades. He noted that he enjoyed some of the conversations about past events in the County. One responsibility of the Board of Supervisors is filling vacancy appointments of which there have been many over the past few years. He recalled a conversation with her regarding an appointment to the Board of Supervisors about why there is a state law that a subsequent appointee must be of the same political party. He commented that transparency in all the Board does is so important and Ms. McCarroll is the person who makes sure that proper notice is given. Supervisor Gates also commented that he was glad to hear that Ms. McCarroll would be helping with the transition to the new Clerk. Supervisor Sellers agreed with the previous comments and thanked Ms. McCarroll for the assistance given to him when he was recently appointed to the Board of Supervisors. Some may not realize how large and complex Maricopa County government is. He said it had been a pleasure to work with her and wished her all the best in the new adventures ahead. Chairman Hickman recounted his experience when he was applying for the appointment to the position in District 4. He noted that Ms. McCarroll was able to give him a good overview of duties and responsibilities. He added that conversations with Ms. McCarroll always had a calming influence because she spoke from experience. He reminded the other members that Ms. McCarroll was going to help with the transition to a new Clerk, noting the importance of the position. The Chairman invited Ms. McCarroll to say a few words. Ms. McCarroll thanked this Board and all of the previous Board members that she had the opportunity to serve over the past years. She noted a special thanks to Supervisor Betsey Bayless saying that “maybe she saw a spark in me and said, maybe she’ll grab this opportunity and run with it.” Ms. McCarroll said she hoped she had lived up to Ms. Bayless’ expectations. Similarly, Ms. McCarroll noted that she wanted to express a thanks to Ed Wolfe who was the Deputy Clerk when she was appointed. He was an excellent mentor, sharing his wealth of experience in the Office. She then commented there are actually thousands of people to whom she could offer a sincere thank you, but there is not enough time in a day to list them all. Ms. McCarroll thanked the many County employees that have been her help and support as teachers and friends along the way, noting how special they were to her and their willingness to provide service every single day. The other 14 Arizona County Clerks have helped her to grow and stretch and learn. They are an incredible support group, and they are ones who understand the word, “Clerkdom.” On a personal note, Ms. McCarroll thanked her sister, Terri, for all of her love and support throughout her entire life. She also said hello to her children and their families – Amy McCarroll Dunn, husband Jeremy and grandchildren Liam and Fiona in Atlanta. Also, she greeted her son, Jeff in Flagstaff and granddaughter Penelope Evangeline. She noted that her children were a very special “bright spot” in her life. Formal Meeting Minutes Wednesday, December 9, 2020 Page 4 of 89 Ms. McCarroll then noted that 29 ½ years previously she met a gentleman named Dean Wolcott who introduced himself as the Clerk’s lawyer. After he left her office she questioned if, as a “Clerk,” did she need a lawyer? But she came to learn how much a Clerk needs a lawyer. She thanked all of the attorneys in the County Civil Division who, over the years, allowed her to “pester" them with questions which helped her to grow in her knowledge of the Office. She then noted that 15 years after meeting Mr. Wolcott, she married him...and still pesters him with questions. Ms. McCarroll then offered thanks to all of the employees past and present within the Clerk’s Office. She noted that she is often the one who sits in the meetings, and is the face of the Clerk’s Office, however, she said, “I am never alone. It is never just me. It is every one of the spectacular people I have worked with. The “Clerk of the Board” is really 13 people.” Any kudos really go to the wonderful “Clerkettes.” She stated that she is thankful to be moving to the position of Clerk Consultant and hopes that she will be a mentor who is as helpful as those who mentored her. As a final word, she commented that she wanted to thank God by sharing the following verse, “You are my servant. I have chosen you and not cast you off. Fear not for I am with you. Be not dismayed, I am your God. I will strengthen you, I will help you, I will uphold you with my righteous right hand.” The Chairman presented Ms. McCarroll with a plaque and said that flowers and a clock awaited her in her office. 4. PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE CONTROL Y CUIDADO DE ANIMALES Monica Gery of Maricopa County Animal Care and Control presented a picture of Luna, a 7-year-old boxer/cattle dog mix who is considered a “senior.” Ms. Gery stated that Luna is very sweet and loves to play in kiddy pools. She commented that the Bissell foundation was sponsoring a special event regarding adoption fees for cats, dogs and kittens, and she invited all listeners to visit pets.maricopa.gov to see available pets. Chairman Hickman asked if there were any changes or corrections to the agenda. Ms. McCarroll responded that there were none. Planning and Development 5. Development of the site shall be in substantial conformance with the Site Plan entitled “Arizona Water Company”, consisting of 1 full-size sheets, dated 21 August 2020, and stamped received 28 August 2020, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “White Tanks Operation Center”, consisting of 16 pages, dated 15 June 2020, and stamped received 24 August 2020, except as modified by the following conditions. c. The following Planning Engineering condition(s) shall apply: 1. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Engineering review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and the MCDOT Roadway Design Manual. 3. Detailed Grading and Drainage Plans showing the new site improvements must be submitted for the acquisition of building permits. d. A copy of the ‘will serve’ letter shall be required as part of the initial construction permit submittal. e. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. f. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change/Plan of Development. The Zone Change/Plan of Development enhances the value of the property above its value as of the date the Zone Change/Plan of Development is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change/Plan of Development had never been granted. h. The following IND-1 IUPD standards shall apply: 1. Height: 40’ max building height. 64’ max height for single radio tower. 2. Screening: 8’ high CMU block wall. 3. VULCAN SOLAR PROJECT Case #: CPA2019014 Supervisor District: 5 Applicant / Owners: Candela Renewables LLC / Arizona State Land Department, Elizabeth E. Shepler, Illian Tachkov Request: Major Comprehensive Plan Amendment (CPA) to change the land use designations in the Old U.S. Highway 80 Area Plan from Rural and Large Lot Residential to Utilities. CPA approval is by Resolution. Site Location: Generally located between the Arlington Canal Service Rd. alignment to the east, 333rd Ave. to the west, Arlington Canal Rd. alignment to the south and the Union Pacific Railroad to the north in the Tonopah-Arlington area Commission Recommendation: On 11/5/20, the Commission voted 5-1 to recommend approval of CPA2019014 subject to conditions ‘a’ – ‘d’: a. Development and use of the site shall be in general conformance with the narrative report entitled “Vulcan Solar Project” dated September 29, 2020 and stamped received October 1, 2020, except as modified by the following conditions. b. Development and use of the site shall be in general conformance with the land use exhibit entitled “Maricopa County Comprehensive Plan Amendment Project Site Land Use Exhibit” dated September 29, 2020 and stamped received September 30, 2020, except as modified by the following conditions. c. The land use designation of utilities approved as part of case CPA2019014 shall be subject to any time limit set forth in the subsequent zone change, and shall change back to the existing Rural and Large Lot Residential designations if the zone change reverts back to Rural-43. d. The applicant is proposing to develop a photovoltaic solar electric generating facility which, pursuant to the Maricopa County Comprehensive Plan, necessitates a change in the land use designation from Rural and Large Lot Residential to Utilities. The proposal by the applicant represents a comprehensive approach to the subject property and will allow the applicant to pursue the proper entitlements pursuant to state law so that they can lawfully operate in unincorporated Maricopa County. This particular proposal is an appropriate plan for the property and is consistent with the overall intention of the comprehensive plan. However, in the event that the zone change or a zone change phase for this particular proposal is not approved by Maricopa County Board of Supervisors (BOS) within five (5) Formal Meeting Minutes Wednesday, December 9, 2020 Page 9 of 89 years from the date of Board approval of this comprehensive plan amendment, this amendment shall no longer be effective as the planning justification for this comprehensive plan amendment will no longer be present. In such instance, a change of the land use designation from Utilities to Rural and Large Lot Residential will occur, and all comprehensive plan land use maps shall be altered to reflect as such, because this represents superior long-range planning by Maricopa County. (C-44-21-153-X-00) Ms. Pokorski recommend taking each item of the remaining items individually. The Chairman asked her to continue with the presentation on item #7, Vulcan Solar Project. Ms. Pokorski noted that the Vulcan Solar Project is located in District 5. The map shown indicates the project is in the Tonopah-Arlington area. This request is a major comprehensive plan amendment because it is over 640 acres. Comprehensive plan amendments are only heard once each year. An amendment changes the land use designation from that which was previously adopted. In this case, the change would be to a Utility Land use designation which could but will not necessarily allow for a future solar electric generating facility. That is what the applicant is proposing for the future use for that land, however, a zone change would also be required prior to the construction of the facility. This is just the Comprehensive Plan amendment. The Planning Commission recommended approval for several reasons. There are several other approved amendments for solar energy in the area (a map showed these facilities). In addition, there is a solar energy generating business in the same area. According to the goals of this Comprehensive plan, generating renewable energy developments is one goal, and discouraging land uses that would put a strain on water resources or would have a heavy impact on roads is another aspect of the plan. Solar energy developments meet these goals. Ms. Pokorski noted that the department had received several letters of opposition. The concerns center around a negative effect on property values as there are some existing rural homes and rural lots to the west of this proposed site. Also, on the site there is an extinct cinder cone which is a landmark in the area so there is a concern about the aesthetics of this project. There was one letter of support from a homeowner who felt the project would have a positive economic impact, and a letter of support from the Buckeye Valley Chamber of Commerce. All of these letters were provided to the Board in their packets. Ms. Pokorski stated the matter before them today is only the Comprehensive Plan amendment. This does not give the applicant any right to develop the sight at this time. That decision would come at the next step. That application would have details including what the applicant might plan to do about the cinder cone. The Chairman asked if Supervisor Gallardo has any questions at the time. The Supervisor responded that it is important to note that this is only the Comprehensive Plan amendment and that the zoning change would be a separate action. Ms. Pokorski commented that one person (Mr. Reid King) in opposition sent an email stating that he wanted to speak only if there was new material presented. The applicant (Mr. Ferrera) is also on the phone. Mr. Ferrera thanked the Board for the opportunity to speak. He stated he would make three points. 1) Re: is this appropriate use of the land in this area? He said that this area is part of the old US 80 planning area. There are other similar land use plans in the immediate area. 2) He stated that what they are proposing represents an improvement to the Comprehensive Plan. Additionally, this project would provide Formal Meeting Minutes Wednesday, December 9, 2020 Page 10 of 89 hundreds of construction jobs. 3) The Developer is committed to open communication with all stakeholders. Mr. Ferrera had sent slides about the project which were projected on the screens for the Board to review. The first slide showed other projects in the area and the adjacency to the old Highway 89 plan. The second slide reviewed the applicant’s outreach activities including working with the Arizona State Land Department. He then outlined their public outreach with efforts which exceeded the requirements which included mailers, posted signs, a virtual meeting and a website providing information about the project. They also met with those in opposition either in person or in virtual meetings. Mr. Ferrera’s next slide showed a compilation of the negative comments or concerns they heard regarding the project. He noted some of the concerns including a question about installing fencing along the road, however, he stated that others may be on the phone and they could state their concerns. The next slide dealt with information about the installation of solar panels – they can be either non-ground-penetrating or ground-penetrating. Some are built on concrete foundations which do not penetrate the ground. He noted that all things including weather conditions are taken into account when installing solar panels. Regarding the cinder cone, Mr. Ferrera stated that it would still protrude over 100 feet above the installation and approximately 90 acres on the south side of the cone would remain undeveloped. Some features of the cinder cone are not located on the area of proposed development. Mr. Ferrera also showed three slides with pictures looking toward the cinder cone from different directions. Mr. Reid King, area resident, then addressed the Board. He commented that he had spoken directly with the applicant. Although he appreciated the pictures on the slides, however he felt that the pictures did not do justice to the cinder cone. He felt that the area would be “decimated” by this development. The current zoning is rural residential, and he felt it should continue to be so designated. The other solar arrays which have been discussed are to the west of this area. He felt this was the appropriate place for such installations. Mr. King also reference the fact that as Supervisor Gallardo noted, this was only the request to change the Comprehensive Plan and a later request would be needed for the zoning change. However, Mr. King felt that the criteria required for a Comprehensive Plan amendment have not been met. The applicant cannot show that they have complied with the terms to amend. If this change passes, then there is a minimum of 5 years when a variety of other uses could come to this area including some industrial uses. Finally, he noted that he had sent a memorandum outlining his objections. He urged the Board to not approve this requested change in the Comprehensive Plan. Mr. Ferrera indicated that he would be open to answering any questions. Supervisor Gallardo indicated that he knew his staff have worked extensively on this case. He stated that he would like to meet with Mr. King regarding his concerns and possibly drive out to view the area. Formal Meeting Minutes Wednesday, December 9, 2020 Page 14 of 89 d. The applicant is proposing to develop a photovoltaic solar electric generating facility which, pursuant to the Maricopa County Comprehensive Plan, necessitates a change in the land use designation from Rural Development Area to Utilities. However, in the event that the zone change or a zone change phase for this particular proposal is not approved by Maricopa County Board of Supervisors (BOS) within five (5) years from the date of Board approval of this comprehensive plan amendment, this amendment shall no longer be effective as the planning justification for this comprehensive plan amendment will no longer be present. In such instance, a change of the land use designation from Utilities to Rural Development Area will occur, and all comprehensive plan land use maps shall be altered to reflect as such, because this represents superior long-range planning by Maricopa County. Continuance Request: Applicant has requested a continuance to the December 9, 2020 hearing date. (C-44-21-091-X-00) Ms. Pokorski indicated that this item is a request to amend the zoning ordinance as it relates to group homes. The request has sparked the County to commission a study for this requested amendment. The staff has reviewed the draft of this study which is recommending some changes to the County’s zoning ordinance. Therefore, staff is now working on drafting their own text amendment regarding this issue. The applicant has now requested to work with the County on this text amendment, therefore he has agreed to continue this item until April 7, 2021. WATER TRUCKS (CONT. FROM 11/4/20) Case #: TA2019006 Supervisor Districts: All Districts Applicant / Owners: Commission-initiated Request: Text Amendment – Water Trucks Commission Recommendation: On 10/8/20, the Commission voted 6-0 to recommend approval of TA2019006 amending MCZO, Art.501.2.10.r (Alternative #8 of the Commission staff report) with the following language: 10. Home occupations, subject to the following: r. Notwithstanding the above, a home occupation for an employee of a water hauling company where a maximum of two water trucks that are registered, operable and actively used in the conduct of the business by the residents may be parked at their residence on a lot in a rural zoning district and within an area not served by a public water system provided the truck is available for emergency response for fire suppression (registered with the local fire district or department), and provided said lot is not located within 500’ of the boundary of another lot housing such a truck. (C-44-21-106-X-00) Ms. Pokorski stated that this item is a staff-driven text amendment that would allow water trucks to park in rural areas where there is not a public water system. She noted that Supervisor Chucri had done some work on this issue and this case which was continued from November 4, 2020. He has met with some members of the community. Supervisor Chucri thanked the Planning staff for working on this issue. He noted that there have been some good stakeholder meetings. He commented that he did not want to rush to adopt this amendment, but rather wanted to make sure the wording would be correct as it is like having to “un-ring a bell” if the wording isn’t exactly right or turns out to be overly prescriptive. He indicated that they would be continuing to have stakeholder meetings and there could be a possibility that there would not be a need for a text amendment. Supervisor Gates thanked Supervisor Chucri for leadership, noting that there are similar issues involving water trucks in his district as well. In response, Supervisor Chucri commented that what may work in one area may not work in a different District. He noted the importance of water in these two regions of their Districts. This is why they want to take a comprehensive look at the entire issue before recommending any text amendment. The CUPD shall limit use of the site to a commercial storage facility or other use acceptable to the Maricopa County Environmental Services Department to have wastewater disposal via on-site septic system. k. The following C-3 CUPD standards shall apply: 1. Minimum front yard setback of ten feet regardless of adjacent zoning districts; Formal Meeting Minutes Wednesday, December 9, 2020 Page 21 of 89 2. Maximum height for fences of ten feet; 3. Minimum landscape buffer on the site along Highway US 60 of ten feet; l. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. m. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. n. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change never been granted. (C-44-21-117-X-00) Ms. Pokorski introduced the item saying that it is a request to change the zoning from C-2 and rural 43 to C-3 CUPD. The site is 37 acres within the Wickenburg Highway Scenic Corridor. She identified the surrounding properties’ zoning designations. She continued by describing the proposed development which would be shaded structures surrounded by a block wall topped with decorative wrought iron. She identified 66 letters of opposition, and where those letters came from on the map. She indicated that the requisite number of opposition letters or comments were not within the specified boundary to trigger a super majority vote. She also identified adjacent properties where there were homes or vacant lots. Chairman Hickman clarified that this property was in the vicinity of Wittman, not Morristown. Ms. Pokorski concurred. Ms. Pokorski continued by saying that most of the opposition center on the idea that at they wanted residential in this area. There was a concern that a truck stop could be constructed here. Additionally, they felt that this did not conform to the Wickenburg corridor guidelines such as the setback requirements. To further inform the Board, Ms. Pokorski stated that both staff and the commission are recommending approval of this application. She listed reasons for this recommendation including: The location of the site is at the intersection of a major highway and a collector street. Part of the property is already zoned commercial The property across the highway is slated for industrial development The area to the south near residential will be buffered by a 100-foot-deep retention area Storage properties are a less intensive use than other commercial uses in that they do not generate a significant amount of traffic, nor do they have a number of employees. The use is consistent with uses expected to be seen along this corridor. Formal Meeting Minutes Wednesday, December 9, 2020 Page 22 of 89 Some additional stipulations are being recommended to deal with the neighbor’s concerns. Also there is there a recommendation to not approve a variance to the Scenic Corridor guidelines for the requested 10-foot setback. The setback would be the 25- foot setback with native plants. She then read into the record the additional stipulations which are being recommended for the Board to consider. These would be amendments to conditions a, j and k. a. Development of the site shall be in substantial conformance with the Narrative Report entitled “West Valley RV, Auto and Boat Storage”, consisting of four pages, dated July 6, 2020, and stamped received August 31, 2020, except as modified by the following conditions. Within 30 days of Board approval a revised narrative and site plan shall be submitted that is acceptable to the Maricopa County Planning & Development Department reflecting the following conditions of approval. j. The CUPD shall limit use of the site to a commercial storage facility or other use acceptable to the Maricopa County Environmental Services Department to have wastewater disposal via on-site septic system. The CUPD shall prohibit adult-oriented-uses, billboards, medical marijuana and marijuana related uses, truck stops, and overnight stays, lodging, and camping. k. The following C-3 CUPD standards shall apply: 1. Minimum front yard setback of ten feet regardless of adjacent zoning districts except for a 25’ landscape setback along the Highway; 2. Maximum height for fences of ten feet; 3. There shall be a 25’ landscape buffer along the ultimate right- of-way of the Highway improved with indigenous landscaping acceptable to staff of the Maricopa County Planning & Development Department. The landscape vegetation must be maintained in perpetuity. Minimum landscape buffer on the site along Highway US 60 of ten feet; and 4 All outdoor lighting must be fully shielded so that illumination is directed downward at an angle 20% below the horizontal plane, thus preventing light trespass onto and illumination of adjacent properties. Chairman Hickman called on the applicant for comments. The applicant, Mr. Glenn Davis said he would address any questions of the Board. He said that he agreed with the added lighting stipulations and the setback recommendations. The Chairman indicated that he would give the applicant additional time to respond after the other speakers to address any questions that may arise. Mr. William Powell said he was speaking for himself and his wife, both 20-year veterans. They live on a one-acre plot just to the west of the subject property. He said he opposed the request as they moved to that area to enjoy the views and the peace and quiet. He mentioned that they enjoy all the aspects of the night sky and he often photographs the night sky and even has “star parties” for local astronomy clubs. He stated that the Formal Meeting Minutes Wednesday, December 9, 2020 Page 23 of 89 asphalt, lighting and metal roofing would destroy the views in the night sky. The emanating heat would cause distortions to any photographs. Mr. Powell also noted that the proposed facility would provide little to no benefit to the surrounding residents including providing very few jobs. He noted that many residents live on properties which are large enough for store their own recreational vehicles. Finally, he noted that the building proposed did not conform to many of the provisions of a scenic corridor guide nor the Wickenburg General plan 2025. Ms. Candy Harris stated that she felt this request constituted a spot rezoning. There is no other C-3 in the area; all is C-2 RUPD 43. This change would set a precedent which would allow others to ask for the same zoning. She said, “C-2 is retail. C-3 goes to a whole other level.” She felt that some of the people owning vacant parcels around this parcel would like to see C-3 because many of them sent in letters to approve the change. She stated that C-3 would allow those owners to increase the price of their properties, also noting that many are owned by LLC’s where none of the principals live in the area. She felt this shows preference for the developer over the residents. She felt this would be 37-acre area that would look like a prison. It is not consistent with the Wickenburg Scenic corridor. Ms. Harris noted that Wittman is growing. She felt many would like to keep the area rural, or at least semi-rural. Mr. Paul Kudel, resident, expressed a concern that many people did not know the whereabouts of Wittman, nor do they know much about the area. He stated that it is a residential area with many custom homes, many worth more than $400,000. He said that he decided to move to this area, as many others did, as they wanted a rural atmosphere away from commercial areas. Many want a peaceful area and they want “neighbors,” not a parking lot. Mr. Kudel commented that he had spoken to the applicant and viewed the other similar developments as was suggested. That development is located in a commercial area, not a residential area. He stated that he thought either that RV center was located in an already establish commercial area, or it was the catalyst for the area to become commercial. He agreed with a previous speaker that this would be spot zoning, and that those who had written letters in favor commented that this development would bring more commercial development to the corridor, and the applicant noted that this would bring future business. He also voiced a concern about what would happen if this business failed. He said it could be that there would simply be a huge area of asphalt left on that land near their homes. He asked the Board to deny this zoning change request. Chairman Hickman asked the applicant if he wanted to respond to any comments that had been made by the speakers. Mr. Davis commented that there was already some commercial zoning along the corridor which could lead to several developments rather than just one development as he is suggesting. He also noted that this development may kickstart other commercial developments as was the intent of this corridor. He said that the requested development would be relatively quiet with the entrance directly off the highway. He stated that he had no intention of ever developing a truck stop. Ms. Pokorski reiterated that there would need to be the 25’ setback rather than the requested 10’ setback along with the other suggested stipulations. She also stated that any other applicants for uses along this corridor would have to come before the Board for approval of their applications. Formal Meeting Minutes Wednesday, December 9, 2020 Page 24 of 89 The Chairman noted the various aspects of this corridor including that it is a well- traveled roadway. He stated that he is well acquainted with the Wittman area and the location of this proposed development. He said that this location offers a good place for the storage of RV’s without having to come all the way into Phoenix. He commented on the continued growth that moves outward to the west valley and the need to be mindful of property rights for all property owners. He added that this property could be a catalyst for other businesses, but he was glad to see the restrictions in the proposed amendments to the stipulations which would prohibit certain uses. He stated that the P&Z staff and his staff have worked hard on this application to deal with a number of the concerns. Now the applicant has agreed to the proposed stipulations such that now he is supportive of the application whereas he was not so with the original plan. He also noted that the City of Surprise controls the area across the street and the County does not control that zoning. Surprise has deemed that area to be industrial. He then asked if there was a motion regarding this case. Supervisor Sellers made a motion to approve this application as proposed with the amendments as stated in the staff report and read into the record earlier in the meeting. Supervisor Gates seconded the motion. Ms. Rich stated that she felt she was in a way additionally representing former County Managers who had worked with Ms. McCarroll and they had all held her in high regard. She noted that over the past months during this difficult time she felt that Ms. McCarroll was always available to deal with issues and that they were handled with the utmost professionalism. Even on weekends and after hours, Ms. McCarroll was available to work on special issues. In response, Ms. McCarroll noted that she had inadvertently skipped over her note to thank Ms. Rich when she “choked up” over comments about her husband. She stated Formal Meeting Minutes Wednesday, December 9, 2020 Page 82 of 89 that Ms. Rich has been more than available during this difficult time. She said that they had worked together in different capacities over the years, and that Ms. Rich has her highest respect and thanks for all that she has done, especially during the past difficult months adding that she is an amazing person to work with. Supervisor Gallardo commented that the Laveen School District, the City of Phoenix, and others will be holding a virtual town hall meeting that evening. They will be working on how to reach out to families in the area and to answer questions that people have regarding dealing with the pandemic. He also noted that the previous day he had participated with the West Valley Mayors in a morning breakfast. He said that it is good to see people come together to work on regional issues. He thanked Bruce Liggett and his entire team for his partnership with a number of cities regarding homelessness. As a final note, he thanked Ms. McCarroll again for her service noting that he had worked with her as an Elected Official, and also in his role as an employee in the Elections department a number of years ago. He was glad that she would not be leaving right away but helping through the transition. Supervisor Gallardo also congratulated the Chairman on his work and leadership throughout this past year as this is the last official meeting of the year. He wished all Happy Holidays to all. Supervisor Gates also thanked the Chairman for his leadership during this unprecedented year. He noted that he wanted to recognize Scott Jarrett for his work in the Elections department, and he thanked Mr. Jarrett and Mr. Valenzuela as they have been excellent representatives of the Elections department in the various lawsuits over the past months. In addition, he wanted to recognize a member of the Madison Elementary School District who will be stepping down soon – Matt Gratz. He also recognized Dr. Jesse Welch who just resigned as Superintendent of the Paradise Valley Unified School District. He noted that he had worked closely with Dr. Welch over the past year and also commented that he has a student in that district. Dr. Welch has done a great job under incredible pressure. James Lee, the previous Superintendent will be coming back on an interim basis and Supervisor Gates welcomed him back. He said he looks forward to working with him as they continue through the challenges that COVID has created. Supervisor Chucri concurred with previous comments also noting the difficult time for school districts. He stated that it has been a difficult year, but Maricopa County always seems to rise to the occasion especially with the leadership of Joy Rich in so many areas including parody with people working either in the office or from home. Even during this time business and people continue to come to Maricopa County. He also thanked so many of the Department Heads as they have had to adjust to the challenges the pandemic brought. He expressed his appreciation to Ms. McCarroll for the professionalism she has shown through the years. Finally, he addressed the Chairman, thanking him for the navigation through this difficult time and has kept the County moving forward. The Chairman responded that he was thankful that everyone worked together through all of the difficulties. Supervisor Sellers offered his thanks to all for the help he has received through the last two years. He commented that many people do not know the complexity of County Government and what a great organization it is. He also noted that this would probably not be the last meeting of year as others had mentioned. Formal Meeting Minutes Wednesday, December 9, 2020 Page 83 of 89 Supervisor Sellers continued by noting that the Gilbert Chamber of Commerce had a seminar called “Guiding Growth, a Conversation with Community Leaders.” He was very impressed with the work they are doing to look to the future for infrastructure needs. He was also able to attend an East Valley Partnership Board meeting designed to have discussions with legislators, however, there were only 3 or 4 legislators who attended. He noted that Rusty Bowers, Speaker of the House, was able to attend for a portion of the meeting. He noted the importance of hearing first- hand the concerns and thoughts of the Legislators as this creates a good working relationship. The Supervisor also thank Marcy Flanagan for the presentation she is going with various communities about the COVID vaccine as this is so valuable for the public. He notes that he had received a number of compliments related to the presentation that Ms. Flanagan did in his community. People were very thankful for the information. Chairman Hickman then commented that Ms. McCarroll is at time called the “Sixth Supervisor,” as she is almost always with the Supervisors at meetings. He likened it to the phrase, “the Fifth Beatle,” saying those are people that bring their skills and their work ethic to the table. He asked if Ms. McCarroll in that role would like to comment at the end of this meeting. Ms. McCarroll commented that she felt she could not adequately express her appreciation to each of the Supervisors that she had worked for. She felt she had learned something from every single person. In addition, she commented that she was not sure if any other person, during the course of 29 years of service has worked for 22 different bosses, but even though it has had its up’s and down’s, it has been a “glorious” journey. She noted that each Supervisor in some way has contributed to her growth in the job and that she was extremely appreciative. Chairman Hickman thanked her for the comments and noted that he was thankful that they would continue to see her as she trained her replacement. The Chairman also mentioned the daily briefings and all of the staff around the county that contribute to the briefing. He noted that the legal team has worked so diligently and reminded all that eight times the courts have sided with the filings from our legal team. In conclusion, the Chairman noted the importance of spending time with family and friends over the Christmas season.
